The online activist group Electronic Privacy Information Center has obtained documents through the Freedom of Information Act <a href="http://epic.org/2013/04/epic-foia-request-reveals-deta.html">which detail</a> a "collaboration between the <keyword id="6354810" type="ORGANIZATION" weightage="100" keywordseo="Defense">Defense</keyword> Department, the Department of Homeland Security, and private companies to allow government monitoring of private Internet networks."
Basically, the Obama administration publicly threatens to veto CISPA — citing privacy concerns — while privately granting immunity to companies like AT&amp;T as they collaborate with government agencies to evade wiretapping laws.
The administration has issued an unknown amount of "2511" Wiretap Act immunity letters to internet providers, essentially making existing <keyword id="6355470" type="CITY" weightage="60" keywordseo="Law">law</keyword> null and void.
Natashe Lennard of Salon writes, "As such, in light of EPIC’s findings, CISPA, <a href="http://www.salon.com/2012/09/27/ndaa_plaintiffs_fear_us_citizens_already_in_military_detention/">like the NDAA</a>, can be seen to retroactively inscribe into law activity the government has already been carrying out in secret."
CNET's <a href="http://www.cnet.com/profile/declan00/">Declan McCullagh</a> <a href="http://news.cnet.com/8301-13578_3-57581161-38/u.s-gives-big-secret-push-to-internet-surveillance/">likens the revelation</a> to John Yoo's torture memos more than ten years ago: 
Paul Rosenzweig, a former Homeland Security official and founder of <a href="http://www.redbranchconsulting.com/">Red Branch Consulting</a>, compared the NSA and DOD asking the Justice Department for 2511 letters to that of the CIA asking the Justice Department for the so-called <a href="http://www.cbsnews.com/8301-503544_162-20104129-503544/ten-years-after-9-11-john-yoo-defends-his-legacy-legality-of-waterboarding/">torture memos</a> a decade ago. (They were written by Justice Department official John Yoo, who reached the controversial conclusion that waterboarding was not torture.)

CISPA Would Legalize Already Common Cyber Surveillance Practices

Charlie Savage of The New York Times <a href="http://www.nytimes.com/2013/05/08/us/politics/obama-may-back-fbi-plan-to-wiretap-web-users.html?hp&amp;_r=0">reported today</a> how the FBI plans to push domestic surveillance to the internet with mandated backdoors into web-communications platforms.
Almost immediately, information security specialists voiced concerns.
From a <a href="http://www.theverge.com/users/jeffblagdon" class="author fn">Jeff Blagdon</a> <a href="http://www.theverge.com/2013/5/7/4310936/white-house-close-to-backing-fbi-internet-wiretap-proposal">report</a> in The Verge:
Many have also been critical of the proposal’s impact on security — exposing systems to wiretaps could also open up more surface area to <keyword id="11094" type="UNKNOWN" weightage="60" keywordseo="Hackers">hackers</keyword> and others trying to gain access illicitly. "I think it’s a disaster waiting to happen,” said Columbia University Computer Science professor Steven M. Bellovin.
Old wiretapping techniques literally required hard-wiring into phone lines locally on telephone poles. Eventually that turned into coordinating with phone companies (<a href="http://www.theatlanticwire.com/politics/2013/05/way-avoid-fbis-internet-wiretaps/65008/">of which, there are few</a> — whereas there are many web entities) to listen in on cell phone calls.
Each required a warrant. The FBI's public argument for web-tapping says that obtaining permission will remain the same — though Declan McCullagh of CNET <a href="http://news.cnet.com/8301-13578_3-57583395-38/doj-we-dont-need-warrants-for-e-mail-facebook-chats/">reports</a> otherwise based on internal memos.
Setting aside the (semi?) legal justifications for a second, even the Times' own reportage contains an expert dubious about the possibilities of exploits built into a system: 
“I think the F.B.I.’s proposal would render Internet communications less secure and more vulnerable to hackers and identity thieves,” said Gregory T. Nojeim of the Center for Democracy and Technology.
With this latest move for web-wiretapping, it should come as no surprise <a href="http://www.huffingtonpost.com/2013/04/16/mike-rogers-cispa_n_3097027.html">that the quarterback behind</a> the design of the controversial Cyber Intelligence Sharing And Protections Act, Rep. Mike Rogers, has <a href="http://www.politico.com/story/2013/05/fbi-group-mike-rogers-for-director-90975.html">gained recent support</a> to head up the FBI.

FBI Internet Wiretapping Is A Cyber Security 'Disaster Waiting To Happen'

The bill, which has <a href="http://mashable.com/2013/04/22/reddit-cispa-blackouts/" target="_blank">stirred up</a> internet <keyword id="6355135" type="COMPANY" weightage="60" keywordseo="Privacy">privacy</keyword> watchdogs and sites like <keyword id="334157" type="COMPANY" weightage="60" keywordseo="Reddit">Reddit</keyword>, followed closely in the footsteps of the last unsuccessfully proposed privacy bills, the Stop Online Piracy Act (SOPA) and Protect I.P. Act (PIPA). SOPA and PIPA met their end last year after <keyword id="6355284" type="ORGANIZATION" weightage="60" keywordseo="senate">Senate</keyword> Majority Leader <a href="http://thinkprogress.org/politics/2012/01/20/407824/breaking-sen-reid-postpones-debate-over-protect-ip-act/?mobile=nc" target="_blank">Harry Reid canceled debate</a> following<a href="http://www.washingtonpost.com/politics/sopa-protests-to-shut-down-web-sites/2012/01/17/gIQA4WYl6P_story.html" target="_blank"> pressure and protests</a> from Internet companies such as Wikipedia, Google, and Reddit. 
The <a href="http://www.businessinsider.com/cispa-legalizes-common-secret-practices-2013-4">heat on CISPA</a> hasn't been as hot as the pressure put on SOPA and PIPA last year, but Sen. Jay Rockefeller (D-WV) who is the Chairman of the U.S. Senate Committee on Commerce, Science and Transportation says that <keyword id="1028545" type="UNKNOWN" weightage="60" keywordseo="CISPA">CISPA</keyword>'s privacy protections are "insufficient" and a committee aid confirmed to CNET that "<a href="http://news.cnet.com/8301-13578_3-57581463-38/cispa-suffers-setback-in-senate-citing-privacy-concerns/" target="_blank">Rockefeller believes the Senate will not take up CISPA</a>." 
Coupled with <a href="http://www.zdnet.com/white-house-threatens-to-veto-new-cispa-bill-ahead-of-vote-7000014099/" target="_blank">President Barack Obama's threatened veto</a>, CISPA as it is now could be all but dead, at least according to Michelle Richardson, legislative council with the American Civil Liberties Union.
"I think it's dead for now," she <a href="http://www.usnews.com/news/articles/2013/04/25/aclu-cispa-is-dead-for-now" target="_blank">told US News</a>. "CISPA is too controversial, it's too expansive, it's just not the same sort of program contemplated by the Senate last year. We're pleased to hear the Senate will probably pick up where it left off last year."
Why the uproar over CISPA? The bill allows companies to pass along what the government calls "cyber threat" data which includes personal information like user data to the United Sates Government. If the bill passed, they could legally give data over to law enforcement and not face legal repercussions. 
But Business Insider's <a href="http://www.businessinsider.com/cispa-legalizes-common-secret-practices-2013-4">Geoffrey Ingersoll says</a> it's passage would have been pointless anyway, because all it would have done is give more legal cover to the government and companies for surveillance practices they already engage in.

CISPA 'Dead For Now': 'Privacy Killer' Bill Hits A Wall In The Senate

<table class="image-container float_right" width="200"><tr><td><div class="image"></div><a href="http://www.aclu.org/national-security/nsa-unchained-infographic">ACLU</a></td></tr></table>The U.S. House of Representatives has <a href="http://rt.com/usa/congress-house-bill-cispa-031/">passed</a> the controversial Cyber Intelligence Sharing and Protect Act (<keyword id="1028545" type="UNKNOWN" weightage="60" keywordseo="CISPA">CISPA</keyword>) by a vote of&amp; <a href="http://clerk.house.gov/evs/2013/roll117.xml">288 to 127</a>, RT reports.
Declan McCullough of CNET <a href="http://news.cnet.com/8301-13578_3-57580268-38/cispa-permits-police-to-do-warrantless-database-searches/">details</a> why the bill — which encourages private businesses to voluntarily share "cyberthreat information" with the U.S. government — has privacy advocates up in arms.
McCullough explains that the legislation "authorizes federal agencies to conduct warrantless searches of information they obtain from e-mail and <keyword id="6357247" type="PERSON" weightage="60" keywordseo="Internet">Internet</keyword> providers," meaning that allows government agencies to collect vast amounts of data from private companies.
Furthermore, the bill overrides existing privacy policies and wiretap laws, so the feds would be able to "compile a database of information shared by private companies and search that information for possible violations of hundreds, if not thousands, of criminal laws."
The House Intelligence committee <a href="http://intelligence.house.gov/sites/intelligence.house.gov/files/documents/cispamythvactFeb122013v2.pdf">contends</a> that any claim that "this legislation creates a wide-ranging government surveillance program" is untrue. 
But groups including the ACLU and Electronic Frontier Foundation <a href="https://www.eff.org/sites/default/files/coalition-letter-cispa-2013.pdf">argue</a> that the bill allows for collection of sensitive private information such as Internet records and contents of emails, which could then be used "without meaningful oversight for purposes unrelated to cybersecurity."
CISPA now heads to the Senate and could soon end up on President Obama's desk to potentially sign into <keyword id="6355470" type="CITY" weightage="100" keywordseo="Law">law</keyword>. Earlier this week senior White House advisers <a href="http://www.infoworld.com/d/security/white-house-threatens-veto-cispa-ahead-of-vote-216644">recommended</a> that the president veto the bill, citing concerns that the bill does not adequately prevent sharing of irrelevant personal information.

The House Just Passed The CISPA Cybersecurity Bill - Here's Why The Internet Is Up In Arms

Remember <keyword id="234158" type="COMPANY" weightage="60" keywordseo="SOPA">SOPA</keyword> and <keyword id="904772" type="UNKNOWN" weightage="60" keywordseo="PIPA">PIPA</keyword>? They were laws introduced in the past two years that could have fundamentally altered the way the internet functions in an effort to curb piracy, but were effectively discontinued after vocal protest and online petitioning.
Now we're met with <keyword id="1028545" type="UNKNOWN" weightage="60" keywordseo="CISPA">CISPA</keyword>. The Cyber Intelligence Sharing and Protection Act aims to make it easier for the US government to investigate threats to cyber security. Activist groups like the Electronic Frontier Foundation and the American Civil Liberties Union aren't having it, though – they want more limits on the government's ability to track your browsing history and fear that power could be abused to spy on the general public instead of people posing a genuine threat.
If police want to search your house, they need a warrant. But CISPA effectively eliminates the need for a warrant if authorities want to follow you around online.
Reddit co-founder Alexis Ohanian was one of the most vocal opponents of PIPA and SOPA when they were presented as legislation. He's now leading a charge against CISPA as well, <a href="http://www.saveyourprivacypolicy.org/">over at SaveYourPrivacyPolicy.org</a>. He's posing a challenge to Google, Facebook, and Twitter – three companies noted for their vocal support of users' rights – to come out against CISPA.

Mike Rogers is running for Senate in Michigan after 9 years in the private sector.</li><li>Financial docs show that has multiplied his wealth since he left Congress in 2015.</li></ul>When former Rep. Mike Rogers decided to retire from Congress in 2014, money seemed to have been at least a little bit on his mind.The Michigan Republican’s aides <a target="_blank" href="https://www.nytimes.com/2014/03/29/us/politics/representative-mike-rogers-will-not-run-again.html">told the New York Times</a> at the time that Rogers would take up a new gig as a talk radio host in part to “earn considerable amounts of money” and to take on “something more lucrative” after years of public service. After all, being a member of Congress just doesn’t pay as well as the private sector: Lawmakers’ salaries have been <a target="_blank" href="https://www.businessinsider.com/members-congress-100000-pay-raise-salaries-174000-2024-1">capped at $174,000</a> a year since 2009.Nine years later, after briefly <a target="_blank" href="https://www.cbsnews.com/video/mike-rogers-on-possible-2024-presidential-bid/">flirting with a presidential bid</a>, Rogers is running for Senate in Michigan with the support of top Republicans. Over the last decade, according to property records and federal financial disclosure documents filed in <a target="_blank" href="https://www.documentcloud.org/documents/24410316-rogers_2015_pfd?responsive=1&amp;title=1">2015</a> and <a target="_blank" href="https://www.documentcloud.org/documents/24410317-rogers_2023_pfd?responsive=1&amp;title=1">2023</a>, he made good on his quest to get rich.That includes more than $32,000 from paid speeches in 2022, nearly $2 million in income from board positions at tech companies and cybersecurity firms in the last two years, and assets totaling as high as $17.5 million.And Rogers added one more key asset to his portfolio in July, just three months before launching his Senate bid: a modest $295,000 house in exurban Detroit. Before that, he was living over 1,000 miles away in sunny Cape Coral, Florida, where he purchased a more than $1.5 million home in 2022.It’s a stark example of how the so-called “revolving door” — where lawmakers, staffers, and other officials capitalize on their experience as they move between the public and private sectors — can fuel the explosion of immense wealth after years in public service."Mike Rogers has always believed that Michiganders deserve full and complete transparency from their elected leaders, which is why he has consistently complied with Senate Ethics and FEC financial disclosure requirements,” said Chris Gustafson, a spokesperson for Rogers’s campaign.<h2>Middling wealth — for a member of Congress</h2>Rogers first came to Congress in 2001, gradually rising through the ranks to become the chairman of the House Intelligence Committee from 2011 to 2015. He became known for authoring major legislation dealing with cybersecurity and intelligence matters, including the Cyber Intelligence Sharing and Protection Act (CISPA), a bill designed to enable the government to obtain personal information from private companies for intelligence and security purposes. Critics of the legislation <a target="_blank" href="https://www.eff.org/cybersecurity-bill-faq#cispa">argued</a> at the time that it would have created a “cybersecurity loophole” to existing privacy laws.Rogers was by no means a destitute congressman, but his wealth was middling for a place where <a target="_blank" href="https://www.opensecrets.org/news/2020/04/majority-of-lawmakers-millionaires/">most of his colleagues are millionaires</a>. In December, Rogers disclosed payments totaling roughly $1,975,000 since January 2022, including $724,887 from IronNet, which recently <a target="_blank" href="https://wtop.com/business-finance/2023/11/northern-virginia-cybersecurity-company-founded-by-retired-four-star-general-files-for-bankruptcy/">went bankrupt</a>; $191,000 from MITRE; nearly $160,00 from D-Wave; and over $20,000 from Telefonica Ingenieria, a Spanish telecommunications company.Rogers also received $460,000 from Nokia in the last two years, despite little public information existing about his affiliation with the Finnish tech company.His campaign did not say what the Nokia payment was for, and representatives for the company did not respond to Business Insider’s request for comment.And despite no longer hosting his radio show, Rogers continues to make big bucks from being a public figure. Put more simply, they were asking the Internet to help them find the suspects.
And the Internet answered: within a few hours of the FBI's release of these images, the Reddit hive-mind produced a <a href="http://www.businessinsider.com/reddit-finds-clear-picture-of-suspect-2-2013-4">much clearer image</a> of the suspected bomber.
Then, as if that weren't enough, Reddit <a href="http://www.businessinsider.com/reddit-photo-suspect-2--victim-2013-4">placed</a> the suspected bomber in the same frame as 8 year-old victim Martin Richard, with a bag that looked an awful lot like the one the FBI was trying to identify.
So basically, in this grisly game of Clue, Reddit did the FBI's job for them: all in one spot, killer, murder weapon, victim, and the scene of the crime.
Now here's the kicker — the FBI is among the top groups lobbying the government and <a href="http://www.nbcnews.com/technology/technolog/google-shares-fbi-requests-data-transparency-report-1C8759458">private web companies</a> for more <keyword id="6354565" type="UNKNOWN" weightage="60" keywordseo="surveillance">surveillance</keyword> over the internet, ie. CISPA, a bill which just passed the House, may pass the Senate, and may cross Obama's desk.
As we've <a href="http://www.businessinsider.com/congress-passes-cispa-cybersecurity-bill-2013-4">covered</a> before, CISPA "authorizes federal agencies to conduct warrantless searches of information they obtain from e-mail and Internet providers," as explained by Declan McCullough of CNET.
Part of the reason for CISPA is that massive companies are hemorrhaging proprietary information, through the likes of hackers conducting cyber espionage. Some of these hackers are <a href="http://www.businessinsider.com/china-hacking-pla-unit-61398-2013-2">state-sanctioned</a>, others are <a href="http://www.businessinsider.com/kristina-svechinskaya-verdict-in-spring-2013-3">downright criminal</a>.
It goes without mentioning that Redditors, and the Internet cesspool dwellers on 4Chan, <a href="http://www.windowsecurity.com/articles-tutorials/misc_network_security/Different-Shades-Hackers.html">hackers of all color</a>, despise this piece of legislation.
Why? Because CISPA would unmask the Internet. Without anonymity, without hacker handles, without online alter egos, there is no image of Martin Richard next to the bomb and the bomber.
Granted, Reddit spurred a few false leads rumors about<a href="http://www.theatlantic.com/technology/archive/2013/04/it-wasnt-sunil-tripathi-the-anatomy-of-a-misinformation-disaster/275155/"> missing Brown student Sunil Tripathi</a> and <a href="http://www.businessinsider.com/salah-barhoun-clears-name-2013-4">various people carrying bags at the Marathon</a> (which was also one of the suspect identifiers investigators were looking for anyway), but the consensus seems to be that Reddit helped more than it hurt.
Because they can operate freely, without recourse, Anonymous and Reddit and 4Chan can crowdsource information gathering. Stripping them of their online identities though — essentially killing the Internet hive mind — would remove the barrier under which these folks operate.
They've proven that they can operate for ill, but their operations for good match the ill <a href="http://www.huffingtonpost.com/2011/01/29/anonymous-internet-egypt_n_815889.html">by tenfold</a> — would they really have worked to restore the internet to a Cairo in upheaval if they knew their own governments could readily, personally identify them? 
Even amongst the trolls, Internet dwellers as a single body, the hive-mind, has an acute sense of justice and injustice.
Gabriella Coleman said "<a href="http://www.technologyreview.com/news/510641/geeks-are-the-new-guardians-of-our-civil-liberties/">geeks are the new guardians</a> of our civil liberties."
Extinguishing that moral compass simply because Bank of America or Lockheed Martin are <a href="http://finance.yahoo.com/news/america-cant-stop-chinese-hackers-191600171.html">losing proprietary information</a> to the <a href="http://www.businessinsider.com/mandiant-china-hackers-wmd-no-one-mentions-2013-2">Chinese</a> is a dangerous course of action.
