Only yesterday, the apex court ruled that the Aadhaar Card is not mandatory to get government benefits and services. The interim order was passed after a retired judge of the Karnataka High Court filed public interest litigation (PIL) as some of the state governments like Maharashtra are mandating the Aadhaar Card as a compulsory requirement without the Parliamentary sanction. 
 The National Identity Authority of India Bill was introduced in 2010 but it was rejected by the <keyword id="61249" type="ORGANIZATION" weightage="40" keywordseo="Parliamentary-Standing-Committee">Parliamentary Standing Committee</keyword> a year later. Till date, our understanding has been that Aadhaar is voluntary in nature and has a different purpose altogether. So the sudden attempt at the Orwellian-style imposition is a bit scary. After all, many of us already have Voter ID cards, PAN cards, passports and driving licences. So why do we need yet another compulsory validation? Aadhaar should be the prerogative of the under-served India living on the edge while the rest of the country can adopt it at its own pace. The macro vision should not be lost either – we need a nationwide social security network and unique identity numbers must be generated to leverage its benefits. 
 Launched by the <keyword id="86474" type="ORGANIZATION" weightage="100" keywordseo="Unique-Identification-Authority-of-India">Unique Identification Authority of India</keyword> (<keyword id="6355252" type="CITY" weightage="100" keywordseo="UIDAI">UIDAI</keyword>), the chief purpose of the Aadhaar scheme is to ensure a broad <keyword id="621722" type="UNKNOWN" weightage="80" keywordseo="economic-inclusion">economic inclusion</keyword>, not enjoyed by millions. Considering the vast Indian population outside the immediate administrative radar and living below the poverty line, it makes sense to have an all-purpose identity proof – a pass key to the direct benefits transfer (DBT) scheme. According to the central government, Aadhaar has been launched to “promote inclusion and benefits of the marginalised sections of the society that has no formal identity proof” and <keyword id="1878763" type="UNKNOWN" weightage="100" keywordseo="Aadhaar-enabled-service-delivery">Aadhaar-enabled service delivery</keyword> is linked to various government schemes such as scholarship, pension, janani suraksha yojana, payment of social security benefits, distribution of LPG subsidy and more. But we have not progressed very far as things can only move slowly in a vast and thickly populated country like India. Once the permanent enrolment centres come up all over the country, the ‘inclusion’ will happen fast. 
 But there is another hitch. The Supreme Court is of the opinion that the use of Aadhaar should not be made mandatory as <keyword id="109240" type="PERSON" weightage="60" keywordseo="illegal-immigrants">illegal immigrants</keyword> may leverage it to legitimise their status. Here is one observation, though. Aadhaar is just an identity proof, not a citizenship proof like a <keyword id="661164" type="UNKNOWN" weightage="60" keywordseo="voter-ID-card">Voter ID card</keyword>. So when the Aadhaar mapping is completed, a second and more stringent level of scrutiny should weed out that problem. 
 
However, one must remember that the consent of an individual is indispensable for Aadhaar. Unlike a Voter ID or a PAN card, one is under no legal obligation to get an Aadhaar Card. Therefore, the sudden and forceful implementation may actually violate one’s Fundamental Rights. Also, a lot of people don’t want to opt for it as they are not too sure if their biometric data (required for Aadhaar Card) will be secure with third party service providers. So the best way ahead will be priority-based adoption and gradual inclusion of the entire country. But how long it will take to reach that goal is anybody’s guess.

<ul><li>The Unique Identification Authority of India (UIDAI) has scrapped its plan to monitor and track citizens on social media — and has no plans of doing so in the future.</li><li>A tender floated by UIDAI in July 2018 invited social media agencies to employ a ‘social listening tool’ to monitor and address ‘negative sentiments’.</li><li>The proposal undermined Aadhar’s sole purpose of accommodating social welfare has been accused of violating the fundamental rights to privacy, freedom of speech, liberty and equality.</li></ul>The Unique Identification Authority of India (<a href="https://www.businessinsider.in/indian-government-portal-leaks-8-9mn-aadhaar-details-again/articleshow/63924186.cms">UIDAI</a>), which manages the biometric identities of <a href="https://www.businessinsider.in/nine-years-later-80-of-indians-are-still-not-convinced-the-worlds-largest-biometric-id-system-is-secure/articleshow/64406235.cms">more than a billion Indians</a>, is going back on its plan to monitor social media — for good. The Attorney General told the Supreme Court that UIDAI is withdrawing its tender and won’t be floating anything along the same lines in the future, according to <a href="https://barandbench.com/social-media-monitoring-tender-for-monitoring-agency-withdrawn-uidai-to-supreme-court/">Bar&amp;Bench</a>. The <a href="https://uidai.gov.in/images/tenders/RFPSocialMediaHQ-18072018.pdf">tender</a>, issued in July 2018, invited companies to help the apex agency employ a ‘social listening tool’ to track and monitor online conversations relating to Aadhaar. It was floated as UIDAI looking for a social media agency to manage its online platforms. The tender was then accused of violating the constitutional rights to privacy, equality, personal liberty and the freedom of speech. Here are all the reasons why it was a good call for UIDAI backtrack on its plan:

However, it added the government can surely make it mandatory for <a href="http://www.businessinsider.in/6-things-for-which-Aadhaar-card-is-mandatory-now/articleshow/57791987.cms">other things</a> like opening bank accounts. The <keyword id="6356229" type="ORGANIZATION" weightage="20" keywordseo="apex-court">Apex Court</keyword> said a seven-judge bench needs to be set up to hear the pleas challenging Aadhaar, and also that it is not possible as of now.

The government has, on its part, already said nobody will be deprived of benefits due to lack of an Aadhaar card, since they can use alternate means of identification to receive benefits until an Aadhaar number is assigned.

In October 2015, SC had lifted its earlier restrictions and permitted the voluntary use of Aadhaar cards for welfare schemes like MGNREGA, all pension schemes, the provident fund and flagship programmes like the '<a href="http://www.businessinsider.in/shocking-rs-74610-croredeposited-in-jan-dhan-accounts-after-note-ban/articleshow/56850719.cms">Pradhan Mantri Jan Dhan Yojna</a>' of the NDA government, along with LPG and PDS schemes. 
 
There has been criticism about making Aadhaar cards mandatory, since <a href="http://www.businessinsider.in/latest/database-completely-secure-uidai-assures/articleshow/57490909.cms">UIDAI</a> is said to be getting biometric details through private agencies, thus violating citizens' fundamental rights.

This, along with the lack of option of manual editing, has left millions of Indians confused, given that systems are rejecting the matching of mismatched details. 
 
K Venkatesh, a Chennai-based banker, has the initial of his father’s name in his PAN card; however, his <a href="http://www.businessinsider.in/6-things-for-which-Aadhaar-card-is-mandatory-now/articleshow/57791987.cms">Aadhaar card </a>lists his full name as Krishnaswamy Venkatesh. When he tried to link, the the system rejected the 'mismatch'.

Similarly, people that have special characters such as an apostrophe in their surnames, like D'Silva, D’Costa etc., along with people who have full stops between their initials in either their PAN cards or Aadhaar cards are also left with no option. 
 
The deadline of linking both accounts is July 31, after which defaulters would not be able to <a href="http://www.businessinsider.in/finance/keep-your-aadhaar-number-ready-while-filing-income-tax-return/articleshow/57777330.cms">file tax returns</a>. However, this confusion has left lawyers and CAs demanding enabling manual intervention, especially for such minor discrepancies.

Systems reject matching PAN cards initials with Aadhaar database

At the beginning of 2018, the <keyword id="86474" type="ORGANIZATION" weightage="20" keywordseo="Unique-Identification-Authority-of-India">Unique Identification Authority of India</keyword> (UIDAI) declared that the individual <keyword id="144117" type="LOCATION" weightage="20" keywordseo="AADHAAR">Aadhaar</keyword> card details of Indians were <a href="https://economictimes.indiatimes.com/news/politics-and-nation/aadhaar-data-is-fully-safe-uidai/articleshow/61725239.cms">“fully safe and secure”</a>. The statement was a response to reports that 210 government-run websites had made Aadhaar info and bank details of a number of people public. To confirm their belief, UIDAI added that the Aadhaar card details of a person couldn’t be misused without their biometric data as transactions could only be processed after biometric authentication. Five months later, the UIDAI’s statement rings false in more ways than one. A <a href="http://www.indiaspend.com/cover-story/164-aadhaar-related-frauds-reported-since-2011-most-in-2018-new-database-81967">report in IndiaSpend</a> highlights the fact that the number of Aadhaar-related <keyword id="38935" type="PERSON" weightage="20" keywordseo="Fraud">fraud</keyword> incidents reported in the English-language media outlets in the year so far (as of 7 May) is 73. This has already surpassed the total of 65 incidents reported in 2017. This means that there are roughly four incidents of Aadhaar fraud that are reported by English news outlets every week. The number would likely be much higher if Hindi and regional language media outlets were taken into account. Further still we must also account for the fact that a lot of incidents involving fraud go unreported. A total of 164 cases of fraud have been reported since the scheme’s launch in September 2011 that currently has around 1.2 billion people currently enrolled. Nature of fraud The incidents mainly involve the forgery, counterfeiting and outright theft of Aadhaar card information for a variety of reasons - purchasing SIM cards, securing loans, transferring assets, and receiving handouts from the government. Around 52 out of the 73 cases recorded as of May 2018 centre on the use of fake or forged Aadhaar card information or the use of fake details to get an Aadhaar card. The remainder involve the use of stolen or fake Aadhaar card data in banking transactions. For example, in March, an investigation by the Mumbai police uncovered the opening of <a href="https://www.hindustantimes.com/mumbai-news/40-bank-accounts-opened-using-forged-documents-in-mumbai-used-for-export-import-business/story-7JpH2wGBI4SwlIBnmhBdcL.html">around 40 bank accounts </a>with stolen Aadhaar card details. The accounts were opened for the purpose of financing an import-export business. Lack of awareness A significant portion of these frauds is due to the lack of awareness people have regarding their <keyword id="6355135" type="UNKNOWN" weightage="20" keywordseo="Privacy">privacy</keyword> and identity rights. Those enrolled on the Aadhaar scheme aren’t completely aware of what they can and can’t share with third parties and government agencies, as well as all the ways their information can be misused. If it can happen to anyone, people usually assume the odds of it happening to them are very low. Furthermore, the biometric authentication aspect of the programme is itself flawed. As per documents from the <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword>, the UIDAI itself admitted that authentication failure rates for transactions through <a href="https://drive.google.com/file/d/1NfVQfq_dMkXrjD9bQxVAQ51yangsCwo1/view">fingerprints and irises were 6% and 8.5%,</a> respectively. Last month, a 38-day hearing over the privacy and <keyword id="145060" type="ORGANIZATION" weightage="20" keywordseo="data-security">data security</keyword> issues of the Aadhaar scheme came to an end. While a verdict on the constitutional validity of the scheme is expected within the next few months, the Supreme Court did declare that the scheme needed <a href="https://economictimes.indiatimes.com/news/politics-and-nation/aadhaar-lacks-regulatory-oversight-supreme-court/articleshow/64117381.cms">more effective regulatory oversight.</a>

But, if you are planning to use your Aadhaar card for eKYC (electronic know-your-customer), the face-recognition feature will <a href="https://indianexpress.com/article/technology/tech-news-technology/uidai-announces-face-recognition-for-aadhaar-from-september-15-heres-what-to-keep-in-mind-5315844/">start rolling out</a> on September 15, 2018. But, here’s the thing, when the measure was originally proposed in March, the aim was to help people who didn’t have <keyword id="102890" type="PERSON" weightage="20" keywordseo="biometrics">biometrics</keyword> or poor biometrics. In the case of authentication failures and financial exclusion, the purpose of facial recognition was to ensure that people with physical disabilities or leprosy wouldn’t be kept from their pensions and provident funds. That being said, reports indicate that telecom service providers are only the first in line. The plan is for a phased rollout to cover all the other Aadhaar Authentication User Agencies (AUAs), once their devices are ready to accommodate face recognition. According to the nodal agency, the Unique Identification Authority of India (<keyword id="6355252" type="DEFINITION" weightage="20" keywordseo="uidai">UIDAI</keyword>), the face recognition verification has been put in place to curbs incidences of fingerprint spoofing and cloning. They also indicated that the measure will also increase the accountability of telecom service providers by tightening the audit process and overall security around mobile SIMs. How does it work The Aadhaar card face recognition feature basically means that users will have to get their picture clicked when using the Aadhaar card for eKYC. Keep in mind, this doesn’t replace fingerprint or iris verification. Those are still in place, but should verification fail at that level, facial identification will be the second factor of authentication. The telecom companies, in turn, will save those photos on their database and send it across on their registered device for verification against the picture of you on file with the UIDAI. Once that’s done, the telecom service providers will have to save both photos on their database for audit purposes down the line. This isn’t a suggestion, it’s a rule with consequences involved. If the telecom companies fail to do so, UIDAI has issued a circular on the financial disincentives that they will be subject to. However, it still isn’t mandatory to fish out an Aadhaar card for obtaining a SIM. It’s only if you choose to use your Aadhaar for eKYC, that face recognition even comes into the picture. Other forms of identification are still valid as KYC documents. Earlier this year, a <a href="https://www.businessinsider.in/nine-years-later-80-of-indians-are-still-not-convinced-the-worlds-largest-biometric-id-system-is-secure/articleshow/64406235.cms">survey</a> by Velocity MR ascertained that nearly 80% of Indians didn’t trust the Aadhaar card system. While the government has continuously reiterated that the Aadhaar database is safe, the concern isn’t with the central database being secure, but with middleman agencies that don’t keep a tight lid on their security when obtaining Aadhaar details are identification proof.

New Delhi, Nov 14 () The government has eased KYC norms for migrants to open bank account by allowing them to give a self-declared local address as sufficient proof of residence in case it is different from one mentioned in Aadhaar document.
Migrants face difficulties in having proof of residence as address on Aadhaar is different from their current location.
The Department of Revenue on Thursday said its notification is with regard to easing of Aadhaar KYC use for opening of the bank account for the convenience of people who often migrate from place to place for jobs or any other reason.
The changes were made by amending the Prevention of Money-laundering (Maintenance of Records) Rules, as per a gazette notification issued on Wednesday.
This amendment has been issued to allow people who have used Aadhaar KYC to open bank account and want to give an address different from the address in Aadhaar as current address on a self-declaration basis. 
"The amended PMLR applies only to Aadhaar KYC purposes for opening of bank account and not for the change of Address in Aadhaar card. 
"If a person has moved residence for purposes of work and needs to use Aadhaar KYC for opening a new bank account or change his bank branch, etc., he can give a self declaration of new address while retaining the original address on his Aadhaar card," Revenue Secretary Ajay Bhushan Pandey said. 
The PML Rules amendment makes opening bank account easier for individuals who are living in an address different from their address in Aadhaar, he said, adding that people who submitted Aadhaar card with a different address as KYC at banks can now submit local address by providing a self-declaration.
He further said that with this amendment, giving a self-declaration about a local address or any address other than the one on Aadhaar card will be sufficient as address proof to open bank account with Aadhaar KYC. 
This amendment brings in convenience especially for the migrant people. For example, if a migrant worker comes from Jharkhand to Mumbai and his/her Aadhaar has Jharkhand's address, then to open a bank account a self-declaration about his/her local address in Mumbai will be sufficient for Aadhaar KYC.
The change has been made through an amendment in the PML Rules and not by way of amending Aadhaar Act/Regulations and it does not apply to change of address in Aadhaar card. DP NKD CS MKJ

 As per the government's estimates, most social sector schemes suffer from suspect beneficiaries, amounting to 10-15% of the recipients. While subsidies offered by the Centre add up to around 3.5 lakh crore a year, use of <keyword id="546774" type="UNKNOWN" weightage="20" keywordseo="Aadhaar-cards">Aadhaar cards</keyword> can significantly reduce the risk of impersonation, saving 35,000-60,000 crore in all regions, annually. 
 
Banks are stressing on Aadhaar identities for quick verification because they are done with the biometric confirmations, which helps in the reduction of time and costs. Because these cards are linked to governments, banks can easily identify accounts that will receive government assistance so that loan seeker's financial status can be identified. 
 
In the past 6 years, the government has spent 7,100 crore in rolling out the ambitious scheme, which aims at providing every resident an unique identification number. 
 
The initiative was recently applauded by the World Bank, which estimated that it was saving the government about $1 billion (650 crore) annually.
