And, while participating in the world’s largest biometric database is now voluntary to a certain extent, millions of citizens have already enrolled and submitted their authentication details to third parties. That being said, the supreme court has directed <keyword id="6379816" type="UNKNOWN" weightage="20" keywordseo="telecom-operators">telecom operators</keyword> and banks to delete the biometric data that they had collected from their customers so far. It even cited the Department of Telecom’s (DoT) circular on the re-verification of phone numbers with Aadhaar details as unconstitutional.

 Sections struck down The SC removed three sections from the Aadhar Act. Section 33 (2) allowed data to be disclosed in the interest of national security. The government or allied institutions could obtain an individual’s biometric data if they were a suspected as threats. The removal of this section means that are no exceptions to individuals not being forced to disclose their authentication data, which includes their Aadhaar biometrics. Section 47 was a cause of concern because any Aadhaar data breach would only be recognised as a criminal offence if reported by an officer at the Unique Identification Authority of India (UIDAI). With this section off the Aadhaar Act, even individuals have the power to register criminal offences under the legislation. The removal of Section 57 will probably have the impact on day to day life with it no longer being ‘mandatory’ for citizens to share their data with any third-party. Aadhaar is still a valid form of identification, but it’s no longer a prerequisite to obtaining third-party services. Basically, any body, corporate or person is no longer allowed to establish the identity of an individual. Daily hustle However, taxpayers are still going to be need their Aadhaar details to register for a Permanent Account Number (PAN) and file their income tax returns (ITR). But, there’s no longer a need for people to link their Aadhaar cards to their bank accounts. Banks can longer cite Aadhaar as a prerequisite for know-your-customer (KYC) authentication. Telecom operators, no only have to delete all that they’ve been hoarding in the past, but even they can’t push for Aadhaar authentication when issuing SIM cards. In a breath of relief for parents, schools can’t ask for Aadhaar card authentication either. NET, CBSE, and UGC applications no longer need it to appear for their respective examinations. This comes in after NET has been implementing mandatory Aadhaar details, without which the application process wouldn’t be validated. Children will also be exempted from needing a Aadhaar card on all fronts. Public sector schemes will remain accessible to them even without a card. The experts and public seem divided on their opinion about these changes. While some think that it’s a step in the right direction, others believe that the dilution of the Aadhaar Act won’t address its underlying problems of privacy.

What does the supreme court verdict on Aadhaar mean for Indian citizens?

New Delhi, Mar 19 () Biometric identifier Aadhaar has been issued to over 90 per cent of the population as of February-end, Parliament was informed on Thursday. In a written reply in the Rajya Sabha, Minister of State for Electronics and IT Sanjay Dhotre said the UIDAI does not maintain urban/rural bifurcation of the Aadhaar holders, and hence information in this regard is not available. "As on 29 February 2020, Aadhaar has been issued to 90.1 per cent of the population," Dhotre said. The UIDAI also does not collect information about financial position of residents. "In accordance with provision contained in...Aadhaar Act 2016, Unique Identification Authority of India (UIDAI) does not collect information regarding financial status of the resident. Hence, such information is not available," he said. To another question on whether there are instances of states sharing Aadhaar data with private companies for identification of beneficiaries under various welfare schemes, Dhotre said, "No such instance has come to the notice of UIDAI." "Unique Identification Authority of India (UIDAI) data is fully secured/ encrypted at all times that is at rest, in transit and in storage. UIDAI has a well-designed, multi-layer robust security system in place and the same is being constantly upgraded to maintain highest level of data security and integrity," he said. The architecture of Aadhaar ecosystem is geared to ensure security and privacy, which is an integral part of the system from the initial design to the final stage, he said. "Comprehensive Information Security Policy and Procedures are in place which are reviewed and updated regularly, ensuring appropriate monitoring and control on movement of people, material and data in and out of UIDAI premises, particularly the data centres," he said. Security audits are conducted on regular basis, he said, adding that security assurance of Aadhaar ecosystem has been strengthened with Aadhaar and Other Laws (Amendment) Act, 2019, which includes stringent penalties and punishment for offenders. Facial recognition feature was a long time coming with reports of Aadhaar authentication failure in the case of senior citizens or people with physical disabilities. New Delhi, Jan 13 () Artificial intelligence (AI) and machine learning (ML) will be powering the 'cyber war rooms' in organisations to help them protect from increasing cyberattacks, as well as detect, predict and respond to the same, a PwC India and Data Security Council of India (DSCI) study said.
The study titled 'Cyber Security India Market: What lies beneath' also notes that the regulatory landscape for privacy and data protection is expected to reach a tipping point in 2020, forcing Indian organisations to comply with not only global regulations but also with the proposed law on personal data protection, the Aadhaar Act.
"On the flip side, cyber attackers too would be weaponising AI/ML to initiate attacks with record speeds and precision," it said, adding that businesses are expected to adopt tools and solutions embedded with AI/ML capabilities to keep threats and attacks at bay.
As per the study, almost all organisations will increase their expenditure on upgrading their security in their cloud environments because of the uniqueness of the threat actors on these systems.
"Organisations will be concerned to protect their cloud-based infrastructure and invest in people, processes and technology to fortify the layers of cloud-based networks, including insider threats," said the joint study.
Further, there will be increased focus on adopting security operation centres to strengthen breach response capabilities, and organisations will leverage emerging tools and technologies with built-in AI/ML capabilities and regularly practice and refine their breach response plans.
As per the study, organisations will begin to recognise the fact that most of the breaches today start at the endpoint, allowing threat actors to sneak into the company networks.
The number of endpoints (including mobile devices) continues to rise and so does the business data being processed/stored in them.
While threats like mobile malware seem to have a low direct impact on businesses, "we do see an increase in the number of data breaches related to mobile device use and misuse", it added.
Every device used to access company systems is yet another endpoint for the organisation to secure.

Cos likely to extensively use AI to deal with cyberattacks, says study

New Delhi, Nov 14 () The government has eased KYC norms for migrants to open bank account by allowing them to give a self-declared local address as sufficient proof of residence in case it is different from one mentioned in Aadhaar document.
Migrants face difficulties in having proof of residence as address on Aadhaar is different from their current location.
The Department of Revenue on Thursday said its notification is with regard to easing of Aadhaar KYC use for opening of the bank account for the convenience of people who often migrate from place to place for jobs or any other reason.
The changes were made by amending the Prevention of Money-laundering (Maintenance of Records) Rules, as per a gazette notification issued on Wednesday.
This amendment has been issued to allow people who have used Aadhaar KYC to open bank account and want to give an address different from the address in Aadhaar as current address on a self-declaration basis. 
"The amended PMLR applies only to Aadhaar KYC purposes for opening of bank account and not for the change of Address in Aadhaar card. 
"If a person has moved residence for purposes of work and needs to use Aadhaar KYC for opening a new bank account or change his bank branch, etc., he can give a self declaration of new address while retaining the original address on his Aadhaar card," Revenue Secretary Ajay Bhushan Pandey said. 
The PML Rules amendment makes opening bank account easier for individuals who are living in an address different from their address in Aadhaar, he said, adding that people who submitted Aadhaar card with a different address as KYC at banks can now submit local address by providing a self-declaration.
He further said that with this amendment, giving a self-declaration about a local address or any address other than the one on Aadhaar card will be sufficient as address proof to open bank account with Aadhaar KYC. 
This amendment brings in convenience especially for the migrant people. For example, if a migrant worker comes from Jharkhand to Mumbai and his/her Aadhaar has Jharkhand's address, then to open a bank account a self-declaration about his/her local address in Mumbai will be sufficient for Aadhaar KYC.
The change has been made through an amendment in the PML Rules and not by way of amending Aadhaar Act/Regulations and it does not apply to change of address in Aadhaar card. DP NKD CS MKJ

It means that holders of the number may use it voluntarily as an identification proof. The bill laid down several provisions concerning offline verification, amongst others. The Bill was introduced in Lok Sabha on June 24 by Union Minister <keyword id="6354886" type="PERSON" weightage="20" keywordseo="Ravi-Shankar-Prasad">Ravi Shankar Prasad</keyword>. He suggested the amendments under the Telegraph Act, 1885, and the Prevention of Money Laundering Act, 2002 “The Opposition got the Aadhaar and now they are opposing it. Moreover, parents are required to be aware of all the possible ways in which the information can be used. Parents also have the right to know the recipient of the information. Use of Aadhaar number by state or corporate body An entity can use Aadhaar as an identity proof, if the UIDAI is satisfied that it is complying with the regulation. Disclosing Information Any Aadhaar related information shall be disclosed if the High Court or Supreme Court orders to do so. Further, officers above the rank of a Secretary can order to reveal Aadhaar information. Registering complaint The Aadhaar Bill is going to allow individuals to take certain cases of misinformation and disclosure of identity of court. Previously, court were allowed to look into the matter only if UIDAI has registered a complaint. Penalties for violating the law The Bill can impose penalties upto ₹100 million along with jail term on all private entities who breach the provisions of Aadhaar Bill. Creation of UIDAI Fund A new Unique Identification Authority of India Fund will be created to collect all the fees and revenue by the UIDAI. These funds are likely to cover all the expenses of the UIDAI. Previously, the revenues were added to the Consolidated Fund of India. The amendments focused on showing only the name, gender and address on the Aadhaar through the 256-bit encryption. Social media platforms, on the other hand, have been fighting against any such move. Their argument is that linking profiles to Aadhaar would violate user privacy. UIDAI told the Ministry of Electronics and Information Technology (MeitY) that since social media platforms are not a part of the Aadhaar Act, a new law would have to be put in place in order to enforce any such accountability. An open letter to the government In October, the <a href="https://www.businessinsider.in/policy/society/news/facebook-twitter-instagram-and-whatsapp-will-be-regulated-in-india-come-january-15/articleshow/71707834.cms">Supreme Court issued a deadline</a> for the central government to come out with new rules and regulations by 15 January 2020 and directed all pending cases pertaining to social media to be transferred to them. The IT intermediary draft rules were floated in December 2018. However, three internet giants — Mozilla, Github, and Cloudfare — wrote an open letter to Prasad calling for public consultation before the new rules are made official. According to the companies, the new rules would amplify the operational and legal burden on new organisations creating an entry barrier. They also pointed out that it is nearly impossible to “proactively” monitor online platforms. "We understand and respect the need to ensure that the internet is a safe space where large platforms take appropriate responsibility. However, the last version of these amendments, which were available in the public domain, suggest that the rules will promote automated censorship, tilt the playing field in favour of large players, substantially increase surveillance, and prompt a fragmentation of the internet in India that would harm users while failing to empower Indians," read the letter. The final draft of the bill is likely to be tabled during the March 2020 session. Social media accounts don’t need to be linked with the Aadhaar Card — Ravi Shankar Prasad tells the Lok Sabha

Amid the privacy and protection concerns voiced by various groups, the top team of <keyword id="86474" type="ORGANIZATION" weightage="20" keywordseo="Unique-Identification-Authority-of-India">Unique Identification Authority of India</keyword> (UIDAI) is exploring the possibility of introducing dummy numbers that would add an extra layer of <keyword id="6355300" type="CITY" weightage="20" keywordseo="security">security</keyword> to every <keyword id="144117" type="PERSON" weightage="100" keywordseo="AADHAAR">Aadhaar</keyword> cardholder. Such a framework would require an individual to share dummy or pseudo numbers — and not the real Aadhaar number — to government agencies, private utilities, banks and while withdrawing money from ATMs or moving funds from one bank account to another under the Aadhaar-enabled payment system. Besides the cardholder, the original Aadhaar number would be known only to UIDAI. No details yet The creation of dummy numbers and the frequency at which it can be generated and used would depend on the design architecture of the system. UIDAI, a statutory authority, is responsible for Aadhaar enrolment and authentication, issuance of Aadhaar numbers as well as ensuring the security of identity information and authentication records of individuals. Its measures on data protection and development of new standards on technologies like Aadhaar-Pay are ongoing. The organization, however, currently finds itself in a situation where the provisions of the very law (Aadhaar Act 2016) under which it was established has been challenged in the country’s highest court of law. Toeing the government directive, banks, utilities and credit card issuers are repeatedly asking customers to link their Aadhaar details to respective accounts by 31 December 2017, failing which services would be discontinued. Critics of Aadhaar are resisting such coercion to link Aadhaar with multiple service providers. They are hoping that some of these rules may change after the <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> ruling. The apex court hearing on the Aadhaar case is scheduled to begin on November 28.

In addition, Section 33(2) of the act, which mandates disclosure of Aadhaar details for the purposes of national security was scrapped. </li></ul>After four months and 38 days of hearings, the matter has been laid to rest. On 26 September, a five-member bench of India’s Supreme Court, led by outgoing chief justice Dipak Misra, upheld the constitutional validity of the Aadhar ID programme, voting 4-1 in favour of the scheme, and allowed its passage as a money bill. In a verdict read by Justice AK Sikri, the scheme was said to empower the marginalised sections of Indian society. The bench also found that the Unique Identification Authority of India (UIDAI), the government agency in charge of the scheme, had taken adequate measures to prevent the card from being duplicated. Enrollment in the programme was also made necessary for filing tax returns through linking with PAN cards. However, in light of the threats to an individual’s privacy, a number of provisions of the Aadhaar Act of 2016 were struck down. Section 33(2) which mandates disclosure of Aadhaar details for the purposes of national security was scrapped, as was Section 57, under which private companies are allowed to ask for a citizen’s Aadhaar details in order to provide services. This means that Indians don’t have to hand over their Aadhaar info when opening up bank accounts or getting a mobile subscription. Infact, telecom companies have been ordered to delete all the Aadhaar details of their customers. Additionally, educational institutions will not be allowed to ask for the Aadhaar details of prospective students. An expected outcome? While it may have seemed far from a foregone conclusion, there was no way that the Supreme Court could undo the world’s largest biometric identification programme and make the government start from scratch, especially in light of the scheme’s progress so far and the amount invested, which is estimated at around ₹88 billion. Despite the amount of data leaks and growing privacy concerns, the scheme has enrolled 1.2 billion Indians and allowed a lot of people to access government services. In retrospect, the scheme was always going to be modified to incorporate <keyword id="145060" type="ORGANIZATION" weightage="20" keywordseo="data-security">data security</keyword> protocols and to allow citizens the option of enrolling. The modifications to the scheme also reflected a landmark decision made by the Supreme Court in August last year, when it declared that privacy was a fundamental right.

<keyword id="6355252" type="CITY" weightage="100" keywordseo="UIDAI">UIDAI</keyword>, the Unique Identification Authority of India, has assured that its biometrics data are completely secure. The announcement was made after some rumours cropped up last week about a possible breach in the biometric security of the <a href="http://www.businessinsider.in/Aadhaar-beats-even-the-FBIsdata-base-fair-and-square-becoming-the-worlds-largest-biometric-database/articleshow/47068353.cms">Aadhaar database</a>. 
 
The authority has said the reported breach was a one-off incident, in which an employee working with a bank's business correspondent's company made an attempt to misuse his own biometrics. The breach was detected by UIDAI internal security system and appropriate action was taken. 
 A police complaint has been filed against Axis Bank, business correspondent Suvidhaa Infoserve and e-sign provider <keyword id="1662229" type="UNKNOWN" weightage="100" keywordseo="eMudhra">eMudhra</keyword> for attempted unauthorised authentication and impersonation by illegally storing <keyword id="144117" type="ORGANIZATION" weightage="100" keywordseo="AADHAAR">Aadhaar</keyword> biometric data, said a release by UIDAI. 
 
 "Any unauthorised capture of iris or fingerprints or storage or replay of biometrics or their misuse is a criminal offence under the <a href="http://www.businessinsider.in/Centre-to-link-Aadhaar-with-NPR-chalks-out-a-budget-of-Rs-951-crore/articleshow/47877985.cms">Aadhaar</a> Act," it said.

"UIDAI uses one of world's most advanced encryption technologies in transmission and storage of data. As a result, during the last seven years, there has been no report of breach or leak of residents' data out of UIDAI," the statement claimed.
