ICAI offers CA students to ‘opt-out’ of the July examination — and sit for November exams instead

<ul><li>The <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> on Thursday (July 2) adjourned the hearing for CA examination in July and the decision on the opt-out scenario to next week. </li><li>This was after the Institute of Chartered Accountants of India (<keyword id="6364696" type="UNKNOWN" weightage="20" keywordseo="ICAI">ICAI</keyword>) appealed to the apex court to allow more time to connect with the exam centres and authorities so as to assess the COVID situation and understand if it's feasible to conduct exams from July 29 onwards. </li><li>As of now, if a student decides to opt out, this attempt (July examination) will not be counted. </li></ul>The Supreme Court on Thursday (July 2) adjourned the hearing for Chartered Accountants’ examination in July and the decision on the opt-out scenario to next week. This was after the Institute of Chartered Accountants of India (ICAI) appealed to the apex court to allow more time to connect with the exam centres and authorities so as to assess the COVID situation and understand if it's feasible to conduct exams from July 29 onwards. The apex court had earlier directed the institute to come up with fresh guidelines — that include the suggestion by the bench — and appear for the hearing on July 2, 2020. The Supreme Court had said that those who were preparing to appear for the July examination but are unable to take the exam should be eligible for the ‘opt-out’ case. “The ICAI counsel may take instructions and file the modified draft notification setting out the changes”, the bench said on June 29. The bench headed by Justice AM Khanwilkar said this during the hearing of a petition filed by the president of India Wide Parents Association Anubha Shrivastava Sahai. The petition sought orders to stay the scheme — which allows those students who applied for the July exam to opt out and appear in the November examination. The petition also appealed to the court for more examination centers. "There are also a limited number of exam centres. Even ICAI says only 232 centres are there. Many students in Bihar have opted for the 15-day long exam in Kolkata which is under lockdown,” Advocate Alok Srivastava <a href="https://www.barandbench.com/news/litigation/ca-exams-be-flexible-you-cannot-be-rigid-supreme-court-tells-icai-to-consider-allowing-students-to-opt-out-even-during-exams">said</a> during the previous hearing. <keyword id="1707038" type="COMPANY" weightage="20" keywordseo="The-Institute-of-Chartered-Accountants-of-India">The Institute of Chartered Accountants of India</keyword> (ICAI) told the Supreme Court on Wednesday that it cannot hold the <keyword id="10220121" type="UNKNOWN" weightage="20" keywordseo="upcoming-ca-exam">upcoming CA exam</keyword> online as suggested by some of the candidates, in view of COVID-19, as it tests the analytical capabilities of the examinees. The ICAI said its 3-hour exam is of a different pattern altogether, which have descriptive answers and not tick marks. A bench of Justices A M Khanwilkar, Dinesh Maheshwari and Sanjiv Khanna asked the ICAI to publish on its website the steps taken for students welfare with regard to COVID-19 and disposed of the petition seeking a detailed <keyword id="110048" type="ENTERTAINMENT" weightage="20" keywordseo="Standard-Operating-Procedure">Standard Operating Procedure</keyword> (SOP) for the examinees in the upcoming CA exams. The Chartered Accountant exams are scheduled to be held on November 21 to December 14. During the hearing, <keyword id="10220122" type="UNKNOWN" weightage="20" keywordseo="senior-advocate-ramji-srinivasan">senior advocate Ramji Srinivasan</keyword>, appearing for the ICAI, said that they don't have any isolation room as examination centres and don't have the facilities for doctors. He said that as directed by the top court in its last hearing, they have examined all the suggestions given by advocate Bansuri Swaraj, representing the petitioners. "There was suggestion that can we hold an online exams. Ours exams has different pattern and therefore we cannot hold the online examination", he said, adding that they test the analytical capabilities of examinees. The bench then told Swaraj that petitioners need to be reasonable in their demands and it was not satisfied with their responses. Srinivasan further said that transport and accommodation was also sought by the petitioner but that is not possible. He submitted that ICAI may request Ministry of Home Affairs to allow e-admit cards to book hotels. The bench said that it is a state specific issue as earlier when such suggestions were made, the state governments have agreed to do so. It told Swaraj that how can online exams be allowed when the answers are required to be descriptive. "How can this be allowed? Just because courts are allowing many things, you cannot keep on asking what you want. Be reasonable in your demands," the bench told the petitioner's counsel. It asked ICAI to put all the information on the grievances raised by the Petitioners on the website and disposed of the plea saying if there is any lapse it will be addressed but exams in the past have been handled well. The petitioners have contended that despite less than a month left for the commencement of examination, no steps have been taken by the authorities with respect to safety of examinees. They have claimed that no safety guidelines have been issued by ICAI on how the examinations will be held amid COVID-19 pandemic. The plea alleged that the examination will be in violation of central government guidelines which prohibits congregations of more than 100 persons at an academic institution. CA Exam 2020: ICAI tells Supreme Court the exams cannot be held online

According to PTI, students alleged that answer sheets have been evaluated incorrectly, deducting marks for the correct answers as well. The students evaluated their own answers, based on the answer key released released by the institute. "They found that many of their correct answers had been marked as wrong and this way, many students flunked the papers. In some cases, even 12 marks have been deducted," CA Neeraj Arora, ICAI member <a href="https://www.news18.com/news/india/over-200-students-stage-protest-at-icai-claim-papers-not-evaluated-properly-2320029.html">told </a>PTI. The exam was conducted in May. Students accessed their answer copies via RTI (Right To Information) enquiries. Until 2018, the CA Act did not allow students to show the answer copies to any other person, which was scrapped after massive protests during that year. The students even want the institute to penalise examiners for the errors. In response to the student outrage, the institute had put out a notification clarifying that "It has been brought to our notice that certain adverse reports relating to the system of evaluation of answer books of CA exams are doing the rounds on social media." Given that, the institute has introduced changes in the evaluation process for the examinations scheduled for November 2019 and May 2020. The examination papers will now undergo digital evaluation to maintain transparency. It will also eliminate manual errors like totalling, variation in marks according to the examiner. In fact, the institute will also roll out OMR-based evaluation for MCQs of Elective Papers. This will keep the examination objective type, eliminating variations in the subjective answers.
