A court on Tuesday granted two-hour custody parole to <keyword id="22243221" type="General" weightage="20" keywordseo="Kashmiri-leader" source="keywords">Kashmiri leader</keyword> <keyword id="834128" type="General" weightage="20" keywordseo="Sheikh-Abdul-Rashid" source="Orion">Sheikh Abdul Rashid</keyword> to take oath as a Lok Sabha <keyword id="19904133" type="General" weightage="20" keywordseo="MP" source="keywords">MP</keyword> on July 5. Rashid, also known as <keyword id="21038061" type="General" weightage="100" keywordseo="Engineer-Rashid" source="keywords">Engineer Rashid</keyword>, was elected from Baramulla seat as an independent candidate defeating National Conference leader Omar Abdullah in the recent Lok Sabha polls. He was <keyword id="19900069" type="General" weightage="20" keywordseo="arrested" source="keywords">arrested</keyword> in a 2017 Jammu and Kashmir <keyword id="20041532" type="General" weightage="20" keywordseo="terror-funding-case" source="keywords">terror funding case</keyword>. Delhi Chief Minister <keyword id="19901384" type="General" weightage="100" keywordseo="Arvind-Kejriwal" source="keywords">Arvind Kejriwal</keyword> will return to <keyword id="56350" type="General" weightage="20" keywordseo="tihar-jail" source="Orion">Tihar jail</keyword> on Sunday as his interim bail in a money laundering case linked to the alleged Delhi liquor policy scam ends on Saturday (June 1). Kejriwal was given interim bail by the <keyword id="19895345" type="General" weightage="20" keywordseo="supreme-court" source="keywords">Supreme Court</keyword> to campaign for the Lok Sabha elections on May 10 and was asked to surrender to Tihar jail on June 2. The Delhi CM had earlier moved the Supreme Court for an extension of interim bail. On Wednesday, the Supreme Court rejected his plea, stating that since he was given liberty to move the trial court for regular bail, the plea here is not maintainable. Meanwhile, Delhi's Rouse Avenue Court on Saturday reserved the order on the interim bail plea moved by Kejriwal, citing medical reasons in a money laundering case related to the alleged excise policy scam. The court fixed June 5 for the pronouncement of the order on the plea seeking 7-day bail, while refused to pass the order today itself as requested by Kejriwal's Lawyer. Senior Advocate N Hariharan, who appeared for Kejriwal, submitted that the interim bail was to campaign for his party (the Am Aadmi Party), which is a national party. "I am out for 20 days and had I not done it, you would've said see he didn't campaign and fell ill. It was a lot of stress due to the campaigning and you know that stress is a aggrevator of diabetes. What was alarming was that keto levels rose in the urine. The aspect of concern is the high level of sugar and the keto numbers," Kejriwal's advocate submitted in the plea. Appearing for the Directorate of Enforcement (ED), Solicitor General Tushar Mehta and Additional Solicitor General SV Raju submitted that Arvind Kejriwal suppressed facts including about his health conditions. During preliminary arguments, ED lawyers stated that they have objections to filing interim bail as well. This court cannot modify the Supreme Court order. He's on interim bail because the SC granted it, what he is asking here is an extension of the Supreme Court order," the ED lawyers submitted. "This interim bail plea is required to be dismissed as it is full of suppression of facts. The Supreme Court had granted Liberty to him that he can file regular bail but the liberty to seek an extension of interim bail was not granted to him. He has said that these tests require 7 days, but the nature of the test has been suppressed," they further stated. ED also raised maintainability issues on interim bail plea and submitted that instead of getting a medical test done, he was travelling across. Medical tests would take more than one hour. ED further submitted that the applicant in fact has gained 1 kg weight and falsely claimed that he has lost 7 kg weight. The Registrar of the Supreme Court has passed a speaking order and the same has been suppressed by them. There is a reason for suppression and it is because he had been travelling for campaigning purposes, but he didn't get the tests done then, ED said. Recently Kejriwal through his legal team filed two different bail applications before the concerned court. His regular bail plea is listed for a hearing on June 7, 2024. Earlier, Arvind Kejriwal posted an emotional message on Friday and said that he is proud that he is going to jail to save the country from dictatorship. In his video message, Kejriwal said, "Tomorrow the 21 days are getting over, the day after tomorrow I have to surrender. I don't know how long they will keep me in jail this time. But my spirits are high. I am going to jail to save the country from dictatorship. I am proud of this. They tried to break me many times, tried to make me bow down but I didn't." Kejriwal was arrested by the ED on March 21 in connection with a money laundering probe relating to alleged irregularities in the now-cancelled <keyword id="20106989" type="General" weightage="20" keywordseo="Delhi-Excise-Policy" source="keywords">Delhi excise policy</keyword> 2021-22.

Delhi excise policy case: Arvind Kejriwal to return to Tihar Jail today, no relief from Court

<keyword id="4637" type="ORGANIZATION" weightage="100" keywordseo="Sahara">Sahara</keyword> chief <keyword id="31933" type="PERSON" weightage="100" keywordseo="Subrata-Roy">Subrata Roy</keyword>'s lawyers have moved the <keyword id="6354977" type="ORGANIZATION" weightage="100" keywordseo="Supreme-Court">Supreme Court</keyword>, seeking a deal room in <keyword id="56350" type="PERSON" weightage="100" keywordseo="Tihar-jail">Tihar jail</keyword> to help Roy raise the amount of Rs 10,000 set by the court as a condition for his bail. The room would be used negotiate business deals. 
 
An application regarding this request was moved by senior advocate KTS Tulsi before a bench headed by Justice TS Thakur. 
 
"He has to deal with people in five different time zones. Some of the potential buyers and lenders want to meet before submitting their financials," Tulsi said. "These would be facilities outside the jail but within the complex." 
 
According to the application by Sahara, the "applicants... appeal to shift them from barrack no. 3 of Tihar jail to an out-house in the Tihar jail premises so that they can enter into effective and fruitful negotiations with prospective buyers, lenders for the sale, encumbrance of domestic and three overseas properties of the group companies."

Subrata Roy Demands Deal Room At Tihar

Starting August 5 and for the following 10 days, Delhi’s Tihar jail will have the sort of visitors who generally find themselves working in very different circumstances. They’ll be coming to see Sahara chief Subrata Roy, who’s trying to raise Rs 10,000 crore as a get-out-of-jail card by selling or mortgaging real estate assets. 
 So how is Tihar preparing for this unusual event? A large 30x18 ft conference room with an attached bathroom and a 12x12 ft annexe inside the <keyword id="2456860" type="ORGANIZATION" weightage="20" keywordseo="Tihar-court">Tihar court</keyword> complex are being readied for Roy and two Sahara directors, Ashok Roy Choudhary and <keyword id="709634" type="PERSON" weightage="20" keywordseo="Ravi-Shankar-Dubey">Ravi Shankar Dubey</keyword>, who are also lodged in the same prison. 
 
Jail authorities have sent a letter to Delhi Lieutenant-Governor Najeeb Jung to notify the conference room as a special jail but with certain relaxations — phones and laptops, WiFi connectivity and visitors from 6 am to 8 pm on all days except Sundays and gazetted holidays. 
 The <keyword id="31906" type="COMPANY" weightage="20" keywordseo="Sahara-group">Sahara Group</keyword> will pay for the privileges. The room, which is used for confidential meetings and press briefings by the directorgeneral of prisons, has a 52-inch TV for making presentations, video-conferencing and a table that seats 25. 
 
It also has wood-paneled walls and is fully air-conditioned. 
 
Visitors coming to meet Roy to be frisked 
 
All Visitors Coming to meet Roy to be Frisked Roy’s guests — corporate bigwigs, investors, top lawyers, merchant bankers, et al — will get vegetarian meals, snacks and tea prepared in the jail canteen, which is manned by a few longtime inmates. All visitors will be subject to frisking. 
 
The Sahara chief has been in Tihar jail since March over the issue of refunds to investors in a financial instrument issued by two group companies in violation of norms. The Securities and Exchange Board of India says Sahara has to pay more than Rs 37,000 crore by way of the refund amount and interest. 
 While Sahara says it has already paid much of the money that is due, the <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> has told Roy that he needs to raise Rs 5,000 crore in cash and Rs 5,000 crore by way of bank guarantees to get bail. 
 
The Sahara boss and the two directors are currently housed in a section for inmates above 60. As with other parts of the jail, no cellphones and laptops are allowed and jammers restrict all forms of electronic communications. That’s why Roy and his team need to be relocated. “We can’t switch off the jammers just for one person. It will send a wrong message to others. It could become a precedent of sorts if we allow him privileges inside the jail and other inmates might start asking for similar things then,” said a senior jail official, who did not want to be named. 
 The court order permits Roy and his team to conduct business meetings and negotiations in the designated area. The most valuable properties on the Sahara list are its three international hotels — Grosvenor House Hotel in London and <keyword id="999813" type="COMPANY" weightage="20" keywordseo="The-Plaza">The Plaza</keyword> and Dream Downtown Hotel in New York. 
 
ET reported last month that those looking to buy the properties include the Poonawalla family based in Pune, an investor group linked to the Qatar royal family and Sultan Hassanal Bolkiah of Brunei. 
 
The Poonawallas have made an offer of £550 million for the London property. One of the world’s largest luxury property investors Madison has offered $800 million for Sahara’s New York hotels. 
 
The terms under which Sahara has been allowed to set up the deal room are listed in the affidavit filed by Rajesh Kumar, superintendent of Central Jail No 3 at Tihar. 
 
“They will have to submit a list of visitors to the superintendent in advance. Confidentiality will be maintained,” said the jail official cited above. 
 
In his affidavit, Kumar had also suggested a second option — a guest house at the new residential complex, which is a type V government accommodation with three double rooms, a single room and two toilets — but the conference facility was found more suitable to conduct business. The conference room is within the Tihar court complex, which usually convenes once a month to deal with petty offences. 
 
“It already is a secure place. There is one common entry and exit point that will be monitored by CCTV cameras,” said another official aware of the planning. 
 
Roy and the two directors will stay at the annexe attached to the conference room and will be free to conduct business through the night considering that they will be dealing predominantly with people in the US and Europe. However, secretarial staff will only be allowed at visiting hours. 
 
Tihar jail is a 200-acre facility, the largest prison complex in South Asia, and has different wards for different types of inmates — firsttimers, hardcore criminals and those over 60. Roy and the two directors are housed in a single room in the over-60 block where there are regular medical check-ups and sevadars to take care of prisoners’ basic needs. 
 For health reasons, Roy sometimes asks for khichdi from the jail canteen for which he pays, said the <keyword id="2456859" type="UNKNOWN" weightage="20" keywordseo="first-jail-official">first jail official</keyword> cited above. He sticks to himself for the most part and is usually meditating on his own, the person said.

"Cockroaches and rodents are plentiful and glue tracks have been placed in Ms. Maxwell's day area to help remediate the problem."<h2>The Brooklyn jail has similar problems to the shuttered Manhattan jail, attorneys say</h2>Maxwell is far from the only high-profile defendant to spend time in the MDC. Federal marshals shuttle R. Kelly between the jail and the federal courthouse in Brooklyn every day for his ongoing sex-crimes trial. It has also served as a home, if temporarily, for Tekashi 6ix9ine, Martin Shkreli, Keith Raniere, and Michael Cohen.The MDC, in Brooklyn's Sunset Park neighborhood, has absorbed around 100 people from Manhattan's MCC, <a href="https://www.nydailynews.com/new-york/ny-manhattan-federal-jail-mcc-closing-gun-troubled-jefrrey-epstein-20210826-uncwx3dddja6vjqjovnrfegumi-story.html">according to the New York Daily News</a>, and <a href="https://www.bop.gov/locations/institutions/bro/">holds around 1,600 people overall</a>. The facility holds mostly pretrial detainees, who are presumed innocent under the law. Defense attorneys <a href="https://www.courthousenews.com/manhattan-jail-closure-renews-concerns-over-brooklyn-facility-conditions/">say it nonetheless routinely flouts civil liberties</a>, including preventing access to quality and timely medical care."It's not any better," civil rights attorney Andrew Laufer told Insider. "They both have very similar habitability problems. Heating and cooling are very poor, sanitary conditions, infestation of insects, sewage - you name it. It's just a mess."For years, the jails have been plagued with personnel problems. Day-to-day problems have worsened in the coronavirus pandemic. They lurch from crisis to crisis, from the gun smuggling to Jeffrey Epstein."A spokesperson for the Department of Justice did not answer Insider's questions about conditions at the MDC."The Department of Justice is committed to ensuring that every facility in the federal prison system is not only safe and secure, but also provides people in custody with the resources and programs they need to make a successful return to society after they have served their time," the spokesperson said.<h2>A blackout in 2019 brought attention to the jail's conditions</h2>Problems at the MDC gained national attention in January 2019, when <a href="https://www.nytimes.com/2019/02/09/nyregion/brooklyn-jail-no-heat-inmates.html">a weeklong blackout</a> amid a polar vortex left incarcerated people stuck in their cells in single-digit temperatures. The people had little light, were unable to receive their medication, couldn't talk to their lawyers or family members, and couldn't even file administrative complaints, according to a Justice Department Inspector General report and a lawsuit filed on behalf of defendants. Members of the jail staff, the report said, were indifferent.The Federal Defenders of New York, <a href="https://www.federaldefendersny.org/about-us/">a group of defense attorneys that fight against mass incarceration</a>, sued the Bureau of Prisons in May of 2019, <a href="https://www.courthousenews.com/wp-content/uploads/2019/02/mdc.pdf">demanding</a> it admit to civil liberties violations and asking a judge to order reform at the facility. In 2020, former US Attorney General Loretta Lynch was appointed to mediate the lawsuit.<div type="image" title="mdc brooklyn" height="1666" width="2223" msid="86103430" hostid="261"></div>The closure of the <keyword id="12069582" type="UNKNOWN" weightage="60" keywordseo="manhattan-mcc" source="Orion">Manhattan MCC</keyword> and transfer of people to the Brooklyn facility may just make things worse, according to Jenna Dabbs, an attorney at Kaplan Hecker &amp; Fink LLP, who is representing the Federal Defenders of New York in its lawsuit."Without thoughtful advance planning, this transition will unquestionably jeopardize the constitutional rights, including access to legal counsel, of those whose lives have been entrusted to these facilities," she told InsiderThe Inspector General <a href="https://oig.justice.gov/reports/2019/e1904.pdf">report</a>, authored in May 2019, found the jail's leaders had ignored urgent HVAC issues for years and failed to communicate with the public about how conditions had changed. It's not uncommon, he said, for him to sue jails in order to get access to his incarcerated clients, or ensure they get proper medical care. Underlying issues like understaffing "by and large repeat themselves prison to prison," he said.If anything, he said, the Manhattan and Brooklyn jails had a big advantage over other jails: They were easier to access. Jails like Rikers Island, in remote locations, made it harder for defense attorneys like him to have a window into how their clients are living."They're in the city, so you could always stop by it in between court appearances or after court appearances," he said. By Yoshita Singh United Nations, Apr 7 () The UN human rights body has urged nations to release individuals detained without sufficient legal basis, including political prisoners, as the world body stressed the need to take a very close look at incarcerations and reduce overcrowding in prisons to prevent catastrophic rates of COVID-19 infection.Rupert Colville, spokesperson for the UN High Commissioner for Human Rights, said recently in Geneva that some countries have been announcing prisoner releases of varying numbers, including of specific at-risk groups such as pregnant women, people with disabilities, elderly prisoners, those who are sick, minor and low-risk offenders, people nearing the end of their sentences and others who can safely be reintegrated into society. "We urge states to release every person detained without sufficient legal basis, including political prisoners, and those detained for critical, dissenting views," Colville said."We stress that with respect to people fairly convicted of serious crimes recognised under international law, or prisoners who might pose serious risk to others, they should only exceptionally be considered for temporary release from custody during the course of the pandemic," he said. Secretary-General Antonio Guterres' spokesperson Stephane Dujarric on Monday said that the UN chief "believes that member states need to take a very close look at incarcerations during a time of COVID-19. It's something the High Commissioner for Human Rights has spoken out about."Dujarric was responding to a question about the release of prisoners in Kashmir. He noted that Iran has increased releases to around 100,000 inmates -- representing 40 per cent of the entire prison population -- and that Indonesia has announced that it would free 30,000 individuals convicted of minor crimes, including drug use."And we understand India and Turkey are similarly considering or in the process of releasing a large number of inmates," he said.The Uttar Pradesh government has decided to free 11,000 prisoners lodged in 71 jails in the state amid the COVID-19 outbreak in India. The Tihar Prison authorities in Delhi also said they are planning to release around 3,000 prisoners to ease congestion in jails over the coronavirus threat. Other prisons in India are also taking similar steps. Concerns remain about Syrian detainees.The Office of the High Commissioner for Human Rights (OHCHR) has described the situation in all official prisons and makeshift detention facilities in Syria as "alarming".Well before the COVID-19 outbreak, the OHCHR warned of overcrowding in central prisons and in facilities run by the four government security branches as the nine-year civil war still rages, and in the Sednaya military prison.Previous reports from the UN office have highlighted deaths in these facilities, including as a result of torture and denial of medical care.Vulnerable people detained in Syria include the elderly, women, children and many with underlying health conditions -- some of them as a result of ill-treatment and neglect, experienced while in detention, the OHCHR said. Political prisoners should be among first released in pandemic response: UN rights chief

<keyword id="31906" type="COMPANY" weightage="20" keywordseo="Sahara-group">Sahara Group</keyword>'s corporate group head <keyword id="31933" type="PERSON" weightage="20" keywordseo="Subrata-Roy">Subrata Roy</keyword>, who has been lodge in Tihar Jail since March 24, has moved the <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> on Tuesday to seek urgent medical help to arrest his deteriorating health condition. 
 
The 66-year-old has been jailed for not complying with the apex court's August 31, 2012 directions to return an amount of Rs 24,000 crore to its 3 crore investors with interest through market regulator SEBI. 
 Mentioning the matter before a bench led by Justice TS Thakur, senior advocate Sidharth Luthra informed the court that Subrata Roy was suffering from <keyword id="24294" type="UNKNOWN" weightage="20" keywordseo="high-blood-pressure">high blood pressure</keyword> (BP), which could further lead to a stroke. 
 
It is important to note, the income tax department had seized Rs 137 crore in cash from Sahara offices in Delhi and Noida during raids on Monday. 
 
Earlier, the court had granted bail to Roy on the condition that he deposits Rs 10,000 crore as part payment of the total amount due from Sahara Housing and Sahara Real Estate. The two Sahara firms were found to have illegally raised the money from three crore small investors through one-time fully convertible debentures (OFCDs). 
 
Notably, the bench told Luthra that it would hear the application on Wednesday, and pass appropriate directions to the Tihar jail authorities provided the plea was filed in the registry in proper form. 
 
The Sahara group is planning to file fresh application seeking Roy's release on medical grounds, as per media reports.

Juarez and her daughter Mairee were stopped by CBP agents and held for three weeks at a detention center in Dilley, Texas, where the infant fell ill.Juarez <a href="https://www.cnn.com/2018/11/28/health/texas-ice-yazmin-juarez-child-lawsuit/index.html" target="_blank" rel="noopener">said in a later lawsuit</a> that she repeatedly requested medical attention for Mairee's declining condition during their time at the facility, but was only prescribed medication that didn't have any noticeable effect.Once they were released to join family in <a href="https://www.northjersey.com/story/news/new-jersey/2018/08/29/mother-blames-poor-care-immigration-facility-babys-death/1119260002/" target="_blank" rel="noopener">New Jersey</a>, Mariee was coughing, vomiting and battling a high fever. Juarez rushed her to an Edison, New Jersey hospital the day after landing in the state on March 25, where she was held for respiratory failure.Mariee would remain there for weeks before she suffered a fatal hemorrhage on May 10.After Mairee's death, Juarez filed a notice of claim against Eloy, Arizona<a href="https://www.cnn.com/2018/08/28/us/texas-ice-child-death/index.html" target="_blank" rel="nofollow noopener">,</a> saying that ICE placed her and her daughter in a facility "with unsafe conditions, neglectful medical care, and inadequate supervision." The notice goes on to claim that Mairee contracted a respiratory infection that "went woefully under-treated for nearly a month."Juarez's lawyers filed a claim last month for <a href="https://apnews.com/7880870980b34cf992adc7fb430c848d" target="_blank" rel="noopener">$60 million</a>, to which the government has six months to respond before a suit can be filed. <keyword id="4637" type="ORGANIZATION" weightage="100" keywordseo="Sahara">Sahara</keyword> has deposited Rs 3,117 crore with market regulator the Securities and Exchange Board of India (<keyword id="35210" type="ORGANIZATION" weightage="100" keywordseo="sebi">Sebi</keyword>) and promised to pay the remaining Rs 1,883 crore soon. The <keyword id="6354977" type="ORGANIZATION" weightage="80" keywordseo="Supreme-Court">Supreme Court</keyword> will now hear Sahara group chief <keyword id="31933" type="PERSON" weightage="100" keywordseo="Subrata-Roy">Subrata Roy</keyword>’s interim bail plea on Thursday and decide whether he will be allowed to come out of Tihar jail. 
 
The court had earlier refused to relax the conditions — depositing Rs 5,000 crore in cash and Rs 5,000 crore through bank guarantee with Sebi — for his interim bail. 
 
In an affidavit filed on Monday, Sahara said, “the company has deposited Rs 3,117.53 crore of which Rs 2,705.70 crore are from encashment/sale/transfer of FDs, bonds and securities while the balance Rs 411.82 crore were from sale proceeds of land at Ahmedabad." 
 
"Now less than Rs 2,000 crore remain to be deposited by the Saharas in compliance with the March 26 order. This shall be done as early as possible," the group said. 
 
The group may deposit Rs 1,883 crore with Sebi by going ahead with the sale of the nine properties it had listed before the court. Of the nine, it has already sold one - the Ahmedabad land for Rs 412 crore. 
 
Sahara chief Roy is in Tihar jail since March 4 after the court found that two companies of the group had failed to comply with its order to pay back Rs 26,000 crore to investors.
