<keyword id="6354572" type="ORGANIZATION" weightage="100" keywordseo="CBI">CBI</keyword> has registered a case against unknown officials of <keyword id="2573" type="CITY" weightage="100" keywordseo="Air-India">Air India</keyword>, German firm SAP AG and global computer major <keyword id="10875" type="CITY" weightage="20" keywordseo="IBM">IBM</keyword> in connection with alleged irregularities in procurement of software worth Rs 225 crore by the national carrier in 2011. The agency has registered the case on the recommendation of the Central Vigilance Commission which found prima facie procedural irregularities in the procurement of the software, CBI sources said. 
 
After considering the reports of Chief Vigilance Officer of Air India, the Commission in a communication to CBI said it was of the view that there were "serious procedural and other irregularities" in the procurement as well as amount paid and extent of services rendered. The CVC had asked the CBI to probe the "irregularities in the tendering process and award of contract and undue benefit caused to the SAP/IBM". It had also asked the agency to investigate whether any of the persons who dealt with the issue at IBM and in the government got any financial or other benefits, besides irregularities relating to the registration by the Directorate General of Supplies and Disposal. CBI files FIR in Air India software procurement 'scam' of Rs 225 crore

In view of increasing cyber crime cases, <keyword id="6354572" type="ORGANIZATION" weightage="20" keywordseo="CBI">CBI</keyword> is mulling setting up a special branch in Mumbai to probe such offences, its director Anil Sinha said on Tuesday. 
 
Sinha was in the city to inaugurate the newly constructed 13-storey office of CBI in suburban Bandra-Kurla Complex. All its branches like anti-corruption bureau, economic offences wing and special crime branch will now operate from the new office. "Over the last two years, the cyber world has witnessed a surge in activities. I am contemplating, provided we get cooperation from the state government, setting up a branch to probe cyber crime offences," Sinha said. 
 
"As of now, such a branch is only in the headquarters (Delhi), but now I think it's time a similar branch is opened here in Mumbai, too. Cyber crime is increasing and a separate team of officers including experts are required," the director said. 
 He said CBI in Mumbai has unearthed several scams like the <keyword id="532918" type="UNKNOWN" weightage="20" keywordseo="Harshad-Mehta-scam">Harshad Mehta scam</keyword>, Telgi fake stamp paper scam, Adarsh Housing society scam and so on. "Apart from such scams, CBI is also probing sensational murder cases of <keyword id="3020388" type="UNKNOWN" weightage="20" keywordseo="Sheena-Bora">Sheena Bora</keyword> and <keyword id="266924" type="PERSON" weightage="20" keywordseo="Narendra-Dabholkar">Narendra Dabholkar</keyword> among others," Sinha said. 
 
"Recently, state governments and high courts have also been handing over several cases to CBI. Though CBI started as an anti-corruption bureau, its scope has increased to economic offences, serious frauds and sensational cases under IPC. It is now a federal investigating agency which can probe any kind of case," he said. 
 
"The corrupt are resorting to devious and ingenious means to outwit investigating agencies. We must, therefore, update our knowledge and reinvent our practices and methods to detect and bring these new methods of corruption within the ambit of substantive evidence," he said. 
 
Sinha said there is also a need to expand the definition of corruption as offenders are adopting new ways of indulging in graft. "We must now think beyond traps. Nobody these days accepts money in their hands directly. Hence, we must think of expanding the definition of corruption," he said.

The agency issued a warning notice for job-seekers informing them about the fake employment opportunities via internships. Fraudsters disguised as senior officers, put out online advertisements for internships — referring to them as employment opportunity. After which, the CBI issued an official notice — “CBI Academy and Internshala to initiate an Internship Scheme of CBI from the year 2020” — on its website. “It has come to our notice that some platforms are referring to our Internship Scheme as an employment opportunity in the CBI. These platforms incorrectly mentioned that the CBI will pay the interns a consolidated amount or salary as per CBI norms, during the internship period. These platforms are also falsely giving alleged information to the general public that after completion of the <keyword id="8672674" type="UNKNOWN" weightage="20" keywordseo="CBI-internship">CBI Internship</keyword>, the interns will be given placement in CBI. The candidates are also being asked to apply for the Internship Scheme of CBI online through a link being provided by recruitment agencies,” said the notice. <keyword id="2687612" type="ORGANIZATION" weightage="20" keywordseo="CBI-Academy">CBI Academy</keyword> and Internshala to initiate an internship scheme from of CBI from the year 2020” The agency is offering internships to Indian nationals — graduates, postgraduates and research scholars — who major in law, cyber, data analysis, criminology, management, economics, commerce and forensic science including digital forensics. The internship will last for a maximum of two months where the selected interns will assist in analysis of information. Internship not employment, clarifies CBI after internet job scams do the rounds

Mumbai, The arrest of ICICI Bank's former Managing Director and Chief Executive Officer (CEO) Chanda Kochhar and her husband Deepak Kochhar by the Central Bureau of Investigation (<keyword id="19896633" type="General" weightage="20" keywordseo="cbi" source="keywords">CBI</keyword>) in a loan fraud case was "without application of mind and due regard to the law", amounting to an "abuse of power", the Bombay High Court has said. A division bench of Justices Anuja Prabhudessai and N R Borkar had on February 6 held the <keyword id="20482859" type="General" weightage="20" keywordseo="kochhars" source="keywords">Kochhars</keyword>' arrest as illegal and confirmed a January 2023 interim order passed by another bench granting them bail. In the order made available on Monday, the court said the CBI has been unable to demonstrate the existence of circumstances or supportive material based on which the decision to arrest was taken. The absence of such circumstances renders the arrest illegal, it said. "Such routine arrest without application of mind and due regard to the law amounts to an abuse of power," the court said. The court also refused to accept the probe agency's contention that the arrest was made as the Kochhars were not cooperating with the probe and said the accused had a right to remain silent during interrogation. "The right to silence emanates from Article 20(3) of the Indian Constitution, which gives an accused the right against self-incrimination. Suffice it to say that exercise of the right to remain silent cannot be equated with non-cooperation," it said in the order. The CBI arrested the couple on December 23, 2022, in the Videocon-ICICI Bank loan case. They immediately moved the high court challenging the arrest and sought for the same to be declared illegal, and by way of interim order, sought to be released on bail. On January 9, 2023, the court, in an interim order, granted the Kochhars bail, noting that the CBI had made the arrest casually and mechanically and without application of mind. In the February 6 order, the bench noted that section 41A of the Criminal Procedure Code (CrPC) was introduced to avoid routine arrests. It cited that this provision restricts the power to arrest when an accused person complies with the notice issued by the police to appear for questioning and mandates that an arrest shall be made only when the police are of the opinion that it is necessary. The court held that while it was within the domain of the investigating agency to interrogate an accused and to arrive at a subjective satisfaction on the issue, the same was not "wholly immune from judicial reviewability". "The court can consider whether the reasons for deprivation of liberty are rational, reasonable or fanciful," it said. The bench further said that the first information report (FIR) against the Kochhars was registered in 2019, and they were summoned for questioning only in 2022. "Despite the gravity of the offence, the petitioners (Kochhars) were not interrogated or summoned for a period of over three years from the date of registration of the crime," it said. From June 2022, the Kochhars have been appearing before the CBI as and when notices under section 41A were issued to them, the bench said. The CBI had claimed that the Kochhars were arrested as they were not cooperating with the probe and that their custodial interrogation was required to unearth the entire gamut of conspiracy. Apart from the Kochhars, the CBI had also arrested <keyword id="20060394" type="General" weightage="20" keywordseo="videocon" source="keywords">Videocon</keyword> group founder <keyword id="20641998" type="General" weightage="20" keywordseo="venugopal-dhoot" source="keywords">Venugopal Dhoot</keyword> in the case. The high court granted him bail in January 2023 in its interim order. The probe agency has alleged that private sector lender ICICI Bank had sanctioned credit facilities to the tune of Rs 3,250 crore to the companies of Videocon Group promoted by Dhoot in violation of the Banking Regulation Act, <keyword id="19899810" type="General" weightage="20" keywordseo="reserve-bank-of-india" source="keywords">Reserve Bank of India</keyword>'s guidelines, and credit policy of the bank. The CBI had named the Kochhars, Dhoot along with Nupower Renewables (NRL) managed by Deepak Kochhar, Supreme Energy, Videocon International Electronics Ltd and Videocon Industries Ltd as accused in the FIR registered in 2019 under the Indian Penal Code sections related to criminal conspiracy and provisions of the Prevention of Corruption Act. The agency has alleged that the ICICI Bank sanctioned credit facilities to the tune of Rs 3,250 crore to these companies in violation of norms. It further claimed that as a part of quid pro quo, Dhoot made an investment of Rs 64 crore in Nupower Renewables through Supreme Energy Pvt Ltd (SEPL) and transferred SEPL to Pinnacle Energy Trust managed by Deepak Kochhar through a circuitous route between 2010 and 2012.

Chanda Kochhar, her husband's arrest in loan fraud case amounts to abuse of power by CBI: HC

India’s premier investigative agency Central Bureau of Investigation (<keyword id="6354572" type="ORGANIZATION" weightage="20" keywordseo="CBI">CBI</keyword>) has filed 45 cases against ministers, Member of Parliaments and former state government ministers in the last three years. 
	 The information was revealed by <keyword id="2489530" type="UNKNOWN" weightage="20" keywordseo="Dr-Jitendra-Singh">Dr Jitendra Singh</keyword>, Minister of State for Personnel, Public Grievances and Pensions, in a reply to a question raised in the Rajya Sabha. He stated that of the 45 cases CBI has registered during the last three years and up to 31.10.2014 of the current year, a total of 45 cases, the highest number of cases were filed in the year 2012. “Out of above 45 cases, 25 cases are under trial and 14 cases are under investigation. Five cases have been closed by CBI and in one case, CBI has gone on Appeal against the order of the Court,” said Singh in the Upper House. 
	 It should be noted that the CBI had filed 12 cases in 2011 followed by 15 in 2012 while 9 cases were filed in both 2013 and 2014 (up to October 31, 2014) respectively. “After completion of investigation, the action is taken in accordance with law. In a series of judgments, the Supreme Court has directed that CBI be given full independence and autonomy while conducting any investigation. Government does not interfere with the investigation of cases by the CBI and does not intervene in the judicial functioning of the courts,” added Singh. Some of the high profile cases being investigated by the CBI include <keyword id="981763" type="UNKNOWN" weightage="20" keywordseo="Coalgate">Coalgate</keyword> Scam, <keyword id="600974" type="UNKNOWN" weightage="20" keywordseo="LTC-scam">LTC scam</keyword> among others.

The Kochhars were arrested by the Central Bureau of Investigation (CBI) last Friday. Dhoot was arrested on Monday. The three were produced before special judge S H Gwalani at the end of their earlier remand on Thursday. The CBI, represented by special public prosecutor A Limosin, did not seek their custody further. The court then sent all the three accused to judicial custody till January 10, 2023. The CBI had named the Kochhars and Dhoot, along with companies Nupower Renewables (NRL) managed by Deepak Kochhar, Supreme Energy Private Limited (SEPL), Videocon International Electronics Ltd (VIEL) and Videocon Industries Limited, as accused in its FIR registered in 2019 under Indian Penal Code sections related to criminal conspiracy and the Prevention of Corruption Act. According to the CBI, a sanctioning committee headed by Chanda Kochhar in 2009 approved a term loan of Rs 300 crore to VIEL in contravention of the rules and policies of the bank by abusing her official position as a public servant. The CBI carried out searches at seven locations on Monday in connection with the <keyword id="8878575" type="UNKNOWN" weightage="20" keywordseo="yes-bank-scam">Yes Bank scam</keyword> pertaining to the Rs 600 crore alleged bribe to the family of its co-founder <keyword id="128581" type="PERSON" weightage="20" keywordseo="Rana-Kapoor">Rana Kapoor</keyword> by DHFL, officials said. Teams of CBI officers are carrying out operations at the residence and official premises of the accused in Mumbai, they said. The agency has alleged that Kapoor, 62, entered into a criminal conspiracy with <keyword id="152129" type="COMPANY" weightage="20" keywordseo="Kapil-Wadhawan">Kapil Wadhawan</keyword>, DHFL promoter, for extending financial assistance to DHFL through Yes Bank in return for substantial undue benefits to himself and his family members through companies held by them, they said. According to the <keyword id="522895" type="ORGANIZATION" weightage="20" keywordseo="CBI-FIR">CBI FIR</keyword>, the scam started taking shape between April and June, 2018 when Yes Bank invested Rs 3,700 crore in short-term debentures of the scam-hit Dewan Housing Finance Corporation Ltd (DHFL). In return, Wadhawan allegedly "paid kickback of Rs 600 crore" to Kapoor and family members in the form of loan to DoIT Urban Ventures (India) Pvt Ltd, they said.
