EXCLUSIVE: WhatsApp’s Grievance Officer in India quits within six months

<ul><li><keyword id="6354616" type="UNKNOWN" weightage="20" keywordseo="Twitter">Twitter</keyword> has named <keyword id="1109299" type="PERSON" weightage="20" keywordseo="Vinay-Prakash">Vinay Prakash</keyword> as its Resident Grievance Officer for India, according to the company's website.</li><li>Twitter had previously appointed Dharmendra Chatur as its interim resident grievance officer for India as required by the IT rules.</li><li>The social-networking app has been at loggerheads with the Indian government over the new social media rules.</li></ul>Twitter has named Vinay Prakash as its Resident Grievance Officer for India, according to the company's website. The US-based company has been in the eye of a storm over its alleged failure to comply with the new IT rules in India, which mandates, among other requirements, the appointment of three key personnel -- chief compliance officer, nodal officer and grievance officer by social media platforms with over 50 lakh users. All the three personnel have to be residents in India. As per the information updated on Twitter's website, Vinay Prakash is the Resident Grievance Officer (RGO). Users can contact him using an email ID listed on the page. Twitter appoints Vinay Prakash as resident grievance officer for India

Amid tensions with the government, <keyword id="6354616" type="UNKNOWN" weightage="20" keywordseo="Twitter">Twitter</keyword> has appointed a Resident Grievance Officer, days after it designated a chief compliance officer, as it also released its first India Transparency Report to meet the new IT rules. The US social media giant's website has listed Vinay Prakash as the new grievance officer, providing contact details and procedure for users to report potential violations of its rules and terms. Twitter had previously appointed Dharmendra Chatur as its interim grievance officer for India after the new IT rules came into force on May 26. However, Chatur stepped down within weeks of taking over the key role. California-based Jeremy Kessel was named as India's grievance redressal officer, on the platform's website - although the appointment did not meet the requirements of IT rules that clearly mandate key officers - grievance officer, chief compliance officer and nodal officer - to be resident in India. Twitter's website on Sunday showed Vinay Prakash as the Resident Grievance Officer (RGO). Users can contact him using an email ID listed on the page. In its India Transparency Report: User Grievances and Proactive Monitoring July 2021 report, Twitter said it had received 94 grievances and "actioned" 133 URLs between May 26 and June 25, 2021. Twitter said the majority of complaints received via Grievance Officer - India channel during the reporting period fell into categories including defamation (20), Abuse/Harassment (6), Sensitive Adult Content (4), Impersonation and privacy infringement (3 each), IP-related Infringement (1), and Misinformation/Synthetic and Manipulated Media (1). In addition to this, Twitter processed 56 grievances which were appealing Twitter account suspensions. In a separate category - '<keyword id="11616040" type="UNKNOWN" weightage="20" keywordseo="proactive-monitoring-data">Proactive Monitoring Data</keyword>', Twitter said 18,385 accounts were suspended over the issue of Child Sexual Exploitation, Non-Consensual Nudity, and similar content, while 4,179 accounts were suspended for <keyword id="3208352" type="PERSON" weightage="20" keywordseo="Promotion-of-Terrorism">Promotion of Terrorism</keyword>. However, the 'Proactive Monitoring Data' -- content proactively identified by employing internal tools and industry hash sharing initiatives -- represents global actions taken, and not just actions related to content from India. Twitter noted that going forward, it will publish this report on a monthly basis and that it will make improvements over time, based on feedback received from the government, or in accordance with internal changes that allow it to provide more granular data. Under the new IT rules, large digital platforms (with over 50 lakh users) are required to publish periodic compliance reports every month, mentioning the details of complaints received and action taken thereon. The new IT rules are designed to prevent abuse and misuse of digital platforms, and offer users a robust forum for grievance redressal. Under these rules, social media companies will have to take down flagged content within 36 hours, and remove within 24 hours content that is flagged for nudity and pornography. Non-compliance with the IT rules would result in these platforms losing their intermediary status that provides them immunity from liabilities over any third-party data hosted by them. The rules also mandate appointment of three key personnel - grievance officer, chief compliance officer and nodal officer. These officials need to be resident in India. The Indian government had confronted Twitter over deliberate defiance and failure to comply with the IT rules, despite repeated reminders. On the same day, Twitter had informed the Delhi High Court that it has appointed an interim chief compliance officer (CCO), who is a resident of India, and that it will make an endeavour to fill the regular position within eight weeks as per the IT rules. In an affidavit, Twitter had said "Twitter has posted publicly a job announcement for a CCO as a direct employee and is accepting applications at this time. Twitter will endeavour in good faith to make an offer of employment to a qualified candidate to fill this position within 8 weeks". Earlier, Twitter had advertised for filling the positions of Chief Compliance Officer, Nodal Officer and Resident Grievance Officer in India on the careers section on its website. The Delhi High Court had granted two weeks' to <keyword id="308642" type="COMPANY" weightage="20" keywordseo="Twitter-Inc">Twitter Inc</keyword> to file an affidavit, notarised in the US, on compliance with the IT rules and had made it clear that it was not extending any protection to the microblogging platform. The grievance officer will be required to acknowledge a complaint filed by a user within 24 hours and dispose of the complaint within 15 days from the receipt of the complaint. The grievance officer will also be required to acknowledge and perform directions given by the central government, the courts or any competent authority. The Grievance Appellate Committee will dispose of the appeal within 30 days from the receipt of the appeal and the social media platforms will be required to comply with its orders. In a sense, this offers the government complete control over the content and users on social media platforms as the committee members will be appointed and answer to the government. The Indian government may soon have more control over how social media companies moderate content and block users

All grievances received from users in India via the grievance mechanisms are evaluated and responded to. The central government counsel submitted before the court that Twitter was given three-month window to comply with IT Rules, but they did not. I have already made it clear that they have to comply." Senior Advocate <keyword id="371031" type="PERSON" weightage="20" keywordseo="Sajan-Poovayya">Sajan Poovayya</keyword>, representing Twitter India, submitted that an interim grievance officer was appointed, but he had withdrawn his candidature on June 21. The bench responded that after June 21, and till July 6, the least it could have done was appoint another person. "How long does your process take? If Twitter thinks it can take as long it wants in our country, I will not allow that," said the bench. Poovayya sought time to seek instructions on the new appointment, which was allowed by the court, and it passed over the matter. Later, Poovayya submitted that he needs more time to obtain detailed instructions from San Francisco-based Twitter. The bench observed that these rules are binding but Twitter has not appointed anyone till now. The court posted the matter for further hearing on Thursday, and asked Twitter to inform by when it will appoint an RGO and other officials. On May 31, the Delhi High Court had issued a notice to the microblogging platform on a plea by advocate Amit Acharya. The plea had urged the high court to issue directions to the Centre to pass necessary instructions to Twitter India and <keyword id="308642" type="COMPANY" weightage="20" keywordseo="Twitter-Inc">Twitter Inc</keyword> to appoint a resident grievance officer under Rule 4 of the Information Technology (Intermediary Guidelines and Digital Ethics Code) Rules, 2021 without any delay. Facing intense scrutiny over the presence of bad accounts and troll armies on its platform globally including in India, <keyword id="6354616" type="UNKNOWN" weightage="20" keywordseo="Twitter">Twitter</keyword> has announced to establish a legal entity in <keyword id="6372909" type="LOCATION" weightage="20" keywordseo="turkey">Turkey</keyword> to continue operating there under the country's internet law that came into place last year. Under the new law, social media firms that have more than one million <keyword id="66720" type="PERSON" weightage="20" keywordseo="users">users</keyword> must store the users' data in the country. Twitter said in a statement that in a continuing effort to provide its service in Turkey, "we have decided to establish a legal entity". "We will continue to work to protect the public conversation in Turkey, empowering people to have access to that conversation, and advocating for our values," the micro-blogging platform added. India has also raised similar demands from Twitter to keep its platform sanitised for meaningful conversations and remove bad accounts. The Indian government last month announced new stringent guidelines for social media platforms along with code of ethics for over-the-top (<keyword id="1245953" type="COMPANY" weightage="20" keywordseo="OTT">OTT</keyword>) platforms and <keyword id="124571" type="ORGANIZATION" weightage="20" keywordseo="digital-media">digital media</keyword>. According to Union Electronics and IT Minister Ravi Shankar Prasad, social media platforms will be classified under two categories -- <keyword id="9859817" type="UNKNOWN" weightage="20" keywordseo="Social-Media-Intermediaries">social media intermediaries</keyword> and significant social media intermediaries -- with the latter being subject to greater obligations. The new Intermediary Liability Rules ask social media companies with over 5 million users in India to not only enable traceability of end-to-end encrypted messages but also establish local offices with senior officials to deal with law enforcement and user grievances. Twitter said, in reference to Turkey, that the company is "committed to protecting and defending the Open Internet, and as part of this work, have called for the establishment of regional and global standards for online services". "We believe that global and not fragmented frameworks protect online communities and their rights and ensure they can experience the Internet in the same way across the world," the Jack Dorsey-run company noted. The Indian Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021 mandate that the intermediaries, including social media intermediaries must establish a grievance redressal mechanism for receiving resolving complaints from the users or victims. Intermediaries will have to appoint a Grievance Officer to deal with such complaints and share the name and contact details of such officer. "Grievance Officer shall acknowledge the complaint within 24 hours and resolve it within 15 days from its receipt," said an official statement.  "I had written an application to the PM in which I said that soldiers, who act as sahayaks, should not be made to polish shoes of officers," said <keyword id="6361419" type="PERSON" weightage="20" keywordseo="Singh">Singh</keyword>, who's with the 42 Infantry <keyword id="50460" type="COMPANY" weightage="20" keywordseo="Brigade">Brigade</keyword> in <keyword id="45016" type="COMPANY" weightage="20" keywordseo="Dehradun">Dehradun</keyword>.  Today, <keyword id="329590" type="COMPANY" weightage="20" keywordseo="The-Army">the Army</keyword> chief said the use of social media to highlight an issue could have deleterious effect on "brave soldiers guarding India's borders." 
 
The Army says officers get '<a href="http://www.businessinsider.in/searchresult.cms?query=indian+army&amp;sortorder=effectivedate">sahayak</a>s' for upkeep of their uniforms and weapons, as well as to act as their radio operators and "buddies" during combat operations. But parliamentary committees and other critics have slammed the 'sahayak' system as a vestige of the colonial era. They say officers blatantly misuse their 'sahayaks', getting them to do household work, walk the dogs and take kids to school. 
 The Army, on its part, has already asked the government to examine whether "non-combatants" should replace soldiers as 'sahayaks' in peace-time locations, while pressing for the system to continue in field and forward areas, said <keyword id="3970926" type="UNKNOWN" weightage="20" keywordseo="gen-rawat">Gen Rawat</keyword> late last week. 
 
But using social media to air grievances isn't ideal, Rawat said. It can be a "<a href="http://www.businessinsider.in/searchresult.cms?query=indian+army&amp;sortorder=effectivedate">two-sided" weapon</a> which can be used favourably but also has "a detrimental effect", he said. The Army already has an "excellent" grievances redressal system that will now be topped by his "suggestions-cum-grievances" boxes, said the new Army chief. 
 
The Army chief said anyone, irrespective of rank or service, can use this mechanism to write directly to him. Assuring full confidentiality, he said the name of the soldier concerned will be deleted before any action is taken.

Reliable sources told IANS on Tuesday that the company finally complied with the June 27 notice sent by the <keyword id="3524863" type="General" weightage="50" keywordseo="ministry-of-electronics" source="Orion">Ministry of Electronics</keyword> and IT (MeitY) over taking action on some controversial tweets. A query sent to Twitter <keyword id="3658" type="General" weightage="50" keywordseo="india" source="Orion">India</keyword> went unanswered. The government had asked Twitter to act on the content take-down notices sent under Section 69A of the <keyword id="6379296" type="General" weightage="20" keywordseo="it-act" source="Orion">IT Act</keyword> along with non-compliance notices issued for not taking the content down. Not complying with the IT rules, 2021 could have resulted in Twitter losing its immunity as a social media intermediary under Section 79 of the IT Act. In May, the IT Ministry issued a similar notice to the micro-blogging platform, directing it to appoint a resident grievance officer, a resident chief compliance officer, and a nodal contact person. The <keyword id="6363148" type="General" weightage="50" keywordseo="information-technology" source="Orion">Information Technology</keyword> (<keyword id="7206149" type="General" weightage="80" keywordseo="intermediary-guidelines" source="Orion">Intermediary Guidelines</keyword> and Digital Media Ethics Code) Rules 2021 mandate that the intermediaries, including social media intermediaries, must establish a grievance redressal mechanism for receiving resolving complaints from the users or victims. Meanwhile, Twitter banned more than 46,000 accounts of Indian users in May over violation of its guidelines, the microblogging platform said in its monthly compliance report. According to the report, Twitter removed 43,656 accounts for child sexual exploitation, non-consensual nudity, and similar content, while 2,870 accounts were banned for promoting terrorism. The platform received 1,698 complaints in India via its local grievance mechanism between April 26, 2022 and May 25, 2022. In addition, Twitter also processed 115 grievances which appealed account suspensions. No account suspensions were revoked, the report said. Under the new IT Rules 2021, big digital and social media platforms, with more than 5 million users, have to publish monthly compliance reports. They are required to register grievance complaints within 24 hours and address the issue within a space of 15 days. This will include how many complaints were received, how they were investigated, and how they were resolved at the end of the day. “The chief compliance officer to be appointed under the guidelines may be personally liable in case of any non-compliance of IT Act or any rules,” noted Rajat Prakash, a partner at law firm Athena Legal. The toughest rule of all puts WhatsApp in a spot Whether it is fake news or any objectionable content, the government wants the social media platforms as well messaging apps to be able to track down the ‘first originator’. “This first originator is not about the content, it's about who began the instigation,” explained Prasad. “If it started outside of India, they will have to track down who started the mischief within India.” The request to share this information will be mandated either by a court order or executive order by the government of India. It will also only apply to instances where the penalty (if the person is found guilty) exceeds five years. This includes instances where there is any violation with respect to the sovereignty or integrity of India, the security of the state, public order, relations with foreign states, and rape or sexually explicit content. “Further tracing of the originator of messages on messaging applications could lead to violation of privacy rights and fall foul of privacy laws of countries outside India and end to end encryption of messages will make it tough for messaging applications to comply,” noted Prakash. Even though WhatsApp does not have a specific response to the government's new guidelines, Facebook told Business Insider that they welcome the new rules. "Facebook is an ally for India and the agenda of user safety and security is a critical one for our platforms," it told Business Insider in a statement. Aadhaar or phone number for social media The Indian government wants social media platforms to set up some sort of verification mechanism for its users for identification citing Aadhar or mobile numbers are possible methods. “If there is any unlawful information on your platform, by court order or government of India, you will have to disable access of the user,” said Prasad, adding that it is for the platform to decide whether they want to use the person’s mobile numbers or Aadhaar (unique identity number given by the government).
