New Delhi, The <keyword id="6354977" type="General" weightage="50" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Friday stayed the conviction of Congress leader <keyword id="5268" type="General" weightage="100" keywordseo="rahul-gandhi" source="Orion">Rahul Gandhi</keyword> in a 2019 defamation case over his Modi surname remark, restoring his status as an MP. A three-judge bench of Justices B R Gavai, P S Narasimha and <keyword id="14272" type="General" weightage="80" keywordseo="sanjay-kumar" source="Orion">Sanjay Kumar</keyword> said no doubt that the utterances were not in good taste and that a person in public life is expected to exercise caution while making public speeches. "No reason has been given by the trial judge for imposing maximum sentence, the order of conviction needs to be stayed pending final adjudication," the bench said. The top court was hearing a plea by Gandhi challenging the Gujarat High Court verdict which dismissed his plea seeking a stay on his conviction in a defamation case over his "Modi surname" remark. Former Gujarat minister Purnesh Modi had filed a criminal defamation case in 2019 against Gandhi over his "How come all thieves have Modi as the common surname?" remark made during an election rally in Kolar in Karnataka on April 13, 2019.

The honourable Supreme Court of India has asked Congress scion <keyword id="5268" type="PERSON" weightage="100" keywordseo="Rahul-Gandhi">Rahul Gandhi</keyword> to either express regret for his comments holding the Rashtriya Swayamsevak Sangh (<keyword id="42498" type="COMPANY" weightage="100" keywordseo="RSS">RSS</keyword>) responsible for Mahatma Gandhi's assassination or be ready for a trail for defamation. 
 
"RSS people killed Gandhiji and today their people (BJP) talk of him...They opposed Sardar Patel and Gandhiji," Rahul had said while he was addressing a public rally in Thane in March 2014. 
 
"Why did you make a sweeping statement against the RSS branding everyone associated with the organization in the same brush," an SC bench asked Rahul Gandhi on Tuesday, when it was hearing a defamation case that has been filed against him based on his remarks. 
 
"You can't make wholesale denunciation of an organization," it added.

From Rahul Gandhi's side, the counsel said that he was right in stating as what he said was a historical fact, and can be found in government records, as per <a href="http://timesofindia.indiatimes.com/india/RSS-killed-Gandhi-Express-regret-or-face-trial-Supreme-Court-tells-Rahul-Gandhi/articleshow/53279452.cms">TNN</a>.

Congress accuses Twitter of ‘double standards’ for allegedly locking 5000 accounts of party leaders and workers

In addition to conceding ground in Telangana, India’s ruling party, the <keyword id="58687" type="ORGANIZATION" weightage="20" keywordseo="Bharatiya-Janata-Party">Bharatiya Janata Party</keyword> (BJP), was <a href="https://www.businessinsider.in/we-accept-the-peoples-mandate-indias-state-election-results-prove-a-huge-setback-for-pm-narendra-modis-bjp/articleshow/67053526.cms">beaten</a> in <keyword id="6355644" type="DEFINITION" weightage="20" keywordseo="elections">elections</keyword> in the states of Rajasthan, Madhya Pradesh and Chattisgarh by the main opposition party -- the Indian National <keyword id="1575" type="ORGANIZATION" weightage="20" keywordseo="Congress">Congress</keyword>. It wouldn’t be remiss to say that the BJP was expecting a better performance in the three states, all of which lie in the Hindu heartland. While the party suffered heavy defeats in Rajasthan, where power has alternated between the BJP and Congress since 1993, and Chattisgarh, it fell short of the Congress by a few seats in Madhya Pradesh, where it was campaigning for its record fourth consecutive term. And so begins a period of introspection for India’s ruling party, which up until yesterday, seemed insurmountable in the face of a divided opposition. While the BJP blames the results on <a href="https://economictimes.indiatimes.com/news/politics-and-nation/local-issues-determined-outcome-will-do-better-in-2019-bjp/articleshow/67049584.cms">“local issues,”</a> in effect, downplaying any apprehensions they have about their strength ahead of next year’s Lok Sabha elections, it remains to be seen what exactly went wrong. Here are a few possible reasons: The anti-incumbency wave One of the primary explanations here seems to be that the BJP underestimated the anti-incumbency problem and how it was mostly targeted at chief ministers. Despite its diverse makeup, the Indian electorate can be remarkably consistent when it comes to voting for change. Anti-incumbency is always a key consideration in the minds of voters come election time and this time it was no different The BJP was the ruler in all three states that it lost to the Congress, and failed to make a good enough case for re-election. This was compounded by the general resentment of upper-caste voters, who felt shunted by recent changes to the SC/ST Act. The BJP wasn’t able to demonstrate that it had made good on its promises. For example, in Rajasthan, Chief Minister Vasundhara Raje, did not deliver on her goal of creating 1.5 million new jobs. Meanwhile its rival Congress swayed voters with promises of better welfare schemes a change in the way of doing things. Farmer distress A number of factors have dominated the public conversation in India all year: High fuel prices, youth unemployment, lack of funds for small businesses and most importantly, the need for farmers to secure debt relief. The BJP suffered heavy losses in rural constituencies as compared to urban ones, and this may be due to the fact that it didn’t cater to a crucial voter bloc. Madhya Pradesh is largely a rural state, and a significant proportion of its voters are farmers. In fact, the BJP lost a number of seats in <a href="https://economictimes.indiatimes.com/news/politics-and-nation/distressed-farmers-speak-out-via-ballots/articleshow/67053185.cms">two key regions in the state</a> that were notable for farmer suicides and protests. In contrast, the Congress made farmers a key part of its election proposals. In addition to promising an increase in the minimum support price for agricultural commodities, <keyword id="5268" type="PERSON" weightage="20" keywordseo="Rahul-Gandhi">Rahul Gandhi</keyword> alluded to a <a href="https://economictimes.indiatimes.com/news/politics-and-nation/rahul-gandhi-hints-at-nationwide-farm-loan-waiver/articleshow/66962964.cms">national waiver</a> for all farmers - an unrealistic proposal, but one that resonated nonetheless - while criticising the Modi administration’s supposed approach to writing off the bad loans of large companies. The BJP was unable to present an adequate response or counter-offer to the Congress’s pitch to farmers. A failure of leadership Anonymous sources told the <a href="https://indianexpress.com/elections/state-assembly-elections-2018-rumbling-in-bjp-just-as-they-take-credit-top-should-share-blame-too-5489279/">Indian Express </a>that the BJP’s core leadership played a very heavy hand in deciding electoral strategies in each state and did not decentralise power to the chiefs of state units, which resulted in them overlooking issues of local importance. In addition, there were reports of conflicts between state chiefs and party leaders, as seen in the tussle between Raje and BJP President <keyword id="6355521" type="PERSON" weightage="20" keywordseo="amit-shah">Amit Shah</keyword> over the <a href="https://scroll.in/article/901550/rajasthan-elections-amit-shah-vasundhara-raje-now-at-loggerheads-over-ticket-distribution">distribution of tickets in Rajasthan.</a> There were also complaints of “overconfidence” among the party’s leaders, a plausible claim given the BJP’s strong showing in multiple state elections over the last few years. More importantly, its decision to play into the Hindutva nationalism narrative, as evidenced by sending UP Chief Minister Yogi Adityanath on the campaign trail and bringing up the Ram Temple issue, did not pay off. The electoral victory is the most significant one for the Opposition since the BJP stormed to power in the general elections of 2014 on a wave of popular support for Brand Modi. It may be too soon to say if the Modi star is dimming, however. In fact, the string of losses will likely propel the ruling party to rely more on its star figure and hand out more sweeteners to allies and farmers as campaigning for the general elections ramps up. The Congress showed that it is still a force to reckon with in the Hindi-speaking belt of India and will now have a renewed vigour when it comes to sealing alliances with other opposition parties. Having presented the election results as a collective assessment on the Modi government, it is in a strong position to take on India’s ruling party in next year’s Lok Sabha elections. However, it remains to be seen if the promise of loan waivers and freebies can fuel its campaign. The stage is set for an interesting 2019. New Delhi, Nov 14 () Welcoming the Supreme Court verdict on Rafale jet, Finance Minister Nirmala Sitharaman on Thursday said the ruling vindicates the government's stand on the fighter plane's pricing, decision making process and offset partner selection.
Sitharaman held the defence portfolio when the Rafale issue heated up during the Lok Sabha polls.

 She also said that the 'Chor' comment by the then Congress president Rahul Gandhi was irresponsible and he should tender an apology for misleading the people.
 "Chor comment by Shri. @RahulGandhi of @INCIndia repeated several times over for political gains, brazenly accusing the @PMOIndia is called out for what it is, irresponsible. He should apologise to the nation for misleading the people with blatant lies, even in the Lok Sabha," she said in another tweet.
"@INCIndia should introspect for having sailed along even as its leader repeatedly insulted @PMOIndia. #NationalSecurity can't be compromised for political ambitions. The Armed Forces were demoralised by the brazen allegations against the then Chief of @IAF_MCC by the @INCIndia," she said.
 The Congress and its leader Rahul Gandhi carried out an aggressive campaign before the last Lok Sabha elections against the multi-billion dollars deal to buy 36 Rafale fighter aircraft from France.
 During the protests, the opposition parties disrupted the proceedings of both houses of Parliament for days together.
 The Supreme Court on Thursday refused to re-examine the aspects of pricing, decision making process and selection of the offset partner in India's deal for purchase of Rafale jet fighters from French company Dassault Aviation.
In the review petition, there were allegations of irregularities on pricing and doubts were raised on decision making in giving priority to Rafale. Aspersions were also cast on choosing Anil Ambani's company as an offset partner.
 The apex court dismissed the pleas seeking review of the December 14, 2018 verdict in which it had said that there was no occasion to doubt the decision-making process in the procurement of 36 Rafale fighter jets. DP MKJ

As per early trends, congress is leading the only Lok Sabha seat. IndiaToday-AxisMyIndia exit polls 2019 predicts that Mayavati’s BSP (Bahujan Samaj Party) is set to win from 16 seats in Uttar Pradesh. This number is the total seats the party will get in the state along with its allies SP and RLD. IN 2019 elections, BSP nominated its candidates from 38 seats. As per the seat sharing arrangement, SP contested from 37 seats and RLD faced the elections from 3 seats. Mayavati has chosen not to contest in 2019 Lok Sabha elections in order to focus more on the election campaign for the victory of her Mahagathbandhan. As per the Chanakya-News24 Exit Poll, the BSP- SP and RLD coalition might win 13 out of 80 seats with over 65 seats predicted for the BJP from the state and just 2 seats predicted for the Congress party. Uttar Pradesh state has the largest number of parliamentary seats in the country numbering 80 in total. In 2014 elections for the Lok Sabha, BSP could not get a single seat in UP. In 2009 elections, BSP got 20 seats from UP leaving BJP with just 10 seats. In 2004 and 1999 Lok Sabha elections, the results gave the party 19 seats and 14 seats respectively. Talking of the vote share in 2014 elections, BSP had got 19.6 % votes in the state while the BJP had got 42.3 % votes. Some of the key candidates like Haji Fazulrahman contested for Saharanpur seat, Girish Chandra was nominated by the party from Nagina (SC) and Amar Chandra Jauhar faced the elections from Shahjahanpur (SC). While nominating their candidates as per the seat sharing agreement, BSP and SP gave two seats for RLD. These two parties have decided not to contest in the two constituencies of Amethi and Raebareli from where the Congress President Rahul Gandhi and Sonia Gandhi are contesting.

Telecom Minister <keyword id="6354886" type="PERSON" weightage="20" keywordseo="Ravi-Shankar-Prasad">Ravi Shankar Prasad</keyword> on Monday hit out at British telco Vodafone for "dictating" terms to India when it threatened of withdrawing from the Indian market following a SC ruling. He also said Mahanagar Telecom Nagar Ltd and Bharat Sanchar Nigam Ltd are strategic assets that should remain in the fray and ensure better competition. After the Supreme Court's ruling on the adjusted gross revenues (AGR) that created a liability of Rs 1.4 lakh crore for telecom firms, Vodafone's global leadership had cast doubts over the future of the company in India.
 "I don't appreciate this kind of statement, firmly and clearly. We have given all the options of doing business but no one should dictate terms to us. India is a sovereign country," Prasad said while speaking at the Times Network's India Economic Conclave.
 "India is a sovereign country, we are open to give all the benefits, all the indulgence, all the help, open to all the suggestions. But, any form of dictation is plainly not acceptable," the minister added.
 Prasad welcomed the explanation given by the company, wherein it had said those remarks were misquoted.
 He said the government has given a potential benefit of up to Rs 42,000 crore by agreeing to defer the spectrum repayment period for the telcos and expressed an inability to do anything beyond that.
 State-owned companies such as GAIL and RailTel Corporation of India have also made representation to the ministry.
 Prasad exhorted the private sector telcos to provide flawless service with enriching customer experience by making the right investments.
 Meanwhile, on the Citizenship Amendment Act-related protests, Prasad said the violence "is regrettable and is also sponsored".
 He also said, "Some people are trying to provoke communal violence. Political parties have to rise beyond petty politics."
 He also decried Rahul Gandhi's statement on Veer Savarkar over the weekend, terming it as "irresponsible and deliberate denigration of a great son of india". <ul><li>The <keyword id="6355187" type="UNKNOWN" weightage="20" keywordseo="lok-sabha">Lok Sabha</keyword> lost 127 hours and 45 minutes due to disruptions while the Rajya Sabha wasted 121 hours. </li><li>In the time spent sitting by the Lok Sabha, a grand total of five bills were passed as against a planned target of 40. Two of these, the Finance Bill and the Appropriation Bill, were passed in less than half an hour. </li><li>Around ₹3.7 billion rupees of taxpayers money was lost as a result of the disruptions to the Budget Session. </li></ul>The 2018 Budget session, which concluded on April 6th, saw India’s <keyword id="6354721" type="ORGANIZATION" weightage="20" keywordseo="parliament">Parliament</keyword> record another unflattering statistic. According to PRS Legislative Research, Delhi-based think tank, it was the <a href="http://www.prsindia.org/uploads/media/Budget%202018/Vital%20Stats%20-%20Budget%20Session%202018.pdf">least productive Budget Session</a> since 2000. Based <a href="http://164.100.47.193/statement/files/statementofwork.pdf">on information</a> from the Lok Sabha secretariat, 127 hours and 45 minutes were wasted in the Lower House of Parliament while business was conducted for only 34 hours. The Rajya Sabha (Upper House) fared slightly better, sitting for 44 hours and wasting 121. All in all, 249 out of a total of 327 hours were completely wasted, culminating in a productivity level of 24%. If you can call it productivity. In human terms, if an MP in the recent session was given four hours to do something, he or she spent three hours arguing about this responsibility, 45 minutes sitting down to think about it and 15 minutes actually doing it. In the time spent sitting by the Lok Sabha, a grand total of five bills were passed as against a planned target of 40. Two of these - the Finance Bill, which comprises taxation measures, and the Appropriation Bill, which details spending plans for government ministries - were passed in quick succession on March 14th. The Speaker of the Lok Sabha, Sumitra Mahajan, was able to pass the bills in less than half an hour without any discussion by administering the “guillotine process”. When a guillotine is applied, all outstanding proposals need to be voted on once a fixed time for discussion is over. The hours wasted by Parliament aren’t borne by MPs but by taxpayers. In September 2012, following a washed-out Monsoon session, the Union Minister for Parliamentary Affairs, Pawan Kumar Bansal, said that the cost to the Exchequer of running the Parliament for <a href="https://www.ndtv.com/india-news/each-minute-of-running-parliament-in-sessions-costs-rs-2-5-lakh-govt-498784">one minute was ₹250,000</a>, a figure which has since been routinely quoted. Based on this estimate, around ₹3.7 billion rupees of taxpayers money was lost as a result of the disruptions to the Budget Session, excluding the salaries of MPs. But one can’t just look at this in monetary terms. There is a significant cost to bills being delayed, not only for the intended beneficiaries of such bills, but in terms of the time they take up in future sessions of Parliament which would normally be reserved for newer bills. At the end of the Budget Session, there were <a href="http://www.prsindia.org/uploads/media/Budget%202018/Session%20wrap%20Budget%20Session%202018.pdf">68 bills pending</a> for discussion and passage, including the Transgender Persons (Protection of Rights) Bill, the Financial Resolution and Deposit Insurance Bill and the Whistleblowers Protection Bill. India’s electorate aren’t unfamiliar with washouts in Parliament. A number of sessions in recent years have been been largely unproductive and beset by interruptions. For example, the Winter Session in 2016, which took place right after the demonetisation, lost 19 of its 21 days due to disruptions. In the absence of institutional incentives to be productive, India’s MPs have no qualms in substituting debate with protests. These disruptions, rather than individual actions, are usually a coordinated ploy by opposition parties too highlight the government’s failings and are met with a equal reaction by ruling parties who wish to stall discussion over a topic. The blame game This Budget Session was no different and both sides were to blame. First, the <keyword id="1575" type="ORGANIZATION" weightage="20" keywordseo="Congress">Congress</keyword> and <keyword id="14666" type="ORGANIZATION" weightage="20" keywordseo="BJP">BJP</keyword> pointed fingers at each other over the Nirav Modi scam at Punjab National Bank. Then, the Telugu Desam Party (TDP), along with opposition parties, started protesting against the Centre’s decision to not give the state special category status. This led to a notice of a no-confidence motion, which was never brought to the floor, which only served to amplify the Opposition’s protests. Even though the BJP had the seats to quash the no-confidence motion, it probably did not want to risk the scrutiny and questions that came with such a motion. Finally, the latter end of the session featured disruptions related to the Cauvery water sharing dispute between Karnataka and Tamil Nadu as well as the Supreme Court’s dilution of the SC/STs Act. The blame game and hollow gestures continued well after the end of the Budget Session. On April 5th, the members of the ruling administration said that they would <a href="https://timesofindia.indiatimes.com/india/nda-mps-wont-take-pay-for-23-wasted-days/articleshow/63618705.cms">forgo their salaries </a>for the 23 wasted days in the second part of the Budget Session, which they attributed to the Congress. On April 9th, Rahul Gandhi led <a href="https://www.financialexpress.com/india-news/rahul-gandhis-fast-at-rajghat-sajjan-singh-jagdish-tytler-asked-to-leave-top-developments/1126556/">a nationwide, day-long fast </a>to protest against the BJP government and the Parliament’s inability to function. The BJP responded with <a href="http://indianexpress.com/article/india/pm-narendra-modi-fast-on-april-12-why-is-pm-fasting-bjp-protests-rahul-gandhi-congress-amit-shah-parliament-5133495/">its own fast</a> against the stalling of Parliamentary proceedings by opposition parties few days later. <keyword id="834154" type="PERSON" weightage="20" keywordseo="No-work-no-pay">No work no pay</keyword>? The decision of the BJP MPs to forgo their salaries has brought the notion of “no work no pay” back into the spotlight. As part of the latest Union Budget, the finance minister, Arun Jaitley, decided to double MPs monthly salaries from ₹50,000 to ₹100,000. In 2007, when the BJP led the Opposition, the Speaker of the Lok Sabha, Somnath Chatterjee, <a href="https://economictimes.indiatimes.com/news/politics-and-nation/somnath-wants-no-work-no-pay/articleshow/2225592.cms">proposed the concept</a> of “no work no pay for MPs”, pointing to the obvious flaw in a system that allowed them to claim their daily allowance for sitting in Parliament even when the session was disrupted. Last month, Manoj Tiwari, a BJP MP and head of its Delhi unit, <a href="https://economictimes.indiatimes.com/news/politics-and-nation/manoj-tiwari-wants-no-work-no-pay-rule-for-mps/articleshow/63385053.cms">proposed the rule again</a>. While the rule makes sense on paper, it presupposes that MPs are motivated to work by their salaries. Many of them are rich to begin with. According to the Association of Democratic Reforms, <a href="https://adrindia.org/media/adr-in-news/13rd-mps-have-criminal-records-82-cent-are-crorepatis-adr">82% of the new Lok Sabha MPs </a>in 2014 had a net worth of over ₹10 million. In fact, the average worth of an MPs assets was ₹146 million. Perhaps the number of days could be increased. While this won’t raise productivity and will likely increase the burden of taxpayers, it could help tackle the growing pile of pending bills and allow more time for matters of public interest to be discussed. The Indian Parliament meets for roughly <a href="http://www.prsindia.org/media/articles-by-prs-team/the-house-is-not-in-session-4425/">70 days a year</a>, compared to 150 in the UK and 140 in the US. Furthermore, MPs are primarily motivated by votes. They are elected to represent the interests of the people who voted for them, not to add numbers to their parties’ protests in the house. It is the responsibility of voters to keep their representatives accountable. Parliamentary disruptions inhibit the functioning of our democracy. The disruptors should be rewarded accordingly when elections come around.
