Rushing to parliament Ravi Shankar Prasad, India’s IT and telecom minister, told the press that taking the Personal Data Protection Bill to parliament will be one of his top priorities during the first 100 days of Prime Minister Narendra Modi’s second term. “In IT, we will try to quickly get the data protection bill to the Parliament and also, notifying the intermediary guidelines,” he said. Before India started out on its journey to address data privacy concerns, the debate had already been ongoing in the US for nearly 20 years and in the EU for over 10 years. The original draft of the Personal Data Protection Bill that was shared in 2018 draws its inspiration from the European Union’s General Data Protection Regulation (GDPR) as well as other legislations around the world. And, given that GDPR has just completed its first year of implementation, Krishnamoorthy feels that there’s a lot that India can learn from the EU’s experience, “It would be beneficial for the government given that GDPR has gone through its anniversary and there were learnings from that. And generally, also there’s been a lot of activity as well, like the G20 Summit in Japan. ” It’s not just that India needs to look at the experience of other countries. The new draft that will be tabled at parliament is considerably different from what was originally presented. “The next version be more robust than what it is currently,” Krishnamoorthy explains. A new draft of the Personal Data Protection Bill speaks of more restrictions and surveillance.  The first steps towards mass surveillance A day before Christmas, the Russian’s Ministry of Communications announced that the country has successfully unplugged the internet according to a <a href="https://www.bbc.com/news/technology-50902496">BBC</a> report. It marks the implementation of Russia’s ‘sovereign internet’ law, which allows the government to block content in an ‘emergency situation’. <a href="https://www.hrw.org/news/2019/10/31/russia-new-law-expands-government-control-online#">Experts</a>’ main critique of the law is that it’s the first step towards dismantling the internet. The definition of an ‘emergency situation’ is vague but the government insists that the main purpose is to prevent cyberattacks. <a href="https://www.cpomagazine.com/data-protection/new-india-data-protection-bill-may-give-government-unlimited-access-to-citizen-data/">Critics</a> in India find similar faults with the Personal Data Protection Bill. Though the government won’t have the power to remove online content, it will be able to track and monitor accounts that it <a href="https://www.businessinsider.in/business/news/iamai-flags-ambiguities-in-draft-data-protection-bill-seeks-clarity-on-classification-consent/articleshow/72282044.cms">deems to be a ‘threat’</a> — essentially creating a backdoor that can be opened at any time without having to lift a finger. Another way to think about it that the new data privacy laws will apply to everyone, <a href="https://www.businessinsider.in/business/news/centres-exemption-powers-in-draft-data-protection-bill-stir-up-industry-worries/articleshow/72461296.cms">except for the government</a>. The trend of data protection through localisation India is already following in China’s footsteps with its data localisation laws, according to a report by the Eurasia Group and Vontobel. They say it’s partly a way to protect domestic technology companies from foreign competition. And while that may be true, multiple studies show that India companies don’t have the adequate cybersecurity infrastructure in place to protect against data theft.  The level of a vulnerability is worryingly high when one takes into considering that the country has already made data localisation mandatory for financial transactions of its citizens. As experts point out, <a href="https://www.businessinsider.in/tech/news/data-localisation-wont-help-local-firms-or-improve-privacy-but-it-could-cost-india-43-billion/articleshow/72251167.cms">data localisation may keep the data from foreign firms</a> — but it also creates a single point of attack. It won’t be cheap either. According to a report by ICRIER and IAMAI, the restrictions would hamper cross-border data flows costing India up to $43 billion in trade. The lingering question The Personal Data Protection Bill 2019 is still under discussion leaving the possibility open for the proposed laws to be changed before they’re official. "Effective data privacy and personal information protection are critical pillars for driving consumer trust in the rapidly growing digital economy," said the country manager for BSA India, Venkatesh Krishnamoorthy. And he rightly points out, maintaining trust is critical as cybersecurity threats are only set to increase in 2020 as technology continues to evolve and legislation struggles to keep up. The combination of data localisation and tracking of users online activity makes a for a dangerous mixture that could have India becoming the next country to splinter the internet along with China, Iran, Russia and Saudi Arabia. Indian data laws have an uncanny resemblance to Russia’s 'new' internet and China’s 'Great Firewall'

<keyword id="46425" type="PERSON" weightage="20" keywordseo="Anand-Mahindra">Anand Mahindra</keyword>, the chairman of the homegrown auto group <keyword id="6357096" type="UNKNOWN" weightage="20" keywordseo="Mahindra-Mahindra">Mahindra &amp; Mahindra</keyword>, on Wednesday admitted that entering the commuter bike segment more than a decade ago was a failure on the part of the group. The group entered two-wheelers after buying out Kinetic Motors in July 2008 and relaunched the 'Freedom' bikes under the label of 'Mojo' but has not been able to make a mark in the vastly entry-model driven two-wheeler space in the country even after a decade. The market is dominated by Hero Motorcorp and Japanese major Honda which together control close to two-thirds of the over 21-million units per annum market. Of this, Mahindra sold a paltry 4,004 units in FY19, down 73 percent from FY18. The only player in an over a dozen OEM market behind Mahindra is Kawasaki Motor which sold 3,115 units in the year, according to Siam data. In the year to March 2019, according to the Saim data, the domestic two-wheeler domestic market stood at 21.2 million units, up 4.86 percent from FY18. Terming failure as "capital", just like financial and human capital, Mahindra said the learning from the commuter bike episode, which was a "product failure" led to the learning and entry into the premium two-wheeler segment where he claimed the group has been successful. Mahindra said they entered the two-wheeler market with the confidence to "win", on the back of having a strong understanding of the ecosystem, distribution, R&amp;D and also brand positioning. "We knew our dream well and we had the right things, but how to win is where we went wrong. We should have never gone to the commuter bike side," Mahindra said, speaking at an event organised by British carrier Virgin Atlantic on looking at 'business as an adventure'. Sharing the stage with the Virgin group founder Richard Brandson, Mahindra said they brought the premium Java brand to the country a year-ago and seemed to suggest that it has been a success, stating that there continues to be a five-month wait for the cult bikes. He also said they will soon be launching the BSA bikes, which was acquired earlier. Meanwhile, amid widespread slowdown in the auto sector, Mahindra claimed that "the most optimistic" people in his group today are those in the auto and farm equipment segments, as they expect sunny days to come back from April. "...the most optimistic people in our group today are our automotive people. They've seen a good close in calendar year and they are hopeful of next year," he said, adding new emission norms from April will be the biggest demand driver for the company. Similarly, in the farm equipment sector, Mahindra said the reservoir levels are good, winter crop harvest will be bountiful and hence, it expects a pick up in the tractor sales from April. "Ironically, the two areas (auto and farm) where people think there is doom, but our people are beginning to smile again," he said, adding October sales were good on the back of festive demand. However, the official numbers shared by the company for November 2019 are different with Mahindra's volumes falling over 9 percent at 41,235 units. Of this, commercial vehicles sales were down 12 percent at 17,384 units, PV sales fell 10 percent to 14,637 units and farm equipment volume plunged to 20,414 units from 25,159 units in November 2018. Asked about the economy, where growth has slipped to a six-year low and pessimistic headlines galore, Mahindra advised everyone to have faith in their inner selves. "Failure is hard to swallow. You have to go inside, and begin investing again. 'dar ke aage jeet hai', beyond the fear lies victory. That is just not a slogan. If we really go inside internally, and we as a nation have a great tradition to understand how to go inside, we find strength," he said. Three <keyword id="20960453" type="General" weightage="20" keywordseo="new-criminal-laws" source="keywords">new criminal laws</keyword> came into effect on Monday, bringing far-reaching changes in India's criminal justice system. The Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagarik Suraksha Sanhita (BNSS) and the Bharatiya Sakshya Adhiniyam (BSA) replaced the colonial-era Indian Penal Code, Code of Criminal Procedure and the Indian Evidence Act, respectively. Commissioner Sanjay Arora also confirmed that the Delhi Police had started registering FIRs under the three new laws. The FIR was registered under Section 285 of the BNS which states, "Whoever, by doing any act, or by omitting to take order with any property in his possession or under his charge, causes danger, obstruction or injury to any person in any public way or public line of navigation, shall be punished with fine which may extend to Rs 5,000." The police said an incident was reported at 12:15 am against a street vendor, who allegedly obstructed a public way to sell goods at a foot overbridge near the New Delhi station. After instructions to move went unheeded, a patrol officer registered a case at 1:30 am. The officer used the e-Pramaan app to record the seizures made, the FIR stated. The app, handled by the Delhi Police's Crime Branch, will directly feed the content to police records for further investigation, an officer said. The Delhi Police has imparted training to its 30,000 personnel -- from the ranks of assistant sub-inspectors and inspectors to assistant commissioners and deputy commissioners -- who are responsible for registering FIRs and conducting investigations. The Delhi Police was among the first forces in the country to start training personnel on the new criminal laws, the officials said. Meanwhile, police chief Arora told reporters during the Delhi Police's Commissionerate Day celebrations at Kingsway Camp that the force was fortunate the new laws came into force on this day. "We are fortunate as today is our Commissionerate Day and, on the same day, these laws are being implemented," Arora said. The first FIR under the new laws was registered early on Monday, he added. Delhi Police lodges first FIR under new criminal law

Union Home Minister <keyword id="19899491" type="General" weightage="20" keywordseo="Amit-Shah" source="keywords">Amit Shah</keyword> on Monday stated that the first case filed under new <keyword id="19917982" type="General" weightage="20" keywordseo="criminal-justice-laws" source="keywords">criminal justice laws</keyword> was about a motorcyle theft registered in <keyword id="20161263" type="General" weightage="20" keywordseo="Gwalior" source="keywords">Gwalior</keyword> in <keyword id="19898705" type="General" weightage="20" keywordseo="Madhya-Pradesh" source="keywords">Madhya Pradesh</keyword> at 10 minutes past midnight. "...The first case (under the new laws) was registered at a Police station in Gwalior. It was a case of theft, someone's motorcycle was stolen. The case was registered at 12.10 am...As far as the case against a vendor (registered at a Police Station in Delhi) is concerned, there were provisions for the same earlier too and it is not a new provision. Police used the provision to review it and dismissed that case," Shah said while addressing a press conference here. Shah's clarification came in response to a media query about the first first case lodged under the new laws that have come into force beginning from today. Delhi Police had registered a case at Kamla Market Police Station in the national capital against a street vendor under the new laws. "If the date of crime is before July 1, 2024, then it will be tried under old laws, if it is later, it will be tried under new laws," Shah said at the press conference today. The three new criminal laws- the Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagarik Suraksha Sanhita (BNSS), and the Bharatiya Sakshya Adhiniyam (BSA), came into effect today. Under this the Indian Penal Code (IPC) has been replaced with the Bharatiya Nyaya Sanhita, the CrPC with Nagarik Suraksha Sanhita and the Indian Evidence Act has been replaced with the Bharatiya Sakshya Adhiniyam. These laws had recieved the assent by President Droupadi Murmu on December 25, 2023. Detailing the new laws, the Union Minister said, "...First of all, I would like to congratulate the people of the country that about 77 years after independence, our criminal justice system is becoming completely 'Swadeshi'. This will function on Indian ethos. After 75 years, these laws were contemplated upon and when these laws are in effect from today, colonial laws have been scrapped and laws made in the Indian Parliament are being brought into practice. Instead of 'Dand', it is now 'Nyay'. Instead of delay, there will be speedy trial and speedy justice. Earlier, only the rights of the Police were protected but now, vicitms' and complainants' rights will be protected too." First case under new criminal justice laws registered for motorcycle theft in Gwalior, not against street vendor in Delhi: Amit Shah

In a move that will completely overhaul the criminal <keyword id="20453941" type="General" weightage="20" keywordseo="justice-system" source="keywords">justice system</keyword> in the country, three <keyword id="19911889" type="General" weightage="20" keywordseo="new" source="keywords">new</keyword> <keyword id="19911888" type="General" weightage="20" keywordseo="criminal-laws" source="keywords">criminal laws</keyword> will come into effect from today, July 1. The <keyword id="19899463" type="General" weightage="20" keywordseo="Bharatiya-Nyaya-Sanhita" source="keywords" meta.keywordsubtype="org" meta.entityname="Bharatiya Nyaya Sanhita" meta.hostid="261" meta.entityid="Bharatiya Nyaya Sanhita">Bharatiya Nyaya Sanhita</keyword> (BNS), the Bharatiya Nagrik Suraksha Sanhita (BNSS), and the Bharatiya Sakshya Adhiniyam (BSA), passed in Parliament last December, will replace the <keyword id="19898811" type="General" weightage="20" keywordseo="Indian-Penal-Code" source="keywords" meta.keywordsubtype="org" meta.entityname="Indian Penal Code" meta.hostid="261" meta.entityid="Indian Penal Code">Indian Penal Code</keyword> (IPC), 1860, the Criminal Procedure Code (CrPC), 1973, and the Indian Evidence Act, 1872 respectively. Several new provisions have been incorporated in the three new criminal laws to suit contemporary times and technologies in vogue. The three new laws received Parliament's nod on December 21, 2023. President Droupadi Murmu gave her assent on December 25, 2023, and was published in the official gazette on the same day. As per the notification, the three laws will focus on justice rather than punishment and are aimed at providing speedy justice, all the way, strengthening the judicial and court management system emphasising 'access to justice by all'. Bharatiya Nyaya Sanhita will have 358 sections (instead of 511 sections in the IPC). A total of 20 new crimes have been added to the bill, and the imprisonment sentence has been increased for 33 of them. The amount of the fine has been increased in 83 crimes and mandatory minimum punishment has been introduced in 23 crimes. The penalty of community service has been introduced for six crimes and 19 sections have been repealed or removed from the bill. Bharatiya Nyaya Sanhita has introduced a new chapter titled 'Crimes against Women and Children' to deal with sexual crimes. Provisions related to the gang rape of a minor woman will become consistent with the Protection of Children from Sexual Offences Act (POCSO), and a provision has been made for life imprisonment or death penalty in the case of girls below 18 years of age. There is the provision of 20 years imprisonment or life imprisonment in all cases of gang rape and the new crime category of gang rape of a woman under 18 years of age in the Sanhita. The Sanhita provides targeted penalties for persons fraudulently engaging in sexual intercourse or promising to marry without true intention to marry. Terrorism has been defined for the first time in the Bharatiya Nyaya Sanhita, and it has been made a punishable offence. The new provisions include armed rebellion, subversive activities, separatist activities or any act threatening the sovereignty or unity and integrity of India. Small organized crimes have also been criminalized, punishable with imprisonment of up to seven years. Bharatiya Nagrik Suraksha Sanhita will have 531 sections (in place of 484 sections of CrPC). A total of 177 provisions have been changed in the bill, and nine new sections as well as 39 new sub-sections have been added to it. The draft act has added 44 new provisions and clarifications. Timelines have been added to 35 sections and audio-video provision has been added at 35 places. A total of 14 sections have been repealed and removed in the Sanhita. The timeline has been added to 35 sections of Bharatiya Nagrik Sukraksha Sanhita, which will make the speedy delivery of justice possible. The Bill prescribes a time limit for initiation of criminal proceedings, arrest, investigation, charge sheet, proceedings before magistrate, cognizance, charges, plea bargaining, appointment of Assistant Public Prosecutor, trial, bail, judgment and punishment, and mercy petition. Bharatiya Sakshya Adhiniyam will have 170 provisions (instead of the original 167 provisions, and a total of 24 provisions have been changed. Two new provisions and six sub-provisions have been added and six provisions have been repealed or deleted in the Adhiniyam. The complete implementation of new criminal laws will ensure an end to 'tareekh pe tareekh' era and justice will be given in three years as earlier informed in the Parliament by Union Home Minister Amit Shah. This process of reform in the three laws of the criminal justice system was started in 2019 and 3,200 suggestions in this regard were received from various stakeholders. Speaking on the three new laws on June 29, Union Home Minister Amit Shah said that the three laws of the British era that were governing the Indian Judicial system have been changed on the concept of delivering speedy justice. Several legal experts say there are big challenges ahead for law-enforcing agencies, judicial officers, and legal professionals as the new laws come into force. The passing of the three criminal law bills in Parliament last year sparked a series of debates regarding the need to take such steps towards evolution in the field of law with the introduction of new criminal laws. "The way the government rushed to bring these laws in Parliament and the way it implemented rushed to, is not desirable in a democracy. These laws were neither adequately discussed in the Parliament committee nor extensively discussed in the House, even no consultation held with the stakeholders," former Union Law Minister and Congress leader Ashwini Kumar told ANI. "Now, the opposition parties demanding a change in the legal architecture of criminal laws should be preceded by meaningful deliberations between all the stakeholders that appears not to have been done. It is the only grievance of the opposition parties that should be addressed by the ruling party," he added. "In the New Criminal Laws, law enforcement agencies have been given unfettered powers without checks and balances and safeguards and safety provisions have been ignored, which will be prone to misuse. Under the New Criminal Laws, there will be potential violations of civil liberties," Advocate Sumit Gehlot told ANI. He said that Sedition Law under Section 150 of BNS, the offence has been made Draconian adding that the insertion of the Sedition Law as a backdoor entry seems to be for political reasons. "Section 150 will surely be challenged, as will other provisions, which will result in being struck down by constitutional courts. Why is terrorism inserted as a general penal law offence when it is already punishable under special legislation? Why has police custody been extended from 15 days to 90 days?" he asked. "The three laws were passed in a hurry and at a time when 25% of the members of Lok Sabha were suspended and had no opportunity to participate in the debate. More consultation with various stakeholders would have allowed the Government to rectify some of the deficiencies, which are now becoming a cause of concern," Former Union Law Secretary PK Malhotra said. Senior Advocate, Supreme Court, NS Nappinai said that the new criminal laws are here to stay and the sooner we adapt to it, the better. "Resistance to change is natural but it can only be assuaged through transparency and effective implementation. For this reason, the shortening of the initial timeline proposed for implementation appears to be a bit of a hasty act. The changes to the procedural aspect in particular needed more time for effective adaptation. One can only hope that an escalated process has been adapted to bring the system to speed," she said. Taking a step ahead, the Delhi Police on January 17 this year, commenced a focused training program for its officers to adapt to the new criminal laws. "Delhi Police Academy being a training institute of Delhi Police which is an executing authority, has commenced a focused training program for its officers to adapt to the new criminal laws passed by the Parliament of India i.e. According to a notification by the Ministry of Home Affairs, the three laws will replace the Indian Penal Code (IPC), 1860; the Code of Criminal Procedure (CrPC), 1973; and the Indian Evidence Act, 1872. The Delhi Police Academy, in collaboration with the National Law University, Dwarka, has meticulously designed its training modules to cover all its officers from Spl CsP to the Constables of Delhi Police in a phased manner. Experts from the National Law University conducted the sessions, ensuring that officers at all levels were proficient in the application of the new laws. New criminal laws will replace IPC, CrPC, Indian Evidence Act from today

Scores of nurses of various Delhi government-run hospitals began their strike on Wednesday to put forth their demands which include regularisation of services and long-due promotions. The <keyword id="15046415" type="General" weightage="20" keywordseo="Delhi-Nurses-Federation" source="Orion">Delhi Nurses Federation</keyword> (DNF) said it is a "<keyword id="1081259" type="General" weightage="20" keywordseo="symbolic-strike" source="Orion">symbolic strike</keyword>" that will be held from 9-11 am from November 2-4. "However, emergency and ICU services won't be affected as nominal staff will work for these two services. OPD services and wards will be impacted due to the nursing staffs' strike that began today," DNF secretary general Liladhar Ramchandani said. He said all major city government-run hospitals have joined the call given by the DNF. So, has LNJP Hospital, GB Pant Hospital, DDU Hospital, GTB Hospital, BSA Hospital, Dr Hedgewar hospital, SGM Hospital, among other hospitals in Delhi, he said. Ramchandani said there were 8,000 sanctioned posts, but 6,000 nurses are working. "Three new hospitals have come up and the staff from the other <keyword id="6368262" type="General" weightage="20" keywordseo="government-hospitals" source="Orion">government hospitals</keyword> has been diverted there. There has been an addition of beds, but no addition to nursing staff," he claimed. The DNF had recently carried out a march till the Delhi secretariat to press for their demands, including regularisation of services, promotions that are long due and creation of new posts. "The Arvind Kejriwal government's health secretary and health minister are not serious about the problems of nurses. That is why there will be a symbolic strike," the DNF had tweeted on Tuesday. "We apologise for the inconvenience and difficulty that patients will have to face during the strike," it said. Several cases of fake teachers have been reported in the state. And as of now, the special task force identified over 4,000 fake teachers — and they are expecting more. According to media reports, the UP government spends roughly <a href="https://khabar.ndtv.com/video/show/prime-time/fake-teachers-scam-in-uttar-pradesh-534014">₹150 billion on primary education</a> and faculty. While investigating, the government found out cases of <keyword id="429939" type="PERSON" weightage="20" keywordseo="Identity-theft">identity theft</keyword> as well. In one case, three ‘people’ from different districts were ‘employed’ on the basis of same Aadhar card and PAN card. The scam came to the fore when the real owner of the IDs filed an ITR and found that multiple accounts are being operated with his credentials. This comes in the backdrop of an ongoing debate on the state of education system in the state. A recent video of an <a href="https://www.news18.com/news/india/english-teacher-fails-to-read-textbook-during-surprise-check-at-up-school-video-goes-viral-2406359.html">English teacher struggling to read a textbook</a> in <keyword id="432256" type="PERSON" weightage="20" keywordseo="Unnao-district">Unnao district</keyword> of UP had gone viral across social media platforms. During the surprise inspection, the students fumbled while reading English textbooks. In fact, the BA pass teacher could not read a single sentence, after which Basic Shiksha Adhikari (BSA) was asked to suspend her. “She should be suspended immediately. She is an English teacher and she can’t even read English properly,” District Magistrate Devendra Kumar Pandey told News18. This is however not the only case. <div class="KonaFilter image-container display-table"><div><div class="image"><img src="https://static-ssl.businessinsider.com/image/5d826b852e22af08f274f725-2400/gettyimages-450831302.jpg" border="0" alt="Jeff bezos" data-mce-source="David Ryder/Getty Images" /></div></div></div><ul class="summary-list"><li><a href="https://www.businessinsider.com/category/amazon">Amazon</a> signed a pledge on August 16 with its third-party sellers that it would give a 30-day suspension notice before permanently removing them from the platform.</li><li>Many sellers and consultants thought that policy would protect them.</li><li>But a month after it went into effect, third-party sellers told Business Insider that they are still being suspended from the platform without notice.</li><li>It's one of the biggest gripes Amazon sellers have with the e-commerce giant. </li><li><a href="https://www.businessinsider.com/?hprecirc-bullet">Visit Business Insider's homepage for more stories</a>.</li></ul>Amazon's third-party merchants power <a href="https://www.sec.gov/Archives/edgar/data/1018724/000119312519103013/d727605dex991.htm">some 58%</a> of the e-commerce giant's sales.But those sellers aren't without their gripes - and one of the biggest complaints centers around just how easy it is to be wiped off the platform without any warning or explanation. Many accounts suspensions <a href="https://www.helium10.com/blog/suspended-amazon-seller-account/">are also the result of an algorithmic decision</a> made by Amazon's internal machine-learning software, which results in some sellers getting booted even if they have done nothing wrong."Nobody likes that your business just shuts down overnight," Amazon seller and consultant <a href="https://egrowthpartners.com">Cynthia Stine</a> told Business Insider. "They keep your money, they keep your inventory, and you're looking at a very vaguely worded notification document that doesn't really tell you what they're looking for."So, as part of <a href="https://www.bundeskartellamt.de/SharedDocs/Meldung/EN/Pressemitteilungen/2019/17_07_2019_Amazon.html?nn=3591568">a German antitrust settlement</a>, Amazon amended <a href="https://sellercentral.amazon.com/gp/help/external/G1791?language=en_US">its Business Services Agreement</a>, which all third-party merchants agree to.That new version gives sellers in and out of Germany a 30-day notice before permanently removing them from the platform. Sellers whose profiles were used for illegal or fraudulent activities, whose products harmed customers, or otherwise "materially breached" the sellers' agreement could still be removed without that 30-day notice.Before the new policy went into effect, Amazon said in its seller agreement that it could "for any reason at any time by notice" remove merchants from the marketplace. That new policy went into effect <a href="https://www.cnbc.com/2019/07/20/amazons-updated-suspension-policy-still-has-sellers-worried.html">on August 16</a> for merchants worldwide.<h2>The policy isn't what sellers or consultants thought it would be</h2>When the August 16 policy was enacted, sellers and consultants believed Amazon would give them that 30-day notice when they were suspended. That's what much of the messaging around the new policy communicated.<a href="https://www.ecommercechris.com/"></a>"This is a much-ballyhooed improvement to account suspension and transparency and we're looking under rocks for it," said <a href="https://www.ecommercechris.com/">Chris McCabe</a>, who is the founder of a consultancy called eCommerceChris that helps Amazon sellers whose accounts have been suspended.The fact that this new policy doesn't protect suspended sellers - and only ones headed for permanent removal- was "a surprise to us," McCabe said. <div class="KonaFilter image-container display-table"><div><div class="image"><img src="https://static-ssl.businessinsider.com/image/5d8a51962e22af0aad1e360e-2400/amazon boxes-3.jpg" border="0" alt="Amazon Boxes 3" data-mce-source="Hollis Johnson/Business Insider" /></div></div></div>The limits of the policy were also news to <a href="https://www.avenue7media.com">Jason Boyce</a>, who was a multimillion-dollar seller on Amazon and is now a consultant to Amazon businesses. "When I read the policy change that came shortly after the EU rulings, I thought, 'Thirty days - this is a good start,'" Boyce told Business Insider. "'I would prefer 60 or 90 days, but this is a step in the right direction to protect third-party sellers.'"To hear now that it had nothing to do with account suspensions, only to do with account cancellations, to me it seems that they only paid the account policy lip service," said Boyce, the founder of <a href="https://www.avenue7media.com">Avenue7Media</a>.An Amazon spokesperson said sellers are "incredibly important" to Amazon and its customers."We have tools and services to help them grow their business, as well as policies to ensure they help us delight our customers," the spokesperson said in a statement emailed to Business Insider. "If sellers violate our policies and damage our customer experience, we take swift action in order to protect both customers and other sellers."<h2>Ever-changing language</h2>Part of the confusion stems from the fact that Amazon frequently changes how it refers to account suspensions or terminations.Germany's federal competition regulator told news media that the settlement would address <a href="https://www.bundeskartellamt.de/SharedDocs/Meldung/EN/Pressemitteilungen/2019/17_07_2019_Amazon.html?nn=3591568">"the termination and blocking of sellers' accounts."</a> But those two terms could feasibly refer to permanent or temporary account actions. Amazon alternatively calls temporary actions "suspensions" or "deactivations." But this hazy language is not an accident, said McCabe, who worked in Amazon's seller compliance department for five years. "They generally like to keep it vague on purpose because they don't want to be, I guess, pigeonholed. They don't want to be quoted back to themselves," McCabe said. "'Well, you told me this, and that's what I've given you.' They don't want to be quoted to themselves. They keep it vague because they want to reserve the right to interpret things as they see fit."<h2>Sellers are still getting removed without 30-day notice</h2>The fact that Amazon is not required to give 30-day notice before suspending an account is still widely not known among sellers.Peter Kearns was a business development manager at Amazon for nearly four years, and now consults suspended Amazon sellers. He told Business Insider that several suspended sellers have contacted him in recent weeks, confused that they didn't receive the 30-day notice before getting booted. "That doesn't say that that's what this was going to do."<div class="KonaFilter image-container display-table"><div><div class="image"><img src="https://static-ssl.businessinsider.com/image/5bcd8186d2e64814446272b4-1781/amazon warehouse.jpg" border="0" alt="Amazon warehouse" data-mce-source="Getty" data-mce-caption="Amazon warehouse in Brieselang, Germany." /></div></div></div>In the UK, Yasmin Calma runs a baby accessory and clothing store called Tiny Alpaca with her partner Kieran Broyd. On September 15, the merchants discovered their account was suspended without any notification. (As of September 18, they're back on the platform.)"We haven't been given any reasoning - no email, no explanation," Calma told Business Insider. They said they had $15,000 of inventory stuck in the Amazon warehouse and couldn't ship it back without losing thousands of dollars.Calma has been monitoring <a href="https://sellercentral.amazon.com/forums/">the Amazon Seller Forums</a>, where scores of sellers have posted about their accounts getting suspended without notification, to learn more. "A lot of them believed they would get a 30-day notice, but they were shut down with no notification," Calma said."If they would just tell sellers, 'you have two weeks to clean up your act,' most sellers would," Stine said. "They would do whatever Amazon wanted. Amazon sellers are like abused kids. They would do anything to please Papa Amazon. They removed the inventory from that product, but failed to delete the listing altogether. Less than two weeks later, on September 11, the seller saw one night that their account was suspended. "My stomach totally dropped," the seller told Business Insider.They thought they would receive a 30-day notification, but did not. <div class="KonaFilter image-container display-table"><div><div class="image"><img src="https://static-ssl.businessinsider.com/image/5d8283732e22af0fe972ad03-1777/amazon package box.jpg" border="0" alt="amazon package box" data-mce-source="John Zeedick/AP Photos" /></div></div></div>That seller ultimately got their account reinstated in less than two days, but there was a hit to the seller's bottom line - they generate some $2,000 a day in sales. "We're running a business," the seller said. "We have lines of credit that we're paying on top of the product - just not a very good situation to find yourself in."And in India, Amazon seller Chirag Jindal told Business Insider that his account was suspended on September 6. He received two emails the prior month, which Business Insider viewed, about inaccurately constructed listings, which he corrected."I didn't get any notification before (I was suspended)," Jindal said. "I have not seen the 30-day warning yet," said Stine, who runs a 25-person business out of Dallas focused on reinstating suspended Amazon sellers. "So far as I can tell, there's been no one who has gotten that 30-day message."<h2>'Good apples' are getting caught up in the crackdown - and the economic consequences can be serious</h2>While they may be thought of as small businesses, some of these marketplace sellers are massive. Around 50,000 third-party Amazon sellers each generated more than $500,000 in sales last year.So, when they're removed from the marketplace platform, they risk losing their entire livelihood. Scott Needham, CTO of Amazon marketplace seller Logan, Utah-based BuyBoxer, <a href="https://www.businessinsider.com/amazon-sellers-organizing-anti-trust-doj-ftc-2019-8">previously told Business Insider</a> that, when his store was suspended for seven days, 100 employees were sent home for a full week. (This shutdown happened prior to the August 16 policy change.)"I just know that like every seller out there has feared the policy enforcement out there," Needham said."Amazon says that they're going after the bad actors. I completely support and I want them to do that, but I can name dozens of sellers that have tried to do things in good faith and they still come across this."<div class="KonaFilter image-container display-table"><div><div class="image"><img src="https://static-ssl.businessinsider.com/image/5d2c9783a17d6c203d66fafb-2238/ap18103509037998.jpg" border="0" alt="amazon prime" data-mce-source="AP Photo/Patrick Semansky, File" /></div></div></div>Plenty of "good apples" can get caught in Amazon's machine learning-based process of suspending sellers, Kearns said. Lots of suspensions result from seller accounts triggering Amazon's algorithm to catch bad actors in the marketplace, and that means sellers who haven't made a mistake can sometimes end up suspended. "Our global team is available 24/7 to support sellers via email, phone, and chat in more than 15 languages. An Amazon merchant who is selling, say, several different colors of water bottles may place a different size or type of bottle in the same listing. This is beneficial for the seller if that original water bottle has a high ranking and review, but it's not allowed under Amazon's seller agreement.And some sellers take it too far, knowingly or not, and pack hundreds of variations in one listing. Ultimately, they risk suspension from Amazon."They are banning people for very minor offenses made out of ignorance," Stine said. "That's why this has been so heartbreaking."Still, the speedy banning is in line with Amazon's ethos of "customer obsession." If a third-party seller is potentially causing a bad experience for customers, the e-commerce giant won't hesitate to eliminate them. "Amazon at its core is obsessed with creating a great customer experience," Kearns said. "If they think a seller is creating a negative customer experience, they'd rather suspend and protect that customer experience rather than allow a potential bad apple."Are you an Amazon seller?
