Under the new laws, a person can now report incidents by electronic communication, without the need to physically visit a police station. This allows for easier and quicker reporting, facilitating prompt action by the police, the sources said. With the introduction of zero FIR, a person can file a First Information Report (FIR) at any police station, regardless of jurisdiction. This eliminates delays in initiating legal proceedings and ensures immediate reporting of the offence. Under the new laws, victims will receive a free copy of the FIR, ensuring their participation in the legal process. An interesting addition of the law is that in the event of an arrest, the individual has the right to inform a person of his choice about his or her situation. This will ensure immediate support and assistance to the arrested individual. Besides, arrest details will now be prominently displayed within police stations and district headquarters, allowing families and friends of the arrested person easy access to important information. To strengthen the case and investigations, it has become mandatory for forensic experts to visit crime scenes for serious offences and collect evidence. Additionally, the process of evidence collection at the crime scene will be mandatorily videographed to prevent tampering of evidence. This dual approach significantly enhances the quality and reliability of investigations and contributes to a fair administration of justice, the sources said. The new laws prioritised the investigations for offences against women and children, ensuring timely completion within two months of recording information. Under the new law, victims are entitled to regular updates on the progress of their case within 90 days. This provision keeps the victims informed and involved in the legal process, enhancing transparency and trust. The new laws guarantee free first-aid or medical treatment to victims of crimes against women and children at all hospitals. This provision ensures immediate access to essential medical care, prioritising the well-being and recovery of victims during challenging times. Summons can now be served electronically, expediting the legal processes, reducing paperwork and ensuring efficient communication between all parties involved. For certain offences against women, statements of the victim are to be recorded, as far as practicable, by a woman magistrate and in her absence, by a male magistrate in the presence of a woman to ensure sensitivity and fairness, creating a supportive environment for victims. Both the accused and the victim are entitled to receive copies of the FIR, police report, chargesheet, statements, confessions and other documents within 14 days. Courts grant a maximum of two adjournments to avoid unnecessary delays in case hearings, ensuring timely justice delivery. The new laws mandate all state governments to implement witness protection scheme to ensure the safety and cooperation of witnesses and enhancing the credibility and effectiveness of legal proceedings. The definition of "gender" now includes transgender individuals, promoting inclusivity and equality. By conducting all legal proceedings electronically, the new laws offer convenience to victims, witnesses and accused, thereby streamlining and expediting the entire legal process. In order to provide more protection to the victim and enforce transparency in investigation related to an offence of rape, the statement of the victim shall be recorded through audio video means by the police. Women, persons below 15 years, persons above 60 years and those with disabilities or acute illness are exempt from attending police stations and can receive police assistance at their place of residence. A new chapter has been added in BNS specifically to address offences against women and children, ensuring focused protection and justice. Various offences against women and children have been made gender-neutral in BNS, covering all victims and perpetrators regardless of gender. The new laws introduce community service for minor offences in order to promote personal growth and social responsibility of an individual. Under community service, the offenders get the chance to positively contribute to society, learn from their mistakes and build stronger community bonds. Under the new laws, the fines imposed for certain crimes have been aligned with the severity of the offences, ensuring fair and proportional punishment, deterring future offences and maintaining public trust in the legal system. The legal processes have been simplified to make them easier to understand and follow, ensuring fair and accessible justice. The new laws promise a faster and fair resolution of cases, instilling confidence in the legal system. The legislations were considered and passed by Parliament in its winter session in 2023. Total 37 members of Parliament from Lok Sabha and 40 from Rajya Sabha participated in the debate.

New criminals laws will allow citizens to lodge police complaints online, file FIR from any jurisdiction

The government has dropped the permit requirement for untested AI models but emphasised the need to label AI-generated content, according to a latest advisory on <keyword id="19904566" type="General" weightage="20" keywordseo="artificial-intelligence" source="keywords">Artificial Intelligence</keyword> technology. Instead of permission for AI models under development, the fresh advisory issued by the <keyword id="19966789" type="General" weightage="20" keywordseo="ministry-of-electronics" source="keywords">Ministry of Electronics</keyword> and IT on Friday evening fine-tuned the compliance requirement as per IT Rules of 2021. "The advisory is issued in suppression of advisory...dated 1st March 2024," the advisory said. It has been observed that IT firms and platforms are often negligent in undertaking due diligence obligations underlined under the <keyword id="19930099" type="General" weightage="20" keywordseo="information-technology" source="keywords">Information Technology</keyword> (Intermediary Guidelines and <keyword id="20033095" type="General" weightage="20" keywordseo="digital-media-ethics-code" source="keywords">Digital Media Ethics Code</keyword> ) Rules, 2021, according to the new advisory. "Where any intermediary through its software or any other computer resource permits or facilitates synthetic creation, generation or modification of a text, audio, visual or audio-visual information, in such a manner that such information may be used potentially as misinformation or deepfake, it is advised that such information created generated or modified through its software or any other computer resource is labelled....that such information has been created generated or modified using the computer resource of the intermediary," the advisory said. In case any changes are made by the user, the metadata should be so configured to enable identification of such user or computer resource that has effected such change, it added. Govt removes permit requirement for untested AI models; calls for labelling content

The shells were fired at the border point which connects Delhi with Haryana. The police officer said, "We are using <keyword id="384876" type="PERSON" weightage="20" keywordseo="tear-gas">tear gas</keyword> to disperse protesting farmers. We are also informing them that in view of the COVID-19 pandemic, any kind of rally and dharna is not allowed." "They have been denied permission and legal action will be taken against them if they still try to enter Delhi," the officer further said. Security has been strengthened at the border and sand-laden trucks and water cannons have been stationed. Barbed wire is also being used for fencing at the Singhu border to prevent the protesters from entering the city. Punjab farmers, representing over 30 farm bodies, have announced they will go to Delhi through several routes -- Lalru, Shambhu, Patiala-Pehowa, Patran-Khanauri, Moonak-Tohana, Ratia-Fatehabad and Talwandi-Sirsa. Tension was escalating at all the border points. Farmers have assembled near the borders in tractor-trolleys laden with rations and essentials for their proposed Delhi march. Section 144 extended in UP's Ghaziabad till May 10 to curb spread of COVID-19

The first confirmed case of novel coronavirus in Odisha was reported on Monday after a researcher who recently returned from Italy tested positive for it, a senior official said. The 33-year-old man is being treated at Capital Hospital here, the official said. "His condition is stable and he is not showing any other complications," said <keyword id="56651" type="PERSON" weightage="20" keywordseo="subroto-bagchi">Subroto Bagchi</keyword>, the state government's chief spokesperson on COVID-19. The patient reached Delhi from Italy on March 6 and travelled to Bhubaneswar by train on March 12. He consulted a doctor on March 13, complaining of fever and headache, Bagchi told reporters. "The man then went to Capital Hospital on March 14 where he was admitted to the isolation ward. His blood and swab samples were sent for medical examination and tests confirmed he is infected with novel coronavirus," Bagchi said. As the man travelled by train from Delhi to Bhubaneswar, the state government launched a "contact tracing exercise", Bagchi, also the chairman of Odisha Skill Development Authority, said. Efforts are on to trace all the people who are suspected to have come in contact with him, the official said. His family members have been quarantined and kept under observation. Data of all those people who travelled with the researcher on the train is being collected so that they can be tracked and quarantined too, Bagchi said. He advised mediapersons against revealing the identities of the infected person and his family members and rushing to the hospital for sound bytes, thus affecting his treatment and risking getting infected. In view of the coronavirus outbreak, the state government ordered the shutting of all shopping malls in Bhubaneswar and Cuttack till March 31 as a precautionary measure. "As per Section 35 of the Odisha Urban Police Act, Commissioner of Police has ordered all Malls in the twin Cities of Bhubaneswar-Cuttack to remain closed till 31 March 2020. The order will come into effect from 16 March 2020," the Commissionerate Police tweeted. Authorities of Ganjam, Khurda, Gajapati and Jharsuguda districts have cancelled the leaves of state government employees to deal with the situation arising out of the pandemic. Replying to the controversy, the IOC said on Thursday in a statement, "All athletes participating in the boxing tournament of the Olympic Games Paris 2024 comply with the competition's eligibility and entry regulations, as well as all applicable medical regulations set by the Paris 2024 Boxing Unit (PBU). As with previous Olympic boxing competitions, the gender and age of the athletes are based on their passports." These two athletes were the victims of a sudden and arbitrary decision by the IBA. Towards the end of the IBA World Championships in 2023, they were suddenly disqualified without any due process," the IOC said. "According to the IBA minutes available on their website, this decision was initially taken solely by the IBA Secretary General and CEO. The IBA Board only ratified it afterwards and only subsequently requested that a procedure to follow in similar cases in the future be established and reflected in the IBA Regulations. The minutes also say that the IBA should "establish a clear procedure on gender testing. The current aggression against these two athletes is based entirely on this arbitrary decision, which was taken without any proper procedure - especially considering that these athletes had been competing in top-level competition for many years. Such an approach is contrary to good governance," the IOC added. The suspicious links originate from the US and France, said the report, adding that the campaign is collecting personal as well as banking information from the user and getting into this type of trap could cause a massive financial loss for the users. The shared link with the SMS has no domain name and is not linked with the Indian government. All IP addresses associated with the campaign belong to some third party dedicated cloud hosting providers, said the report. The whole campaign uses plain http protocol instead of the secure https. This means anyone on the network or internet can intercept the traffic and get the confidential information in plain text to misuse against the victim. It asks users to download an application from a third party source instead of Google Playstore. The application asks to provide administrator rights and unnecessary access permissions of the device. On opening the link http://204.44.124[.]160/ITR, users are redirected to a landing page that is mostly similar to the government income tax e-filing website. On clicking the green 'Proceed to the verification steps' button, users are asked to submit personal information such as full name, PAN, Aadhar number, address, pincode, date of birth, mobile number, email address, gender, marital status and banking information like account number, IFSC code, card number, expiry date, CVV/CVC and card PIN. Additionally, the bank name is automatically detected from the IFSC code entered in the form. After submission of data, users are redirected to a page where they are asked to confirm the entered data. Clicking on the green 'confirm' button directs users to a fake banking login page almost similar to the official one. It asks for the username and password for online banking. After these details are entered, for the next step, users are asked to enter a Hint question, Answer, Profile password and CIF number. Once submitted, a mobile verification section with instructions provided to download an android application (.apk file) appears, to complete the ITR verification. Here, users are deliberately instructed to grant all device permissions to the particular application, the investigation revealed. The application, called Certificate.apk, starts downloading upon clicking the green 'Download' link. The overall layout and functionalities of the web page used in the campaign are similar to the official e-filing site to lure laymen, said the report. Mumbai, The arrest of ICICI Bank's former Managing Director and Chief Executive Officer (CEO) Chanda Kochhar and her husband Deepak Kochhar by the Central Bureau of Investigation (<keyword id="19896633" type="General" weightage="20" keywordseo="cbi" source="keywords">CBI</keyword>) in a loan fraud case was "without application of mind and due regard to the law", amounting to an "abuse of power", the Bombay High Court has said. A division bench of Justices Anuja Prabhudessai and N R Borkar had on February 6 held the <keyword id="20482859" type="General" weightage="20" keywordseo="kochhars" source="keywords">Kochhars</keyword>' arrest as illegal and confirmed a January 2023 interim order passed by another bench granting them bail. In the order made available on Monday, the court said the CBI has been unable to demonstrate the existence of circumstances or supportive material based on which the decision to arrest was taken. The absence of such circumstances renders the arrest illegal, it said. "Such routine arrest without application of mind and due regard to the law amounts to an abuse of power," the court said. The court also refused to accept the probe agency's contention that the arrest was made as the Kochhars were not cooperating with the probe and said the accused had a right to remain silent during interrogation. "The right to silence emanates from Article 20(3) of the Indian Constitution, which gives an accused the right against self-incrimination. Suffice it to say that exercise of the right to remain silent cannot be equated with non-cooperation," it said in the order. The CBI arrested the couple on December 23, 2022, in the Videocon-ICICI Bank loan case. They immediately moved the high court challenging the arrest and sought for the same to be declared illegal, and by way of interim order, sought to be released on bail. On January 9, 2023, the court, in an interim order, granted the Kochhars bail, noting that the CBI had made the arrest casually and mechanically and without application of mind. In the February 6 order, the bench noted that section 41A of the Criminal Procedure Code (CrPC) was introduced to avoid routine arrests. It cited that this provision restricts the power to arrest when an accused person complies with the notice issued by the police to appear for questioning and mandates that an arrest shall be made only when the police are of the opinion that it is necessary. The court held that while it was within the domain of the investigating agency to interrogate an accused and to arrive at a subjective satisfaction on the issue, the same was not "wholly immune from judicial reviewability". "The court can consider whether the reasons for deprivation of liberty are rational, reasonable or fanciful," it said. The bench further said that the first information report (FIR) against the Kochhars was registered in 2019, and they were summoned for questioning only in 2022. "Despite the gravity of the offence, the petitioners (Kochhars) were not interrogated or summoned for a period of over three years from the date of registration of the crime," it said. From June 2022, the Kochhars have been appearing before the CBI as and when notices under section 41A were issued to them, the bench said. The CBI had claimed that the Kochhars were arrested as they were not cooperating with the probe and that their custodial interrogation was required to unearth the entire gamut of conspiracy. Apart from the Kochhars, the CBI had also arrested <keyword id="20060394" type="General" weightage="20" keywordseo="videocon" source="keywords">Videocon</keyword> group founder <keyword id="20641998" type="General" weightage="20" keywordseo="venugopal-dhoot" source="keywords">Venugopal Dhoot</keyword> in the case. The high court granted him bail in January 2023 in its interim order. The probe agency has alleged that private sector lender ICICI Bank had sanctioned credit facilities to the tune of Rs 3,250 crore to the companies of Videocon Group promoted by Dhoot in violation of the Banking Regulation Act, <keyword id="19899810" type="General" weightage="20" keywordseo="reserve-bank-of-india" source="keywords">Reserve Bank of India</keyword>'s guidelines, and credit policy of the bank. The CBI had named the Kochhars, Dhoot along with Nupower Renewables (NRL) managed by Deepak Kochhar, Supreme Energy, Videocon International Electronics Ltd and Videocon Industries Ltd as accused in the FIR registered in 2019 under the Indian Penal Code sections related to criminal conspiracy and provisions of the Prevention of Corruption Act. The agency has alleged that the ICICI Bank sanctioned credit facilities to the tune of Rs 3,250 crore to these companies in violation of norms. It further claimed that as a part of quid pro quo, Dhoot made an investment of Rs 64 crore in Nupower Renewables through Supreme Energy Pvt Ltd (SEPL) and transferred SEPL to Pinnacle Energy Trust managed by Deepak Kochhar through a circuitous route between 2010 and 2012.

These ‘copy-paste’ hackers take the old source code of a virus or malware and repurpose it to launch an attack. “New nations who are joining the game quite late have suddenly skewed the whole cyber warfare landscape in a different proportion,” said Ritesh. Old malware makes a comeback More sophisticated and experienced cybercriminals, like the Russians, North Koreans, or the Chinese, have the tools required to create their new malware. New players, on the other hand, don’t have a lot of capabilities, according to Ritesh. Instead of creating new code, they modify what already exists. “A three-year-old malware which was nowhere in the game has come back all over again in the last four to five months,” said Ritesh. In the last four months, more than 130 new variants of the malware have been spotted by DeCYFIR, Cyfirma’s threat prediction software. Dharma ransomware, which first reared its head in 2016, was spotted attacking small and medium businesses. Many variations of the source code have been dumped online or can be found for sale, according to cybersecurity firms Sophos. Conficker, a 12-year-old malware, also made a comeback. Exploiting weaknesses in Internet of Things (IoT) devices, the malware has inflicted most of its damage in the healthcare sector. Joker, another old Malware found making the rounds on the Google Play Store by cybersecurity firm Check Point. Introducing Patchwork There is no better example of ‘copy-paste’ hackers than one of the more prominent Indian hacker groups, Patchwork. Back in 2016, the Patchwork group of hackers ripped code and tolls from Github and around the Dark New to build their kit. "The requests for these lawful interception of electronic communication are made as per relevant rules under the provisions of Section 5(2) of Indian Telegraph Act ,1885 and Section 69 of the Information Technology (Amendment) Act, 2000," the official said. He mentioned that India's Minister of Electronics &amp; IT has also spoken in detail, including in the <keyword id="6354721" type="ORGANIZATION" weightage="20" keywordseo="parliament">Parliament</keyword>, that there has been no unauthorised interception by Government agencies. "It is important to note that government agencies have a well-established protocol for interception, which includes sanction and supervision from highly ranked officials in Central and state governments, for clear stated reasons only in national interest.
