The federal judge overseeing the Justice Department's election-interference case against former President Donald Trump issued a formal gag order on Tuesday. The order bars Trump from attacking prosecutors, witnesses, and courthouse staffers.
But it allows him to insult former Vice President Mike Pence, the Biden administration, the Justice Department, and other political rivals.
"Undisputed testimony cited by the government demonstrates that when Defendant has publicly attacked individuals, including on matters related to this case, those individuals are consequently threatened and harassed," the order said. And since being indicted earlier this year, Trump "has continued to make similar statements attacking individuals involved in the judicial process, including potential witnesses, prosecutors, and court staff," it continued.
Trump's allegation that those involved in his prosecution and trial are liars, "thugs," and treasonous "pose a significant and immediate risk" that witnesses, prosecutors, public servants, and court staff will be "intimidated or otherwise unduly influenced" by the prospect of being targeted, US District Judge Tanya Chutkan wrote.
She also noted that the threat is more pronounced "in the age of the Internet," adding that Trump's statements pose "grave threats" to the integrity of the proceedings in the case.
That said, Chutkan noted that the order does not prohibit Trump from making broader statements criticizing the government, the Biden administration, and the Justice Department. Trump is also allowed to claim his prosecution is politically motivated and criticize "the campaign platforms or policies of" current political rivals, "such as former Vice President Pence."
Trump was indicted on four counts related to his efforts to subvert the 2020 election results. Prosecutors accuse the former president of conspiring to defraud the US, conspiring to obstruct an official proceeding, obstructing an official proceeding, and conspiring against rights.
It's one of four indictments against Trump; Smith's office also brought charges against Trump in connection to his handling of classified documents, and the Manhattan DA's office brought 34 counts related to falsifying business records against Trump. The Fulton County DA's office also brought charges against Trump and more than a dozen co-defendants in a sprawling RICO case connected to their efforts to nullify the 2020 election results in Georgia.
