A special court here on Tuesday remanded former JD(S) MP <keyword id="20313055" type="General" weightage="100" keywordseo="Prajwal-Revanna" source="keywords">Prajwal Revanna</keyword>, who is facing charges of <keyword id="19907938" type="General" weightage="20" keywordseo="rape" source="keywords">rape</keyword> and <keyword id="20027232" type="General" weightage="20" keywordseo="sexual-abuse" source="keywords">sexual abuse</keyword>, to <keyword id="19911103" type="General" weightage="20" keywordseo="judicial-custody" source="keywords">judicial custody</keyword> till June 24. The 42nd Additional Chief Metropolitan Magistrate court had on June 12 remanded him to the custody of the <keyword id="20085377" type="General" weightage="20" keywordseo="Special-Investigation-Team" source="keywords">Special Investigation Team</keyword> (<keyword id="19925651" type="General" weightage="20" keywordseo="SIT" source="keywords">SIT</keyword>), which is probing the cases against him, till June 18. The 33-year-old had failed in his bid to retain the <keyword id="22095822" type="General" weightage="20" keywordseo="Hassan-parliamentary-constituency" source="keywords">Hassan parliamentary constituency</keyword> in the recent polls. SIT officials arrested Revanna soon after he landed at Bengaluru airport from Germany on May 31. He had left for Germany on April 27, a day after Hassan went to the polls. A '<keyword id="21526463" type="General" weightage="20" keywordseo="Blue-Corner-Notice" source="keywords">Blue Corner Notice</keyword>' seeking information on his whereabouts had earlier been issued by the Interpol, following a request by the SIT via the Central Bureau of Investigation. Revanna was arrested in a case registered against him in Holenarasipura in Hassan district on April 28. He was accused of sexually harassing a 47-year-old former maid. He has been booked in three cases of sexual assault. There are also charges of rape against him. The cases of sexual abuse came to light after pen-drives containing explicit videos allegedly involving Revanna were reportedly circulated in Hassan, ahead of Lok Sabha polls there on April 26. JD(S) suspended him from the party after cases were filed against him.

Bengaluru court remands Prajwal Revanna to judicial custody till June 24

New Delhi: The <keyword id="19895345" type="General" weightage="20" keywordseo="supreme-court" source="keywords">Supreme Court</keyword> on Wednesday said it will hear on September 17 the appeal of US-based creditor Glas Trust Company LLC against a judgment of the <keyword id="19916400" type="General" weightage="20" keywordseo="nclat" source="keywords">NCLAT</keyword>, which had stayed insolvency proceedings against ed-tech firm BYJU's and approved its Rs 158.9 crore dues settlement with the <keyword id="19901245" type="General" weightage="20" keywordseo="bcci" source="keywords">BCCI</keyword>. A bench comprising Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra was urged by a battery of lawyers that the plea be heard urgently keeping in mind the subsequent developments in the case. The plea was mentioned by senior advocate NK Kaul, appearing for the ed-tech major, that the case needed to be heard at the earliest. The submission was supported by Solicitor General Tushar Mehta, appearing for the <keyword id="19901245" type="General" weightage="20" keywordseo="bcci" source="keywords">BCCI</keyword>, and senior lawyer Abhishek Singhvi, also appearing for the ed-tech firm. Kaul said another plea in the case has also been filed and that is listed for hearing on September 17 and hence, the present plea be either heard on that day or the hearings in both the cases be advanced to this Friday. "We will hear both the pleas on September 17," the CJI said. Senior advocate Shayam Divan, appearing for the US-based creditor, said let the matters be heard together on September 17. Earlier on August 22, the bench had refused to pass an interim order to ensure that the committee of creditors (CoC) does not hold any meeting in pursuance of the insolvency proceedings against the embattled ed-tech firm. It had listed the plea for a final hearing on August 27. The bench had said the developments, which may take place in the meantime, can be negated if it finds there was no merit in the appeal of the US-based creditor against the judgment of appellate insolvency tribunal <keyword id="19916400" type="General" weightage="20" keywordseo="nclat" source="keywords">NCLAT</keyword>. The plea was mentioned earlier also on August 20 by Byju's and the BCCI and the top court had then also refused to pass an interim order to restrain the Insolvency Resolution Professional (IRP) from constituting a committee of creditors (CoC) in the insolvency proceedings against the ed-tech firm. In a major setback to Byju's, the top court had on August 14 stayed the verdict of NCLAT, setting aside the insolvency proceedings against the ed-tech major and approving its Rs 158.9 crore dues settlement with the Indian cricket board. The August 2 verdict of the NCLAT had come as a huge relief for Byju's as it had effectively put its founder Byju Raveendran back in control. The top court, however, had prima facie termed the NCLAT verdict as "unconscionable" and stayed its operation while issuing notices to Byju's and others on the appeal of the ed-tech firm's US-based creditor against the judgment of the insolvency appellate tribunal. The case stemmed from Byju's default on a Rs 158.9 crore payment related to a sponsorship deal with the BCCI. The top court had directed the BCCI to keep a sum of Rs 158 crore it had received from Byju's after a settlement in a separate escrow account till further orders. "Issue notice. Pending further orders there shall be a stay of the impugned order of August 2 of NCLAT. In the meantime, BCCI shall maintain the amount of Rs 158 crore, which shall be realised in pursuance of a settlement, in a separate escrow account until further orders," the bench had said. The NCLAT had approved the Rs 158.9 crore dues settlement with the BCCI and set aside the insolvency proceedings against Byju's. Byju's had entered into a "Team Sponsor Agreement" with the BCCI in 2019. Under the agreement, the ed-tech firm got exclusive rights to display its brand on the Indian cricket team's kit and some other benefits. Byju's had to pay a sponsorship fee. The company met its obligations till the middle of 2022 but defaulted on subsequent payments of Rs 158.9 crore. After insolvency proceedings were initiated, Byju's entered into a settlement with the BCCI. On July 16, the Bengaluru bench of the <keyword id="19902197" type="General" weightage="20" keywordseo="national-company-law-tribunal" source="keywords">National Company Law Tribunal</keyword> (NCLT) had admitted 'Think and Learn', Byju's parent company, to the insolvency resolution process on a plea filed by the BCCI over default in payment of outstanding dues of almost Rs 158.9 crore. While suspending the board of the ed-tech firm, the NCLT had appointed an interim resolution professional to run the operations of the company, suspended the company's board of directors, and brought it under moratorium by freezing its assets. The US-based lenders suspected that the settlement amount was being diverted from the credit they had extended to Byju's.

Supreme Court agrees to list plea related to insolvency proceedings against ed-tech firm Byju's

A single-judge bench of Justice M. Nagaprasanna, on Friday, though dismissed the petition, upheld its maintainability. The Chinese technology company is facing charges of violations of the provisions of the Foreign Exchange Management Act (FEMA). The bench observed that challenge to the Constitutional validity of Section 37A of the Act by the petitioner is held to be maintainable, on the fulcrum of the allegation that it is violative of Article 14 of the Constitution. As Article 14 is person centric whereas Fundamental Rights under Article 19 are citizen centric. Appearing for the central government and the ED, Additional Solicitor General M.B. Nargund Amaintained that Xiaomi is a foreign entity and can not maintain writ petition. Earlier, counsels for <keyword id="2210169" type="General" weightage="50" keywordseo="xiaomi-india" source="Orion">Xiaomi India</keyword> had argued that the firm was being targetted as it is a Chinese company and other companies are allowed to make payments of technology royalty. They have also brought to the notice of the court that banks are not allowing Xiaomi to make remittances in foreign exchange for imports. They argued that the company is required to make payments for foreign companies in connection with manufacturing and marketing smartphones. Contesting this Additional Solicitor General Nargund had explained that the authorities had no complaints if Xiaomi is agreeable to keep the seized amount in the bank and use remaining amount. He brought to the notice of the court that on April 24 and 29, before the ED passed the order to seize Xiaomi's bank accounts, there was a transfer of around Rs 1,500 crore from the company's bank accounts as per the available information. However, <keyword id="2402890" type="General" weightage="50" keywordseo="xiomi" source="Orion">Xiomi</keyword> is maintaining that royalty payments made to three companies abroad would not violate the FEMA Act. The company further maintained that the IT department itself had allowed it as a value added activity. K'taka HC rejects plea by Chinese firm Xiaomi challenging ED

A US court has asked <keyword id="285457" type="COMPANY" weightage="20" keywordseo="Antrix">Antrix</keyword> Corporation, the commercial arm of Indian Space Research Organisation, to pay compensation of USD 1.2 billion to a Bengaluru-based startup, <keyword id="406024" type="COMPANY" weightage="20" keywordseo="Devas-Multimedia">Devas Multimedia</keyword>, for cancelling a satellite deal in 2005. As per the agreement in January 2005, Antrix agreed to build, launch and operate two satellites and to make available 70 MHz of S-band spectrum to Devas, which the latter planned to use to offer hybrid satellite and terrestrial communication services throughout India. The agreement was terminated by Antrix in February 2011. Over the next several years, Devas approached various legal avenues in India. This included the Supreme Court, which directed for a tribunal. In his order dated October 27, Judge Thomas S Zilly, US District Judge, Western District of Washington, Seattle, ruled that Antrix Corporation pay a compensation of USD 562.5 million to Devas Multimedia Corporation and the related interest rate amounting to a total of USD 1.2 billion. In its lawsuit filed in the US District Court, Western District of Washington in September 2018, Devas Multimedia said three separate international tribunals and nine different arbitrators have found the termination of the Devas-Antrix agreement to have been wrongful, with one of the tribunals describing it as "conduct 'which shocks, or at least surprises, a sense of juridical propriety,'" and another finding it to be "a clear breach of simple good faith" by India. Antrix, in November 2018, had sought the dismissal of the lawsuit citing jurisdictional issues. The court, however, asserted that it had jurisdiction over the issue, but stayed the matter for one year and asked the two to file a joint status report by April 15, 2020. On July 16, 2020, both Devas and Antrix filed the instant motion, a Joint Status Report in which they disputed whether the court should lift or extend the stay, and, if the latter, whether Antrix be required to post security. Devas, according to submissions, has argued that the US court has jurisdiction over these cases, as Antrix engages in business in this district and across the United States. Antrix and Spaceflight Industries, which is headquartered in Seattle have an agreement to provide satellite launch services using India's PSLV rocket. Antrix and RBC Signals LLC, which is headquartered in Redmond, Washington have a worldwide agreement to provide space communications services to satellite operators. Antrix in 2018 launched a satellite for Redmond, a Washington-based Planetary Resources. Antrix agreed in 2015 to launch two satellites for Colorado-based PlanetiQ. Antrix is contracted with DigitalGlobe, which has headquarters in Colorado and other locations in Florida, Virginia and Washington to procure certain satellite data, which is then distributed by the Indian Space Research Organisation's National Remote Sensing Centre. Devas said that after the initial signing of the agreement, the two companies performed in good faith for five years. Among other things, in May 2009, Dr Appanna Bhaskarnaryana, the Director of the Satellite Communications Programme Office of <keyword id="6358064" type="UNKNOWN" weightage="20" keywordseo="isro">ISRO</keyword>, spent four to five weeks in the US with Devas personnel meeting with Hughes Networks, Sirius XM SkyTerra, Qualcomm and ICO North America to understand the technologies used by, and operation of, hybrid satellite-terrestrial operators providing telecommunications services. Devas subsequently conducted experimental trials in India (attended by Antrix officials, including the company's then chairman), Chengdu and Beijing in China, and Stuttgart in Germany, which successfully demonstrated the hybrid satellite-terrestrial systems and end-user terminals that Devas had developed in conjunction with a global network of leading technology players such as Alcatel Lucent, it said. On February 25, 2011, Antrix issued a termination notice to Devas, which among other things stated that the policy decision was of the central government, acting in its sovereign capacity is the event of force majeure, which was an occurrence on February 23, 2011. "The scope and duration of the said decision cannot be anticipated. It is likely to be indefinite. It is not possible for Antrix to take any effective step to resume the obligations under the agreement," Antrix said. Devas disputed Antrix's repudiation of the agreement and sought to conduct discussions among senior management as contemplated by that agreement. In June 2011, Devas commenced arbitration proceedings under the Rules of Arbitration of the International Chamber of Commerce. Antrix initially refused to participate in the arbitration and obtained an injunction from the Indian Supreme Court enjoining the arbitration. After one year, the Supreme Court lifted the injunction, allowing the arbitration to proceed. Thereafter, Antrix participated fully in the arbitration. US court asks ISRO's commercial arm to $1.2 billion compensation to Bengaluru start-up for cancelling a satellite deal

<keyword id="6354742" type="General" weightage="20" keywordseo="Flipkart" source="Orion">Flipkart</keyword> co-founder <keyword id="225032" type="General" weightage="20" keywordseo="Sachin-Bansal" source="Orion">Sachin Bansal</keyword> has moved the Madras High Court challenging a show cause notice (SCN) dated July 1 this year issued by the Enforcement Directorate (ED), which held that he and another individual were personally responsible for the alleged violation of FDI policy involving a staggering amount of approximately ₹23,000 crore. Justice R Mahadevan, before whom the writ petition from Bansal came up for hearing on Friday, pulled up the authorities for the delay of 12 years in issuing the notice and adjourned the matter by three weeks, after directing the ED and its officials to file the counters. The petition sought to quash the notice as illegal and arbitrary, insofar as he is concerned. The interim prayer is to stay its operation. The SCN was issued on the basis of a complaint filed by the Deputy Director of Enforcement in Bengaluru, for instituting adjudication proceedings under Sec.16 of the Foreign Exchange Maintenance Act (FEMA) against the petitioner, another co-founder Binny Bansal of the e-commerce giant, Accel, Tiger Global, Subrata Mitra (nominee director of Accel) and Lee Fixel (nominee director of Tiger Global) on the alleged contravention of the various provisions of the FEMA. The notice was issued pursuant to an alleged non-compliance with a condition prescribed vide the Consolidated Foreign Direct Investment Policy of 2010 dated April 1, 2010 in respect of issuance of shares of certain Flipkart group companies to foreign investors during 2009-14. According to Bansal, he ceased to have any association with Flipkart and its group of companies, pursuant to his unanticipated exit following the acquisition of Flipkart by Wal-mart International Holding, Inc. on August 17, 2018. Among other things, he contended that issuance of the SCN was arbitrary, unreasonable and patently a perverse one, as it was issued after 12 years. The complaint followed an investigation by the Directorate of Enforcement in New Delhi, which commenced in 2012, i.e. 9 years ago. He had proactively participated and cooperated in the investigation undertaken by the ED. Given the substantial lapse of time following the inquiry, the petitioner has conducted himself under the bonafide belief that after due study of the materials obtained during the course of the probe, the ED had concluded that no action was warranted in the matter. And, he had effected bonafide transfers to third parties in the intervening period and had completely exited from the Flipkart group in August 2018. However, to the utter shock and dismay, the ED issued the notices, he contended. Specifically, there is no statutory period prescribed under FEMA within which the authorities concerned were required to file the complaint for initiating the adjudication proceedings. In the absence of any period of limitation under the statute, it has been settled by the <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> in various judgments that the Constitution requires every authority, including the ED, to exercise its power to file a complaint within a reasonable time, failing which the actions taken by the statutory authority will be amenable to the writ jurisdiction of constitutional courts, petitioner said. The woman alleges that she was tortured by her parents and brother and despite her lodging a police complaint that clearly stated she did not wish to marry the prospective groom, she was forced to get married to him on March 14. Twenty days post the wedding, the woman fled her parents’ home and headed to Delhi. On arrival, she approached the <keyword id="83267" type="ORGANIZATION" weightage="20" keywordseo="Delhi-Commission-for-Women">Delhi Commission for Women</keyword> and the Supreme Court almost immediately ordered her to be given police protection. Fearing retaliation from her parents and husband, her lawyer, <keyword id="214301" type="PERSON" weightage="20" keywordseo="Indira-Jaising">Indira Jaising</keyword>, also sought police protection in <keyword id="6354321" type="LOCATION" weightage="20" keywordseo="Bengaluru">Bengaluru</keyword>, where the woman wants to go to pursue her masters in engineering. <keyword id="3198942" type="PERSON" weightage="20" keywordseo="Jaising">Jaising</keyword> claimed, “Her brother, supported by her mother, had threatened to rape her.” To this, the bench said, “She can go to any place she desires to. Parents or any family member of X, the husband or his family members, cannot create any obstacle in the path of the woman.” The bench also suggested that if she feared for her safety since her family wielded significant power in the city, she should approach the area assistant commissioner of police who would be the best person to take appropriate measures to give her protection. The lawyer representing her parents, <keyword id="6507803" type="PERSON" weightage="20" keywordseo="basava-patil">Basava Patil</keyword>, assured the court that her parents will not take any kind of coercive measure against their daughter and would return all her belongings including her educational certificates and documents. Patil said, “She need not apprehend anything. There will be no interference with her life from the parents. All things she desires will be given back to her.”

The recent execution of the <a href="http://www.businessinsider.in/1-million-people-to-lose-job-inindia-blame-drunken-driving-for-it/articleshow/57971679.cms">Supreme Court’s judgement</a> on putting a ban on alcohol sales within 500 metres of national and state highways has been made effective since April 1. 
 However, at this point, the people who are at stake belong to the business of hospitality. In most cities across India, there are star hotels on the highways, strategically located for better connectivity and luxury of space. In the metro cities like Delhi, Mumbai, <keyword id="6354321" type="CITY" weightage="20" keywordseo="Bengaluru">Bengaluru</keyword>, Chennai and other cities like <a href="http://www.businessinsider.in/1-million-people-to-lose-job-inindia-blame-drunken-driving-for-it/articleshow/57971679.cms">Chandigarh, Jaipur and Lucknow </a>invite a lot of tourists both domestic and foreign because of their hospitality infrastructure. Most hotels lined up on the highways have a bar to make sure the guests are taken care of. While the argument of whether alcohol is the a decent way to enjoyment is a different argument, but the fact that can’t be denied is alcohol helps the economy of the state to profit way better than other luxury, thanks to high excise duty. 
 
Even if that isn’t enough to back up the logic on <a href="http://www.businessinsider.in/1-million-people-to-lose-job-inindia-blame-drunken-driving-for-it/articleshow/57971679.cms">importance of alcohol</a>, what’s far more serious is loss of jobs. About one million people would be chucked out from their jobs. In a country where engineering graduates line up for Grade 4 rank jobs in the government, such is the scarcity of openings; getting fired from jobs for a court order is abominable. 
 
While the government should have enforced better vigilance and made stricter punishments to curb on drunken driving, this verdict is more like uprooting a whole tree because one branch of it was interfering with the electrical wires. 
 Serial entrepreneur and a renowned name in the hospitality industry, <keyword id="138484" type="PERSON" weightage="20" keywordseo="Priyank-Sukhija">Priyank Sukhija</keyword>, recently mentioned on a <a href="http://www.businessinsider.in/1-million-people-to-lose-job-inindia-blame-drunken-driving-for-it/articleshow/57971679.cms">Facebook post</a>, “Last month had to painfully say goodbye to 85 staff members because of the sealing of rooftops in CP which the <keyword id="6373991" type="ORGANIZATION" weightage="20" keywordseo="NDMC">NDMC</keyword> has no consideration for ... ruining the most epic hub in the country ! This month it would be more than 100 after the 500 metre ban.” 
 Even Amitabh <keyword id="287016" type="PERSON" weightage="20" keywordseo="Kant">Kant</keyword>, CEO of NITI Aayog is equally vocal about the crisis. In one of his recent tweets, Kant wrote,” TOURISM creates jobs. Why kill it? SC's highway liquor ban verdict may hit one million jobs.”
