The UK Supreme Court on Thursday denied fugitive diamantaire <keyword id="571991" type="General" weightage="80" keywordseo="nirav-modi" source="Orion">Nirav Modi</keyword>'s plea against his extradition to <keyword id="3658" type="General" weightage="80" keywordseo="india" source="Orion">India</keyword>. Modi lost the bid to take his fight against extradition to India on charges of fraud and money laundering to the UK's Supreme Court. "The appellant's application for permission to appeal to the Supreme Court is refused," Lord justice Stuart Smith said in his statement. The diamantaire, who fled India in 2018 before details of his alleged involvement in large-scale fraud at the Punjab National Bank became public, has argued there is a high risk of suicide if he is extradited. In November, <keyword id="740578" type="General" weightage="100" keywordseo="nirav" source="Orion">Nirav</keyword> Modi filed an application before the UK High Court for permission to appeal against his extradition to India in the UK Supreme Court. He lost the appeal on Thursday to take his fight against extradition to the UK Supreme Court. Nirav Modi reportedly filed an application in the High Court in London, seeking permission to appeal against his extradition order, two weeks after a UK court dismissed his plea against extradition back to India. On November 9, Nirav Modi lost his appeal against extradition to India with a United Kingdom court dismissing his plea. Earlier, the High Court of London (United Kingdom) dismissed the appeal of Nirav Modi, who is wanted in India to face money laundering and fraud cases. The Ministry of External Affairs (MEA) later welcomed the UK High Court's decision to reject Nirav's plea. "India has been vigorously pursuing the extradition of economic fugitives so that they face justice in India. We welcome the decision of the UK High Court. We want to bring him to India as soon as possible," said MEA spokesperson Arindam Bagchi during a press conference. Nirav Modi, who is a prime accused in the Rs 13,500 crore PNB scam, had fled India. He lost his appeal after he had moved the High Court in London against extradition on mental health grounds. The bench of Justice Stuart Smith and Justice Robert Jay of the High Court said there are "no features of psychotic illness". The court rejected Nirav Modi's counsel's claims that he will die by suicide due to severe depression and said "Nirav Modi neither is nor is very likely to be at the most severe end of the scale of depressive illness". "He has so far displayed no features of psychotic illness. Although he has exhibited persistent suicidal ideation, he has neither attempted suicide or deliberate self-harm nor disclosed plans to do so, except in the vaguest and general way," the court said. The High Court also noted the steps taken to render Barrack 12 safe and to ensure that there is effective constant monitoring to reduce both the risk of attempted suicide and the prospect of suicide being committed. The court noted that the Government of India sought the appellant, Nirav Deepak Modi. Nirav Modi last year had moved the UK High Court against District Judge Sam Goozee's Westminster Magistrate Court ruling in favour of his extradition. He is presently behind bars at Wandsworth Prison in southeast London. Fugitive diamantaire Nirav Modi loses bid in UK court against extradition to India

Fugitive diamond merchant <keyword id="571991" type="General" weightage="100" keywordseo="nirav-modi" source="Orion">Nirav Modi</keyword> has filed an application in the <keyword id="6355392" type="General" weightage="80" keywordseo="high-court" source="Orion">High Court</keyword> in London, seeking permission to appeal against his extradition order in the Supreme Court. The 51-year-old diamantaire lost an appeal on mental health grounds earlier this month, when a two-judge High Court bench ruled that his risk of suicide was not such that it would be either unjust or oppressive to extradite him to India to face charges of fraud and money laundering in the estimated USD 2 billion Punjab National Bank (PNB) loan scam case. Nirav, who remains behind bars at Wandsworth Prison in London, had two weeks to file an application seeking an appeal on the grounds of a point of law of general public importance, which according to experts is a high threshold that is not met very often. It is unknown if and when extradition may take place as Nirav Modi still has legal challenges open to him, UK Home Office sources said. The Crown Prosecution Service (CPS), acting on behalf of the Indian authorities, is now expected to respond to the latest application, following which a High Court judge is to give a ruling on paper without a full hearing. The entire process may eventually fall into the New Year, given the Christmas holiday period next month. On November 9, Lord Justice Jeremy Stuart-Smith and Justice Robert Jay who had presided over the appeal at the Royal Courts of Justice in London ruled that they were "far from satisfied that Mr Modi's mental condition and the risk of suicide are such that it would be either unjust or oppressive to extradite him". Their verdict also found every reason to accept that the government of India (GOI) will treat its assurances on Nirav's medical care at Barrack 12 of Arthur Road Jail in Mumbai with "appropriate seriousness". "On the basis of the assurances that the GoI has given, we accept that there will be suitable medical provision and an appropriate plan in place for the management and medical care of Mr Modi, which will be provided in the knowledge that he is a suicide risk (i.e. a person who, in the absence of preventative measures, may or will attempt suicide and will or may succeed)," the judgment read. If his attempt to have his appeal heard in the Supreme Court fails, in principle, Nirav Modi can apply to the European Court of Human Rights (ECHR) to try and block his extradition on the basis that he will not receive a fair trial and that he will be detained in conditions that breach Article 3 of the European Convention on Human Rights, to which the UK is a signatory. The threshold for an ECHR appeal is also extremely high because he would also have to demonstrate that his arguments on those grounds before the UK courts have been previously rejected. The dismissal of the High Court appeal earlier this month marked a major win for the Central Bureau of Investigation (<keyword id="6354572" type="General" weightage="80" keywordseo="cbi" source="Orion">CBI</keyword>) and Enforcement Directorate (ED) case against the businessman, who has been in prison since his arrest on an extradition warrant in March 2019. The latest High Court ruling noted three sets of criminal proceedings against the diamantaire in India the CBI case of fraud on the PNB which caused losses equivalent to over GBP 700 million, the ED case relating to the alleged laundering of the proceeds of that fraud and a third set of criminal proceedings involving alleged interference with evidence and witnesses in the CBI proceedings. Then UK Home Secretary, Priti Patel, had ordered Nirav's extradition based on Judge Sam Goozee's Westminster Magistrates' Court ruling in April 2021 and the case has been undergoing an appeals process since then. Pune, May 17 () Authorities in Maharashtra havereleased over 7,200 prisoners so far to check overcrowding injails amid the coronavirus pandemic, officials said on Sunday.Around 10000 more will be released shortly, they said.In a bid to decongest state jails due to coronavirusoutbreak, the state prisons department has so far releasedover 7,200 prisoners across the state on either temporary bailor parole, an official said.Following the Supreme Court directives to states andUnion territories to set up a panel to consider the release ofprisoners on parole to avoid overcrowding in jails to checkthe spread of coronavirus, the state government had said thataround 11,000 prisoners in Maharashtra, whose sentence periodis less than seven years, would be released temporarily."The pre-lockdown population in the 60 prisons acrossthe state was over 35000 and so far we have released over7200inmates temporarily to decongest the jails," an officialfrom the prisons department told .In all, around 17000 jail inmates would be released ontemporary bail or parole, he said.A high-powered committee appointed by the stategovernment recently decided to release 50 per cent prisonersfrom various jails across the states and this figure is around17000, he said. The committee's decision came after over 100 inmatesand staff of central Mumbai's Arthur Road Jail tested positivefor COVID-19.The pre-lockdown population of Arthur Road Jail was2300, of which around 700 prisoners were released, he said.There are 1572 inmates in the jail now, he added. COVID-19: Maha releases 7,200 prisoners to curb overcrowding

New Delhi, May 9 () Prominent Muslim body Jamiat Ulema-e-Hind on Saturday said it will approach the Supreme Court seeking conditional bail or parole to eligible prisoners lodged in jails across India in the wake of the coronavirus pandemic. Jamiat Ulema-e-Hind president Maulana Arshad Madani said the Supreme Court had taken suo motu cognizance of the matter in March and asked all state governments to set up a committee to consider bail or parole to inmates in jail on humanitarian grounds, but so far many state governments have not taken action on this. The health department has directed that social distancing is the only effective way to prevent the spread of the novel coronavirus, but it is impossible to do so in prisons as they have more prisoners than their prescribed capacity, he said in a statement. He said the Jamiat will file a plea in the Supreme Court in this regard. Citing the example of Mumbai's Arthur Road Jail, Madani said the families of inmates and officials are worried after many of them tested positive for COVID-19. According to information, around 103 inmates and officials who tested positive for COVID-19 are being treated at different hospitals in the city, he said. The Arthur Road Jail has a capacity of around 800 inmates, but about 2,600 prisoners are currently lodged in the prison, Madani said. The Supreme Court in its order of March 23 had directed the states and union territories to constitute high-powered committees which could decide which prisoners may be released on interim bail or parole during the pandemic. The court has said that the purpose of the order was to prevent overcrowding of prisons so that in case of an outbreak of coronavirus in the prisons, the spread of the disease is manageable. ASK SMN

Mumbai, May 8 () The Bombay High Court on Fridayrejected temporary bail to Hemant Bhatt, an accused in themulti-crore Punjab National Bank (PNB) scam, after noting thatthe 66-year-old has tested positive for novel coronavirus atArthur Road jail in central Mumbai.Justice Bharati Dangre rejected Bhatt's plea after theprosecution told the court that a COVID-19 patient cannot beallowed to be freed on temporary bail.The court said jail authorities shall provide allmedical facilities to Bhatt.Bhatt had, last month, approached HC seeking temporarybail on the ground that he is a senior citizen with chronicheart ailment and, hence, there was a risk of being infectedwith coronavirus.The court had on May 6, while hearing Bhatt'sapplication, directed the police to inform the court about thesituation at Arthur Road prison.Additional public prosecutor Shahaji Shinde, onFriday, informed the court that a number of inmates at ArthurRoad prison and some staff members had tested positive forcoronavirus, and Bhatt was one of them.Bhatt, an authorised signatory in diamond businessmanand fugitive economic offender Nirav Modi's company, has beenbooked by CBI on charges of cheating and fraud in connectionwith the PNB scam.He is also facing money laundering charges initiatedby Enforcement Directorate. Virus: HC rejects bail of PNB scam accused who tested positive

New Delhi, May 14 () The NHRC has sent notices to the Maharashtra government and the chief of state prisons over allegations of wrong interpretation of a Supreme Court order on releasing prisoners in the wake of the COVID-19 pandemic, officials said on Thursday.The notices have been sent based on a complaint filed by the commission's Prison Monitor Maja Daruwala."The National Human Rights Commission (NHRC) has taken cognisance of a complaint that the government of Maharashtra has adopted an inappropriate approach about the release of prisoners, which may lead to infecting many prisoners with COVID-19," the NHRC said in a statement.The policy allegedly adopted by the Maharashtra government to decongest jails has arisen due to "misinterpretation of directions" given by the Supreme Court in the matter, the rights panel said.It said, allegedly, of the random tests conducted on 144 prisoners in the Arthur Road Jail, 103 were found positive, including 26 members of the staff. The complainant has requested for the intervention of the commission to ensure the well-being of prisoners. Several suggestions have been given in her communication, the NHRC said.The commission has observed that it is aware of the fact that in many jails, prisoners as well as staff members have fallen prey to the COVID-19 due to overcrowding, lack of manpower and medical facilities.The NHRC said, accordingly, it has sent a copy of the complaint to the chief secretary and the DG (Prisons), Maharashtra, seeking a detail report within four weeks.The report should be submitted to the commission in a format giving details of all the jails in the state, mentioning capacity of the jail, number of prisoners presently lodged, number of prisoners found positive for COVID-19, number of prisoners kept under quarantine, number of prisoners who have died due to COVID-19 and steps being taken by the state prison authority to ensure safety of prisoners and the personnel working in jails.According to the complaint, the Supreme Court had directed all states and union territories to constitute a high-powered committee to decide which class of prisoners will be released in order to decongest jails by way of bail or parole. The directions have been given due to spread of COVID-19 inside various jails and to maintain social distancing, at the maximum, as per the complaint.It is mentioned in the complaint that 60 jails in the state of Maharahstra have 36,000 inmates against the available capacity of 24,095. Only, the Yerawada Central Prison in Pune which is one of the largest prisons of the state, houses over 6,000 inmates against available capacity of 2,500. It is also mentioned that a large number of posts are lying vacant in these prisons, including medical staff. COVID-19: NHRC notice to Maha over 'wrong interpretation' of SC order on releasing prisoners

Mumbai, Jun 10 () The Bombay High Court has sought details from the Maharashtra government about the health condition of HDIL promoters Rakesh Wadhawan and Sarang Wadhawan, arrested on charges of money laundering in the multi-crore PMC Bank fraud case. The court has also asked in which barrack of the Mumbai-based Arthur Road prison they are lodged. Justice Bharati Dangre was on Tuesday hearing petitions filed byHousing Development and Infrastructure Ltd (HDIL) promoters Rakesh Wadhawan and his son Sarang Wadhawan, seeking bail on medical grounds. The petitioners also claimed that there are no proper facilities in the jail in view of the COVID-19 outbreak. Apart from Wadhawans' medical condition and barrack details, Justice Dangre also asked the state government what steps it has taken to prevent the spread of COVID-19 among prisoners. The prosecution shall ascertain the position regarding the applicants (Rakesh and Sarang) with regard to their medical condition, their placement in the barracks and also steps taken to keep the prisoners free from the COVID-19 pandemic, the court said. It has posted the bail pleas for further hearing on June 12. The fraud at the Punjab and Maharashtra Cooperative (PMC) Bank came to light in September 2019 after the Reserve Bank of India found that the PMC Bank had allegedly created fictitious accounts to hide over Rs 4,355 crore of loans extended to the almost-bankrupt HDIL. According to RBI, the PMC Bank masked 44 problematic loan accounts, including of HDIL, by allegedly tampering with its core banking system, and the accounts were accessible only to limited staff members. Mumbai, May 12 () The Maharashtra government andthe Brihanmumbai Municipal Corporation (BMC) told the BombayHigh Court on Tuesday that they will inform the court byFriday whether vacant tenements in Mahul in suburban Chemburwill be used for quarantining suspected COVID-19 patients,including inmates of Arthur Road jail.The authorities made the submission before a bench ofChief Justice Dipankar Datta and Justice Amjad Sayed via videoconferencing.The bench was hearing a public interest litigationfiled by Sharda Tevar, the mother of an undertrial at ArthurRoad prison, and by NGO Ghar Bachao Ghar Banao Andolan.The petitioners, through advocate Ronita Bector,submitted that as per news reports, state authorities werecontemplating using two buildings in Mahul as quarantinefacilities.However, all buildings in the said area, built forrehabilitating those whose homes were affected by various BMCdevelopment projects, have been considered uninhabitable byBombay HC and NGT previously."We told HC that these buildings were consideredunsafe by the Supreme Court too due to the toxic pollution inthe area because of refineries and industries. Now if suchpeople who are suspected to or are suffering from COVID-19 arebrought to such an area that is heavily polluted and posesfurther health risks, then the very purpose of quarantine getsdefeated," Bector said."Also, as COVID-19 patients have severe respiratorydiseases it would be improper to quarantine them in Mahul,"she said.As per the petition, Mahul is a heavily industrializedbelt and home to refineries of Hindustan Petroleum CorporationLimited, Bharat Petroleum Corporation Limited, RashtriyaChemicals and Fertilisers, and Bhabha Atomic Research Centre.The HC, on September 23 last year, stopped projectaffected persons from being rehabilitated in these buildings.Bector also told the court that some news reports haveclaimed that the state government had temporarily rescindedits decision and, hence, it must issue a clarification on thesame.Government pleader Poornima Kantharia and senioradvocate Anil Sakhare, for BMC, sought time to takeinstructions and inform the court at the next hearing on May15. Peter Mukerjea released from jail After spending more than four years behind the bars, former media baron Peter Mukerjea was released from the Arthur Road Jail on Friday. He was arrested on November 25, 2015 by the CBI in relation to the murder of his wife Indrani Mukerjea’s daughter, Sheena Bora. The Bombay High Court granted Mukerjea bail in February but stayed the order for six weeks so the Central Bureau of Investigation could file an appeal. The stay ended on Thursday and the CBI did not file an appeal in the Supreme Court. Rana Kapoor sent to judicial custody The founder of the now-troubled Yes Bank Rana Kapoor was sent to judicial custody by the Mumbai High Court in connection with the Dewan Housing Finance Ltd (DHFL) scam, on Friday. The Enforcement Directorate (ED) claims that Yes Bank gave loans of ₹30,000 crore out of which loans worth ₹20,000 crore became bad, during Kapoor’s tenure. The ED accuses that Kapoor and his family received ₹4,300 crore as kickbacks for granting these loans. Kapoor has been sent to judicial custody to Taloja jail in Navi Mumbai, till April 2. The CBI is also in the process of seeking his custody, so he might end up behind the bars for longer. Tamil actor, writer and director Visu passes away Popular Tamil actor and director M.R. Viswanathan, fondly known as Visu, passed away in Chennai on Sunday. The 75-year-old actor had a cardiac arrest, following which he was rushed to a hospital. Visu’s daughter, Lavanya said, “He passed away shortly after. The funeral will be held on Monday.” He was reportedly suffering from kidney-related ailments for the past couple of years. His mortal remains have been brought to his residence in Thoraipakkam. The final rites will take place at Besant Nagar crematorium at 4PM today.
