The program gets more interest than it can meet — with the number of yearly visas <a target="_blank" href="https://www.businessinsider.in/international/news/us-reaches-h-1b-cap-for-fiscal-year-2024/articleshow/106011187.cms">capped at 85,000</a> — so the government uses a lottery process to decide who comes in.The lottery has had a loophole that some have abused in past years to try to game the system. Nothing in the law had prohibited an individual from having multiple entries in the lottery if they can secure multiple job offers, said Jason Finkelman, an Austin<a target="_blank" href="https://www.businessinsider.com/immigration-attorneys-lawyers-helping-startups-founders-entrepreneurs-secure-work-visas-2021-8"> immigration lawyer</a> who specializes in work visas. In theory, having more registrations in the lottery gave migrant workers more chances to win a coveted visa.Last year, the number of registrations filed on behalf of foreign nationals jumped to 780,000, a 61% increase over the previous year.<a target="_blank" href="https://www.uscis.gov/working-in-the-united-states/temporary-workers/h-1b-specialty-occupations-and-fashion-models/h-1b-electronic-registration-process"> Data shows</a> much of the increase was due to a record-breaking number of employers submitting multiple H-1B registrations for the same person. They might have set up unique corporate structures or banded with other companies to try and get around the rules."This led to many individuals being entered into the lottery multiple times, through different companies, and ultimately decreasing the odds of being selected in the lottery," Finkelman said.The new regulations aim to curtail this sort of behavior. Registrations will now be selected from a pool of unique individuals rather than the total number of entries. The changes have also reduced the number of people using student passes as a loophole to work. The government <a target="_blank" class="" href="https://www.gov.uk/government/news/tough-government-action-on-student-visas-comes-into-effect">forecast</a> that the changes would lead to 140,000 fewer people coming to the country.In the US, <a target="_blank" href="https://www.businessinsider.com/h1b-visa-lottery-changes-benefit-startups-hiring-immigrants-2024-2">dwindling chances</a> of landing a work visa after graduation because of the H-1B lottery system have made the country less attractive for some foreign students. The US State Department has quietly implemented recommendations of a presidential commission which has suggested steps like opening up American diplomatic missions outside India for visa appointments to reduce the visa backlog in the country. India was one of the very few countries where applications for US visas saw a major upswing after coronavirus-related travel restrictions were lifted. Moved by a commission member, Ajay Jain Bhutoria from Silicon Valley, the presidential commission observed that inordinate visa appointment delays were causing huge problems for the students and visitors who have plans to come to study in the US and visit the country. The State Department should allow virtual interviews where applicable and allow staff from embassies around the world and the US consular staff to help conduct the virtual interviews at embassies with high backlogs and help clear them, the commission recommended. The recommendations included opening up American diplomatic missions outside India for visa appointments, having more counters and deploying additional resources to process visa applications. The <keyword id="50596" type="General" weightage="20" keywordseo="US-embassy" source="Orion">US Embassy</keyword> in India processed over 1 lakh applications just in January 2023, their highest total in a single month and the highest in any month since July 2019. In its December meeting, the President’s Advisory Commission on Asian Americans, Native Hawaiians, and Pacific Islanders recommended several steps to reduce the growing delay in visa appointment times in India and other countries like Pakistan, Nepal and Bangladesh. It recommended the State Department hire new Full-Time officers/consular or Temporary Staff or contractors or bring back retired consular officers to clear the backlog at Embassies in Asia which have wait times of 400 or more days and shrink the wait time to 2-4 weeks be clearing the visa application backlog. The State Department could also use staff from other embassies around the world to help clear the backlog in countries in Asia which have huge backlogs and delays in visa appointments, it had recommended. The advisory committee noted that in 2012 President Barack Obama issued a memo to reduce the wait time from several months to a few days and this memo streamlined the visa process. The Trump administration had rescinded the President Obama memo, and this is also contributing as one of the factors in causing delays for Visa appointments, it said. As such, it recommended that President Joe Biden should consider issuing a memo to the State Department to shrink the visa appointment wait times to 2-4 weeks maximum for countries with significant backlogs including India, Pakistan, Bangladesh, and other countries in a similar situation. There have been growing concerns in India over the long waiting period for first-time visa applicants, especially for those applying under B1 (business) and B2 (tourist) categories. The waiting period for first-time B1/B2 visa applicants in India was close to three years in October last year. In January, the State Department not only implemented remote processing of interview waiver cases for applicants with previous US visas but also launched several initiatives, including scheduling special interviews for first-time applicants and increasing the strength of consular staff. It also conducted "special Saturday interview days" on January 21. US State Department implements several recommendations of presidential commission to reduce visa backlog in India

The cow-to-cow transmission is the latest escalation in a global <a target="_blank" href="https://www.businessinsider.com/egg-prices-poised-to-spike-again-thanks-to-avian-flu-2023-12">outbreak</a> that began when the virus reemerged in Europe in 2020. It has since killed tens of millions of birds and more than 40,000 sea lions and seals in South America. "If it keeps spreading in animals, then it is eventually going to cause problems for humans, either because we don't have food because they've got to start exterminating flocks, or because it starts to make a jump in humans," Adams, <keyword id="6366244" type="General" weightage="20" keywordseo="who" source="Orion">who</keyword> served under former President Donald Trump and was on the administration's initial COVID-19 task force, told Business Insider. "The more it replicates, the more chances it has to mutate." Though he agrees with the CDC's <a target="_blank" href="https://www.cdc.gov/flu/avianflu/inhumans.htm">assessment</a> that the current risk to humans is low, Adams fears the US is repeating many mistakes it made in the early days of COVID-19. <h2>Weak messaging with no clear leaders</h2>Who is in charge of an animal pandemic in the US? The CDC? The US Department of Agriculture? The FDA? The answer is, sort of, all of them. That decentralized responsibility could be behind the lack of widespread, clear public messaging so far. For example, Adams says he hasn't changed anything about his diet, since pasteurization and proper cooking procedures should kill any live virus present. But he isn't sure everyone is getting the message. It's those groups who need strong, targeted guidance right now, Adams said. <h2>Only testing the sick</h2>So far, the USDA has only been testing <a target="_blank" href="https://www.businessinsider.com/beef-prices-higher-drought-fewer-cattle-less-meat-2022-8">cattle herds</a> when an animal appears sick. That means asymptomatic spread could be flying under the radar. "An animal can't tell you, 'Hey, I feel a little under the weather today.' So they're literally waiting until an animal is collapsing or showing fatigue or showing severe symptoms," Adams said. "We need a testing strategy that is proactive and allows true surveillance, and not reactive." The USDA took a step forward on Wednesday, ordering that all lactating dairy cows must be tested for H5N1 before they're moved across state lines and that all positive test results must be reported. New York Times columnist Zeynep Tufekci <a target="_blank" href="https://www.nytimes.com/2024/04/24/opinion/bird-flu-cow-outbreak.html">reported</a> that same day that, until now, the USDA has not been keeping track of positive test results in cattle. <h2>Election distraction</h2> <div type="image" title="donald trump" height="3333" width="5000" msid="109603134" hostid="261"></div>In late 2019 and early 2020, the big news story was the impeachment, and later acquittal, of President Trump. Now a different <a target="_blank" href="https://www.businessinsider.com/donald-trump-hush-money-trial-kicks-off-fiery-da-openings-2024-4">Trump trial</a> is dominating the news. And, as in 2020, this is an election year. "The Biden administration, particularly the White House, has been incredibly quiet on this bird flu situation. Why? To me, it looks like they very much don't want to scare the public and spook the economy in an election year," Adams said. <h2>Business vs. public health</h2>Just like the lockdowns of COVID-19 were devastating for the restaurant and hospitality industries, a crackdown on avian flu can be devastating to the chicken industry. The treatment for a <keyword id="1433269" type="General" weightage="20" keywordseo="bird-flu-outbreak" source="Orion">bird flu outbreak</keyword> is to kill all the chickens. Even before that, just testing the flock can slow down production. "We're seeing the same tension between business interests and public health interests," Adams said. What's more, many of the workers who handle chickens and cattle are undocumented immigrants. That can make them and their bosses hesitant to call in authorities over diseased animals. Many vulnerable groups were hesitant to report illness in the early COVID days, too, including migrant workers and people who didn't have sick leave from work. "My concern is we keep making the same mistakes over and over again," Adams said. "Because we keep focusing on the wrong things instead of focusing on the root causes."

But granting employment authorisation to all spouses of <keyword id="6358066" type="General" weightage="20" keywordseo="H-1B-visa" source="Orion">H-1B visa</keyword> holders would encourage more skilled migrants, including Indians, to choose the US over Canada, the study by National Foundation for American Policy revealed. "The US can reap significant economic benefits, ease labour shortages, and attract more workers in the global competition for talent if it expanded current rules on work eligibility for the spouses of H-1B visa holders," the study, authored by Madeline Zavodny, said. The number of Indians who became permanent residents in Canada increased by over 115 per cent between 2016 and 2020 and 2021. In 2015, then President <keyword id="15962" type="General" weightage="80" keywordseo="barack-obama" source="Orion">Barack Obama</keyword> allowed the spouses of H-1B visa holders to work in the US via the H4 (dependent) visa. H4 visas are issued to dependent spouses and children who accompany H-1B, H-2A, H-2B, and H-3 visa holders to the US. The spouses of H-1B visa holders tend to be highly educated, many of them in STEM fields, and previously had careers of their own or worked to support their families. "Allowing the spouses of H-1B visa holders to work upon arrival would help recruit and retain skilled workers and increase the already-considerable economic benefits of the H-1B visa category," Zavodny said. She estimates that almost 90 per cent of the spouses of H-1B visa holders have at least a bachelor's degree, and over half have a graduate degree, based on American Community Survey data (2017-2019). Out of these 90 per cent of spouses, two-thirds are from India and 6 per cent are from China. "Almost half of spouses of likely H-1B visa holders who have a bachelor's degree had a STEM-related major. Among spouses of likely H-1B visa holders who are employed, 42 per cent are working in a STEM field," she noted. The Department of Homeland Security (DHS) regulation published in 2015 allows spouses who hold an H4 visa to apply for an Employment Authorization Document (EAD). Currently, H4 spouses can only apply for an EAD after their H-1B spouse is in the queue for a permanent visa. That typically does not occur until the H-1B has worked in the US for several years; indeed, some spouses may apply only after their H-1B spouse has worked in the US for at least six years. The H4 visa holder must be selected in the H-1B lottery, which only occurs once a year and has low odds of success. Long delays in processing H4 EADs have plagued the US Citizenship and Immigration Services (USCIS) and the spouses who need the approval to work. Spouses of workers who hold an L-1 intracompany transferee visa, an E-1 treaty trader, an E-2 treaty investor, or E-3 specialty occupation worker from Australia visa are allowed to work. Spouses of these visa holders are "considered employment authorised incident to status", that is, their visa allows them to work and they do not need to apply separately for an EAD. Since mid-2015, some 171,000 H-4 visa holders have been approved for employment authorisation, a significant portion of whom are from India. In fiscal 2021, Indians bagged the highest number of H1B visas i.e., over 74 per cent of the allotments. Out of 4.07 lakh H1-B visas approved by the USCIS, 3.01 lakh were allotted to Indians whereas, 50,000 Chinese received the visas. Research shows that the H-1B visa category bumps up economic growth, creates jobs for American workers, and slows offshoring of high-paid jobs. "If allowed to work, these spouses would make considerable contributions to the US labour market as most of them would enter occupations with very low unemployment rates and high job vacancy rates," says Zavodny. US risks losing skilled professional H-1B visa holders to Canada

The <keyword id="420863" type="ORGANIZATION" weightage="20" keywordseo="US-Chambers-of-Commerce">US Chambers of Commerce</keyword>, the <keyword id="436947" type="ORGANIZATION" weightage="20" keywordseo="National-Association-of-Manufacturers">National Association of Manufacturers</keyword> (<keyword id="1294720" type="PERSON" weightage="20" keywordseo="NAM">NAM</keyword>) and several other organisations have filed a lawsuit against the federal government, asserting that recent H1B regulations will undermine high skilled immigration into the United States. Early this month, in its interim final rule, the Department of Homeland Security announced to narrow the definition of "specialty occupation" as Congress intended by closing the overbroad definition that allowed companies to game the system. It also requires companies to make "real" offers to "real employees," by closing loopholes and preventing the displacement of the American worker. And finally, the new rules would enhance the department's ability to enforce compliance through worksite inspections and monitor compliance before, during, and after an H1B petition is approved. Filed on Monday in the Northern District of Columbia, the lawsuit alleges that "harmful and haphazard rules on H1B visas" if left in place, would affect hundreds of thousands of American-based workers and disrupt manufacturers' ability to hire and retain critical high-skilled talent. "The rules being implemented by the Department of Homeland Security and the Department of Labor undermine high-skilled immigration in the US and a company's ability to retain and recruit the very best talent," said US Chamber CEO Thomas J Donohue. If these rules are allowed to stand, they will devastate companies across various industries, he said, adding that these measures will discourage investment, diminish economic growth, and impede job creation in the US. US Chambers of Commerce, NAM and others file lawsuit against latest H1B regulations

The United States on Thursday announced that it will modify the selection process for H-1B visa, giving priority to salary and skills instead of the current lottery procedures. The final rule to be published in the federal register on January 8, officials said, is aimed to protect the economic interests of US workers and better ensure the most highly skilled foreign workers benefit from the temporary employment programme. The H-1B visa is a non-immigrant visa that allows US companies to employ foreign workers in specialty occupations that require theoretical or technical expertise. The technology companies depend on it to hire tens of thousands of employees each year from countries like India and China. Modifying the H-1B cap selection process will incentivise employers to offer higher salaries, and/or petition for higher-skilled positions, and establish a more certain path for businesses to achieve personnel needs and remain globally competitive, said <keyword id="368921" type="COMPANY" weightage="20" keywordseo="US-Citizenship-and-Immigration-Services">US Citizenship and Immigration Services</keyword>. The final rule will be effective 60 days after its publication in the Federal Register. The next H-1B visa filing season is slated to start on April 1. "The H-1B temporary visa programme has been exploited and abused by employers primarily seeking to fill entry-level positions and reduce overall business costs," said <keyword id="137642" type="COMPANY" weightage="20" keywordseo="USCIS">USCIS</keyword> Deputy Director for Policy Joseph Edlow. "The current H-1B random selection process makes it difficult for businesses to plan their hiring, fails to leverage the programme to compete for the best and brightest international workforce, and has predominantly resulted in the annual influx of foreign labor placed in low-wage positions at the expense of US workers," he said. This effort will only affect H-1B registrations (or petitions, if the registration process is suspended) submitted by prospective petitioners seeking to file H-1B cap-subject petitions. It will be implemented for both the H-1B regular cap and the H-1B advanced degree exemption, but it will not change the order of selection between the two as established by the H-1B registration final rule, USCIS said. The <keyword id="134917" type="COMPANY" weightage="20" keywordseo="department-of-homeland-security">Department of Homeland Security</keyword> had previously published a notice of proposed rulemaking on November 2, 2020. It carefully considered the public comments received before deciding to publish the proposed regulations as a final rule, USCIS said. According to the final rule, a version of which was released by Department of Homeland Security, Instead, a registration system that faithfully implements the Immigration and Nationality Act (INA) while prioritising registrations based on wage level within each cap will incentivize H-1B employers to offer higher wages, or to petition for positions requiring higher skills and higher-skilled aliens that are commensurate with higher wage levels, to increase the likelihood of selection and eligibility to file an H-1B cap-subject petition. Moreover, it will maximize H-1B cap allocations, so that they more likely will go to the best and brightest workers; and it will disincentivise abuse of the H-1B programme to fill relatively lower-paid, lower-skilled positions, which is a significant problem under the present selection system, it said. "While administering a random lottery system is reasonable, it is inconsiderate of Congress's statutory purposes for the H-1B program and its administration," said the final rule. The changes in this final rule will apply to all registrations, including those for the advanced degree exemption, submitted on or after the effective date of the final rule. As per Congressional-mandated cap, USCIS in one year can issue a maximum of 65,000 H-1B visas. It can also issue another 20,000 H-1B visas to those foreign students who have completed higher studies from a US university in STEM subjects. During the public notice period, the department said, several commenters expressed support for the rule and the need to stop visa fraud, abuse, and flooding of petitions by certain staffing or consulting companies. One commenter said the proposed rule would disincentivize companies from abusing the H-1B programme and harming US workers. Other commenters said the proposed rule would decrease potential visa abuse by employers and make sure all workers were paid according to their skillset as employers no longer would be able to lower labor expenses by hiring foreign workers. Another said that the proposed rule would have a positive impact on US employees and college educated US citizens who take out loans for their education by making it harder for technology companies to discriminate against US citizens; US workers are being laid off in large numbers because corporations are outsourcing for profits; and the proposed rule is necessary because Indian corporations are acquiring US jobs, it said. US to modify H1B visa selection process — wages, skill level to get priority over lottery system

<ul><li>H1-B denial rates for initial petitions have increased from 6% in 2015 to 32% within the first quarter of 2019. </li><li>Attorneys and employers believe it’s because the United States Citizenship and Immigation Services has increased the standard of proof the approval of H1-B visas.</li><li>Top companies, like Amazon, witnessed their denial rate skyrocket from 3% to over 30% for continuing H1-B petitions.</li></ul>Denial rates for H-1B petitions is at an all time high and attorneys believe its because the United States Citizenship and Immigration Services (USCIS) has <a href="https://www.uscis.gov/h-1b-data-hub">increased</a> the standard of proof for approval without the requisite legal authority. H1-B denial rates for initial petitions have increased four times between 2015 to 2018, from 6% to 24%. The denial rates have spiked further to 32% in the first quarter of 2019 . An analysis by the National Foundation for American Policy (NFAP) <a href="https://nfap.com/wp-content/uploads/2019/04/H-1B-Denial-Rates-Past-and-Present.NFAP-Policy-Brief.April-2019.pdf">states</a> that, in contrast, denial rates have never exceeded 8% in the years between 2010 and 2015.

H-1B visas are designed for certain skilled workers such as those employed in science, engineering, and information technology fields, while H-2B visas are given to seasonal workers such as hotel and construction staff. L-1 visas are meant for executives who work for large corporations and J-1 visas are issued to research scholars, professors and other cultural and work-exchange programs. Trump will reportedly sign an executive order to suspend the visas through the end of the year, as the administration is addressing a major economic fallout, including high unemployment among Americans, amid the coronavirus pandemic. The Trump administration in a new lawsuit accused Facebook of reserving over 2,600 high-paying jobs for foreign workers instead of hiring Americans

The US State Department in a federal notification Wednesday proposed to make changes to its existing visa regulations under which <keyword id="738953" type="PERSON" weightage="20" keywordseo="Foreign-professionals">foreign professionals</keyword>, which would fall under H-1B, would not be issued temporary visa for business, as has been widely prevalent currently. If finalized, this proposal will eliminate any misconception that the "B-1 in lieu of H policy" provides an alternative avenue for foreign professionals to enter the US to perform <keyword id="438013" type="PERSON" weightage="20" keywordseo="skilled-labour">skilled labour</keyword> that allows, and potentially even encourages them and their employers to circumvent the restrictions and requirements relating to the H nonimmigrant classification established by the Congress to protect US workers, the State Department said. The move is likely to impact a lot of Indian companies who send their technology professionals on B-1 visas for a short stay to complete the jobs on site in the US. On December 17, 2019, the California Attorney General announced a $800,000 settlement against <keyword id="6354512" type="COMPANY" weightage="20" keywordseo="Infosys">Infosys</keyword> Limited to resolve allegations that approximately 500 Infosys employees worked in California on Infosys-sponsored B-1 visas rather than H-1B visas, the State Department said. "The proposed changes and the resulting transparency would reduce the impact of foreign labour on the US workforce of aliens performing activities in a specialty occupation without the procedural protections attendant to the H-1B classification," it said. In its federal notification issued on Wednesday, the State Department said US architecture firm seeking protection from rising labour costs in the country might believe it could lay off its US architects and contract for the same professional architectural services to be provided by a foreign architecture firm. If the foreign firm sought H-1B visas for its architects, it would be required to pay the prevailing wage for architects in the area of intended employment in the United States, presumably the same wage the US architects had been paid, and meet the other requirements enacted by the Congress to protect US workers. But under the B-1 in lieu of H policy, the foreign architects could ostensibly seek B-1 visas and travel to the US to fill a temporary need for architecture services, so long as they retained a residence in the foreign country and continued to receive a salary, perhaps significantly lower than what is customary for US architects, dispersed abroad by the foreign firm (or under the auspices of a foreign parent or subsidiary), the State Department said. Under the Department's guidance, visas could be issued for multiple architects planning temporary work in the United States, in certain situations. However, a foreign employer may succeed in undermining US immigration law and policy by rotating architects between the US and the foreign country to effectively fill the position of one US architect at a significantly lower cost, the notification said. "If the architects who intended to perform skilled labour were "of distinguished merit and ability... seeking to perform (temporary architectural services) of an exceptional nature requiring such merit and ability, one might argue the current regulatory language suggests this type of labour is a permissible basis for B-1 nonimmigrant visa issuance," the State Department said. This potential outcome is harmful to US workers and contrary to policies of the Trump Administration, it said. The State Department said the application process for a B-1 visa does not include similar procedural requirements to protect US workers like that of H-1B visas. Also, the fees for the B-1 visas are far less than that of H-1B visas. While the Congress required H-1B employers to pay significant fees to fund assistance to the US workforce as well as prevention and detection of fraud related to skilled labour, employers are not required to pay comparable fees to employ skilled workers under the B-1 in lieu of H policy, it said. According to the notification, the State Department estimates that this proposal will affect no more than 6,000 to 8,000 foreign workers per year, specifically aliens intending to provide services in a specialty occupation in the US. As per its estimate, up to 28 per cent of the approximately 8,000 annual B-1 visa issuances under the B-1 in lieu of H policy were to foreign workers who applied for a visa to perform services in a specialty occupation for a small entity in the US.
