New Delhi: The <keyword id="19909267" type="General" weightage="20" keywordseo="Centre" source="keywords">Centre</keyword> has granted absolute powers to the Delhi lieutenant governor to constitute any <keyword id="20069121" type="General" weightage="20" keywordseo="authority" source="keywords">authority</keyword>, board and <keyword id="19933395" type="General" weightage="20" keywordseo="commission" source="keywords">commission</keyword> such as the Delhi Commission for Women and the Delhi Electricity Regulatory Commission. In a notification, the Union Home Ministry said the <keyword id="20452846" type="General" weightage="100" keywordseo="Delhi-LG" source="keywords">Delhi LG</keyword> can also appoint members to such authority, board, commission or statutory bodies. Soon after the gazette notification was made public, Lieutenant Governor V K Saxena appointed presiding officers for MCD ward committee polls after Mayor Shelly Oberoi refused to do so saying her conscience does not allow her to participate in an "undemocratic election process". The notification has been issued in pursuance of clause (1) of article 239 of the Constitution read with section 45D of the Government of National Capital Territory of Delhi Act, 1991 (1 of 1992). "The <keyword id="19895704" type="General" weightage="20" keywordseo="President" source="keywords">President</keyword> hereby directs that the Lieutenant Governor of the National Capital Territory of Delhi shall, subject to the control of the President and until further orders, exercise the powers of the President under clause (a) of section 45D of the said Act for constitution of any authority, board, commission or any statutory body by whatever name it may be called, or for appointment of any Government officer or ex officio member to such authority, board, commission or any statutory body," the notification said. Article 239 of the Constitution relates to the administration of the Union territories. It says, "Save as otherwise provided by Parliament by law, every Union territory shall be administered by the President acting, to such extent as he thinks fit, through an administrator to be appointed by him with such designation as he may specify." "Notwithstanding anything contained in Part VI, the President may appoint the Governor of a State as the administrator of an adjoining Union territory, and where a Governor is so appointed, he shall exercise his functions as such administrator independently of his Council of Ministers," the Article 239 says. Section 45D of the Government of National Capital Territory of Delhi (Amendment) Act, 2023 relates to power to appoint authorities, boards, commissions or statutory bodies. "Notwithstanding anything contained in any other law for the time being in force, any authority, board, commission or any statutory body, by whatever name it may be called, or any office bearer or member thereof, constituted or appointed by or under any law made by the Parliament for the time being in force, applicable to the National Capital Territory of Delhi, shall be constituted or appointed or nominated by the President; and any law made by the Legislative Assembly of National Capital Territory of Delhi for the time being in force, the Authority shall recommend a panel of suitable persons for constitution or appointment or nomination by the Lieutenant Governor, in accordance with the provisions of section 45H," it says.

As per a news report in The Economic Times, electricity bills are expected to shoot up by 5%-20% from June as the <keyword id="750744" type="ORGANIZATION" weightage="20" keywordseo="Apellate-Tribunal-of-Electricity">Apellate Tribunal of Electricity</keyword> (APTEL) has pulled up <keyword id="6379315" type="ORGANIZATION" weightage="20" keywordseo="Delhi-Electricity-Regulatory-Commission">Delhi Electricity Regulatory Commission</keyword> (<keyword id="6377890" type="ORGANIZATION" weightage="20" keywordseo="DERC">DERC</keyword>) over failure to pass on power purchase adjustment charges (PPAC). 
 DERC has also received an order from APTEL to pass on the charges for two quarters (from October 2014 to March 2015) within three weeks. A copy of the order has been sent to DERC <keyword id="5504" type="POSITION" weightage="20" keywordseo="Chairperson">chairperson</keyword> PD Sudhakar. The controversial PPAC order for the first quarter of 2015-16 will be heard in July. 
 Sources informed the ET that the petition to APTEL was filed by <keyword id="45008" type="CITY" weightage="20" keywordseo="Tata-Power">Tata Power</keyword> Delhi in March and pleadings were completed by April. Later, the BSES discoms supported the petition citing worsening financial problems with the withdrawal of PPAC. 
 
The discoms stated that they were getting PPAC for three quarters (July 1, 2014 to March 31, 2015) despite submitting petitions to DERC regularly. The charges of July 1 to September 30, 2014 were the first ones denied to discoms. DERC had on November 13, 2014 allowed the charges to discoms, but a day later this order was withdrawn after citing non-furnishing of complete details of the fuel bills of generators. 
Discoms claimed they moved APTEL as DERC was mum on the issue. "DERC, in its reply to the interim application by discoms, cited difficulties such as frequent revision of tariffs and adverse public interest for not releasing PPAC. It added that tariff determination for the current year, which will be completed shortly, can accommodate this PPAC so the application should not be allowed," discom sources have informed the financial daily. 
 
The power distribution companies, however, cited financial crunch and argued that in 2011 the tribunal had passed clear directions that PPAC was to be provided monthly or maximum on quarterly basis. 
 What Delhi’s CM would be doing is the obvious question. The <keyword id="1462125" type="UNKNOWN" weightage="20" keywordseo="Aam-Admi-Party">Aam Admi Party</keyword> has reduced power tariff after coming to power.

New Delhi, May 27 () State-owned power giant NTPC has decided to foray in electricity distribution business by evincing interest to buy 51 per stake in Anil Dhirubhai Ambani Group's (ADAG) two utilities in Delhi. The ADAG has two discoms namely BSES Rajdhani Power Ltd (BRPL) and BSES Yamuna Power Ltd (BYPL). This assumes significance because NTPC is primarily power generation company. In a letter written to Delhi Electricity Regulatory Commission (DERC) on May 26, 2020, the power giant said, "NTPC has decided to foray into power distribution sector and keen on acquiring the distribution assets (BRPL and BYPL)". "We have learnt from media reports that ADAG wants to divest its 51 per cent stake in BRPL and BYPL." The company also said, "NTPC is keen to explore the opportunities for acquiring 51 per cent stake in BRPL and BYPL, which are on sale, provided that the equity sale is done through a transparent process". The speculation is rife that number of players are keen to buy 51 per stake in the two utilities. KKS BAL

<keyword id="6358777" type="COMPANY" weightage="80" keywordseo="New-Delhi">NEW DELHI</keyword>: The Delhi government told the Supreme Court that BSES companies of <keyword id="10926" type="CITY" weightage="60" keywordseo="Reliance">Reliance</keyword> Infrastructure were “inefficient” as they had defaulted on their dues to NTPC and other <keyword id="44578" type="UNKNOWN" weightage="80" keywordseo="electricity">electricity</keyword> suppliers, unlike the Tata group’s distribution arm that had promptly paid. 
 
“These two companies owe Rs 4,500 crore. My concern is outages. You cannot take electricity and not pay for it. At the end of the day the Tatas are paying, why can’t (BSES) Rajdhani? Both are working in the same regulatory regime,” Additional Solicitor General Siddharth Luthra told a two-judge bench hearing the case. The two Reliance companies have been locked in a bitter stand-off with the generating companies over arrears. They claim that the Delhi Electricity Regulatory Commission (DERC) has failed to provide adequate tariffs that can cover costs and give reasonable returns. 
 
BSES lawyer Mukul Rohatgi claimed on Wednesday that the dues outstanding to the two companies are around .`15,000 cr. The company has cited this outstanding amount as the reason why it could not pay generating companies any more money till it recovered some part of the dues. Power major NTPC has earlier threatened to cut off powers to BSES if the stalemate continued. 
 
At the last hearing, the bench asked NTPC to desist from doing any such thing in “consumer” interest and asked BSES to pay a sum of.`700 crore due from the beginning of the 2014. 
 
On Wednesday, when the bench reconvened, BSES and the power generating companies again traded charges over non-payment of dues. While NTPC insisted that no dues have been paid since the last court hearing and suggested “power regulation” to deal with the problem, a euphemism for power cuts, BSES claimed it had paid.`601 crore so far. Senior advocate KK Venugopal claimed that NTPC had in turn to pay Coal India and non-payment by BSES was having a “cascading effect” all around. 
 
“He is the biggest industrialist in the country,” Venugopal stated. Rohatgi countered this. “I am owed Rs15,000 crore, and I am termed inefficient!” The bench then adjourned the case till Tue dayto allow both sides to sort out the issue of payment of current dues, but not before the DERC, through senior advocate Meet Malhotra, had similarly accused BSES of being “inefficient” and “financially indisciplined”. 
 
Malhotra claimed that there were major variations in figures in audited statements made earlier and now, adding a CAG audit would help uncover the facts. The previous arrears may accordingly have to be downgraded, he said. 
 
The DERC has in a roadmap for recovery of dues suggested an 8per cent surcharge to recover these over a period. Any adjustments will bring down the recovery period. He also accused BSES of not infusing enough equity to instill enough confidence in banks to loan them amounts necessary to pay back power generating companies. 
 
“It is evident that the current financial position could have been avoided by infusion of requisite equity from time to time by BYPL,” he told Justices SS Nijjar and AK Sikri who are hearing the case. The discoms accuse the state and the central governments of failing to bail them out by subsidising their costs as done in other states.

Tata Power consumers in Delhi will soon be able to know about their daily electricity consumption and access various other details like reasons for technical fault in transmission line with the company working on a Rs 100-crore project to introduce "new-age" technology. 
 
Under the first of its kind initiative in the country, domestic consumers of Tata Power Delhi Distribution Ltd (TPDDL), will be no longer required to report to the company about snapping of electricity supplies as real time monitoring of power transmission to each and every consumer will be ensured through a communication network, currently used by very few countries. 
 
TPDDL CEO and Managing Director Praveer Sinha said consumers, by using an app in their smart phones, will be able to access a host of information such as consumption during peak and off-peak hours, details of consumption for any period in the current fiscal compared to same period a year ago etc. 
 
He said technology for the ambitious smart metering and communication network project is being sourced from across the globe and a number of leading companies like General Electricals, IBM have been roped in. 
 
"It will totally be a whole new experience for our consumers in Delhi. Such an ambitious project is being implemented for the first time in the country. 
 
"We are planning to cover 2.5 lakh consumers by April 2018 under the project which will be rolled out in early next year," Sinha told PTI. 
 
He said TPDDL is also augmenting its infrastructure for introduction of the Time of Day metering (TOD), which involves dividing the day, month and year into tariff slots and with higher rates at peak load periods and low tariff rates at off-peak load periods. 
 
Delhi's power regulator DERC has planned to introduce TOD, a concept borrowed from European countries, under which price of power is much lower in off-peak hours of the day compared to peak hours of 7 to 10 PM. 
 
"We are working on technology through which consumers will be able to control power consumption through smart metering. 
 
"For example, if a consumer wants to run washing machine during off peak hours always or if somebody wants to use other appliances during a specific period of time, they will have the option," he said Sinha. 
 
He said under the smart metering project, TPDDL will be able to know about consumption of power by consumers every half an hour and can share the information with them. 
 
The TPDDL has a consumer base of 15.5 lakh which includes consumers in the commercial category. 
 
The immediate plan of the company is to cover 7.5 lakh consumers under the project. 
 
"We are going to invest over Rs 100 crore in modernizing the communication network. 
 
"Already a global tender has been floated for the project," said Sinha, adding smart metering will also significantly help the company root out power theft and other leakages.
