A bench of Chief Justice D Y Chandrachud and Justices P S Narasimha and J B Pardiwala rejected the <keyword id="19925995" type="General" weightage="20" keywordseo="Delhi-government" source="keywords">Delhi government</keyword>'s plea challenging the LG's power to nominate 10 aldermen in the <keyword id="19907640" type="General" weightage="20" keywordseo="Municipal-Corporation-of-Delhi" source="keywords" meta.keywordsubtype="org" meta.entityname="Municipal Corporation of Delhi" meta.hostid="345" meta.entityid="Municipal Corporation of Delhi">Municipal Corporation of Delhi</keyword> without the aid and advice of the council of ministers. The apex court pronounced its verdict on the Delhi government's plea after reserving it for nearly 15 months. In its ruling impacting the fraught relationship between the LG's office and the AAP-led Delhi government, the bench said the Delhi Municipal Corporation Act as amended in 1993 "expressly enables the LG to nominate persons having special knowledge to the corporation". It said the power expressed by the statute in the name of the LG, also seen in the context of other provisions, demonstrates the statutory scheme in which the powers and duties are distributed among authorities under the Act. "The context in which the power is located confirms that the LG is intended to act as per the mandate of the statute and not guided by the aid and advice of the council of ministers. The power to be exercised is the statutory duty of the LG and not the executive power of the state. This is how we analysed the constitutional provisions," Justice Narasimha said while pronouncing the verdict on behalf of the bench. The bench said the statutory power under provision 3(3)(b)(1) which deals with nomination of persons having special knowledge was vested with the LG for the first time by the 1993 amendment of the DMC Act of 1957. The bench said the DMC Act as amended in 1993 recognises five authorities exercising the state's power and duties under the Act -- these are the Central government, the government of NCT, administrator, corporation and the commissioner. It said the amendment Act of 1993 carries out several amendments to the original DMC Act of 1957 by which the power, duties were allocated to the authorities depending on the function they perform under the law. The bench said by way of the amendment the power of nomination of aldermen was given to LG under the provision just like the power of nomination of MLAs was given to the speaker of the House. On May 17 last year, the top court had said that giving the LG the power to nominate aldermen to the MCD will mean he can destabilise an elected civic body. The MCD has 250 elected and 10 nominated members. In December 2022, the Aam Aadmi Party defeated the <keyword id="19894848" type="General" weightage="20" keywordseo="BJP" source="keywords" meta.keywordsubtype="org" meta.entityname="BJP" meta.hostid="345" meta.entityid="BJP">BJP</keyword> in the civic elections, winning 134 wards and ending the saffron party's 15-year run at the helm of the MCD. The BJP won 104 seats and the Congress finished a distant third with nine. Senior advocate Abhishek Singhvi, appearing for the Delhi government, had contended during the hearing that no separate powers have been accorded to the state government to nominate people to the MCD. For the past 30 years, the practice of the LG nominating aldermen on the aid and advice of the city government has been followed, he said. Additional Solicitor General Sanjay Jain, appearing for the LG's office, submitted that just because a practice has been followed for 30 years does not mean it is correct. The top court had observed that giving the LG the power to nominate aldermen will effectively mean that he can destabilise a democratically elected MCD because these aldermen get appointed to the standing committees and have voting power. Earlier, the top court had questioned the "source of power" of the LG under the Constitution and the law to nominate aldermen to the MCD without the aid and advice of the elected government. On May 12 last year, the top court observed that LG has to act on the "aid and advice" of the council of ministers of the Delhi government in nominating 10 aldermen to the MCD.

SC backs LG's right to nominate aldermen to MCD, setback for AAP govt

The <keyword id="19895344" type="General" weightage="20" keywordseo="Enforcement-Directorate" source="keywords">Enforcement Directorate</keyword> alleged Saturday that the CPI(M) in <keyword id="19896018" type="General" weightage="20" keywordseo="Kerala" source="keywords">Kerala</keyword> was holding proceeds of <keyword id="19899231" type="General" weightage="20" keywordseo="money-laundering" source="keywords">money laundering</keyword>, as it attached a land parcel and <keyword id="20202062" type="General" weightage="20" keywordseo="bank-deposits" source="keywords">bank deposits</keyword> worth Rs 73 lakh of the political party in a <keyword id="19913348" type="General" weightage="20" keywordseo="probe" source="keywords">probe</keyword> linked to the Karuvannur Service Cooperative Bank "scam". Assets worth Rs 28.65 crore of various individuals and entities linked to the case have also been attached by the federal agency after a provisional order under the <keyword id="19912399" type="General" weightage="20" keywordseo="prevention-of-money-laundering-act" source="keywords">Prevention of Money Laundering Act</keyword> (PMLA) was issued. Official sources said the party may be nam<keyword id="19956083" type="General" weightage="20" keywordseo="ED" source="keywords">ed</keyword> as an accused in the next supplementary chargesheet to be filed in this case. If so, it will be the second political party to be arraigned as accused in a money laundering investigation after the Aam Aadmi Party. AAP has recently been named by the ED in the Delhi excise policy case. The CPI(M) vehemently denied the charges of wrongdoing and money laundering. The attached assets include 18 immovable properties, valued at Rs 28.65 crore, consisting of lands and buildings in Kerala of the beneficiaries of the "scam", including an immovable property worth Rs 10 lakh registered in the name of a district secretary of the Communist Party of India (Marxist) for a party office, the ED said in a statement. The attachment also includes eight movable properties, including a credit balance of Rs 63.62 lakh in eight "undisclosed" bank accounts of the CPI(M) local area committees in Thrissur, it added. The agency claimed that the CPI(M) received these funds from the beneficiaries as donations through the governing body and the party is "in possession of proceeds of crime" which has been invested in the purchase of immovable properties and credited to its five bank accounts in the Karuvannur Service Cooperative Bank Ltd. The bank is promoted by the party. The CPI(M) rejected the ED charges, saying it would legally and politically fight any move by the agency to arraign it in the case linked to the alleged multi-crore Karuvannur bank scam. Party state secretary M V Govindan alleged that the ED was trying to make opposition parties and their leaders accused in various cases due to political reasons. He also accused the central agency of attempting to create a smokescreen as it had failed to collect any evidence against the party. The ED believes that the land parcel attached by it was meant for the CPI(M) party office and was purchased using alleged kickbacks from the loanees or beneficiaries of the loans sanctioned by the Karuvannur Service Cooperative Bank. The agency has relied on the "confessional" statements of at least two accused in this case who claimed in their statements recorded before a judicial magistrate that the purported irregularities in the bank were orchestrated at the behest of CPI(M) Thrissur district committee leaders. The ED alleged that "bogus loans" were sanctioned by the Karuvannur Service Cooperative Bank on the same property multiple times without the knowledge of members of the society. "Investigation found benami loans were sanctioned to non-members against inflated property valuations in the names of other members and such loan funds were siphoned off and laundered by the accused beneficiaries," it said, adding that the loan amounts were disbursed in cash to avoid a money trail. "Such benami and illegal loans were sanctioned at the behest of the secretary and the governing body of the society in connivance with the then-bank manager, at the behest of the Thrissur district committee, CPI(M). "In return, the Thrissur district committee, CPI(M), collected money in the form of donations and salary cut from the beneficiaries and society committee members into their undisclosed and illegally opened bank accounts in the same society," the agency said. These funds, according to the ED, were utilised for the purchase of land worth Rs 10 lakh by the secretary of the Thrissur district committee of the CPI(M) for the construction of the party office, which has now been attached as proceeds of crime. Govindan said it has been a decades-long practice of registering the office and other assets of party units in the name of the respective district committees. What role does the party have in the office constructed by one of its local committees, he asked. But the ED is now trying to tarnish the image of the CPI(M) in the name of the assets of one such party unit, Govindan claimed. "We will fight it legally and politically. We haven't got any notice in this regard so far," he told reporters. The ED filed a chargesheet in this case against 55 accused entities in November last year. The money laundering case stems from 16 FIRs registered by the <keyword id="20086884" type="General" weightage="20" keywordseo="kerala-police" source="keywords">Kerala Police</keyword> (<keyword id="20146853" type="General" weightage="20" keywordseo="crime-branch" source="keywords">Crime Branch</keyword>) in Thrissur in 2010. Four people have been arrested by the ED in this case so far.

BJP spokesperson Sambit Patra said politicians used to scratch each other's back to help each other while indulging in scams but this has changed in the last 10 years under the government headed by Prime Minister <keyword id="19895781" type="General" weightage="20" keywordseo="narendra-modi" source="keywords">Narendra Modi</keyword>. "Should he (Kejriwal) be let off because he is a chief minister and not a common man," he asked, alleging that the Delhi chief minister is a kingpin in the corruption case being probed by the Enforcement Directorate (ED). With opposition parties, including the Congress, rallying to Kejriwal's defence and describing his arrest as part of the Union government's crackdown on their leaders, the BJP spokesperson said it is a case of thieves displaying brotherhood. Patra also played a statement of Congress leader Ajay Maken in which the he had lashed out at Kejriwal for the alleged excise scam and accused him of using Rs 100 crore collected from it to harm the Congress in the Goa assembly polls in 2022. Even the Supreme Court has spoken about a money trail of over Rs 338 crore while denying bail to AAP leader <keyword id="19909124" type="General" weightage="20" keywordseo="manish-sisodia" source="keywords">Manish Sisodia</keyword> in the same case, he said. The arrest, the first of a sitting chief minister, came hours after the Delhi High Court refused to grant protection to the <keyword id="19914482" type="General" weightage="20" keywordseo="aap" source="keywords">AAP</keyword> national convenor from any coercive action by the agency. The 55-year-old leader's arrest, amid campaign for the <keyword id="19895394" type="General" weightage="20" keywordseo="lok-sabha" source="keywords">Lok Sabha</keyword> elections, drew angry reactions from his Aam Aadmi Party (AAP). Soon after the high court order, an ED team reached his residence and carried out searches. Subsequently, he was arrested, officials said. Officials said the ED would produce the chief minister before a court here on Friday and seek his custody for interrogation. As the ED officials carried out their action inside, additional Delhi Police personnel and Rapid Action Force (RAF) and CRPF teams were deployed around the chief minister's residence. The additional deployment was made as the ED sought extra security measures in anticipation of protests by AAP supporters, sources said. A large number of AAP workers and leaders gathered near the chief minister's residence and shouted slogans against the ED action. During the day, <keyword id="19895701" type="General" weightage="20" keywordseo="kejriwal" source="keywords">Kejriwal</keyword> moved the Supreme Court against the high court's order denying him any relief in the matter. The ED's action is virtually a replay of what transpired during the arrest last week of Bharat Rashtra Samithi (BRS) leader <keyword id="19987244" type="General" weightage="20" keywordseo="k-kavitha" source="keywords">K Kavitha</keyword>, who is now in ED custody in the same case. The case pertains to alleged corruption and money laundering in formulating and executing the Delhi government's excise policy for 2021-22, which was later scrapped. AAP leaders Manish Sisodia and Sanjay Singh are in judicial custody in the case. Kejriwal's name has been mentioned multiple times in the charge sheets filed by the ED. The agency has alleged that the accused were in touch with Kejriwal for formulating the excise policy that resulted in undue benefits to them in return for which they paid kickbacks to the AAP.

While the party did not say in which case Kejriwal is likely to be arrested, it said that this was being done to prevent the AAP from stitching an alliance with the Congress for the upcoming Lok Sabha elections as the <keyword id="19894848" type="General" weightage="20" keywordseo="bjp" source="keywords">BJP</keyword> is scared of the two parties coming together. While there was no immediate response from the Central Bureau of Investigation (CBI) to the AAP's claims, the BJP said AAP leaders are trying to create confusion and generate sympathy for Kejriwal. The Congress and the AAP are likely to have a seat-sharing pact in Delhi, Gujarat and Haryana for the Lok Sabha polls and the talks between the two sides are in the final stages, sources said on Thursday. Addressing a press conference here, Delhi cabinet minister and senior AAP leader <keyword id="19945966" type="General" weightage="20" keywordseo="saurabh-bharadwaj" source="keywords">Saurabh Bharadwaj</keyword> said as soon as reports of finalisation of seat-sharing talks between the Congress and the AAP started coming in, the ED sent a seventh summons to Kejriwal in the excise policy case. "We have learnt from reliable sources that the CBI is planning to arrest Kejriwal. The CBI will also serve a notice to Kejriwal either this afternoon or by the evening," Bharadwaj said. Kejriwal will be arrested in the next two to three days, he said. "We are getting messages that if the AAP-Congress alliance is formed, Arvind Kejriwal will be arrested. The BJP is scared of the AAP-Congress alliance. You can arrest Kejriwal if you want, but the alliance will be forged," he said. The Enforcement Directorate has issued a fresh summons to Kejriwal asking him to appear before it for questioning in the Delhi excise policy-linked money laundering case on February 26, sources said on Thursday. This is the seventh summons issued by the ED to the chief minister, who skipped the previous six. AAP Rajya Sabha MP Sandeep Pathak said people will take to the streets if Kejriwal is arrested. "There will be a tsunami. Their (BJP) political calculations will go wrong. We are not scared of being arrested. We are forging this alliance for the country," he said. Delhi BJP president <keyword id="20040814" type="General" weightage="20" keywordseo="virendra-sachdeva" source="keywords">Virendra Sachdeva</keyword> said Kejriwal knows that the talks on the AAP's alliance with the Congress are failing but AAP leaders have been spreading rumours since Thursday and are trying to generate sympathy for the chief minister. "Kejriwal may delay his punishment with the help of lawyers but ultimately, the people of Delhi will punish him harshly in the coming elections," the BJP leader said. The AAP and Kejriwal should remember that Congress leader Ajay Maken had submitted the first written complaint to the lieutenant governor regarding the liquor "scam" under his government, Sachdeva said. The BJP won all the seven seats in Delhi with 51 per cent votes in the 2014 Lok Sabha polls and 59 per cent in 2019. In the 2024 Lok Sabha elections, the people of Delhi will give 70 per cent votes to the BJP, he asserted.

New Delhi, About 82 per cent of the total income from unknown sources declared by national political parties in 2022-23 came from electoral bonds, according to a poll rights body. The Association for Democratic Reforms (ADR) also said that the analysis of the national parties' audit reports and donation statements filed with the Election Commission (EC) shows that the sources remain largely unknown. Out of the Rs 1,832.88 crore as income from unknown sources, the share of income from electoral bonds was Rs 1,510 crore or 82.42 per cent, according to the analysis of the financial reports for the fiscal year 2022-23 submitted to the poll panel, it stated. For this study, six national parties were considered -- the <keyword id="19931558" type="General" weightage="20" keywordseo="bharatiya-janata-party" source="keywords">Bharatiya Janata Party</keyword> (BJP), the Congress, the Communist Party of India (Marxist) (CPI-M), the Bahujan Samaj Party (BSP), the Aam Aadmi Party (AAP) and the National People's Party (<keyword id="20864989" type="General" weightage="20" keywordseo="npep" source="keywords">NPEP</keyword>). The BJP declared the highest income from unknown sources among the national parties at Rs 1,400 crore or 76.39 per cent of the total amount. The Congress declared an amount of Rs 315.11 crore (17.19 per cent). The BSP has declared that it did not receive any funds from voluntary contributions -- above or below Rs 20,000, sale of coupons or electoral bonds, or unknown sources of income, the ADR said. Though the amount of donations from electoral bonds has been highlighted for the national parties, state parties also get a substantial amount of money from electoral bonds, the NGO noted. Between the financial years 2004-05 and 2022-23, the national parties collected Rs 19,083 crore from unknown sources, it said. On its latest analysis for the financial year 2022-23, the ADR said among these unknown sources, the major contributor was income from electoral bonds, constituting a "massive 82.42 per cent of the total income from unknown sources". Further scrutiny revealed that out of the total income from unknown sources, Rs 1,510 crore came from electoral bonds, it said. In addition, the Congress and the CPI(M) have also declared a combined income of Rs 136.79 crore from the sale of coupons, constituting 7.46 per cent of the income from unknown sources, its analysis showed. The BSP received Rs 29.27 crore from other known sources of income which included bank interest (Rs 15.05 crore), membership fees (Rs 13.73 crore), gain on sale of immovable property (Rs 28.49 lakh) and interest on income tax refund for 2021-22 (Rs 20.65 lakh), the organisation said. The total income of the six national political parties in the financial year 2022-23 is Rs 3,076.88 crore, it said. Donations from voluntary contributions below Rs 20,000 formed 10 per cent of the income from unknown sources, totalling Rs 183.28 crore. Currently, political parties are not required to reveal the names of individuals or organisations giving less than Rs 20,000. The ADR has suggested stringent measures to enhance transparency and accountability in political funding. It advocates for full disclosure of all donors under the Right to Information (RTI) Act and proposes that the mode of payment for all donations, regardless of the amount, be declared in the audit reports submitted to the Income Tax Department and the EC. Moreover, the EC's recommendation to grant tax exemption only to parties contesting and winning seats in elections, along with the disclosure of donors contributing above Rs 2,000, has received support from the ADR. In a landmark verdict delivered last month, ahead of the <keyword id="19895394" type="General" weightage="20" keywordseo="lok-sabha" source="keywords">Lok Sabha</keyword> polls, the <keyword id="19895345" type="General" weightage="20" keywordseo="supreme-court" source="keywords">Supreme Court</keyword> scrapped the government's electoral bonds scheme of anonymous political funding, terming it "unconstitutional" and ordering disclosure of the names of the purchasers, value of the bonds and their recipients.
