Trump plans to fly back to Mar-a-Lago, hours after his expected arraignment. He will likely be 'allowed to go and travel wherever he wants,' legal experts say.

Following a historic arraignment in New York, former President Donald Trump will be hopping on a plane right back down to his Palm Beach club Mar-a-Lago Tuesday to deliver remarks, potentially on the legal process itself.

Trump will fly into New York Monday night, he said, then head to a Manhattan criminal court for arraignment on Tuesday afternoon. His attorney Susan Necheles told Insider that "it will be a smooth surrender."

On the day of the arrangement, there won't be a dramatic perp walk, and Trump likely won't be seen in handcuffs, Insider previously reported. The former president will have his fingerprints taken, along with a mugshot and a mandatory DNA cheek-swabbing.

After his arraignment, during which he will stand before a judge, hear the charges, and enter a plea, Trump said on Sunday that he plans to give a speech at his Mar-a-Lago resort in Palm Beach.

Legal experts, including a former senior staffer with the Manhattan District Attorney's Office, said Trump will have to comply with conditions of release after his arraignment.

Ambrosio Rodriguez, a Los Angeles criminal defense attorney, told Insider that it would be highly unlikely that the president would put up bail, and would be "allowed to go and travel wherever he wants."

"It is safe to assume that Trump will be released on his own recognizance," Ambrosio Rodriguez, a Los Angeles criminal defense attorney, told Insider.

Los Angeles criminal defense attorney Joshua Ritter agreed, saying there was no reason to believe a judge would impose travel restrictions on Trump.

"It's also hard to argue that Trump is a flight risk," Ritter said. "You know, he's one of the most well-recognized people on the planet. I don't think there's a real concern about him returning to court at future dates."

Trump hasn't said what his remarks will be about, but the former president may be limited on what he can say specifically regarding his indictment.

Duncan Levin, a former senior staffer at the Manhattan District Attorney's Office, told Insider that it is "extremely likely that there will be a gag order in the case."

"Gag orders are very common in criminal cases, particularly in cases where there is an enormous amount of pretrial publicity like this one," he said.

Criminal defense attorney Rachel Fiset told Insider that it "would not be surprising" if Trump faced a gag order, but added that it would likely go both ways, meaning the DA's office would also have to comply with the order.

If a judge did restrict Trump's ability to speak about the case, Fiset said it was likely that Trump would "try to walk the line of what he can and can't talk about."

Rodriguez, on the other hand, said that he did not believe a gag order would happen at all.

"I don't think there's a gag order big enough to gag Trump," Rodriguez said. "Trump would just send a fundraiser email saying 'They're trying to silence me.'"

It is expected that the charges related to Trump's indictment will be unsealed during the arraignment. A source familiar with the case told Insider it is a felony indictment. Two sources told CNN that Trump faces more than 30 counts related to business fraud.
