"Tribes are not private organizations within state boundaries. Their reservations are not glorified private campgrounds. Tribes are sovereigns."The majority sided with the state of Oklahoma in the case, Oklahoma v. Castro-Huerta, holding that the state had concurrent jurisdiction with the federal government to prosecute some crimes committed on reservations. Like Gorsuch, <a href="https://www.businessinsider.com/oklahoma-tribal-land-as-lawless-dystopias-for-scotus-sovereignty-experts-2022-7">Native law experts were stunned and dismayed</a> by the ruling, which they said went against almost 200 years of precedent and weakened tribal sovereignty.The part that wasn't surprising to the experts? That Gorsuch broke from his fellow conservatives."The majority opinion is a pretzel twisting itself to get to that outcome instead of letting it flow," James Maggesto, a lawyer who focuses on Native American law, told Insider. "The reason Justice Gorsuch gets these opinions right is because he's had experience in those circuit courts."Maggesto, a member of the Onondaga Nation, said Gorsuch's background in the West and years of firsthand experience contributed to his deep understanding of Native law and the real-world implications of the court's decisions when it comes to Native people.<h2>A Westerner on the High Court</h2>Gorsuch grew up in Denver, Colorado. His family moved to Maryland when he was in his early teens and he attended <a href="https://www.gprep.org/about/alumni/notable-alumni">Georgetown Prep</a>, where he graduated two years after his future colleague, Justice Brett Kavanaugh. Like many Supreme Court justices, Gorsuch went on to the Ivy Leagues, including Colombia and Harvard Law.But unlike many justices, Gorsuch moved back to his home state of Colorado in 2006 to serve as a judge on the <a href="https://www.denverpost.com/2006/11/20/10th-circuit-judges-oath-a-family-affair/">US Court of Appeals for the 10th Circuit</a>. He spent the next decade on the circuit, which covers district courts in Colorado, Wyoming, New Mexico, Utah, Kansas, and Oklahoma — in other words, lots of Indian country.When Gorsuch was appointed to the Supreme Court in 2017, a former colleague, Michael W. McConnell, told <a href="https://www.nytimes.com/2017/01/31/us/politics/neil-gorsuch-supreme-court-nominee.html">The New York Times</a> Gorsuch would bring a unique perspective. "He's a Westerner," McConnell said. "There are so many cases that have to do with the West, and I also think the cultural sensibilities of the West are different. He's an outdoorsman, and the Supreme Court needs a little bit more geographical diversity."Maggesto said as a result of being on the 10th Circuit, Gorsuch would have seen many Native law cases under various contexts, helping him gain a deep understanding of the historic precedents."Westerners have a lot more opportunities to come across tribal issues throughout the formative years of their legal jurisprudence," he said, adding that judges who primarily come up in the East are less likely to develop an appreciation for tribal law issues.<h2>Endorsed by tribes</h2>Even liberal justices who don't have experience with tribal law can sometimes miss the mark on such cases, Maggesto said. He noted tribal organizations are not partisan entities, as their members can have all kinds of political views, and that Native law cases generally are not inherently partisan.What matters to tribes in terms of judges is a deep understanding of Native law, which is why — as Democrats plotted to block Gorsuch's nomination to the Supreme Court — tribes endorsed him."Judge Gorsuch's record includes a great number of decisions involving tribal governments, tribal people and tribal interests, and he has consistently demonstrated not only a sound understanding of Federal Indian Law principles, but a respect for our unique and closely held cultural values," Alvin Not Afraid Jr., then-chairman of the Crow Tribe Executive Branch, wrote in a letter to Senate leadership, according to <a href="https://indiancountrytoday.com/archive/tribes-support-neil-gorsuch-supreme-court-nod-democrats-plan-filibuster">Indian Country Today</a>.In another letter sent to the Senate, Mark Azure, president of the Fort Belknap Indian Community Council, said they did not expect to agree with Gorsuch on every Native law issue but that they believed he was "immensely well qualified" and a "mainstream, commonsense Westerner who will rule fairly on Indian country matters."In paperwork related to his nomination filed to the Senate Judiciary Committee, Gorsuch listed a case involving a Native American prisoner among the ten most significant he had ever ruled on, ICT reported. His ruling held the prisoner had <a href="https://caselaw.findlaw.com/us-10th-circuit/1655508.html">a right to access a sweat lodge</a> to exercise his religious beliefs.And in 2020, Gorsuch authored the historic ruling in <a href="https://www.supremecourt.gov/opinions/19pdf/18-9526_9okb.pdf">McGirt v. Oklahoma</a>, in which the court ruled much of eastern Oklahoma, more than 40% of the state, was tribal land. In that decision, he was also the only conservative justice to rule against the state and in favor of tribal sovereignty.<h2>Spending time in Indian country</h2><a href="https://law.stanford.edu/directory/elizabeth-reese/">Elizabeth Hidalgo Reese</a>, a scholar of tribal and federal Indian law at Stanford University, agreed that Gorsuch has a deep understanding of Native law. Historically, however, that's not automatically the case for judges who come from the West or have a lot of experience with such cases, she said.Justices who have been the most reliable on Indian law decisions, regardless of party, are the ones who "just made the effort to understand this very complicated body of law, not just in the abstract sense but also what it means on the ground," Reese, a member of the Pueblo of Nambé, said."That really takes spending time with Indian people, spending time in Indian country," she said, adding that justices can choose to do that before or after they join the high court.Reese pointed to Justice Sonia Sotomayor, who is from New York and served in the 2nd Circuit, where she would not have seen many Native law cases in the years leading up to her Supreme Court appointment in 2009."One of the first things she did when she got on the bench was go to Indian countries and spend time with a group of folks who know and understand tribal law and federal Indian law," she said.In 2011, Sotomayor became the first Supreme Court justice in over 200 years to meet with a tribe when she visited the Pueblo Indians in New Mexico, <a href="https://indiancountrytoday.com/archive/supreme-court-justice-sotomayor-meets-oklahoma-tribal-leaders-students">ICT</a> reported. During my first-ever vote on "<keyword id="11911223" type="UNKNOWN" weightage="60" keywordseo="survivor" source="Orion">Survivor</keyword>: Philippines," I was fairly confident I wasn't being targeted, so I got to enjoy walking in with a torch, dipping it into the fire, and listening to <keyword id="12154563" type="UNKNOWN" weightage="60" keywordseo="jeff-probst" source="Orion">Jeff Probst</keyword> run through the lines I'd heard on <keyword id="11898468" type="UNKNOWN" weightage="60" keywordseo="tv" source="Orion">TV</keyword> since I was 12 years old.Then it came time to vote and, even though I knew I was safe, I <a href="https://www.insider.com/survivor-contestants-how-do-they-poop-go-to-bathroom-2021-11">nearly poo'd myself</a>. But beyond the inevitable stress, there are a lot of details that surprised even me. Here are a few that stand out.Full disclosure, it's been a few years since I competed — most recently in 2017 — and this is based on my experience.<h2>Walking down the beach sucked – and we had to do it multiple times</h2>You know that <a href="https://www.insider.com/former-survivor-player-whats-wrong-with-the-show-new-season-41-2021">classic "Survivor" footage</a>, shot just before Tribal Council starts, where the castaways are marching single-file down the beach with their torches, bathed in the reds and golds of an idyllic tropical sunset?I hate that. So, so much.Even if you didn't see it in the episode, we did the walk every time we went to Tribal. We'd line up, wait for a producer's cue, then march 100 yards down the beach. Then we'd turn around, hike the 100 yards back, wait for the next cue, and do it all over again. Producers probably have us do this to ensure they have the perfect shot <a href="https://www.insider.com/what-its-like-being-on-survivor-contestants-reveal-2021-6">in case they want to use it for the episode</a>. But for the tribe, who's already lost an immunity challenge earlier in the day, it's insult added to injury.<h2>Tribal can take a long time to start, especially since it needs to be dark outside</h2>I'll hazard a guess that, after leaving camp, it usually took two and a half hours for Tribal Council to start.There are several contributing factors here. Travel from our camp on the beach to the Tribal set usually took well over half an hour. Once there, everyone had to go through medical checks and get mic'd up.This would <a href="https://www.insider.com/survivor-players-meet-before-show-starts-but-cant-talk-2021-9">all happen in complete silence</a> under the watchful eyes of producers — if anyone said anything during this time, which doesn't exist on the show, it wouldn't be able to be included on TV.Even if all those steps happened quickly, we'd have to wait for total darkness before starting Tribal. <div type="image" title="Malcolm Freberg, Roxanne &quot;Roxy&quot; Morris, Russell Swan, Denise Stapley and Angie Layton during Tribal Council on the second episode of Survivor: Philippines sitting in front of a fire" height="1333" width="1778" msid="91650236" hostid="261"></div><h2>We're given seat assignments before entering Tribal</h2>I'm often asked, "Why would you sit so far away from your allies?" It's because we didn't have a say as to where we'd sit for Tribal.Minutes before we'd walk onto set, a producer would pull out a notebook, shows us a ragged hand-drawn diagram of how the seats are arranged that night, and tell us our spot.Then they'd line us up and send us in.<h2>Probst always gave us a volume test before our first vote</h2>The voting "booth" is usually situated about 20 yards away from where the castaways are sitting. Close enough that, if you're not careful, someone sitting on their stool might hear you talk through your vote.On the flip side, if you whisper too quietly, the cameras can't hear you explain why you wrote that name.So every season I've been on, Probst stood in front of us and said, "This is me talking," at a normal volume. The host repeated the phrase over and over again as he walked to the voting booth and as he returned to us. You could usually just barely hear him in the booth.Then he'd change his volume to a whisper and repeat the process. Now, you absolutely couldn't hear a word while he'd ostensibly be voting.It's incredibly helpful and made me feel comfortable knowing how loud to speak during the vote. <div type="image" title="&quot;Survivor&quot; host Jeff Probst sitting at Tribal Council in front of fire-lit torches" height="2000" width="2666" msid="91650237" hostid="261"></div><h2>It's on players to stop Probst if they have more to say </h2>The host-with-the-most usually walks you through a few other nuances before the first Tribal begins. Even returning players get these reminders.One point that always stands out is that you, the player, shouldn't allow the vote to start unless you've said all you need to say.On one of my seasons, Probst prefaced this tip with a vague anecdote. He said a former player — I don't know who — complained after their boot that they hadn't gotten the chance to say all they wanted to say at Tribal.So now Probst makes a point of empowering every castaway to hold up the vote if they feel the need to do so.<h2>Handling Probst at Tribal Council is a 'Survivor' skill just as important as outwitting, outplaying, and outlasting</h2>He doesn't say this, of course. But I advise you do not, under any circumstance, piss off Probst if you go on the show. Watching at home, you've undoubtedly thrown popcorn at the TV when a castaway gives away too much information when answering one of Probst's questions. But <a href="https://www.insider.com/survivor-scenes-that-got-cut-from-the-show-2021-6">you know what you've never seen</a>? Someone simply answer "yes" or "no" as a response to them. Because players aren't really supposed to.Imagine watching a Tribal Council with everyone boycotting Probst's questions. It might make sense from a gameplay perspective, but <a href="https://www.insider.com/surprising-fun-facts-about-survivor-2018-6">"Survivor"</a> is first and foremost a television show. And "Survivor" players are first and foremost storytellers. Being too cagey with an answer at Tribal won't get Probst off your back. He'll probably just come right back to you.I remember during my first season, someone at their first Tribal Council tried only giving "yes" or "no" answers to Probst. I won't disclose too much detail, but imagine the worst tongue lashing your father ever gave you in front of all your friends, and your father is a television icon that, in part, can control your chance at a million-dollar prize.<div type="image" title="Sandra Diaz-Twine, Jeff Varner, Aubry Bracco, Malcolm Freberg and Hali Ford at Tribal Council on Survivor, sitting in a torch-lit area" height="2004" width="3000" msid="91650238" hostid="261"></div><h2>Counting the votes takes more time than you'd think </h2>On TV, Probst says, "I'll go tally the votes," disappears for a few seconds, then quickly comes back with an island-themed jug in his hands.In reality, immediately after Probst disappears, multiple producers come onto the set and enforce silence. Because, again, this interlude doesn't exist for television purposes and anything significant said between castaways would have to be cut. It takes about 15 minutes for Probst to return. <h2>Players who'd been to Tribal are often at a disadvantage the next day</h2>Assuming you <a href="https://www.insider.com/what-happens-after-youre-voted-off-survivor-2021-7">survive the vote</a>, the night is far from over. You exit Tribal and are immediately on quiet time again -- though significant looks, both relieved and furious, often pass around the tribe.You still have to travel all the way back to camp, reconvene with allies (if you have any left), and do interviews for the cameras about your feelings.You're also probably not getting the sleep you've become used to. On normal nights, tribes typically go to bed shortly after dark and wake up at sunrise. But after Tribal, you're lucky if you're settled in by midnight. Should there be a challenge the next day, the other tribe(s) will be much better rested than you.Conclusion: <a href="https://www.insider.com/worst-and-grossest-things-about-playing-on-survivor-2021-6">Tribal council is the worst</a>, for all the reasons.When reached for comment, a CBS representative said some of these were "false statements," but declined to specify further. <ul class="summary-list"><li>The <keyword id="11893011" type="UNKNOWN" weightage="60" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> ruled last week the state of <keyword id="11910055" type="UNKNOWN" weightage="60" keywordseo="oklahoma" source="Orion">Oklahoma</keyword> has some jurisdiction over tribal lands.</li><li>Native law experts told Insider the ruling ran counter to decades of Native law.</li></ul>Oklahoma engaged in a coordinated effort to disparage <keyword id="12075946" type="UNKNOWN" weightage="60" keywordseo="native-american" source="Orion">Native American</keyword> <keyword id="14365028" type="UNKNOWN" weightage="60" keywordseo="tribes" source="Orion">tribes</keyword> and convince the Supreme Court to weaken tribal <keyword id="13423327" type="UNKNOWN" weightage="60" keywordseo="sovereignty" source="Orion">sovereignty</keyword> — and it worked, according to Native law experts.On Wednesday, the Supreme Court sided with the state in Oklahoma v. Their reservations are not glorified private campgrounds. Tribes are sovereigns."The win for Oklahoma came two years after another case decided by the high court, McGirt v. Oklahoma, held that much of eastern Oklahoma was reservation land. The result was that 43% of the state was acknowledged as Indian country, limiting the ability of the state to prosecute crimes there.Following that decision, Oklahoma could have sought jurisdiction by working with the tribes and going to Congress to pass legislation. Instead, Gorsuch writes, the state responded with a "media and litigation campaign" to portray reservations as "lawless dystopias."<h2>Oklahoma spent $10 million on a tribal litigation fund</h2>"The court has never had the authority to give states any jurisdiction over tribal lands," <a href="https://www.newyorker.com/culture/persons-of-interest/mary-kathryn-nagle-changes-the-story-in-court-and-onstage">Mary Kathryn Nagle</a>, a lawyer who specializes in federal Indian law, told Insider. That power has belonged to the federal government and Congress. But she said the governor "spent 10 million on a PR campaign" to convince the Supreme Court otherwise.In 2021, Gov. Kevin Stitt successfully sought <a href="https://www.oklahoman.com/story/news/2021/05/19/oklahoma-needs-millions-mcgirt-ruling-legal-fund/5138322001/">$10 million for a tribal litigation fund</a> to hire private attorneys to work on disputes between the state and the tribes.In the state's recent argument before the Supreme Court, it <a href="https://www.supremecourt.gov/DocketPDF/21/21-429/192789/20210917145304296_Castro_pet.pdf">argued</a> McGirt caused "instant and sweeping turmoil" in Oklahoma. The state claimed it lost jurisdiction over 18,000 cases per year and that "numerous crimes are going uninvestigated and unprosecuted, endangering public safety."However, it's unclear how exactly Oklahoma came up with its numbers. Tribal governments and journalists have been unable to confirm them and accused the state of exaggerating. A months-long analysis by <a href="https://www.theatlantic.com/ideas/archive/2022/04/scotus-oklahoma-castro-huerta-inaccurate-prosecution-data/629674/">The Atlantic</a> found the state's numbers dubious at best and "inaccurate and misleading" at worst.The state's characterization of the situation has also been disputed by some officials. Trent Shores, who served as the US attorney for the Northern District of Oklahoma from 2017 to 2021, said the reality on the ground is far more reassuring."I have experience working with and in the tribal court system, and I know that they are just as dedicated to justice and ensuring that these victims get a measure of justice," he told <a href="https://www.kosu.org/politics/2021-02-24/trent-shores-reflects-on-his-time-as-u-s-attorney-remains-committed-to-justice-for-indian-country">KOSU</a> last year.Still, the Supreme Court appeared to take Oklahoma at its word, with Justice Brett Kavanaugh repeating Oklahoma's claims in the majority opinion."It's very clear they're buying this false narrative that McGirt created a public safety issue," Nagle said.<h2>Tribes will 'guard their sovereignty and protect it very closely'</h2>James Maggesto, an attorney who focuses on Native American Law, agreed that "the sky wasn't falling at the local jurisdictions" but that Oklahoma's efforts to paint it that way unfortunately "carried the day in this case."He said that despite the state asserting otherwise, there is "no tension between respecting tribal sovereignty and law and order." Similar to how states respect one another's jurisdiction over their own lands, the jurisdiction of the tribes, as sovereign nations, should also be honored and respected.Maggesto said it was just another example of the court wanting a specific outcome and finding a way to get there, rather than following the law where it actually leads: "The majority opinion is a pretzel twisting itself to get to that outcome instead of letting it flow.""Far from settling things, I think the court has kind of muddied the water now," he said, adding he expects to see the tribes fight the implications through legislation or the courts.
