India plans repairability index for mobile, electronics to tackle e-waste

The government has dropped the permit requirement for untested AI models but emphasised the need to label AI-generated content, according to a latest advisory on <keyword id="19904566" type="General" weightage="20" keywordseo="artificial-intelligence" source="keywords">Artificial Intelligence</keyword> technology. Instead of permission for AI models under development, the fresh advisory issued by the <keyword id="19966789" type="General" weightage="20" keywordseo="ministry-of-electronics" source="keywords">Ministry of Electronics</keyword> and IT on Friday evening fine-tuned the compliance requirement as per IT Rules of 2021. "The advisory is issued in suppression of advisory...dated 1st March 2024," the advisory said. It has been observed that IT firms and platforms are often negligent in undertaking due diligence obligations underlined under the <keyword id="19930099" type="General" weightage="20" keywordseo="information-technology" source="keywords">Information Technology</keyword> (Intermediary Guidelines and <keyword id="20033095" type="General" weightage="20" keywordseo="digital-media-ethics-code" source="keywords">Digital Media Ethics Code</keyword> ) Rules, 2021, according to the new advisory. The government has asked firms to label content generated using their AI software or platform and inform users about the possible inherent fallibility or unreliability of the output generated using their AI tools. "Where any intermediary through its software or any other computer resource permits or facilitates synthetic creation, generation or modification of a text, audio, visual or audio-visual information, in such a manner that such information may be used potentially as misinformation or deepfake, it is advised that such information created generated or modified through its software or any other computer resource is labelled....that such information has been created generated or modified using the computer resource of the intermediary," the advisory said. In case any changes are made by the user, the metadata should be so configured to enable identification of such user or computer resource that has effected such change, it added. Govt removes permit requirement for untested AI models; calls for labelling content

New Delhi, The <keyword id="19895782" type="General" weightage="20" keywordseo="election-commission" source="keywords">Election Commission</keyword> Thursday directed the Centre to immediately stop delivering bulk WhatsApp messages to people under the "<keyword id="21003206" type="General" weightage="20" keywordseo="viksit-bharat-sampark" source="keywords">Viksit Bharat Sampark</keyword>" initiative to highlight the government's achievements. The direction was issued to the Secretary, <keyword id="19959928" type="General" weightage="20" keywordseo="ministry-of-electronics-and-information-technology" source="keywords">Ministry of Electronics and Information Technology</keyword>, after the <keyword id="19933395" type="General" weightage="20" keywordseo="commission" source="keywords">Commission</keyword> received complaints about the matter. "The move is a part of a series of decisions taken by the Commission to ensure a level-playing field," the Commission said. Asking the government to ensure there is "no further delivery" of the bulk WhatsApp messages to people, the Commission sought an "immediate" compliance report on the matter from the ministry. The ministry had informed the Commission that the messages along with a letter from Prime Minister <keyword id="19895781" type="General" weightage="20" keywordseo="narendra-modi" source="keywords">Narendra Modi</keyword> were sent before the Model Code of Conduct came into force on March 16 with the announcement of Lok Sabha poll schedule. According to the notification by the Directorate General of Foreign Trade (DGFT), for clearance of import consignments with effect from November 1, 2023, a valid licence for restricted imports is required. The government has told tech companies that the restrictions are not to ban imports but to promote exports via domestic manufacturing, according to industry representatives who attended the meeting. The <keyword id="6474066" type="General" weightage="50" keywordseo="economic-times" source="Orion">Economic Times</keyword> was first to report on the development. The Central government earlier deferred its decision to restrict the import of certain categories of laptops and computers until November 1, allowing companies three-months time to import these devices. Post November 1, no entity will be allowed to import laptops, computers, and related items without a license. "Import consignments can be cleared till October 31, 2023, without a licence for restricted imports," the notification said, adding that liberal transitional arrangements will be notified for the import of laptops, tablets, all-in-one personal computers, and servers till October 31. This is a partial reversal from its August 3 order, which had imposed import restrictions on these devices with immediate effect. The committee, which includes representatives from the Ministry of Electronics and Information Technology (MeitY), Ministry of Micro, Small and Medium Enterprises (MSME) and industry stakeholders, is expected to submit a comprehensive report on the Repairability Index framework by November 15. The key components of the proposed Repair Ecosystem include comprehensive repair information, accessible spare parts, affordable tools, modular product design and ensuring the economic feasibility of repairs for consumers. "By standardising the assessment of repairability, the index will create an ecosystem where consumers can easily compare products and choose options that align with the ethos of mindful consumption and sustainability," the DoCA statement said.

Data breach reported by Toyota Kirloskar Motor

Micro-blogging website Twitter has complied with the <keyword id="296566" type="General" weightage="100" keywordseo="it-ministry" source="Orion">IT Ministry</keyword>'s last notice within the final July 4 deadline, after receiving a warning to either comply with new IT Rules, 2021 or face stricter action. Reliable sources told IANS on Tuesday that the company finally complied with the June 27 notice sent by the <keyword id="3524863" type="General" weightage="50" keywordseo="ministry-of-electronics" source="Orion">Ministry of Electronics</keyword> and IT (MeitY) over taking action on some controversial tweets. A query sent to Twitter <keyword id="3658" type="General" weightage="50" keywordseo="india" source="Orion">India</keyword> went unanswered. The government had asked Twitter to act on the content take-down notices sent under Section 69A of the <keyword id="6379296" type="General" weightage="20" keywordseo="it-act" source="Orion">IT Act</keyword> along with non-compliance notices issued for not taking the content down. Not complying with the IT rules, 2021 could have resulted in Twitter losing its immunity as a social media intermediary under Section 79 of the IT Act. In May, the IT Ministry issued a similar notice to the micro-blogging platform, directing it to appoint a resident grievance officer, a resident chief compliance officer, and a nodal contact person. The <keyword id="6363148" type="General" weightage="50" keywordseo="information-technology" source="Orion">Information Technology</keyword> (<keyword id="7206149" type="General" weightage="80" keywordseo="intermediary-guidelines" source="Orion">Intermediary Guidelines</keyword> and Digital Media Ethics Code) Rules 2021 mandate that the intermediaries, including social media intermediaries, must establish a grievance redressal mechanism for receiving resolving complaints from the users or victims. Meanwhile, Twitter banned more than 46,000 accounts of Indian users in May over violation of its guidelines, the microblogging platform said in its monthly compliance report. According to the report, Twitter removed 43,656 accounts for child sexual exploitation, non-consensual nudity, and similar content, while 2,870 accounts were banned for promoting terrorism. The platform received 1,698 complaints in India via its local grievance mechanism between April 26, 2022 and May 25, 2022. In addition, Twitter also processed 115 grievances which appealed account suspensions. No account suspensions were revoked, the report said. Under the new IT Rules 2021, big digital and social media platforms, with more than 5 million users, have to publish monthly compliance reports. In a letter to the <keyword id="296566" type="General" weightage="80" keywordseo="it-ministry" source="Orion">IT Ministry</keyword>, the coalition that represents <keyword id="6354427" type="General" weightage="50" keywordseo="apple" source="Orion">Apple</keyword>, Meta, Google, Amazon, Twitter, and Spotify, among others, said that the proposed changes in the new IT Rules 2021 would affect continuity in business operations for all intermediaries that have made significant investments in the country in regard to technology, workforce, and other resources. The coalition said that intermediaries, as conceived under Section 79 of the IT Act, only provide a technology platform or a computer resource as a service to the user. "It is ultimately the user who determines the nature of content to be communicated or transmitted on the platforms/computer resources operated by the intermediaries. Given this, it may be more beneficial to impose mandates prohibiting the dissemination of certain types of content on the user itself," it argued. The republished draft by the IT Ministry has revealed a plan to form an appeals panel that can reverse content moderation decisions by Big Tech companies. The new IT rules also require big social media platforms to help the government trace the originator of messages in special cases. The coalition said that the MeitY should allow industry to adopt a self-regulatory grievance redressal mechanism as an alternative to the Grievance Advisory Committee (GAC). "An industry-led self-regulatory mechanism will enable businesses to adopt best practices and ensure long term solutions by identifying trends and gaps. In this regard, we request MeitY for a period of at least six months to implement such a self-regulatory mechanism," the group said. The letter to the IT Ministry came as Indonesia, a country with nearly 28 crore population, forced Meta Platforms and Google to abide by new rules for Big Tech which gives authorities the power to block social media applications and online sites. Facebook, Instagram, and WhatsApp signed up for new rules before the Wednesday deadline. The AIC said that it further recommend these new requirements - deadlines of 24 hours to acknowledge requests to block or suspend a user, or remove information relating to Rule 3(1)(b), and would shorten complaint redress periods to 72 hours for certain content - be limited to intermediary services that have a demonstrated propensity for virality. "These obligations should only attach to services or parts of services that enable sharing of material to all end users, and where the intermediary reasonably knows, based on past experience, that there is a propensity for material to be amplified or accessed virally on the service," the letter argued. The coalition aimed to draw the IT Ministry's attention to the fact that a single instance of non-compliance by the intermediary can lead to loss of safe harbour protections under the IT Act. "We request MeitY to consider providing clarity on the manner in which 'due diligence, privacy and transparency' expectations of users must be met over and above existing compliances already present in Indian law," it added.
