Former <keyword id="71" type="POSITION" weightage="80" keywordseo="Prime-Minister">Prime Minister</keyword> <keyword id="6359397" type="PERSON" weightage="80" keywordseo="Manmohan-Singh">Manmohan Singh</keyword> does not have to appear in a <keyword id="6364736" type="ORGANIZATION" weightage="80" keywordseo="Delhi-court">Delhi court</keyword> on April 8, the <keyword id="6354977" type="ORGANIZATION" weightage="80" keywordseo="Supreme-Court">Supreme Court</keyword> said today. The top court has suspended the summons sent to the <keyword id="6378412" type="POSITION" weightage="80" keywordseo="politician">politician</keyword> by a <keyword id="6362306" type="ORGANIZATION" weightage="80" keywordseo="CBI-court">CBI court</keyword> last month. The investigating agency has three weeks to respond to Dr Singh's petition against his summons. 
 Dr Singh, 82, had been told to make a personal appearance with industrialist Kumar <keyword id="286113" type="PERSON" weightage="80" keywordseo="Mangalam-Birla">Mangalam Birla</keyword> for a case that says a coal field was illegally awarded in 2005 to Hindalco, a company owned by Mr Birla. At the time, Dr Singh held direct charge of the <keyword id="111919" type="ORGANIZATION" weightage="80" keywordseo="coal-ministry">Coal Ministry</keyword>. 
The former PM has not been charged with any crime but is being investigated for criminal breach of trust, criminal conspiracy, and corruption. He has denied any wrong doing. The CBI has twice said it would like to close the case against him, but has been over-ruled by the judge handling the matter. 
 "There was no criminal intent, it (the allotment) was an administrative decision and not an illegality," said the politician's lawyer, <keyword id="30182" type="PERSON" weightage="80" keywordseo="Kapil-Sibal">Kapil Sibal</keyword>, who was also <keyword id="2789849" type="UNKNOWN" weightage="80" keywordseo="Telecom-Minister-in-Dr-Singh">Telecom Minister in Dr Singh</keyword>'s government. Two of Dr Singh's three daughters were present in court today. 
 The case known as "Coalgate" came to light in 2012 after <keyword id="222693" type="COMPANY" weightage="80" keywordseo="The-National">the national</keyword> auditor said 1.86 lakh crores had been lost because coal blocks were distributed without a transparent bidding process. Last year, the Supreme Court declared as illegal nearly 300 coal licenses issued by consecutive governments since 1993. Over the last few weeks, 32 of the coal blocks were auctioned by the <keyword id="6360789" type="ORGANIZATION" weightage="80" keywordseo="Modi-Government">Modi government</keyword>. 
 Judge <keyword id="2055026" type="UNKNOWN" weightage="80" keywordseo="Bharat-Parashar">Bharat Parashar</keyword> of the CBI court said in the summons to Dr Singh that "a well-planned conspiracy was hatched" to award a coal field in Odisha to <keyword id="105310" type="CITY" weightage="80" keywordseo="Hindalco-Industries">Hindalco Industries</keyword>, part of the $40 billion <keyword id="44373" type="CITY" weightage="80" keywordseo="Aditya-Birla-Group">Aditya Birla Group</keyword>, which is chaired by Kumar Mangalam Birla. 
 
Hindalco has said that it made its case for the mining license "in a transparent and lawful manner".

Supreme Court sides with Ex PM Manmohan Singh, says appearance in court on April 8 not required

The <keyword id="219589" type="POSITION" weightage="80" keywordseo="Special-CBI-Judge">special CBI judge</keyword> <keyword id="2055026" type="UNKNOWN" weightage="80" keywordseo="Bharat-Parashar">Bharat Parashar</keyword> has hogged the limelight after having summoned the former PM Manmohan Singh as an accused in the coal scam. 
 The Economic Times reports, the Patiala House courts additional sessions judge, later nominated by Supreme Court on recommendation of a sitting <keyword id="6355014" type="ORGANIZATION" weightage="80" keywordseo="Delhi-High-Court">Delhi High Court</keyword> judge, has taken to task various investigating agencies from time to time. Pressurizing the <keyword id="6354572" type="ORGANIZATION" weightage="80" keywordseo="CBI">CBI</keyword> for not sticking to the deadlines in the <keyword id="981763" type="UNKNOWN" weightage="80" keywordseo="Coalgate">Coalgate</keyword> scam and refusing to accept its closure reports, he has always been a taskmaster for the CBI. 
 He hit the headlines in the coal case first, when he asked the CBI point blank whether they had questioned the then PM, Manmohan Sngh, who held the coal portfolio during some of the coal block allocations, the ET has reported. The CBI later did question the then <keyword id="71" type="POSITION" weightage="80" keywordseo="Prime-Minister">Prime Minister</keyword>.

Coal Scam: Meet Bharat
Parashar: the CBI judge who had guts to summon Manmohan Singh and KM Birla

A Special CBI court on Monday sentenced former <keyword id="6358932" type="UNKNOWN" weightage="20" keywordseo="Union-Minister">Union Minister</keyword> <keyword id="305123" type="PERSON" weightage="20" keywordseo="Dilip-Ray">Dilip Ray</keyword> to three-years imprisonment in a coal block allocation case. Ray was the Minister in the Atal Bihari Vajpayee government in 1999. The case pertains to allocation of 105.153 hectares of non-nationalised and abandoned coal mining area in Jharkhand's Giridih district in favour of Castron Technologies Limited by 14th Screening Committee of the Ministry of Coal in 1999. Special Judge Bharat Parashar also awarded three years term each to two senior officials of the Ministry of Coal at that time -- Pradip Kumar Banerjee and Nitya Nand Gautam -- and Castron Technologies Limited's Director Mahendra Kumar Agarwalla. The CBI had earlier urged the court to award life imprisonment to Ray and other convicts to send a message to the society as white-collar crimes were on a rise. The convicts had requested the court to take a lenient view in respect of their old age and prior clean antecedents. On October 6, the court had convicted them in the case, noting that they conspired together beyond shadows of all reasonable doubts to procure allocation of the coal block. Besides Ray, two former senior officials of the Ministry of Coal -- Pradip Kumar Banerjee, the then Additional Secretary and Nitya Nand Gautam, former advisor (Projects), Castron Technologies Limited, its director Mahendra Kumar Agarwalla and Castron Mining Limited have also been found guilty. The court held them guilty of the offences under 120-B (criminal conspiracy) 409 (criminal breach of trust) and 420 (cheating) of the Indian Penal Code and various sections of the Prevention of Corruption Act. Besides this, Castron Technologies Limited, Mahesh Kumar Agarwalla and Castron Mining Limited were also held guilty for the offence under 379 (punishment for theft) and 34 (common intention) of the Indian Penal Code. As many as 51 witnesses were examined in the case. The prosecution had argued that the facts and circumstances of the case clearly pointed to the hatching of a criminal conspiracy by the private parties and the public servants involved in the process of allocation of impugned coal block. It was submitted that Brahmadiha coal block was not a nationalised coal mine and was not included by CIL or its subsidiary companies in the identified list of captive coal blocks to be allocated by the Ministry of Coal. Senior Public Prosecutor A.P. Singh had told the court that as Brahmadiha coal block was not an identified captive coal block to be allocated to private parties, even the screening committee was not competent to consider its allocation to any company much less to Castron Technologies Limited. The prosecution further stated that Dilip Ray had himself approved the guidelines of the Coal Ministry that no coal block shall be allocated for captive mining to a company engaged in production of iron and steel or sponge iron if the annual production capacity is less than one MTPA in opencast mining but in the case of Castron Technologies Limited, he agreed to relax the said guidelines so as to extend undue benefits to the private parties involved. Delhi Court sentences ex-Union Minister Dilip Ray to 3-years jail in coal scam

Taking a U-turn, the Central Bureau of Investigation (<keyword id="6354572" type="ORGANIZATION" weightage="60" keywordseo="CBI">CBI</keyword>), which had earlier filed a closure report in the coalgate scandal involving industrialist Kumar Mangalam Birla and former coal secretary PC Parakh, has now told a special court that it has enough evidence against the accused. The CBI also placed on record all the necessary documents pertaining to the case. 
 The <keyword id="6354977" type="ORGANIZATION" weightage="60" keywordseo="Supreme-Court">Supreme Court</keyword> appointed-special public prosecutor (SPP) RS Cheema submitted before special CBI Judge Bharat Parashar that there is "evidence against the accused to show their involvement." 
 
"SPP states that under the facts and circumstances of the case, prima facie there is enough material to take cognizance of the offences against private parties and some of the government officials involved in the process of coal blocks allocation. Put up for consideration on the closure report on November 25," the judge said. 
 
The court has fixed 25 November as the next date of hearing in the case.

Coalgate: CBI Takes U-turn, It Now Has Enough Evidence Against KM Birla, PC Parekh

The Central Bureau of Investigation (<keyword id="6354572" type="ORGANIZATION" weightage="80" keywordseo="CBI">CBI</keyword>) has filed a revised closure report before special CBI Judge Bharat Parashar in the coal block allocation scandal. The case involves <keyword id="6359480" type="PERSON" weightage="100" keywordseo="Aditya-Birla">Aditya Birla</keyword> Group Chairman Kumar Mangalam Birla and former coal secretary PC Parakh. 
 
"Investigating officer (IO) DSP KL Moses has filed a revised final report which is stated to be detailed and comprehensive... The final report is also in the nature of a closure report. Special public prosecutor RS Cheema seeks some time to advance arguments... Put up for November 10," the judge said. 
 
The CBI also filed some additional documents seized during the investigation. Cheema said, "Now, we are taking precaution and the agency will see that each and every document is filed in the court." 
 
On September 12, the court had asked the CBI, which had filed a closure report on August 28, why it was in a hurry to close the case.

CBI Files Revised Closure
Report In KM Birla Coal Case

According to media reports, the Central Bureau of Investigation (<keyword id="6354572" type="ORGANIZATION" weightage="20" keywordseo="CBI">CBI</keyword>) has questioned former Prime Minister <keyword id="6359397" type="PERSON" weightage="20" keywordseo="Manmohan-Singh">Manmohan Singh</keyword> in a case related to the allocation of the <keyword id="1928982" type="UNKNOWN" weightage="20" keywordseo="Talabira-II-coal-block">Talabira II coal block</keyword> in Orissa to Hindalco in 2005. Manmohan Singh was in charge of the coal ministry at that time. 
 
Various media reports suggest that a team of CBI officers went to Singh’s residence and enquired him about two letters — dated May 7, 2005 and June 17, 2005 — that were sent to Singh by industrialist Kumar Mangalam Birla. In the letter, Birla had requested to allocate the coal block to Hindalco. 
 
Earlier, a special CBI court had refused to accept a closure report filed in the case. It had also asked the CBI to examine the role of the former Prime Minister. “I am of the considered opinion that before the matter is examined further as to what offence, if any, stands committed or by whom the same has been committed, it will be appropriate that the then minister of coal be first examined qua various aspects,” Special CBI Judge Bharat Parashar had said. 
 
The court had also noted that the letter written by Hindalco chief Birla “certainly raised eyebrows.” It further added that “The number of reminders which were sent by the PMO, as well as repeated telephonic requests seeking an early response from the coal ministry raises grave shadows of suspicion.” 
 
“There are certain circumstances which need to be elaborated and explained, especially regarding the manner and the circumstances under which the matter was taken up in the PMO or under what circumstances the recommendations of the 25th screening committee were set aside even though it already stood approved,” the court had said.

CBI Questions ex-PM Manmohan Singh

A day after the CBI filed a chargesheet in the <keyword id="420379" type="UNKNOWN" weightage="80" keywordseo="coal-scam">Coal scam</keyword> case, a <keyword id="121350" type="ORGANIZATION" weightage="80" keywordseo="special-court">Special Court</keyword> today rapped the central investigative agency for not impounding the passport of Congress leader and industrialist <keyword id="11128" type="PERSON" weightage="80" keywordseo="Naveen-Jindal">Naveen Jindal</keyword>, chargesheeted along with 14 others in the scam, saying the agency cannot adopt a different policy for some of the accused. 
 <keyword id="219589" type="POSITION" weightage="80" keywordseo="Special-CBI-Judge">Special CBI Judge</keyword> Bharat Parashar also asked the <keyword id="84586" type="POSITION" weightage="80" keywordseo="CBI-director">CBI Director</keyword> to ensure that a uniform policy is laid down for seizure of passports of accused during the probe in the case. 
 
"It is clear that while a uniform policy which appears to have been adopted by CBI is that passports of all accused are seized by them whenever a case is registered, but in the present case a different policy was adopted for the reasons best known to them," the judge observed. 
 
During the hearing, senior public prosecutor V K Sharma told the court that it was decided in CBI's office that passport of Naveen Jindal will not be seized during the probe. 
 
The investigating officer told the court that a notice was issued to Jindal to submit his passport before the CBI but after taking some time he gave a coloured copy of his passport to the agency with a request that his passport be not seized. 
 
To this, the court said, "CBI Director is directed to ensure that a uniform policy is laid down to be followed in all cases in future so that precious time of this court is not wasted." 
 
During the hearing, the agency said that out of the 10 individual accused, charge sheeted in the case, passports of two accused-- Suresh Singhal and Rajeev Jain-- were seized. 
 Court has now fixed the matter for May 6 for considering the CBI charge sheet filed in the case yesterday against Jindal, former Minister of State for Coal Dasari Narayan Rao, formerJharkhand Chief Minister <keyword id="57155" type="PERSON" weightage="80" keywordseo="Madhu-Koda">Madhu Koda</keyword> and 12 others in connection with Amarkonda Murgadangal coal block allocation scam case. 
 Besides them, former Coal Secretary H C Gupta and five firms, including <keyword id="106159" type="CITY" weightage="80" keywordseo="Jindal-Steel">Jindal Steel</keyword> and Power Ltd and <keyword id="1725858" type="UNKNOWN" weightage="80" keywordseo="Jindal-Realty-Pvt-Ltd">Jindal Realty Pvt Ltd</keyword>, were also chargesheeted in the case for alleged offences under sections 120-B (criminal conspiracy) read with 420 (cheating) of IPC and under provisions of the Prevention of Corruption Act.
