The body of the on-duty trainee doctor was found in the seminar room of the state-run hospital on August 9, triggering nationwide outrage. The CBI is investigating the case from the second week of August on an order of the high court. The petitioner prayed in the PIL that the CBI be directed to investigate the <keyword id="22008077" type="General" weightage="20" keywordseo="cyber-offences" source="keywords">cyber offences</keyword> in connection with the "unfortunate and brutal incident." The court asked the Additional Solicitor General Asok Kumar Chakrabarti, representing the central agency, whether it could find a way to block these types of posts. The division bench, presided by Chief Justice T S Sivagnanam, directed the joint director, CBI, Kolkata, to look into the grievance expressed by the petitioner with regard to the issue of such abominable <keyword id="20074678" type="General" weightage="20" keywordseo="social-media-posts" source="keywords">social media posts</keyword>. The bench, also comprising Justice Hiranmay Bhattacharyya, directed the CBI joint director or any other competent officer to file a report in this regard by September 18, when the PIL will come up for hearing again along with other petitions relating to the August 9 rape-murder of the doctor. After the order was dictated, Chakrabarti submitted before the court that the CBI does not have any separate wing to investigate such cyber crimes. Maintaining that the state police has a special unit to monitor such matters, he prayed that the <keyword id="20054502" type="General" weightage="20" keywordseo="West-Bengal-government" source="keywords" meta.keywordsubtype="org" meta.entityname="West Bengal government" meta.hostid="153" meta.entityid="West Bengal government">West Bengal government</keyword>'s cyber crime branch be also directed to file a separate report. The court said that it would consider the prayer on the next date of hearing.

Calcutta High Court seeks CBI report on nasty social media posts on RG Kar hospital rape-murder victim

New Delhi, The <keyword id="19914482" type="General" weightage="20" keywordseo="aap" source="keywords">AAP</keyword> on Friday claimed the CBI is planning to arrest Delhi Chief Minister Arvind <keyword id="19895701" type="General" weightage="20" keywordseo="kejriwal" source="keywords">Kejriwal</keyword> in the next few days and will serve him a notice by the evening. While the party did not say in which case Kejriwal is likely to be arrested, it said that this was being done to prevent the AAP from stitching an alliance with the Congress for the upcoming Lok Sabha elections as the <keyword id="19894848" type="General" weightage="20" keywordseo="bjp" source="keywords">BJP</keyword> is scared of the two parties coming together. While there was no immediate response from the Central Bureau of Investigation (CBI) to the AAP's claims, the BJP said AAP leaders are trying to create confusion and generate sympathy for Kejriwal. The Congress and the AAP are likely to have a seat-sharing pact in Delhi, Gujarat and Haryana for the Lok Sabha polls and the talks between the two sides are in the final stages, sources said on Thursday. Addressing a press conference here, Delhi cabinet minister and senior AAP leader <keyword id="19945966" type="General" weightage="20" keywordseo="saurabh-bharadwaj" source="keywords">Saurabh Bharadwaj</keyword> said as soon as reports of finalisation of seat-sharing talks between the Congress and the AAP started coming in, the ED sent a seventh summons to Kejriwal in the excise policy case. "We have learnt from reliable sources that the CBI is planning to arrest Kejriwal. The CBI will also serve a notice to Kejriwal either this afternoon or by the evening," Bharadwaj said. Kejriwal will be arrested in the next two to three days, he said. "We are getting messages that if the AAP-Congress alliance is formed, Arvind Kejriwal will be arrested. The BJP is scared of the AAP-Congress alliance. You can arrest Kejriwal if you want, but the alliance will be forged," he said. The Enforcement Directorate has issued a fresh summons to Kejriwal asking him to appear before it for questioning in the Delhi excise policy-linked money laundering case on February 26, sources said on Thursday. This is the seventh summons issued by the ED to the chief minister, who skipped the previous six. AAP Rajya Sabha MP Sandeep Pathak said people will take to the streets if Kejriwal is arrested. "There will be a tsunami. Their (BJP) political calculations will go wrong. We are not scared of being arrested. We are forging this alliance for the country," he said. Delhi BJP president <keyword id="20040814" type="General" weightage="20" keywordseo="virendra-sachdeva" source="keywords">Virendra Sachdeva</keyword> said Kejriwal knows that the talks on the AAP's alliance with the Congress are failing but AAP leaders have been spreading rumours since Thursday and are trying to generate sympathy for the chief minister. "Kejriwal may delay his punishment with the help of lawyers but ultimately, the people of Delhi will punish him harshly in the coming elections," the BJP leader said. The AAP and Kejriwal should remember that Congress leader Ajay Maken had submitted the first written complaint to the lieutenant governor regarding the liquor "scam" under his government, Sachdeva said. The BJP won all the seven seats in Delhi with 51 per cent votes in the 2014 Lok Sabha polls and 59 per cent in 2019. In the 2024 Lok Sabha elections, the people of Delhi will give 70 per cent votes to the BJP, he asserted.

Mumbai, The arrest of ICICI Bank's former Managing Director and Chief Executive Officer (CEO) Chanda Kochhar and her husband Deepak Kochhar by the Central Bureau of Investigation (<keyword id="19896633" type="General" weightage="20" keywordseo="cbi" source="keywords">CBI</keyword>) in a loan fraud case was "without application of mind and due regard to the law", amounting to an "abuse of power", the Bombay High Court has said. A division bench of Justices Anuja Prabhudessai and N R Borkar had on February 6 held the <keyword id="20482859" type="General" weightage="20" keywordseo="kochhars" source="keywords">Kochhars</keyword>' arrest as illegal and confirmed a January 2023 interim order passed by another bench granting them bail. In the order made available on Monday, the court said the CBI has been unable to demonstrate the existence of circumstances or supportive material based on which the decision to arrest was taken. The absence of such circumstances renders the arrest illegal, it said. "Such routine arrest without application of mind and due regard to the law amounts to an abuse of power," the court said. The court also refused to accept the probe agency's contention that the arrest was made as the Kochhars were not cooperating with the probe and said the accused had a right to remain silent during interrogation. "The right to silence emanates from Article 20(3) of the Indian Constitution, which gives an accused the right against self-incrimination. Suffice it to say that exercise of the right to remain silent cannot be equated with non-cooperation," it said in the order. The CBI arrested the couple on December 23, 2022, in the Videocon-ICICI Bank loan case. They immediately moved the high court challenging the arrest and sought for the same to be declared illegal, and by way of interim order, sought to be released on bail. On January 9, 2023, the court, in an interim order, granted the Kochhars bail, noting that the CBI had made the arrest casually and mechanically and without application of mind. In the February 6 order, the bench noted that section 41A of the Criminal Procedure Code (CrPC) was introduced to avoid routine arrests. It cited that this provision restricts the power to arrest when an accused person complies with the notice issued by the police to appear for questioning and mandates that an arrest shall be made only when the police are of the opinion that it is necessary. The court held that while it was within the domain of the investigating agency to interrogate an accused and to arrive at a subjective satisfaction on the issue, the same was not "wholly immune from judicial reviewability". "The court can consider whether the reasons for deprivation of liberty are rational, reasonable or fanciful," it said. The bench further said that the first information report (FIR) against the Kochhars was registered in 2019, and they were summoned for questioning only in 2022. "Despite the gravity of the offence, the petitioners (Kochhars) were not interrogated or summoned for a period of over three years from the date of registration of the crime," it said. From June 2022, the Kochhars have been appearing before the CBI as and when notices under section 41A were issued to them, the bench said. The CBI had claimed that the Kochhars were arrested as they were not cooperating with the probe and that their custodial interrogation was required to unearth the entire gamut of conspiracy. Apart from the Kochhars, the CBI had also arrested <keyword id="20060394" type="General" weightage="20" keywordseo="videocon" source="keywords">Videocon</keyword> group founder <keyword id="20641998" type="General" weightage="20" keywordseo="venugopal-dhoot" source="keywords">Venugopal Dhoot</keyword> in the case. The high court granted him bail in January 2023 in its interim order. The probe agency has alleged that private sector lender ICICI Bank had sanctioned credit facilities to the tune of Rs 3,250 crore to the companies of Videocon Group promoted by Dhoot in violation of the Banking Regulation Act, <keyword id="19899810" type="General" weightage="20" keywordseo="reserve-bank-of-india" source="keywords">Reserve Bank of India</keyword>'s guidelines, and credit policy of the bank. The CBI had named the Kochhars, Dhoot along with Nupower Renewables (NRL) managed by Deepak Kochhar, Supreme Energy, Videocon International Electronics Ltd and Videocon Industries Ltd as accused in the FIR registered in 2019 under the Indian Penal Code sections related to criminal conspiracy and provisions of the Prevention of Corruption Act. The agency has alleged that the ICICI Bank sanctioned credit facilities to the tune of Rs 3,250 crore to these companies in violation of norms. It further claimed that as a part of quid pro quo, Dhoot made an investment of Rs 64 crore in Nupower Renewables through Supreme Energy Pvt Ltd (SEPL) and transferred SEPL to Pinnacle Energy Trust managed by Deepak Kochhar through a circuitous route between 2010 and 2012.

Actor <keyword id="1623055" type="General" weightage="20" keywordseo="sooraj-pancholi" source="Orion">Sooraj Pancholi</keyword> shook off the controversy clouding his life and career on Friday with a special <keyword id="6354572" type="General" weightage="20" keywordseo="cbi" source="Orion">CBI</keyword> court acquitting him in the 2013 <keyword id="6356238" type="General" weightage="20" keywordseo="suicide" source="Orion">suicide</keyword> case of his girlfriend <keyword id="19566" type="General" weightage="20" keywordseo="jiah-khan" source="Orion">Jiah Khan</keyword>. Pancholi, 32, the son of actors <keyword id="966" type="General" weightage="20" keywordseo="aditya-pancholi" source="Orion">Aditya Pancholi</keyword> and Zarina Wahab, hasn't really been able to make a dent after his promising debut as the lead in the remake of "Hero" opposite Athiya Shetty in 2015. The film, which won him a Filmfare Award for best debut, was backed by Salman Khan and Subhash Ghai. It didn't do well and Pancholi's career has been moving in fits and starts since then. He has since worked in the little-known "Satellite Shankar" and "Time to Dance". Pancholi, who has also worked as assistant director on films such as Sanjay Leela Bhansali's "Guzaarish" and Salman Khan-starrer "Ek Tha Tiger", hit the headlines when he was accused of abetting Jiah Khan's suicide. He was charged on the basis of a six-page letter purportedly written by Khan, who was found hanging in her Juhu home on June 3, 2013. In an interview to PTI in 2015, Pancholi had said, "My name will always be associated with her and I have no guilt for that. I am happy that something at least stays with me. I am sad that she ended her life. But at least her name is with me and I have no problems with it." On Friday, Pancholi was there with his mother when the judge read out the verdict. Special CBI judge A S Sayyad called him to the witness box and asked his name. When the actor said Sooraj, the judge asked him to state his full name. The actor then replied, "Sooraj Aditya Pancholi." The judge then said, "Due to paucity of evidence, this court holds you (Sooraj) not guilty... acquitted." Sooraj nodded with his head down and stepped out of the witness box. He didn't speak to reporters. Actor <keyword id="1623055" type="General" weightage="50" keywordseo="sooraj-pancholi" source="Orion">Sooraj Pancholi</keyword>, who is facing charges of abetting the suicide of actress Jiah Khan, reached CBI Court along with his mother on Friday morning. Jiah Khan was found dead in her suburban home on June 3, 2013. Sooraj <keyword id="968" type="General" weightage="80" keywordseo="pancholi" source="Orion">Pancholi</keyword> is accused of abetting the suicide of Jiah Khan based on a letter seized on June 10, which the 25-year-old actor purportedly wrote, Mumbai Police booked Pancholi under section 306 (abetment to suicide) and arrested him. Sooraj, son of actors <keyword id="966" type="General" weightage="50" keywordseo="aditya-pancholi" source="Orion">Aditya Pancholi</keyword> and Zarina Wahab, was allegedly in a relationship with Jiah. Here is a timeline of Jiah Khan's suicide case: on June 3, 2013, Jiah Khan's body was found in flat number 102 of Sagar Sangeet Society in Mumbai On June 7, 2013, Mumbai police recovered a six-page suicide note from Jiah's house. On June 10, 2013, Sooraj Pancholi was arrested by the Juhu police after allegations of abetting Jiha for suicide. On July 2, 2013, the Bombay High Court granted bail to Suraj Pancholi and he got released after spending 22 days in jail. In October 2013, Jiha's mother, Rabia Khan, moved to the Bombay High Court demanding a CBI probe. In July 2014, the case was handed over to the CBI. In December 2015, the CBI submitted a report before the court and termed the case as an abetment to suicide. A few days later, Rabia demanded for an SIT to probe the matter. In February 2017, the High Court rejected the demand for the formation of the SIT. The trial court also rejected Rabia's demand for further investigation in 2018. On 15 March 2019, the trial began in the Jiah Khan case. In the year 2021, the case was reassigned to the Special CBI Court because the sessions court said that the jurisdiction of the CBI case is not with the sessions court. On March 21, 2023, the government side closed its case with the statement of 21 witnesses. On April 20, 2023, both sides presented their final arguments after which the court fixed 28 April to announce the verdict. The <keyword id="6354572" type="General" weightage="80" keywordseo="cbi" source="Orion">CBI</keyword> has filed an <keyword id="6358015" type="General" weightage="80" keywordseo="fir" source="Orion">FIR</keyword> against telecom infrastructure major <keyword id="95837" type="General" weightage="100" keywordseo="gtl" source="Orion">GTL</keyword> for allegedly diverting a substantial portion of a Rs 4,760 crore loan availed from a consortium of banks led by <keyword id="6357560" type="General" weightage="80" keywordseo="idbi-bank" source="Orion">IDBI Bank</keyword>, officials said. The agency has booked the company, unidentified directors, public officials and vendors under IPC sections related to criminal conspiracy, cheating and provisions of the Prevention of Corruption Act, following a preliminary enquiry which showed that GTL had fraudulently obtained various credit facilities from consortium of banks, they said. According to the FIR, the company allegedly diverted or siphoned off a majority of the loan amount in conspiracy with its vendors, unidentified bank officers, among others. The FIR has alleged <keyword id="1504826" type="General" weightage="80" keywordseo="gtl-limited" source="Orion">GTL Limited</keyword> was extending advances to vendors year on year without supply of material/goods, and eventually these advances were provisioned. "Various vendor companies were created and operated with the malafide intention of siphoning off the bank short term funds and other credit facilities in connivance with borrower i.e. GTL Limited," the FIR has alleged. The IDBI Bank had conducted a special audit of the company in 2011 and raised the issue of suspicious transaction with the vendors. The Economic Offences unit of the agency has found that Reserve Bank of India (RBI) had warned IDBI Bank on April 1, 2016 to "red flag" the account and conduct a forensic audit, but in its response submitted two months later, the bank stated on behalf of the entire consortium lenders not to classify the account as 'Red Flags' and also not to appoint a forensic auditor as it may delay the dues settlement. The RBI reiterated its directive following which a forensic audit was instituted on July 30, 2016. The company was engaged in the business of providing telecom network deployment services, operations and maintenance services professional services, network planning and design services and energy management services to telecom operators in India and international markets. Manoj Tirodkar and Global Holding Corporation Pvt Ltd (GHC) are the promoters of the company, the CBI has said. The CBI has alleged that an amount of Rs 1,213.97 crore (86.84 per cent) is outstanding against four companies -- Acuity Trading Pvt Ltd, Lenity Trading Pvt Ltd, Venerate Trading Pvt Ltd and Vinamara Multitrading Pvt Ltd -- which were given huge advances for supply of material from financial year 2009-10 to 2011-12, but supply orders were completed. "Eventually, Rs 1,213.97 crore was left outstanding towards these four vendors which was gradually provisioned till 2017-18," the FIR alleged. The CBI found that advances were given despite their meagre net worth and their recent incorporation. "The enquiry further revealed that all these vendor companies were incorporated within a short span of less than three months. And the Memorandum of Association (MoA) of these vendors of GTL Limited is exactly the same. There are same corrections in all the MoA's which clearly establishes that all the MoA's have been drafted by the same agency/source," the FIR alleged. During the enquiry of some of these vendors entities were examined. "These directors had no knowledge about the supply made by them to GTL Limited, source of procurement by vendor companies, godown of vendor companies, where was the material being supplied. They also did not have any knowledge of the work that these vendor companies used to do," it said. The 2016 forensic audit of the company showed GTL Limited has made substantial advances for the procurement of material to some of the vendors even though the purchases made from these parties were much lesser.
