<ul class="summary-list"><li>Lending groups filed a lawsuit against the CFPB, challenging its funding structure.</li><li>They argue the agency should have to receive funding from Congress, rather than the Fed.</li></ul>The nation's highest court will soon hear arguments on a case that challenges the structure of a federal consumer watchdog. The ruling could have significant implications for student-loan borrowers — and consumers nationwide.The Supreme Court announced in February that <a href="https://www.businessinsider.com/elizabeth-warren-supreme-court-donald-trump-consumer-financial-protection-bureau-2023-2">it would be taking on the case</a> Consumer Financial Protection Bureau v. Community Financial Services Association of America Ltd., which <a href="https://www.businessinsider.com/elizabeth-warren-supreme-court-donald-trump-consumer-financial-protection-bureau-2023-2">challenges the funding structure of the Consumer Financial Protection Bureau</a>. Since the CFPB was formally established in 2011, the Federal Reserve has funded the agency rather than relying on annual funding approval from Congress. While some experts and lawmakers have argued that the agency's funding structure is crucial for it to maintain independence and best serve consumers, the Fifth Circuit <a href="https://www.businessinsider.com/elizabeth-warren-blasts-fifth-circuit-cfpb-funding-unconstitutional-student-loans-2022-10">ruled in October the structure was unconstitutional</a>."Congress did not merely cede direct control over the Bureau's budget by insulating it from annual or other time limited appropriations," the Trump-appointed Fifth Circuit judges wrote in their ruling. "It also ceded indirect control by providing that the Bureau's self-determined funding be drawn from a source that is itself outside the appropriations process — a double insulation from Congress's purse strings that is 'unprecedented' across the government."The purpose of the CFPB is in its name: protecting consumers. But support for the agency has been largely partisan, with many conservatives taking issue with the agency's regulatory actions — for example, the Fifth Circuit's decision also overturned the CFPB's regulation on payday lenders that would have imposed stricter standards on the industry. Beyond payday lenders, the CFPB has taken several actions over the past decade to better protect student-loan borrowers from predatory lending behavior. As federal borrowers have been gearing up for the return to loan repayment in October, the agency cracked down on companies that it accused of illegally charging borrowers for normally free debt-relief services. In June, for example, the CFPB <a href="https://www.businessinsider.com/student-loan-borrowers-scammed-getting-refunds-illegal-debt-relief-cfpb-2023-7">returned $3.5 million to over 7,000 borrowers</a> who fell victim to one of those scams. Additionally, the CFPB has scrutinized how student-loan servicers treat borrowers, and it found earlier this year that <a href="https://www.businessinsider.com/student-debt-bankruptcy-relief-companies-ignoring-court-orders-loan-forgiveness-2023-3">some servicers were continuing to collect on debt</a> that was discharged in bankruptcy. Should the Supreme Court decide the agency's funding structure is unconstitutional — and leave its funding at the will of Congress — it's unclear whether the CFPB would continue to get resources to enforce consumer protections."Despite years of desperate attacks from Republicans and corporate lobbyists, the constitutionality of the CFPB and its funding structure have been upheld time and time again," Sen. Elizabeth Warren of Massachusetts, who helped create the CFPB, <a href="https://www.businessinsider.com/elizabeth-warren-supreme-court-donald-trump-consumer-financial-protection-bureau-2023-2">said</a> in February. "If the Supreme Court follows more than a century of law and historical precedent, it will strike down the 5th Circuit's decision before it throws our financial markets and economy into chaos."<h2>The case against the CFPB's structure</h2>The group that brought the case against the CFPB — Community Financial Services Association of America — represents nonbank lenders that offer credit products and other financial services to consumers. Shahid Naeem, a senior policy analyst at the nonprofit American Economic Liberties Project, coauthored a <a href="https://www.economicliberties.us/our-work/the-war-on-the-consumer-financial-protection-bureau-community-financial-services-of-america-v-cfpb/#_ftn8" target="_blank" rel="noopener">brief</a> on the lawsuit and told Insider that the case was "a campaign against what the government should be doing, which should be working for the people that it represents."Naeem added: "If you look at the parties involved in this case, you have a payday-lending lobby and then you have the CFPB, which was birthed out of the 2008 financial crisis by Congress as a way of protecting Americans from the kind of predatory and exploitative financial-services practices that got us into 2008 and various other crises as well."In 2010, via the Dodd-Frank Wall Street Reform and Consumer Protection Act, Congress ensured that the CFPB would not have to rely on the annual appropriations process for funding and instead could request funding from the Federal Reserve so long as its request did not exceed $597 million, adjusted for inflation. Placing a cap on spending requests ensured the CFPB would not have limitless funding, while allowing it to sidestep political debate over receiving more money.The lenders that brought the lawsuit wrote in their <a href="https://www.supremecourt.gov/DocketPDF/22/22-448/252221/20230113130438937_22-448%20bio.pdf" target="_blank" rel="noopener">legal filing</a>: "The Appropriations Clause vests the power of the purse in Congress, enabling the most politically accountable branch to both protect the federal fisc and check the exercise of executive power."They added: "The 2010 Congress, however, deliberately circumvented that safeguard by vesting the CFPB with discretionary authority to fund its operations by taking as much as hundreds of millions of dollars directly from the Federal Reserve each year forever."The Bureau's defenses of Congress's unprecedented abdication of its fiscal oversight all fail. And the Bureau's contention that the Rule should be upheld regardless fares no better."The CFPB wrote in its <a href="https://www.supremecourt.gov/DocketPDF/22/22-448/274470/20230802113142512_22-448rbUnitedStates.pdf" target="_blank" rel="noopener">response</a> that its funding mechanisms were "far from novel." It said that other agencies, such as the Federal Reserve and Federal Deposit Insurance Corp., had uncapped funding and larger budgets, while holding significant regulatory authority.The Supreme Court is hearing oral arguments on the case on October 3.<div type="image" title="Consumer Financial Protection Bureau" height="1996" width="3992" msid="103534773" hostid="261" sizebytes="490364"></div><h2>What's at stake for Americans</h2>If the Supreme Court rules the CFPB's funding structure unconstitutional, "we're opening the floodgates to see a storm of challenges to any source of congressionally authorized appropriated funding that does not fall in the annual process," Naeem said.It's something a conservative witness at a House committee hearing suggested in March. Devin Watkins, an attorney at the libertarian think tank Competitive Enterprise Institute, told lawmakers: "There are other agencies out there that do have nonappropriated funds, and Congress should review those as well and think about how to return those agencies to congressionally funded appropriations process as well."While it's unclear how broadly the Supreme Court will rule, or whether it will strike down the CFPB's funding structure entirely, an adverse ruling could mean that consumers lose a host of protections the agency offers. For example, the American Association of Retired Persons <a href="https://www.supremecourt.gov/DocketPDF/22/22-448/266856/20230515134812270_22-448%20Final%20AARP%20CFPB%20brief.pdf" target="_blank" rel="noopener">filed an amicus brief</a> to the Supreme Court expressing its support for the CFPB's continued funding structure, saying: "Older adults are among the consumers who depend heavily on the CFPB's protections."It added: "Corrupt actors seek to defraud student loan borrowers with promises of debt relief because they know that student loans can be a financial strain, especially when the borrowers are paying student loans in retirement."But those fraudulent schemes end up leaving borrowers in a worse financial condition. The CFPB's enforcement actions against this type of illegal conduct are important to protecting borrowers' financial security and obtaining their money back." The CFPB also wrote in its brief that the lenders' argument would "call into questions" appropriations for programs such as Social Security and unemployment assistance because they're not reliant on the annual congressional-funding process."Part of the stability and independence of our financial regulators is that they aren't beholden to the annual appropriations process," Naeem said.Now consumers will have to wait and see how the Supreme Court views a top federal consumer watchdog's constitutionality.

But there are loads of side issues to consider in this case. Surprisingly, much of the business came from the single screens while multiplexes saw a lukewarm response during the first weekend. However, R… Rajkumar has certainly romped past <keyword id="333" type="PERSON" weightage="60" keywordseo="Saif-Ali-Khan">Saif Ali Khan</keyword>’s <keyword id="1952408" type="UNKNOWN" weightage="100" keywordseo="Gangster-flick">gangster flick</keyword> Bullett Raja that grossed only Rs 25 crore at the end of Day IV. After the 11th day (it opened on November 29), the <keyword id="1960832" type="UNKNOWN" weightage="100" keywordseo="Saif-Sonakshi-starrer">Saif-Sonakshi starrer</keyword> is still languishing with a total collection of Rs 46.60 crore. 
 
Going by the numbers, Shahid’s all-new Dabaang-like <keyword id="44111" type="CITY" weightage="40" keywordseo="Avatar">avatar</keyword> (a far cry from the sophisticated <keyword id="111697" type="COMPANY" weightage="60" keywordseo="BADMAASH-COMPANY">Badmaash Company</keyword>) has managed to capture the audience after a series of flop shows. But critics have torn it apart and not without reasons, either. The movie veers between mindless violence and inane comedy while watering down some things as serious as corruption and custodial rape. 
 <keyword id="122490" type="POSITION" weightage="60" keywordseo="film-critic">Film critic</keyword> and analyst Taran Adarsh has tweeted: #RRajkumar movie review: Doesn’t work. It is Prabhu Dheva’s weakest Hindi film to date! Taran, however, acknowledges its box office success, saying: #RRajkumar sails safe! 
 
Film critic Anupama Chopra writes, “R…Rajkumar is ostensibly Prabhu Dheva’s first non-remake Hindi film but you’ve seen it all before… That’s not enough to take you through <keyword id="818790" type="UNKNOWN" weightage="40" keywordseo="the-rest">the rest</keyword> of this bludgeoning movie. I’m going with one and half stars.” 
 
Others, too, are quite caustic about Shahid’s flick. According to Tushar Joshi of DNA, “Watch it if you are in the mood for a loud no-brainer that relies on formulaic over the top entertainment.” Shubhra Gupta (Indian Express) wrote, “It is nothing but blank putrid noise. R… for Rubbish.” Subhash K. Jha of SKJBollywoodnews comments, “R… Rajkumar is Prabhudheva’s rumbustious raga of the Rowdy.” 
 
But all said and done, the latest flick has helped Shahid come out of a three-movie span of either flops or middling performers. His earlier release this year was Phata Poster Nikhla Hero, an action comedy directed by Rajkumar Santoshi. The movie earned around Rs 37.1 crore in India in a span of two weeks and was declared a flop. <keyword id="894544" type="ENTERTAINMENT" weightage="80" keywordseo="Teri-Meri-Kahaani">Teri Meri Kahaani</keyword> (2012) and Mausam (2011) suffered similar fate even after good starts and critical acclaim. Mausam, a romantic comedy, collected Rs 44 crore nett in its first week and ended its lifetime collections with Rs 69 crore nett. <keyword id="1101066" type="ENTERTAINMENT" weightage="40" keywordseo="teri-meri">Teri Meri</keyword>, a rom-com directed by <keyword id="6530774" type="PERSON" weightage="80" keywordseo="kunal-kohli">Kunal Kohli</keyword>, finished with average overseas business of around $2.3 million. At home, the movie collected around Rs 23 crore. 
 
Does it mean only age-old formula movies can churn out money as far as the Indian audience is concerned? Not really, but the reception of R…Rajkumar seems a bit paradoxical. However, the coming weeks are sure to reveal more about the trend, and we will wait and watch.

<ul class="summary-list"><li>Tony Khan launched All Elite Wrestling in 2019, and it is now the biggest competitor to WWE.</li><li>Khan has pulled this off thanks to weekly TV shows, sold-out pay-per-views, and working over 80 hours a week.</li></ul>It's a pretty good bet that <a href="https://www.insider.com/aew-mjf-steiner-math-his-idea-tony-khan-2023-9">Tony Khan</a> is working right now.Yes, the 40-year-old businessman is riding on the success of his billionaire father, Shahid Khan, as an executive on sports teams that his father owns, like the <a href="https://www.insider.com/nfl-draft-first-pick-jaguars-travon-walker-2022-4">Jacksonville Jaguars in the NFL</a> and the Premier League soccer club Fulham.But Khan is doing everything in his power to dispel any notion that he's a <a href="https://www.insider.com/9-nepo-babies-that-raise-the-profiles-of-their-parents-2022-12">nepo baby.</a>That's certainly the case when it comes to his greatest passion: being the owner and CEO of All Elite Wrestling (AEW).A fanatic of pro wrestling since he was a kid, Khan loves it even as an adult, recalling watching wrestling in his office in Jacksonville, Florida, while plowing through analytics on the Jaguars' next opponent.In 2019, he took his fandom to the next level when he convinced his father to front him the money to launch AEW. When Insider speaks to him over a Zoom call, he's clean-shaven, wearing a Jaguars polo shirt, and is fully engaged with his big brown eyes and bigger grin. He seems like a guy who is living his best life.Yet, that doesn't mean he's not dealing with challenges. At the record-breaking "All In" pay-per-view in August, a backstage altercation between wrestlers Jack Perry and CM Punk prior to the opening match almost derailed the entire show. There are also unsubstantiated <a href="https://tjrwrestling.net/news/cm-punk-more-than-lunging-tony-khan-all-in/">reports</a> that Punk made a beeline for Khan.The incident led to Khan firing Punk, a beloved wrestler whom Khan brought out of retirement to come to AEW in 2021, a week later. You could see the distress the decision caused Khan when he addressed Punk's hometown crowd in Chicago with a <a href="https://www.youtube.com/watch?v=mNp2lRQPJrc" target="_blank" rel="noopener">passionate explanation</a> about why he did it before an episode of "Collision" on September 2.Here, Khan talks to Insider about how he goes about juggling all his jobs, his hopes of getting his AEW stars to branch out beyond wrestling (one even wants to climb Mount Everest), and what it was like telling the AEW fans that CM Punk was fired.You do so much. With the NFL season starting, how much of your day-to-day is AEW?I have worked 80 to 100 hours a week for a very long time. I just love the stuff I do so much. I wouldn't want to do anything other than football and wrestling. Wrestling was a hobby of mine for a long time, it was my vice. Now, I don't have much of a vice because I'm doing both. But a lot of the work I do in the NFL, we have a huge staff. When we started the analytics department, it was just me and now there's a bunch of people and it's grown and grown, so I don't have to be in the office anywhere near 80 hours a week anymore. I still give my reports during the week; I've done this week already. There's a lot of work in the transfer world for Fulham. And then there's a lot happening with AEW, with the ratings being up. So what do you do to relax these days? I don't. I'll watch a lot of English football. So even when you're taking a break, you're not. Does that at all have to do with you trying to prove that even though your father owns the teams you work for, and helped you financially to launch AEW, you have put in the work? No one works harder than my dad, and I'm honestly very lucky because he's the hardest-working person I've ever seen. And here I am, I get to work on the stuff I love. But I've worked hard to get to a position where I can work on things I love all the time. But someone can love something and not put in 80-hour weeks...80 hours is nothing. That was before "Collision." Before that, 80 hours was a good week. I'm way past that now.You know, I'm the only person who has never missed an AEW show. We had a referee that had never missed a show until a few weeks ago. He missed a "Collision," so now I'm the one. And, God bless this guy, he made hundreds of shows. "Dynamite" alone, we've done 206 episodes, so that's not counting "Rampage," "Collision," and all the pay-per-views. So now I'm the iron man. But what else am I going to do?Do what you love, man. "All In" at Wembley was such a success. Do you feel the UK is fertile ground for pro wrestling? Could we see a "Dynamite" or one of the other weekly shows going over there once in a while?We'll think about that, but I want to keep the biggest focus on "All In." It's such a special place. I remember standing outside Wembley Stadium with a bunch of the guys; we were walking out of the show, and Oje Hart was with us — Owen Hart's son. In the shadow of Wembley Stadium, as we all walked out, he said: "Pro wrestling took everything from me and I hate it, yet here I am and AEW feels like home to me." It's a moment I'll never forget. It was so perfect to happen there. At Wembley.The <a href="https://en.wikipedia.org/wiki/Owen_Hart_Cup">Owen Hart tournament</a> is not just a once-a-year thing, it's really special. They are a part of our crew. To have Christian Cage, Jeff Jarrett, Dustin Rhodes, people who were really close to Owen Hart, it means a lot to people here to continue that legacy. It sounds like you got into wrestling through seeing Hulk Hogan in episodes of "The A-Team," Sgt. Slaughter doing the intro to "G.I. Joe" episodes... I was a big WWF fan as a kid and didn't know what WCW was until I saw movies like "Over the Top" and "Road House" that starred Terry Funk. Do you think about how to get AEW talent out in pop culture beyond wrestling fandom?Wow, that's a really cool question. And, yes, that's how I got into wrestling. And I think all the time how we can do more of that.I always love when people come up to Orange Cassidy and Kris Statlander and talk about how they saw them on an episode of "Floor Is Lava" on Netflix. And you have Chris Jericho being in a bunch of movies. And a number of wrestlers have done music — Brody King is a musician, Darby Allin has worked with a number of musicians. We've brought hip-hop stars like Rick Ross into AEW.The biggest celebrity crossover has to be <a href="https://www.youtube.com/watch?v=NYih440wNUE" target="_blank" rel="noopener">when we brought Shaq in</a>. If I were a kid today seeing someone like him do AEW, that would have gotten me into wrestling. I really am focused on getting AEW stars involved in projects outside of wrestling as much as possible. Darby Allin is actually talking to me about climbing Mount Everest.What? really? Yeah. Darby wants to be the first pro wrestler to climb Mount Everest.That sounds like a series right there. Yeah, I think we got something there. What is your take on the <a href="https://www.espn.com/mma/story/_/id/38386430/ufc-wwe-officially-combine-tko-umbrella" target="_blank" rel="noopener">WWE/UFC merger</a>?It is fascinating. It will be interesting to see what happens in the world of sports, combat sports, and pro wrestling. I love pro wrestling, it's an amazing business. I think there are a lot of really exciting things happening with sports media rights.I have to ask about the firing of CM Punk. This is a guy you brought out of retirement. You were a huge fan of his. How has it been since "All In," dealing with the decision you had to make?I can't talk about that. Please ask me another question. <div type="image" title="CM Punk and AEW boss Tony Khan." height="627" width="1200" msid="103786092" hostid="261"></div>Let me ask this: "Collision" and "All Out" were in Chicago the weekend Punk was fired. That's Punk's hometown but also, Illinois is your home state. What was it like walking out to the top of the ramp and essentially pouring your heart out to that crowd, your fans, as to why you had to fire CM Punk? Chicago is home to my family. I grew up in Champaign. I've been going to the United Center since it was first built when I was 11. My family was at the show, countless friends, everyone I grew up with. It meant a lot to go out and speak to the fans and be able to put on a great show. But I'm very curious. Why address the crowd at the top of the ramp and not in the center of the ring?[Long pause.] You can't see everybody's face from the center of the ring. You have to choose one side of the crowd to face when you're in the ring. And I wanted to be able to see everybody. I felt like, I'm not a wrestler and I don't need to be in the ring, and for this moment, I thought I would just sit down and talk to everybody. That's why I brought out a chair.And when I was done and walked backstage, the first person I saw was Ricky Steamboat and he said, "That was great, you turned the crowd. You turned them around. That's so hard to do, and you did it." I felt I at least owed that much to the wrestlers and the fans, to go out there and talk to everybody. "Both countries have to work through the past to open the door to the future."The cozier diplomatic ties have so far focused on Afghanistan, where Russia has cultivated ties to the Afghan Taliban militants who are fighting US troops and have historic links to Islamabad. Moscow says it is encouraging peace negotiations.Both Russia and Pakistan are also alarmed by the presence of Islamic State (IS) inside Afghanistan, with Moscow concerned the group's fighters could spread towards central Asia and closer to home. In Pakistan, IS has already carried out major attacks."We have common ground on most issues at diplomatic levels," Pakistan's Prime Minister Shahid Khaqan Abbasi told Reuters.
