The circular issued by DGCA on February 20 said that the operators shall establish aerodrome-wise standard operating procedures and provide guidance to flight operations personnel to ensure safe flight procedures with no destination alternate and have the same approved by DGCA. It further reads that in a rapidly changing global economy, the international air transport industry must continuously adapt to new trends and increasingly competitive market conditions. "While technological improvements in aviation continue to increase reliability and predictability, economic and environmental concerns will continue to compel operators to use fuel more efficiently. Consequently, all operators, including those leveraging existing technologies and those investing in new technologies to meet operational challenges, should be afforded the opportunity to receive a return on their investments," the circular from DGCA read. "This circular aims to provide extended guidance material necessary to support the implementation of policy to operate flights with no destination alternate in compliance with CAR Section 8 Series O Part II," it read further. DGCA has suggested certain guidelines to formulate SOP for flights with No Destination Alternate, it says that the operators shall establish a laid down procedure for each aerodrome as approved by DGCA in order to undertake flights with No Destination Alternate. DGCA in the circular also said that the procedure is only applicable to destinations with more than one independent runway. "At least one runway should be available with an instrument approach procedure. Change over time from the primary runway to the secondary runway should be specified by the airport operator. The operator should have signed MoU with each aerodrome where they intend to undertake a flight with No Destination Alternate. All the possible non-normal scenarios and contingency plans shall be discussed at the organizational level and shall be shared with the personals involved. All the personnel involved shall be trained prior to undertake flight operations with No Destination Alternate (NDA)," it read. "Operators involved in Ultra long-range (ULR) flight operations may look into No Destination Alternate in conjunction with re-clearance flight planning in order to undertake flight operations with NDA flight. Also, necessary approval shall be taken from the local regulator along with each aerodrome. The decision to commence or continue the flight with "No Destination Alternate" lies entirely with the Pilot In Command (PIC). If circumstances so dictate, the flight will be dispatched with a Destination Alternate," it read further. DGCA asks aircraft operators to frame SOP for commercial flights with 'no destination alternate'

The lessors submitted before the high court that denial of deregistration by the Directorate General of Civil Aviation (DGCA) is "illegitimate". Justice <keyword id="14907621" type="General" weightage="50" keywordseo="tara-vitasta-ganju" source="Orion">Tara Vitasta Ganju</keyword>, who heard the arguments advanced by the petitioner lessors for over an hour and half, listed the matter for May 30 for hearing the submissions of the respondents. The high court also asked the parties to file written submissions a day before the next hearing. The lessors who have approached the high court are Accipiter Investments Aircraft 2 Limited, EOS Aviation 12 (Ireland) Limited, Pembroke Aircraft Leasing 11 Limited and SMBC Aviation Capital Limited. With a moratorium in force on financial obligations and transfer of assets of Go First in the wake of the insolvency resolution proceedings, the lessors are unable to deregister and take back the aircraft leased to the carrier. The lawyers for the lessors said they had approached the civil aviation regulator for deregistration of their aircraft but it rejected their pleas. They said they have not received any communication from the DGCA, but having checked the status of their applications on the regulator's website, they found their requests have been rejected. Senior advocate <keyword id="195903" type="General" weightage="50" keywordseo="mukul-rohatgi" source="Orion">Mukul Rohatgi</keyword>, appearing for one of the lessors, said the aircraft was its property and an interim resolution professional (IRP) has no power to take over assets of a third party. Senior advocate <keyword id="251871" type="General" weightage="50" keywordseo="dayan-krishnan" source="Orion">Dayan Krishnan</keyword>, representing EOS Aviation 12 (Ireland) Limited, said NCLAT cannot deal with the issue of deregistration of aircraft and the remedy lies under Article 226 of the Constitution as the issue is between the lessor and the DGCA. Another lawyer contended that under Irrevocable De-registration and Export Request Authorisations (IDERA), it was mandatory for the DGCA to deregister the aircraft at their request. The National Company Law Tribunal (NCLT) had on May 10 allowed the voluntary insolvency resolution plea by Go First. On May 22, the NCLAT upheld the order of the Delhi-based principal bench of NCLT, which had earlier this month admitted the plea of Go First to initiate voluntary insolvency resolution proceedings, and appointed an interim resolution professional (IRP) to suspend the company's board. DGCA required to deregister aircrafts, Go First lessors tell Delhi HC

In order to enhance <keyword id="182124" type="General" weightage="20" keywordseo="safety-standards" source="Orion">safety standards</keyword> in the <keyword id="34987" type="General" weightage="20" keywordseo="aviation-industry" source="Orion">aviation industry</keyword>, Directorate General of Civil Aviation on Wednesday said that a total of 542 <keyword id="6641634" type="General" weightage="20" keywordseo="enforcement-actions" source="Orion">enforcement actions</keyword> were taken in the year 2023 which was a 77 per cent increase as compared to the 305 enforcement actions carried out in 2022. In a statement, <keyword id="6354787" type="General" weightage="20" keywordseo="dgca" source="Orion">DGCA</keyword> informed that, in a significant move towards enhancing safety standards in the aviation industry, DGCA has taken stringent measures to ensure compliance with regulations through the conduct of <keyword id="1808201" type="General" weightage="20" keywordseo="surveillance-activities" source="Orion">surveillance activities</keyword> on airlines, aerodrome operators, approved organisations, and aviation personnel under its regulatory control to meet laid-down safety obligations. Extensive surveillance mechanisms play a pivotal role in safety by mitigating potential safety risks and enhancing safety margins across the industry. During the year 2023, DGCA intensified its safety oversight efforts and conducted a staggering 5745 surveillances (4039 planned surveillances, 1706 spot checks and night surveillance), which is an all-time high. This marked a notable increase of 26 per cent in surveillance activities compared to the year 2022, emphasising the commitment to ensure compliance and safety within the aviation landscape. Consequent to the findings of the surveillance conducted, enforcement action on non-compliant personnel, airlines, and other operators was taken. A total of 542 enforcement actions were taken in the year 2023 witnessing a 77 percent increase as compared to the 305 enforcement actions carried out for the year 2022. Significant enforcement actions for the year 2023 included the suspension of the Approved Training Organisation of Air India and financial penalties on airlines like Air India, Air Asia, Indigo and Spice Jet for various non-compliances. Enforcement actions were also taken against erring pilots and cabin crew, ATCOs, non-scheduled airlines, flying training organizations and aerodrome operators. The decision came after the <keyword id="6354705" type="General" weightage="20" keywordseo="Directorate-General-of-Civil-Aviation" source="Orion">Directorate General of Civil Aviation</keyword> (DGCA) conducted a spot audit of Air India in January, during which evidence was collected and fleet-wise random reports were analysed. "The analysis of reports and evidence revealed that <keyword id="20879472" type="General" weightage="20" keywordseo="air-india-limited" source="keywords">Air India Limited</keyword> operated flight(s) with both flight crew aged above 60 years flying together in a few instances. "... the operator was also found deficient in providing adequate weekly rest, adequate rest before &amp; after ultra-long range flights and adequate rest on layover to the flight crew, which violates the extant provisions of the <keyword id="20777683" type="General" weightage="20" keywordseo="civil-aviation-requirements" source="keywords">Civil Aviation Requirements</keyword> pertaining to FDTL," the regulator said in a release. Further, the DGCA said there were instances of exceeding duty periods, wrongly marked training records and overlapping duties. On March 1, the regulator issued a show cause notice to Air India with respect to the violations. "The operator submitted its response to the show cause notice, which was not found satisfactory. Pursuant to the non-satisfactory response submitted by the operator, a fine of Rs 80,00,000 has been imposed on the operator," the release said.

The revised <keyword id="20777683" type="General" weightage="20" keywordseo="civil-aviation-requirements" source="keywords">Civil Aviation Requirements</keyword> (<keyword id="19993399" type="General" weightage="20" keywordseo="car" source="keywords">CAR</keyword>) in this regard will come into force after three months, the <keyword id="19926254" type="General" weightage="20" keywordseo="directorate-general-of-civil-aviation" source="keywords">Directorate General of Civil Aviation</keyword> (DGCA) said in a release on Thursday. Currently, the breath analyser test percentage required is 10 per cent and that has been increased to 25 per cent. It will be applicable for air traffic controllers, ground staff, aircraft maintenance engineers, and ground handling services personnel right. According to the regulator, revisions have been made to the CAR on the procedure for breath analyser examination of the personnel engaged in safety-sensitive work such as aircraft maintenance, air traffic control services, aerodrome operations, and ground handling services for detecting the consumption of alcohol. DGCA said the revision in the CAR will further enhance the level of safety and is an effective step in view of the increase in air traffic and ground movements at airports. The amended norms will be effective after three months from the date of issue in order to provide adequate time to the industry to suitably enhance the existing infrastructure for breath analyser tests at various locations, it added.

NEW DELHI: India’s civil aviation regulator is likely to make it easier for companies to start flight operations, especially those seeking to use small <keyword id="6367788" type="UNKNOWN" weightage="80" keywordseo="Planes">planes</keyword>. It’s also recommended that small operators be allowed to run scheduled services to boost connectivity of destinations that aren’t served by airlines. 
 
DGCA is preparing a new set of civil aviation rules that would substantially ease the process of getting an air operator’s permit or flying licence for so-called non-scheduled operators (NSOPs), said a senior official at the regulator. Such companies typically run corporate or chartered flight services. 
 
The proposed rules could result in the time an NSOP needs to get a flying licence being slashed to six months from around a year now. 
 
Currently, both scheduled and non-scheduled operators have to meet the same guidelines for a flying licence. 
 “It has been found that the NSOPs do not need to meet a lot of conditions to get a licence, which the scheduled operators have to, since they operate with much lesser complex aircraft and systems. The work is on for a less complex set of rules for them, making them simpler,” said the <keyword id="322095" type="POSITION" weightage="60" keywordseo="DGCA-official">DGCA official</keyword> cited above. 
 
The new rules are likely to categorise general aviation operators into two — companies that operate smaller and less complex aircraft and others that operate large aircraft as well. The rules are likely to be simpler for the first and more elaborate for the second. 
 
Operators welcomed the move. 
 
“This was a long-pending demand from our side since we do no need to go through such a complex process for licences like the scheduled operators. 
 
This is a step in the right direction,” said RK Bali, secretary of the Business Aircraft Operators’ Association. 
 
There are about 130 NSOPs in the country that are registered with the DGCA.

“We have recommended this, but the government has to take a call. This will help in increasing regional connectivity,” said the DGCA official. 
 If this is allowed, NSOPs will have the right to publish flight schedules and run flights on routes not served by existing scheduled airlines. Unlike scheduled airlines, an NSOP doesn’t operate flights to a timetable, but does so depending on the business it gets. The new government has shown itself to be keen on strengthening air connectivity, with new <keyword id="48837" type="POSITION" weightage="40" keywordseo="Aviation-minister">aviation minister</keyword> Ashok Gajapathi Raju Pusapati having reportedly approved proposals for six new airlines.

DGCA Likely To Make It Easier For Small Operators To Start Flight Operations

Replying to a question raised in <keyword id="48510" type="ORGANIZATION" weightage="20" keywordseo="Rajya-Sabha">Rajya Sabha</keyword> regarding hiring by Indian aviation regulator Directorate General of Civil Aviation (<keyword id="6354787" type="ORGANIZATION" weightage="20" keywordseo="DGCA">DGCA</keyword>), Mahesh Sharma, Minister of State for Ministry of Civil Aviation stated that the agency has hired for 75 new positions, it had created last year. 
	 
	“The Department of Personnel and Training (DoPT) accorded approval to DGCA to directly hire the FOIs from the market instead of going through the UPSC route while Department of Expenditure approved the proposal for paying remuneration to the FOIs at par with the industry,” said Sharma. 
	 The decision was taken following <keyword id="137685" type="ORGANIZATION" weightage="20" keywordseo="FAA">FAA</keyword>’s audit in December 2013, which was a follow-up of the audit carried out in September 2013. The US auditor Federation of Aviation Administration (FAA) had pointed out that DGCA did not have adequate number of Flight Operations Inspectors (FOIs) required for checking the worthiness of an aircraft. 
	 
	Last year, the DGCA hired only 18 FOIs on full-time contract basis out of the approved 75 FOI positions. According to him, 40 positions have been created for FOIs for commercial aircraft while seven has been made for helicopters. Similarly, 17 Senior FOIs for airplanes have been appointed while three appointments have been made for helicopters. 
	 
	He further added, “The government will appoint six and one Deputy FOIs for airplanes and helicopters respectively. While only one Chief FOI will be there for both aircrafts.” 
	 
	Last year, the US auditor had raised doubts on DGCA’s performance as the industry watchdog. “The FAA had categorically pulled up DGCA for lack of adequate number of type-rated operations inspectors as we had been using the services of FOIs from the airlines themselves. This has actually compromised the quality of the inspection carried out by the regulator,” disclosed a senior official from the ministry.

 For the first time, the Indian government is going to choose the next Director General of the country's aviation regulator, <keyword id="6354705" type="UNKNOWN" weightage="20" keywordseo="Directorate-General-of-Civil-Aviation">Directorate General of Civil Aviation</keyword> (<keyword id="6354787" type="ORGANIZATION" weightage="20" keywordseo="DGCA">DGCA</keyword>), through an interview process. 
 
Presently, the DGs are selected based on their eligibility and credentials, who are shortlisted from a bunch of resumes. 
 
As per reports, all four joint DGs have been called for an interview. 
 
"However, interviewing joint DGs does not guarantee that the government would select someone as DG from within the organisation,” an official told ET. 
 
The DGCA is running without a DG since August when M Sathiyavathy left the post after she was appointed as OSD to the Ministry of Labour &amp; Employment. 
 
The post is being handled by BS Bhullar, additional secretary in the aviation ministry. 
 "The government should select someone who makes DGCA work as an independent body and support the growth of the aviation industry. I would like the government decide on whether he should be a technocrat or generalist, but the person selected for the post should be a senior person,” Shakti Lumba, an aviation analyst who previously headed operations at <keyword id="2573" type="CITY" weightage="20" keywordseo="Air-India">Air India</keyword> and IndiGo, told ET. 
 
"Over the years, DGCA, rather than becoming an independent regulator, has become an extension of the civil aviation ministry,” Lumba told ET. 
 
The government has changed recruitment rules for the DGCA chief and now officials from all central government services can apply for the post.

"The acceptance is subject to the outcome of the writ petitions/ applications pending before the Hon'ble High Court of Delhi &amp; Hon'ble <keyword id="6355809" type="General" weightage="20" keywordseo="nclt" source="Orion">NCLT</keyword>, Delhi," it said. Go First may resume scheduled flight operations on the availability of interim funding and approval of flights scheduled by DGCA, the release said. Further, the regulator has directed Go First to ensure compliance with all the applicable regulatory requirements and the continued airworthiness of the aircraft engaged in operations. The airline's Resolution Professional (RP) submitted the resumption plan to DGCA on June 28, and subsequently, the regulator conducted a special audit of the carrier's facilities in Mumbai and Delhi. "DGCA has ensured that the findings of the special audit have been adequately addressed by Go First," the release said, adding that the resumption plan was amended on July 15. A senior DGCA official said that based on reports of cancellation of flights and financial stress being experienced by <keyword id="22971642" type="General" weightage="20" keywordseo="spicejet-airlines" source="keywords">Spicejet Airlines</keyword>, a special audit of Spicejet engineering facilities was conducted on the August 7 and Auugst 8, 2024, which has revealed certain deficiencies. Following a series of occurrences reported on the Spicejet fleet in 2022, a special drive of spot checks was undertaken during which Spicejet was permitted to release aircraft for operations only after confirming to DGCA that all reported defects/malfunctions had been rectified. During the year 2023, based on reports of the airline being under financial stress, it was again placed under enhanced surveillance. In light of the past record and the special audit carried out in August 2024, Spicejet has once again been placed under enhanced surveillance with immediate effect. This would entail an increase in the number of spot checks and night surveillance with a view to ensure safety of operations. According to reports, the airline's passengers were on Thursday barred from checking-in for their flights at Dubai airport over delayed payments. On reports of cancellation of Spicejet flights from Dubai, the airline spokesperson said, "Due to operational reasons, a few SpiceJet flights from Dubai were cancelled. Affected passengers have been accommodated on subsequent SpiceJet flights, on other airlines or provided with a full refund. All our scheduled flights from Dubai are now operating as planned."
