In the wake of protests against the Centre's Agnipath scheme, the <keyword id="11900977" type="General" weightage="100" keywordseo="gurugram" source="Orion">Gurugram</keyword> district administration on Friday imposed Section 144 <keyword id="90013" type="General" weightage="80" keywordseo="crpc" source="Orion">CrPC</keyword> as a precautionary measure to maintain law &amp; order. "Orders were issued as a precautionary measure to maintain the law &amp; order situation in district Gurugram," SDM Gurugram Ankita Chowdhary said. Section 144 of CrPC restricts the assembly of four or more persons in the district. Violators will be punished under Section 188 of the IPC. Demonstration was reported in Gurugram's Farrukhnagar Road in Chandu and <keyword id="6889440" type="General" weightage="50" keywordseo="pataudi-road" source="Orion">Pataudi Road</keyword> on Friday morning. Around 100 people tried to block the Gurugram-Jhajjar Road and Pataudi Road but were removed by the police. Assistant Commissioner of Police, Sadar, <keyword id="953334" type="General" weightage="50" keywordseo="aman-yadav" source="Orion">Aman Yadav</keyword> who was stationed at the Rajiv Chowk along with the force, said "Adequate police force has been deployed in view of the protest. The Supreme Court on June 10 ruled that a divorced Muslim woman is entitled to seek maintenance from her husband under Section 125 of the Criminal Procedure Code (CrPC), asserting that any discrimination against Muslim women in matters of alimony under the secular laws of the country would be regressive and against <keyword id="20809677" type="General" weightage="20" keywordseo="gender-justice" source="keywords">gender justice</keyword> and equality. Earlier, the <keyword id="20066702" type="General" weightage="20" keywordseo="NCW-chief" source="keywords">NCW chief</keyword> wholeheartedly welcomed the Supreme Court's landmark ruling, stating that the decision is a significant step towards ensuring <keyword id="20250318" type="General" weightage="20" keywordseo="gender-equality" source="keywords">gender equality</keyword> and justice for all women, regardless of their religion. The NCW Chairperson emphasised that the decision reinforces the principle that no woman should be left without support and protection under the law. The NCW remains committed to advocating for women's rights and ensuring that justice prevails for every woman in India, she emphasised. Rekha Sharma also addressed the "lewd" comment incident that occurred earlier regarding a picture of the widow of Kirti Chakra recipient Captain Anshuman Singh. NCW chief Rekha Sharma said, "It was a very derogatory comment that we saw on social media, and we immediately took suo motu cognizance of it. The police have filed an FIR against this person. However, the individual is most likely from Pakistan." "Many such comments are being made, and we are taking those comments very seriously and urging the police to file FIRs in those cases as well," she added. Delhi Police acknowledged the National Commission for Women's (NCW) letter to the Delhi Commissioner of Police, demanding the arrest of the man and submission of a detailed report to the panel within three days. The police said a complaint was received from the National Commission for Women, alleging that a social media user had made an extremely lewd and derogatory comment on a picture of the widow of a late soldier. Taking cognizance of the complaint and after a preliminary examination of its contents, a case FIR under Sections 79, BNS-2023, and Section 67 of the IT Act 2000 has been registered at the Police Station Special Cell, and an investigation is underway. Captain Anshuman Singh, a doctor, was posted with the 26 Punjab as a medical officer in the Siachen Glacier area. On the night of July 19, 2023, there was a fire incident at an Indian Army ammunition dump at the camp where he was posted. Captain Singh saw a fibreglass hut engulfed in fire and immediately acted to rescue four to five individuals trapped inside. He went inside the medical investigation room, which was also on fire, to retrieve the critical medical aid box but could not make it out due to heavy fire amid strong winds. He was awarded the Kirti Chakra posthumously. Captain Singh's wife, Smriti, and his mother received the award from President Droupadi Murmu.

Expressing "serious concern" over <keyword id="19902052" type="General" weightage="20" keywordseo="pendency" source="keywords">pendency</keyword> of a large number of <keyword id="22472776" type="General" weightage="100" keywordseo="cheque-bounce-cases" source="keywords">cheque bounce cases</keyword>, the <keyword id="19895345" type="General" weightage="20" keywordseo="Supreme-Court" source="keywords" meta.keywordsubtype="org" meta.entityname="Supreme Court" meta.hostid="261" meta.entityid="Supreme Court">Supreme Court</keyword> has said courts should encourage <keyword id="20151747" type="General" weightage="20" keywordseo="compounding" source="keywords">compounding</keyword> of offences under the <keyword id="20905075" type="General" weightage="20" keywordseo="Negotiable-Instruments-Act" source="keywords">Negotiable Instruments Act</keyword> if parties are willing to reach a compromise. A bench of Justices Sudhanshu Dhulia and Ahsanuddin Amanullah set aside the conviction of a man named P Kumarasamy in a cheque bounce case, after noting that the parties have entered into a <keyword id="21163406" type="General" weightage="20" keywordseo="settlement-agreement" source="keywords">settlement agreement</keyword> and Rs 5.25 lakh has been paid to the complainant. "A large number of cases involving dishonour of cheques are pending before courts which is a serious concern for our judicial system. Keeping in mind that the 'compensatory aspect' of remedy shall have priority over the 'punitive aspect', courts should encourage compounding of offences under the NI Act if parties are willing to do so," the bench said in its July 11 order. The Negotiable Instruments Act governs all negotiable instruments like promissory notes, bills of exchange, and cheques. Compoundable offences are those where a compromise can be reached by the rival parties. The bench said it has to be remembered that dishonour of cheques is a <keyword id="22472777" type="General" weightage="20" keywordseo="regulatory-offence" source="keywords">regulatory offence</keyword> which was made an offence only in view of public interest so that the reliability of these instruments can be ensured. "Considering the totality of the circumstances and compromise between the parties, we allow this appeal and acquit the appellants by setting aside the impugned order dated April 1, 2019 as well the trial court's order dated October 16, 2012. Appellant no.2 (P Kumarasamy), who was exempted from surrendering by this Court, need not surrender and his sureties are hereby discharged," the bench ordered. The bench noted that in 2006, P Kumarasamy alias Ganesh had borrowed Rs 5,25,000 from respondent A Subramaniam but did not repay the loan. To discharge the debt, the bench said, Kumarasamy gave a cheque for Rs 5.25 lakh in the name of his partnership firm M/s New Win Export. "Since the cheque was dishonoured due to insufficient funds, respondent filed a complaint under Section 138 NI Act against the appellants where the trial court vide order dated October 16, 2012 convicted the appellants and imposed a sentence of one year of simple imprisonment each," it said. It noted Kumarasamy challenged the conviction before the appellate court, which reversed the findings of the trial court and acquitted him and the firm. "Finally, when the matter was taken to the high court at the instance of the respondent/complainant, the high court in its order dated April 1, 2019 set aside the order of the appellate court and restored the order of the trial court, convicting the appellants," the bench noted. It noted the firm and Kumarsamy challenged the high court order before the apex court. The bench added that Section 147 of the Negotiable Instruments Act, 1881 makes all offences under it compoundable. "In our opinion, this settlement agreement can be treated to be compounding of the offence. All the same, Section 320 (5) of CrPC provides that if compounding has to be done after conviction, then it can only be done with the leave of the court where appeal against such conviction is pending," it said. The bench said in cases where the accused relies upon some document for compounding the offence at the appellate stage, courts shall try to check the veracity of such documents. "For the same, in the present matter, this court vide order dated March 18, 2024 had asked the respondent-complainant to file an affidavit to bring on record whether or not any compromise has been reached between the parties," it said. The bench said an affidavit was filed by the complainant in compliance with the order where it was said that the accused have paid the amount to the satisfaction of the complainant, and that he has no objection if conviction of the appellants is set aside. "Now, when the accused and complainant have reached a settlement permissible by law and this court has also satisfied itself regarding the genuineness of the settlement, we think that the conviction of the appellants would not serve any purpose and thus, it is required to be set aside," it said.

Mumbai, The arrest of ICICI Bank's former Managing Director and Chief Executive Officer (CEO) Chanda Kochhar and her husband Deepak Kochhar by the Central Bureau of Investigation (<keyword id="19896633" type="General" weightage="20" keywordseo="cbi" source="keywords">CBI</keyword>) in a loan fraud case was "without application of mind and due regard to the law", amounting to an "abuse of power", the Bombay High Court has said. A division bench of Justices Anuja Prabhudessai and N R Borkar had on February 6 held the <keyword id="20482859" type="General" weightage="20" keywordseo="kochhars" source="keywords">Kochhars</keyword>' arrest as illegal and confirmed a January 2023 interim order passed by another bench granting them bail. In the order made available on Monday, the court said the CBI has been unable to demonstrate the existence of circumstances or supportive material based on which the decision to arrest was taken. The absence of such circumstances renders the arrest illegal, it said. "Such routine arrest without application of mind and due regard to the law amounts to an abuse of power," the court said. The court also refused to accept the probe agency's contention that the arrest was made as the Kochhars were not cooperating with the probe and said the accused had a right to remain silent during interrogation. "The right to silence emanates from Article 20(3) of the Indian Constitution, which gives an accused the right against self-incrimination. Suffice it to say that exercise of the right to remain silent cannot be equated with non-cooperation," it said in the order. The CBI arrested the couple on December 23, 2022, in the Videocon-ICICI Bank loan case. They immediately moved the high court challenging the arrest and sought for the same to be declared illegal, and by way of interim order, sought to be released on bail. On January 9, 2023, the court, in an interim order, granted the Kochhars bail, noting that the CBI had made the arrest casually and mechanically and without application of mind. In the February 6 order, the bench noted that section 41A of the Criminal Procedure Code (CrPC) was introduced to avoid routine arrests. It cited that this provision restricts the power to arrest when an accused person complies with the notice issued by the police to appear for questioning and mandates that an arrest shall be made only when the police are of the opinion that it is necessary. The court held that while it was within the domain of the investigating agency to interrogate an accused and to arrive at a subjective satisfaction on the issue, the same was not "wholly immune from judicial reviewability". "The court can consider whether the reasons for deprivation of liberty are rational, reasonable or fanciful," it said. The bench further said that the first information report (FIR) against the Kochhars was registered in 2019, and they were summoned for questioning only in 2022. "Despite the gravity of the offence, the petitioners (Kochhars) were not interrogated or summoned for a period of over three years from the date of registration of the crime," it said. From June 2022, the Kochhars have been appearing before the CBI as and when notices under section 41A were issued to them, the bench said. The CBI had claimed that the Kochhars were arrested as they were not cooperating with the probe and that their custodial interrogation was required to unearth the entire gamut of conspiracy. Apart from the Kochhars, the CBI had also arrested <keyword id="20060394" type="General" weightage="20" keywordseo="videocon" source="keywords">Videocon</keyword> group founder <keyword id="20641998" type="General" weightage="20" keywordseo="venugopal-dhoot" source="keywords">Venugopal Dhoot</keyword> in the case. The high court granted him bail in January 2023 in its interim order. The probe agency has alleged that private sector lender ICICI Bank had sanctioned credit facilities to the tune of Rs 3,250 crore to the companies of Videocon Group promoted by Dhoot in violation of the Banking Regulation Act, <keyword id="19899810" type="General" weightage="20" keywordseo="reserve-bank-of-india" source="keywords">Reserve Bank of India</keyword>'s guidelines, and credit policy of the bank. The CBI had named the Kochhars, Dhoot along with Nupower Renewables (NRL) managed by Deepak Kochhar, Supreme Energy, Videocon International Electronics Ltd and Videocon Industries Ltd as accused in the FIR registered in 2019 under the Indian Penal Code sections related to criminal conspiracy and provisions of the Prevention of Corruption Act. The agency has alleged that the ICICI Bank sanctioned credit facilities to the tune of Rs 3,250 crore to these companies in violation of norms. It further claimed that as a part of quid pro quo, Dhoot made an investment of Rs 64 crore in Nupower Renewables through Supreme Energy Pvt Ltd (SEPL) and transferred SEPL to Pinnacle Energy Trust managed by Deepak Kochhar through a circuitous route between 2010 and 2012.

Nandyal (Andhra Pradesh) [India], September 9 (ANI): Former Andhra Pradesh chief minister and <keyword id="58641" type="General" weightage="20" keywordseo="TDP-chief" source="Orion">TDP chief</keyword> N <keyword id="6354350" type="General" weightage="20" keywordseo="chandrababu-naidu" source="Orion">Chandrababu Naidu</keyword> who was arrested Saturday morning on an alleged case of corruption said that the CID made the arrest without any proper information and that they refused to show him evidence. Talking to mediapersons ahead of police taking him into custody, Naidu said, I did not commit any malpractice or corruption. CID arrested me without any proper information and I asked them to show the evidence but they refused to show and attached my name to the FIR without my role." The TDP chief was taken into custody by the Andhra Pradesh Criminal Investigation Department (CID), in connection with alleged in the skill development scam case. A First Information Report (FIR) in the case was lodged in 2021. As police arrived early this morning to arrest the TDP Chief, they faced resistance from TDP cadres. A minor scuffle also broke out between officials and Naidu's supporters during his arrest. Naidu has been named as accused number 1 in the case, which involves over Rs 250 crore. Details of the FIR and other details were provided to Naidu's advocates, who also demanded prima facie evidence, pointing out that the former chief minister's name was not mentioned in the FIR report. The former Andhra Chief Minister has been charged under sections for criminal conspiracy, cheating and dishonestly inducing delivery of property. "It is to inform you that you have been arrested under CrPc's Sections 120(8), 166, 167, 418, 420, 465, 468, 471, 409, 201, 109 rw 34 and 37 IPC and other sections of Prevention of Corruption Act, 1988," the notice issued under Section 50 (1) (2) of Criminal Procedure Code. According to details, Naidu was to be shifted to Nandyal Hospital for a medical examination. However, his medical check-up was conducted at a camp after he refused to go to the hospital. Naidu was taken to Vijayawada from Nandyal through the road. Earlier, there were reports that police would take him on the flight. The State Police also detained several party leaders including Naidu's son Nara Lokesh in East Godavari district as a preventive action to maintain the law and order situation in the state. (ANI)
