A five-judge constitution bench headed by Justice S.A. Nazeer and comprising Justices B.R. Gavai, A.S. Bopanna, V. <keyword id="853181" type="General" weightage="80" keywordseo="ramasubramanian" source="Orion">Ramasubramanian</keyword>, and B.V. <keyword id="620466" type="General" weightage="80" keywordseo="nagarathna" source="Orion">Nagarathna</keyword>, delivered the verdict. However, Justice Nagarathna delivered a separate judgment. Justice Ramasubramanian, reading the majority judgment, said no additional restrictions against free speech can be imposed except those mentioned under the Article 19(2) of the Constitution. "The grounds...in Article 19(2) for restricting the right to free speech are exhaustive... additional restrictions not found in Article 19 (2) cannot be imposed on the exercise of the right conferred by Article 19 (1) (a)", said Justice Ramasubramanian. The top court said a minister's statement can't be vicariously attributed to the government and the minister is liable for the statement himself. The constitution bench judgement delivered the verdict on whether restrictions can be imposed on the right to freedom of speech and expression of a public functionary. Justice Nagarathna said hate speech strikes at the root of equality and fraternity and added that fundamental duties could be used to check disparaging speeches and promote harmony among citizens. Justice Nagarathna said the court cannot impose any greater/ additional restrictions on the fundamental right of free speech of such public functionaries. The plea also sought lodging of a case against Khan in connection with his controversial statement that the gang rape case was a "political conspiracy". The Samajwadi party led by Akilesh Yadav faced the elections as part of the Mahagathbandhan involving SP, BSP and RLD. The exit poll results for the SP as per Axis IndiaToday-Axis MyIndia predict that the alliance made up by the three parties might win from 16 seats only. The Chanakya predictions for 2019 Lok Sabha seats presume only 2 seats for SP and its alliance. The other predictions for SP for the Lok Sabha elections 2019 include 17-19 by News18, 13 seats by India Today, 40 constituencies by CVoter and 41 seats by NewsX. The total number of parliamentary seats in UP is 80. In 2014 general elections for the parliament, SP got only 4 seats out of 80 from Uttar Pradesh. In 2009 elections, SP won from 22 constituencies. The winning statistics for SP during 2004 was 35 seats. In 2019 Lok Sabha elections, Akilesh Yadav is fighting from Azamgarh Lok Sabha seat. Since the Section came to power, several petitions were filed at various courts challenging the section on the basis of what constituted ‘grossly offensive or menacing character’? The main contention has been that who is it that will decide what action or ‘post’ or ‘comment’ constituted ‘offensive’ enough to be put behind bars.  So what exactly does Section 66 A of the <keyword id="6379296" type="UNKNOWN" weightage="80" keywordseo="IT-Act">IT Act</keyword> say? 
 The Information Technology Act, 2000 was amended in 2008. The amended Act which received the assent of the <keyword id="2540" type="POSITION" weightage="80" keywordseo="President">President</keyword> on February 5, 2009, contains section 66A. 
 
66A-Punishment for sending offensive messages through communication service, etc. 
 
Any person who sends, by means of a computer resource or a communication device,— 
(a) any information that is grossly offensive or has menacing character; or 
(b) any information which he knows to be false, but for the purpose of causing annoyance, inconvenience, danger, obstruction, insult, injury, criminal intimidation, enmity, hatred or ill will, persistently by making use of such computer resource or a communication device, 
(c) any electronic mail or electronic mail message for the purpose of causing annoyance or inconvenience or to deceive or to mislead the addressee or recipient about the origin of such messages, shall be punishable with imprisonment for a term which may extend to three years and with fine. 
 
For the purpose of this section, terms “electronic mail” and “electronic mail message” means a message or information created or transmitted or received on a computer, computer system, computer resource or communication device including attachments in text, images, audio, video and any other electronic record, which may be transmitted with the message.

What is Section 66A of the IT Act?

The Uttar Pradesh police has filed a chargesheet against <keyword id="6374198" type="POSITION" weightage="100" keywordseo="BJP-President">BJP President</keyword> <keyword id="6355521" type="PERSON" weightage="100" keywordseo="Amit-Shah">Amit Shah</keyword> for allegedly giving a ‘<keyword id="6406418" type="UNKNOWN" weightage="100" keywordseo="Hate-speech">hate speech</keyword>’ in violation of the model code of conduct while campaigning for the Lok Sabha elections in Muzaffarnagar. The chargesheet was filed in a Muzaffarnagar court for allegedly seeking votes on the basis of religion, race, caste and community. 
 
The chargesheet has been filed under various sections of IPC, including 153A (promoting enmity between different groups on grounds of religion, race, place of birth, etc.), 295A (deliberate and malicious acts, intended to outrage religious feelings of any class) and 505 (false statement, rumour, etc. circulated with intent to cause mutiny or offence against the public peace), and Section 123-3 of Representation of People Act (making an appeal to vote on the grounds of religion amounting to corrupt practice). 
 Shah had allegedly said that the 2014 <keyword id="43815" type="UNKNOWN" weightage="100" keywordseo="Lok-Sabha-election">Lok Sabha election</keyword> was an opportunity to seek "revenge for the insult" meted out during the riots in Muzaffarnagar in 2013. Shah's political opponents accuse him of using communal tension to electoral advantage, which he has denied. The ruling <keyword id="6354265" type="ORGANIZATION" weightage="100" keywordseo="samajwadi-party">Samajwadi Party</keyword> leader <keyword id="6355085" type="PERSON" weightage="100" keywordseo="Azam-Khan">Azam Khan</keyword> was also under fire for similar charges.

Chargesheet Filed Against Amit Shah For Alleged Hate Speech In Muzaffarnagar

He was known as '<keyword id="2986120" type="General" weightage="20" keywordseo="Dhartiputra" source="Orion">Dhartiputra</keyword>' and remained a true son of the soil. His style of politics was firmly grounded and success and failure did not affect him. <keyword id="6357168" type="General" weightage="50" keywordseo="mulayam-singh-yadav" source="Orion">Mulayam Singh Yadav</keyword> was one of the last of his generation of politicians who kept his values intact and did not corporatize his politics. For him, the last man in the line remained important - whether it was from his family, his village or his state. He was a friend of friends and even turned his foes into friends. <keyword id="25541" type="General" weightage="80" keywordseo="mulayam-singh" source="Orion">Mulayam Singh</keyword> had first contested the Assembly election from Karhal in 1967 on Ram Manohar Lohia's Samyukta Socialist Party ticket. Groomed by the likes of Ram Manohar Lohia and Raj Narain, Yadav served eight terms as the member of the state Assembly. In 1975, during Indira Gandhi's imposition of the Emergency, Yadav was arrested and kept in custody for 19 months. He first became a state minister in 1977. Later, in 1980, he became the president of the Lok Dal in Uttar Pradesh which later became a part of the Janata Dal. In 1982, he was elected leader of the opposition in the Uttar Pradesh Legislative Council and held that post until 1985. When the Lok Dal party split, Yadav launched the Krantikari Morcha party. <keyword id="42422" type="General" weightage="100" keywordseo="mulayam" source="Orion">Mulayam</keyword> Singh Yadav first became the chief minister of Uttar Pradesh in 1989. Being a shrewd politician, he had the uncanny knack of sensing the upheavals in politics. After the collapse of the V.P. Singh national government in November 1990, Yadav joined Chandra Shekhar's Janata Dal (Socialist) party and continued in office as the chief minister with the support of the Congress. His government fell when the Congress withdrew support in April 1991 and Mulayam Singh lost to the BJP in the midterm elections. In 1992, Yadav founded his own Samajwadi Party and then allied with the Bahujan Samaj Party for the elections to the Uttar Pradesh Assembly, held in November 1993. The alliance between the Samajwadi Party and Bahujan Samaj Party prevented the return of the BJP to power in the state and Yadav became the chief minister of Uttar Pradesh with the support of Congress and Janata Dal. Mulayam's stand on the movement for demanding separate statehood for Uttarakhand was as much controversial as his stand on Ayodhya movement in 1990 was. The firing on Ayodhya activists and then Uttarakhand activists at Muzaffarnagar on October 2, 1994 remained black spots of his regime. In 1995, the SP-BSP alliance broke with the infamous State Guest House incident but Mulayam Singh Yadav made sure that his party bounced back to power in 2003. He was sworn in as the chief minister of Uttar Pradesh for the third time in September 2003. Yadav contested the 2004 Lok Sabha elections from Mainpuri while he was still Chief Minister of Uttar Pradesh. However, he later resigned from the Lok Sabha and continued as chief minister till 2007 when the SP lost to the BSP in the state elections. Mulayam Singh Yadav was one of the few politicians who blatantly promoted nepotism and had no qualms about it. At any given time, there were about a dozen family members in politics in Uttar Pradesh. "He always pushed us into politics and asked us to make a career for ourselves. It was always he who decided what was best for us and took keen interest in our careers," said one of his nephews. Mulayam Singh valued his friends deeply. Whether it was Beni Prasad Varma, or Azam Khan or Mohan Singh or Janeshwar Mishra - each one had a special place in his life. His war with Balram Singh Yadav and Darshan Singh Yadav in Etawah had acquired legendary proportions, but Mulayam, over a period of time, managed to change his equations and both became his friends. Mulayam shared a love-hate relationship with the media. His famous 'Halla Bol' agitation against some newspapers grabbed national headlines. However, Mulayam made sure that his individual relationship with journalists never deteriorated. Even if he ticked off a scribe for his writing, he made sure to call out to him and mend fences at the earliest. For party workers, he remained their beloved 'Netaji' - one who was always approachable and available. "I do not remember a single occasion when I went to meet Mulayam Singh and came back without doing so. He remembered even the smallest party worker by name and it was this that endeared him to everyone," said a senior party MLA. Mulayam Singh Yadav was one chief minister who enjoyed full loyalty from his bureaucrats. He took tough decisions and his officers implemented them. In fact, many claim that the politicisation of bureaucracy began only after Mulayam became the chief minister. In the past five years, after Akhilesh Yadav took over the reins of the party, Mulayam had withdrawn into a shell. The changing dynamics in the party reduced the stream of visitors into a trickle and Mulayam - for the first time, became a lonely man. "He would often ask us if there was anyone waiting to meet him. He loved going to the party office and relished the hustle-bustle there. At home, he had almost nothing to do and this bothered him," said one of his close staff members. Mulayam was disturbed by the recent happenings in his family -- daughter-in-law Aparna joining the BJP, the split between son Akhilesh and brother Shivpal. He made no public mention of it but it was clear that he was deeply affected by what was happening. The demise of his second wife Sadhana Gupta Yadav in July this year, sources say, left Mulayam distressed and lonely and this led to a deterioration in his physical condition. Political parties all over the country enrolled female star power to increase their visibility in the <keyword id="4577611" type="PERSON" weightage="20" keywordseo="lok-sabha-election-2019">Lok Sabha Election 2019</keyword>. The Bharatiya Janata Party (BJP) headlined four veteran actresses to cheer its cause across the country — Hema Malini, Kirron Kher, Jaya Prada and Smriti Irani, who served as the Textiles Minister during Modi’s 2014 tenure. Congress, on the other hand, brought only one female actress to contest the elections — Urmila Matondkar in Mumbai North. The Election Commission’s counting shows that BJP’s Gopal Shetty, isn’t just leading, but dominating over Matondkar garnering 72.2% of the vote share. Even Poonam Sinha, Samajwadi Party (SP)’s Bollywood candidate, is trailing far behind her contender, BJP’s Rajnath Singh in Lucknow. BJP contestants largely beat exit poll predictions Contesting the Lok Sabha Election from Amethi, a Congress stronghold, Irani seems to be leading over the incumbent Rahul Gandhi by a margin of 10,000 votes according to data from the Election Commission in contrast to the exit poll that predicted a Gandhi victory. During the 2014 election, Gandhi did manage to beat out Irani but she dented his vote share by at least 12%. BJP’s ‘dream girl’ candidate, Hema Malini, flipped from trailing during the initial vote count to commanding a strong lead of 62.2%. Her primary contender, Kunwar Narendra Singh from the Rashtriya Lok Dal (RLD) was left in the dust with 33.3% vote share. Jaya Prada, on the other hand, looks unlikely to bring a victory home for the BJP as she trails behind Samajwadi Party (SP)’s Azam Khan in Rampur with a difference larger than 100,000 votes between them.

As the second phase of the <keyword id="43573" type="EVENT" weightage="20" keywordseo="General-Election">general election</keyword> takes off in India, voters in 11 states and 1 union territory— West Bengal, Odisha, <keyword id="20154" type="ORGANIZATION" weightage="20" keywordseo="tamil-nadu">Tamil Nadu</keyword>, Maharashtra, Karnataka, Jammu and Kashmir, Uttar Pradesh, Bihar, Chhattisgarh, Assam, Manipur and Puducherry — were up early queuing up at the election booths. Nearly 5 million people are eligible to vote in the state of West Bengal with a nearly equal distribution between men and women, albeit there are only 87 registered third-gender voters in the three constituencies going to vote in the state today today. And Puducherry, while being a union territory, is home to nearly one million voters who have been facing <a href="https://economictimes.indiatimes.com/news/elections/lok-sabha/india/puducherry-congress-tries-to-win-back-sole-mp-seat/articleshow/68899027.cms">increasing</a> debt and a fall in social initiatives due to lower devolution of taxes from the central government. A lot of voters and politicians are wondering if the second phase of polling will be marred with problems of EVM malfunctions and poll booth violence like evidenced during the first phase of the general election in India. Two incidents of poll booth violence have already been reported in West Bengal. In Uttar Pradesh, four of the contesting politicians — Samajwadi Party’s Azam Khan, Union Minister Maneka Gandhi, Chief Minister Yogi Adityanath and Bahujan Samaj Party’s Mayawati — have been <a href="https://www.businesstoday.in/top-story/up-election-2019-after-yogi-mayawati-ec-bans-azam-maneka-from-campaigning/story/337566.html">banned</a> from campaigning by the Election Commission of India (ECI) for issuing controversial comments. For Tamil Nadu, the days leading up to the election were a little chaotic after the Income Tax (IT) department seized over 1,350 kilograms of gold and nearly ₹14.8 million which was allegedly stashed to bribe voters. Elections in Vellore, one of Tamil Nadu’s most-watched constituencies, were cancelled altogether after ₹1.05 million was found at Durai Murugan’s house, the father of Kathir Anand — a DMK candidate in the district. Another ₹115.3 was also found at Poonjolai Srinivasan’s cement godown, a known associate of Murugan. Even Maharashtra hasn’t had an easy go of it with over 15,000 cases of alleged Model Code of Conduct violations <a href="https://www.hindustantimes.com/lok-sabha-elections/lok-sabha-elections-2019-over-15-000-code-of-conduct-cases-filed-in-maharashtra/story-luAZtetS7fq6EUDRsYztmI.html">registered</a> since March 10.The Additional Chief Electoral Officer, Dilip Shinde, has stated that over 700,000 officers and employees of the states are involved in keeping elections in Maharashtra peaceful and efficient for the 10 seats of the state going to the polls today. <div type="ExtQuote" text="The enforcing departments (Income Tax and Police) also lodged total 15,095 FIRs against the offenders for violating the model code of conduct, with most of the cases pertaining to storage and distribution of illicit liquor, followed by possession of firearms." auname="Additional Chief Electoral Officer Dilip Shinde"></div>

 If voters aren’t being bribed, then they’re being threatened. Kawasi Lakhma, a Congress minister from Chhattisgarh, has been <a href="https://www.ndtv.com/india-news/general-elections-2019-chhattisgarh-congress-mla-kawasi-lakhma-threatens-voters-with-electric-shocks-2024279">telling</a> voters that they vote against his party, the EVM machine will deliver an electric shock. While Maharashtra and Tamil Nadu struggle with voter bribery issues, Bihar and Karnataka are more concerned with voter turnout. The city of Bengaluru — the Silicon Valley of India — in particular, has issues of <a href="https://www.businessinsider.in/election-2019-gold-confiscated-in-tamil-nadu-ahead-of-second-phase/articleshow/68933494.cms">voter turnout</a> while Bihar’s <a href="https://www.livemint.com/elections/lok-sabha-elections/bihar-elections-2019-patna-is-missing-a-whole-generation-of-millennials-1555350536677.html">brain drain</a> means that a lot of its eligible millennial voters don’t actually live in the state anymore. As Manipur goes to polls again, the Returning Officer (RO)The Returning Officer (RO) of the Outer Manipur Parliamentary Constituency, Haobam Rosita, has <a href="https://www.newsclick.in/returning-officer-recommends-re-poll-19-polling-stations-manipur">recommended</a> that re-polling needs to take place at 19 of the polling stations from the first phase of the general elections in the state. Among the many reasons that Rosita cites for repolling, the most disturbing is probably one of the constituencies showed that voter turnout in excess of 100% and that the polling booth for the Najang Village was put up at a non-designated location. In order to keep disruptive elements from affecting the polls similarly, the west Indian states of West Bengal and Assam are <a href="https://timesofindia.indiatimes.com/city/patna/2nd-phase-tight-security-in-five-election-bound-districts/articleshow/68868180.cms">increasing</a> security in constituencies along the border — especially in districts classified as ‘vulnerable’ and ‘critical’. And unfortunately, for Jammu and Kashmir, none of the contesting political parties are talking about the environmental issues which have a heavy bearing on the state’s water supply as well as its tourism industry, which has been suffering as more and more of the state’s green capital is being destroyed. The third phase of the general election will kick off on April 23 covering 14 states — Assam, Goa, Karnataka, Odisha, Dadra and Nagar Haveli, Bihar, Gujarat, Kerala, Uttar Pradesh, Daman and Diu, Chhattisgarh, Jammu and Kashmir, Maharashtra and West Bengal.
