"The mandate (of the Assembly polls) was in favor of abrogation of Article 370 because we (BJP) got 26 percent votes against NC's 23 percent," Sham Lal Sharma argued, framing the election results as support for the Centre’s 2019 decision to revoke Article 370. Meanwhile, Deputy Chief Minister Surinder Choudhary defended the resolution, emphasizing the need to restore special status. In presenting the resolution, Choudhary declared, "This Assembly reaffirms the importance of the special status and constitutional guarantees, which safeguarded the identity, culture, and rights of the people of Jammu and Kashmir, and expresses concern over their unilateral removal." The resolution also called for the Government of India to initiate a dialogue with the elected representatives of Jammu and Kashmir for the restoration of special status and constitutional guarantees and to devise constitutional mechanisms to achieve these ends. "This Assembly emphasises that any process for restoration must safeguard both national unity and the legitimate aspirations of the people of Jammu and Kashmir," the document added. As the fallout continues, the resolution has stirred deep-seated <keyword id="21391765" type="General" weightage="20" keywordseo="political-tensions" source="keywords">political tensions</keyword>, exposing rifts within the Assembly and drawing the spotlight back on the long-running debate over Article 370. "We are happy and excited to join our classes, it is really good to meeting with our teachers and friends after such a long time, we can only hope that we will be quickly able to compensate for the losses in our education last year," said Azmat, a Class XII student of the Mallinson school in Srinagar. <ul><li>India's Narendra Modi government has made a historic move to annul Constitutional provisions that confer Jammu and Kashmir a 'special' status that allows it to make its own laws and ward off 'outsiders.</li><li>India's Home Minister Amit Shah declared in the Parliament today that Article 370 and Article 35A of the Constitution will be abrogated.</li><li>The government also informed the Parliament that Jammu and Kashmir and Ladakh will be split into two Union Territories, which will be the entire region directly under the Centre's rule.</li><li>Ahead of this announcement, Section 144 was imposed in Kashmir valley-- internet services have been suspended, political leaders like Omar Abdullah and Mehbooba Mufti have been placed under house arrest-- to prevent any backlash.</li></ul> The Narendra Modi government is keen to create history by putting an end to provisions in the Indian Constitution that confer a special status to state of Jammu and Kashmir, which has been the centre of a conflict with Pakistan as well as a hotbed for separatists in the region. The government's overpowering majority in the Indian Parliament as well as the fact that the state is under President's rule for now, help Modi get his way. India's Home Minister Amit Shah declared in Parliament that Article 35A and Article 370 of the Indian Constitution that give special status given to Kashmir -- and rights to make its own laws-- will be abrogated. "The entire constitution will be applicable to Jammu and Kashmir state,” Shah said. In a subsequent order, India’s president approved the government’s changes.  Shah's declaration was faced with an uproar from the opposition leaders in the Rajya Sabha. Congress leader Ghulam Nabi Azad argued that Article 370 has been a crucial factor in keeping Jammu and Kashmir united with India since its independence in 1947. Shah responded saying that Azad's argument was a lie perpetuated by the Congress for decades and Article 370 only managed to isolate Kashmiris from the rest of India. What it means India's first Prime Minsiter Jawaharlal Nehru and Kashmiri icon Sheikh Abdullah agreed to a 'special' status for the state of Jammu and Kashmir to protect the land rights of the 'permanent citizens'. Article 35A prohibits 'outsiders' from owning property, getting government jobs and scholarship, and from settling in the state. The Article, also called the Permanent Residents Law, also prohibits women from inheriting property if they marry someone from outside the state. Apart from the autonomy, Article 370 -- which makes Artice 35A possible-- allows the state to make its own law and also makes it compulsory for the state assembly to agree to any move proposed by the central government in New Delhi. However, as of now, the state is under President's rule and there is no need for consent from the state assembly. Those against the 'special' status given to Jammu and Kashmir argue that Article 370 was a 'temporary' provision but the courts, including the Supreme Court, have held that it is a permanent part of the Constitution, in a judgement as recent as 2018. However, Parliamentarians from the Bharatiya Janata Party (BJP) argued in the Parliament the it is indeed a temporary provision, which must be abolished now. As many as 22 bills are to be tabled this session, which intends to protect women, senior citizens, and transgenders and turn adoption easier. The Surrogacy (Regulation) Bill, 2019 The bills bans commercial surrogacy in India. Constitutes the National Surrogacy Board and respective State Surrogacy Boards to regulate the practise of surrogacy. Introduced in Lok Sabha on July 15, 2019 and passed by the Lok Sabha on August 5. The Juvenile Justice (Care and Protection of Children) Amendment Bill, 2019 The bill empowers the District Magistrate instead of the Court to reduce delays for receiving adoption order. The Maintenance and Welfare of Parents and Senior Citizens (Amendment) Bill, 2019 The Bill aims to make life easier for senior citizens by amending the existing act to make it contemporary as per the changing socio-economic needs. The Personal Data Protection Bill 2019 The Bill if it turns into a law will protect and regulate all aspects of personal data, and promote the growth of digital economy. The Prohibition of Electronic Cigarettes (Production, Manufacture, Import,Export, Sale, Distribution, Storage and Advertisement) Bill, 2019 It will replace an ordinance and prohibit the production, manufacture, import, export, sale, distribution, storage and advertisement of e-cigarettes, vaping products and similar devices. The Healthcare service personnel and Clinical Establishments (Prohibition of violence and damage to the property) bill, 2019 It will prohibit violence against healthcare service personnel, and damage or loss of property of clinical establishments. The Citizenship (Amendment) Bill, 2019 Amends the definition of illegal migrant, reduces the residency requirement to obtain Indian citizenship through naturalisation, and empowers the central government to cancel the registration of an Overseas CItizen of India (OCI) card. The National Commission for Indian System of Medicine Bill, 2019 It repeals the Indian Medicine Central Council Act, 1970 and sets up a National Commission to regulate the education and practise of Indian systems of medicine. It was introduced on Jan 7, 2019 in Rajya Sabha. A standing committee report is pending on the matter. The Jallianwala Bagh National Memorial (Amendment Bill, 2019 It removes the president of the Indian National Congress as a trustee and empowers the central government to remove nominated members. Introduced in Lok Sabha on July 8, 2019, and passed by the Lok Sabha on August 2. The Dam Safety Bill, 2019 As the country suffered through many floods this year, the bill intends to manage its dams better. The Bill provides for the surveillance, inspection, operation and maintenance of specified dams across the country. It was introduced in the Lok Sabha on July 29, 2019 and passed by it on August 2. The Inter-State River Water Disputes (Amendment) Bill, 2019 It provides for a permanent tribunal with multiple benches and a Dispute Resolution Committee for adjudication of inter-state river water disputes. It was introduced in the Lok Sabha on July 25, 2019 and passed by the Lok Sabha on July 31. The Arms (Amendment) Bill, 2019- Amends the <keyword id="7183713" type="UNKNOWN" weightage="20" keywordseo="Arms-Act-1959">Arms Act, 1959</keyword> to enable the law enforcement machinery to curb crimes related to illegal arms. The Assisted Reproductive Technology (Regulation) Bill, 2019 Establishes the National Board, the state boards and the National Registry to regulate and supervise assisted reproductive technology clinics. Establishes assisted reproductive technology banks to prevent misuse and promote ethical practices. The Aircraft (Amendment) Bill, 2019 The bill intends to meet the recommended standards and practices laid down by ICAO for the safety and security oversight function. The Mines and Minerals (Development and Regulations) Amendment Bill, 2019 Amends section 5(1), section 6(1), and section 17A (2A) of MMDR Act, 1957 to remove the requirement of prior approval of the central government before the grant of a mining lease. The National River Ganga (Rejuvenation, Protection and Management) Bill, 2019 It prescribes measures to prevent, control and abate pollution in the river Ganga and ensure its continuous and adequate flow.

<ul><li>Prime Minister Narendra Modi addressed the nation late last evening on the Kashmir issue, but didn’t mention when the curfew would be uplifted. </li><li>Kashmiris continue to live in curfew, with no internet, no calls. </li><li>The UN Secretary General too has expressed his concern about the worsening of human rights in <keyword id="23412" type="CITY" weightage="20" keywordseo="Jammu-Kashmir">Jammu &amp; Kashmir</keyword>.</li></ul>For the last five days, Indians have been arguing, joking and debating the abrogation of Article 370, resulting in endless calls, and social media messages. But those who should have had a say in the matter, Kashmiris, are silent. Because, they have been silenced. The Union Home Minister Amit Shah announced in the Rajya Sabha that Article 370 is scrapped. And Kashmir has been on lockdown a day before the announcement, which is August 4. Since Sunday night, internet services have been suspended in Jammu &amp; Kashmir, with a curfew in place since Monday morning (August 5). And, Prime Minister Narendra Modi made no announcement on lifting it in an address to the nation <a href="https://www.businessinsider.in/narendra-modi-address-to-the-nation-live-updates-and-speech-highlights-on-kashmir-news/articleshow/70589852.cms">yesterday</a>, even as he doled out infrastructure and industry benefits. Modi however did promise that he would facilitate Eid celebration. But he did not say how, as the status quo remains in the valley. He did not speak about the communications blackout and transportation issues in the newly formed union territories. This is the case even as Muslims across the country are gearing up to celebrate Eid on August 12. Kashmiris are still not sure about their fate. Social media is filled with messages and pleas from Kashmiris living outside of Jammu &amp; Kashmir hoping for the safety of their family back home. Screenshots of messages are doing the rounds of students and professionals trying to reach out to their parents, but have no response. But the new found constitutional status is not on top of the minds of Kashmiris. A <a href="https://www.indiatoday.in/mail-today/story/kashmir-article-370-revoked-valley-faces-shortage-essential-items-due-curfew-1578458-2019-08-08">shortage of food</a> and other necessities is beginning to worry them as the curfew prevails. Reports say that people are unable to communicate with their neighbours as well. Over a 100 people have been arrested so far. That includes former chief ministers like Mehbooba Mufti, Omar Abdullah as well as Jammu and Kashmir People's Conference leaders Sajjad Lone and Imran Ansari. There is no word from the government on when they would be released, either. António Guterres, the UN Secretary General expressed his concerns over the plight of Kashmiris. A statement released on Thursday by the UN said, “The Secretary-General is also concerned overreports of restrictions on the Indian-side of Kashmir, which could exacerbate the human rights situation in the region.”

Although the <keyword id="42498" type="COMPANY" weightage="100" keywordseo="RSS">RSS</keyword> wants <keyword id="405091" type="UNKNOWN" weightage="100" keywordseo="Article-370">Article 370</keyword> to be abolished, it is not in a hurry and wants a debate on the issue. As per media reports, RSS said debates and discussions are healthy signs in a democracy. 
 
Interestingly, Abrogation of Article 370 and construction of Ram Temple in Ayodhya featured in BJP’s election manifesto. 
 Reacting to <keyword id="17605" type="UNKNOWN" weightage="100" keywordseo="Jammu-and-kashmir">Jammu and Kashmir</keyword> Chief Minister Omar Abdullah's statement that the state will not remain part of the country if Article 370 is scrapped, RSS leader Ram Madhav said, “The state will always be an integral part of India, with or without the provision.” 
 
"J&amp;K won't be part of India? Is Omar thinking it is his parental estate? 370 or no 370, J&amp;K has been and will always be an integral part of India," Madhav said on Twitter. 
 
The controversy cropped up after Jitender Singh, an MP from Jammu and MoS in the Prime Minister's Office, said the process of repealing Article 370 had started and discussions were being held with he ‘stakeholders concerned.’ 
 RSS ideologue MG Vaidya said <keyword id="6354477" type="PERSON" weightage="100" keywordseo="Narendra-Modi">Narendra Modi</keyword> had called for a debate on Article 370 in his election campaign in Jammu and its relevance should be discussed. 
 
"The IAS and IPS officers are working in the valley. Moreover, the verdict of the Jammu &amp; Kashmir Assembly can be challenged before the Supreme Court of the country and the Union Government can impose President's rule if such a situation arises," he said.

RSS Not In A Hurry To Abolish Article 370

And we have the dates now for the grand finale: June 4! The Election Commission of India on Saturday announced the dates for the general elections to be held from April 19 to June 1 in seven phases. Chief Election Commissioner <keyword id="20110344" type="General" weightage="20" keywordseo="rajiv-kumar" source="keywords">Rajiv Kumar</keyword> announced today that the results will be announced on June 4. Phase 1 voting will be held on April 19, Phase 2 on April 26, Phase 3 on May 7, Phase 4 on May 13, Phase 5 on May 20, Phase 6 on May 25, and Phase 7 on June 1. “We will take democracy to every corner of the country. As the tenure of Andhra Pradesh, Sikkim, Arunachal Pradesh, and Odisha assemblies will also end in June, these states will get an early taste of the ‘one nation, one election’ process, wherein voters will be casting votes for both Lok Sabha and assembly elections. <cmsannotation type="cmsannotation" annotationid="subhead" text="Model code of conduct kicks in">Model code of conduct kicks in</cmsannotation> With the announcement of election dates, the model code of conduct comes into immediate effect. Chief Election Commissioner Rajiv Kumar asked all political parties and their leaders to strictly adhere to the poll code. The Model Code of Conduct (MCC) mandates that no party or candidate shall indulge in any activity which may aggravate existing differences, create mutual hatred or cause tension between different castes and communities, religious or linguistic, according to the set of guidelines issued by the EC. It lists out the dos and don'ts regarding general conduct, meetings, processions, conduct of parties and their candidates on polling day, polling booth, observers, party in power and guidelines on election manifestos. According to the guidelines, all parties and candidates shall avoid scrupulously all activities which are "corrupt practices" and offences under the election law, such as bribing of voters, intimidation of voters, impersonation of voters, canvassing within 100 meters of polling stations, holding public meetings during the period of 48 hours ending with the hour fixed for the close of the poll, and the transport and conveyance of voters to and from the polling station. Political parties and candidates shall ensure that their supporters do not create obstructions in or break up meetings and processions organized by other parties. As soon as the poll code comes into effect, the party in power be it at the Centre or in the State or states concerned, shall ensure that no cause is given for any complaint that it has used its official position for the purposes of its election campaign. <cmsannotation type="cmsannotation" annotationid="subhead" text="Major players and issues">Major players and issues</cmsannotation> Undoubtedly, the scale and magnitude of a nationwide election in a country like India involve numerous complex considerations. In a letter to the citizens of India on March 15, the Prime Minister noted, “The trust and support of 140 crore Indians inspires and motivates me. The transformation that has taken place in the lives of the people is the biggest achievement of our government over the last 10 years. These transformative outcomes are the result of the sincere efforts made by a determined government to improve the quality of life for the poor, farmers, youth and women.” BJP is building its campaign by highlighting the welfare schemes of the government, infrastructural development across the country, and the rejuvenation of the country’s cultural heritage. The major opposition party <keyword id="19895371" type="General" weightage="20" keywordseo="congress" source="keywords">Congress</keyword>, on the other hand, is banking on its <keyword id="20366194" type="General" weightage="20" keywordseo="nyay" source="keywords">Nyay</keyword> guarantees to woo voters. The grand old party saw some success in the state elections of Himachal Pradesh, Karnataka and Telangana when it pitched such 'Nyay' guarantees to the people. For the Lok Sabha polls, the party has put forward its 5 guarantees aimed at ensuring justice for youth, farmers, women, labourers, and participatory justice. The INDIA bloc, including the Congress, has been raising the issue of unemployment and rising prices of essential commodities. They have stated repeatedly that the lack of jobs is the single biggest issue and sought to corner the government over the issue. The BJP has hit back citing job growth and a fast-growing economy. Other major poll issues include electoral bonds, abrogation of Article 370, <keyword id="19963301" type="General" weightage="20" keywordseo="caa" source="keywords">CAA</keyword>, Uniform Civil Code, Ayodhya Ram Mandir, farmer protests for legal guarantee of MSP, and the Viksit Bharat vision of the government. New Delhi, Feb 1 (PTI) The Union Territory of Jammu and Kashmir was on Tuesday allocated Rs 35,581.44 crore in the Budget 2022-23 as part of the central government's assistance, grants and loans. The erstwhile state of Jammu and Kashmir was bifurcated on August 5, 2019 into two UTs - Jammu and Kashmir and Ladakh -- following the abrogation of Article 370. Both the UTs are currently under central rule. While Jammu and Kashmir has been given Rs 35,581.44 crore for 2022-23, compared to Rs 34,704.46 crore in 2021-22, Ladakh has been given Rs 5,958, the same as in the current fiscal. The bulk of the funds - Rs 33,923 crore- in the budget for Jammu and Kashmir is under central assistance. A sum of Rs 273 crore has been allocated as grants towards rehabilitation of Dal Nageen lake and Rs 279 crore has been given as grants towards contribution to UT Disaster Response Fund. The budget allocated Rs 500 crore as support for capital expenditure of UT, Rs 476.44 crore has been given as grants towards equity for Ratle 800 MW hydroelectric project and Rs 130 crore has been given as grants towards equity contribution for 624 MW Kiru hydroelectric project. Among other UTs, Andaman and Nicobar Islands got Rs 5,703.65 crore compared to Rs 5,923.64 crore in 2021-22. Lakshadweep has been allocated Rs 1,394.75 crore. The figure was Rs 1,296.26 crore in the current fiscal. Chandigarh has been allocated Rs 4,846.79 crore compared to Rs 4,428.25 given in 2021-22. Dadra and Nagar Haveli and Daman and Diu has been given Rs 2,374.10 crore. It was Rs 2,312.80 crore in the current fiscal. The budget has also earmarked Rs 1,168 crore as transfers to Delhi, a UT.
