<ul><li>The Department of Industrial Policy and Promotion held a roundtable meeting with industry leaders on February 4. </li><li>A working committee has been assigned to resolve the issues related to <keyword id="6406536" type="UNKNOWN" weightage="20" keywordseo="Angel-Tax">angel tax</keyword>. </li><li>According to a survey, 73% of <keyword id="982553" type="PERSON" weightage="20" keywordseo="Indian-startups">Indian startups</keyword> have been served with angel tax notices. </li></ul>The Indian government is reportedly all set to take a decision on the angel tax issue that startups and investors alike have voiced against – within the next week. The step is expected to bring clarity to the country’s early stage entrepreneurs who say the rule has hurt their funding prospects. On Monday, the Department of Industrial Policy and Promotion (which recently got upgraded to be the Department for Promotion of Industry and Internal Trade) held a roundtable meeting with industry leaders from the Indian startup ecosystem to work on providing solutions for the angel tax issue, together. The meeting which was held with Indian Private Equity and Venture Capital Association (IVCA), angel investors and other leaders, saw the government take support from industry bodies to understand and implement changes that will be accepted by all. “We will form a smaller working group to come out with certain suggestions on resolving those issues in the next four-five days,” said Ramesh Abhishek, DIPP Secretary to the <a href="https://www.thehindubusinessline.com/economy/policy/working-group-to-examine-angel-tax-pain/article26176774.ece">media.</a> The angel tax issue had stirred up again after several startups were sent notices for the same. According to survey done by the IVCA, 73% of startups in India received <a href="https://yourstory.com/2019/02/indian-startups-angel-tax-notice/">Angel tax notices</a>. However, the DIPP secretary has said that no coercive action will be taken against these startups. In the last month, the government had introduced changes to tax laws under the Section 56(2) (vii b) of the Income Tax Act that will exempt ‘genuine’ investors in startups which are recognised by the DIPP. Till date, 15,278 startups have been recognised by the DIPP, while 129 startups have been funded under the Startup India program. Since the tax was introduced in 2012, Indian startups have claimed it has slowed down the funding at earlier stages because of the high tax rate. There have been several calls from the startup industry to remove the tax completely. The angel tax was added by the Indian government to prevent money laundering, however, over the years, entrepreneurs believe it has only become a hurdle in the funding stages. Indian government to take a stand on angel tax within a week

It is clear from various initiatives taken up by the government ever since it came in power that they want to project India as one of the best countries to do business in and to do business with. Therefore the <keyword id="6354424" type="ORGANIZATION" weightage="20" keywordseo="World-Bank">World Bank</keyword>'s 'ease of doing business' survey 2018 which is slated to be released on October 31 is something that the government is eagerly waiting for. The report is likely to give a clearer view of where India stands in terms of ‘ease of doing business’ compared to other countries. Top officials in the government have reason to believe that India's ranking may improve significantly in the World Bank's ease of doing business report on the back of reforms initiated by the government. "We have worked very hard so we are definitely expecting," <keyword id="6391107" type="ORGANIZATION" weightage="20" keywordseo="DIPP">DIPP</keyword> Secretary <keyword id="254331" type="PERSON" weightage="20" keywordseo="Ramesh-Abhishek">Ramesh Abhishek</keyword> told when asked if the country's ranking would improve. Will India’s ranking in ‘ease of doing business’ improve? Government anticipates a “good news”

<ul><li>The government has announced in what it believes are easier processes for startups to claim exemption from <keyword id="6406536" type="UNKNOWN" weightage="20" keywordseo="Angel-Tax">Angel Tax</keyword>. </li><li>Startups incorporated before April 2016 can also apply for exemption. </li><li>However, startups need to be recognised by <keyword id="6391107" type="UNKNOWN" weightage="20" keywordseo="DIPP">DIPP</keyword> for the same.</li></ul>Indian startups have long been fighting the demon that came into their lives with the ‘angel <keyword id="45031" type="PERSON" weightage="20" keywordseo="Tax">tax</keyword>,’ which requires them to pay up for money they received from early investors. Now, the government has introduced changes to tax laws under the Section 56(2) (vii b) of the Income Tax Act that will exempt ‘genuine’ investors in recognised startups – but not without another red tape. They have to be registered with the government’s Department of Industrial Policy and Promotion (DIPP) in order to get the exemption. The angel tax, which was introduced in 2012, mandated that angel investments should be treated as “income from other sources” if the <keyword id="138263" type="PERSON" weightage="20" keywordseo="startup">startup</keyword> issues shares at a price that exceeds the fair market value of the shares. The Indian government believes it is now providing a simpler mechanism to claim exemption from the tax. While earlier, exemption from this tax was available only for startups incorporated after 2016 under the government’s ‘Startup India program’ – a much-touted initiative of the Modi government to boost entrepreneurship. “All previous and future investments are covered, startups incorporated before April 2016 also covered,” DIPP secretary Ramesh Abhishek told <a href="https://economictimes.indiatimes.com/small-biz/startups/newsbuzz/angel-tax-wont-haunt-startups-any-longer/articleshow/67566526.cms">Economic Times.</a> Since the launch of the Startup India program, 15,113 companies have been recognised under DIPP; India is home to a total of over 40,000 startups until June 2018 according to a <a href="https://yourstory.com/2018/06/presenting-india-startup-report-yourstory-overview-startup-ecosystem/">YourStory report</a>. With the new rule in place, DIPP-recognised startups applying for the exemption to the Central Board of Direct Taxation will be able to get an approval in 45 days. All in all, the rule becomes another added layer of bureaucratic hoops that startups now have to jump through, even though culturally speaking, a startup’s way of functioning is very different than that of a typical ‘registered company’. Experts believe that investments in a startup by an individual is a commercial decision that needs to be treated like one. “The government’s intent is to check if anyone is misusing the methodology for money laundering. If the source of the money is not tainted then why should there be an angel tax,” said Ved Jain, a tax expert and past president of The Institute of Chartered Accountants of India. The question that most experts are weighing in on is – why do we really need an angel tax? By implementation of the rule to register under DIPP, the government gets a say on how and when you startup – and that might not exactly be the ‘ease’ of doing business that the government is promoting. “Why are we moving with a presumption that whichever company is receiving the share capital with a difference in the fair market value, there is something wrong with the deal. There has to be a difference between a commercial and government decision. However if there is an allegation that it has been misused, only then additional rules should be implemented,” said Jain. Indian government just added a lot more red tape for startups while trying to fix the devilish ‘angel tax’

A dedicate portal and a mobile application would now let Indian start-ups register themselves online in a single day. Not only this, they would also be able to know about all the incentives that the government can offer to them under the Start-up India Action Plan. 
 
The portal and app, developed by the Department of Industrial Policy and Promotion (DIPP), would be launched within a week. It would provide all information about tax benefits and incubation facilities that the government provides, would serve as a single point of contact for clearances, approvals and registrations. 
 
"This is part of our effort to create a conducive environment for start-ups. It will facilitate easy exchange of information between all stakeholders," a senior official told ET. 
 
Later, the portal would be equipped to get the companies registered under the Companies Act. 
 
The launch has come right when promised by PM Modi, when he announced the Start-up India Action Plan in January and said that a portal and app dedicated for start-ups will be launched on April 1. 
 
As for the interest of the stakeholders, the portal would bring all stakeholders, including start-ups, incubators, accelerators, venture capital funds, seed capital funds, angel investment funds and government functionaries under one roof.

 Incentivising and giving wider tax breaks to early stage <keyword id="6362513" type="ORGANIZATION" weightage="20" keywordseo="Startups">startups</keyword> will encourage budding entrepreneurs while many think the government’s 3-year tax break is a short-sighted move.

 The Department of Industrial Policy and Promotion (<keyword id="6391107" type="ORGANIZATION" weightage="20" keywordseo="DIPP">DIPP</keyword>), the one that created the startup policy, is also in discussions with the <keyword id="47209" type="ORGANIZATION" weightage="20" keywordseo="Finance-Ministry">Finance Ministry</keyword> to exempt startups from service tax, besides providing them relief on income tax-related issues.

Here is how the upcoming budget might affect startups: 
 
• Lower holding period for long-term capital gains The primary matter of concern for startups in India has been <keyword id="6383566" type="PERSON" weightage="20" keywordseo="Taxation">taxation</keyword>. 
The DIPP has proposed that the period for long-term capital gains for unlisted securities should be reduced from the current limit of 24 months which can lead to higher investments. 
 
• Taxation of ESOPs during sale 
The DIPP has proposed that the employee stock option plans (ESOPs) for startups should be taxed at the time of sale of these stocks. Larger startups can now rejoice since this would provide them with transparency from a valuation perspective as well as further boost their liquidity from a tax outflow perspective. 
 
• Tax holiday period 
The tax concession period currently spans three years and there is a demand to increase this to between five and seven. If this demand is accepted then it could mean that there will be a huge increase in a number of start-ups.

The budget should aggressively focus on innovation-led businesses and some encouraging fiscal policies to make provisions to enable India to improve its Ease of Doing Business ranking by encouraging investments in startups.

What
should Indian startups hope for in Budget 2017

<keyword id="3209160" type="ORGANIZATION" weightage="20" keywordseo="DIPP-secretary-amitabh-kant">DIPP Secretary Amitabh Kant</keyword> says India will reduce its massive backlog of patent patency in coming 18 months and will bring down to US, Japan levels. 
 Addressing a jam-packed audience at <keyword id="3003094" type="UNKNOWN" weightage="20" keywordseo="Startup-India">Startup India</keyword> event at Vigyan Bhawan in New Delhi, Kant said <keyword id="388837" type="UNKNOWN" weightage="20" keywordseo="intellectual-property">Intellectual Property</keyword> Rights applications will be processed as around 1,000 patent examiners have been hired and the work has also been outsourced to IITs. 
 
"In 18 months time we will bring our patent pendency to exactly the same level as in the US and Japan. And in about a year's time we will bring the trade mark pendency down to zero level," said Kant. 
 
About 2.46 lakh patent applications and 5.32 lakh trademark registrations were pending (as on November 1, 2015) due to shortage of manpower. On the other hand, the pendency level is quite low in developed countries like the US and Japan. 
 
When asked what will be done to ensure that Startups are not limited to cities like Bengaluru and Gurgaon, HRD Secretary V S Oberoi said his ministry will provide the backup, handholding and other helps to young entrepreneurs. 
 
"Our effort is to spread this across India...In the next few months I would see a strong element of support that incidentally is not metro or big city oriented. It is really out there (other parts of the country) we hope to concentrate," he added.

A few months ago, Petroleum Minister Dharmendra Pradhan had asked commerce minister <keyword id="129243" type="PERSON" weightage="100" keywordseo="Nirmala-Sitharaman">Nirmala Sitharaman</keyword>, whose ministry administers the government's Start-up India, Stand up India programme, to help him find a start-up that collects used oil at an industrial scale, so that it can be recycled and put to use again. 
 This inspired the Department of Industrial Policy and Promotion (<keyword id="6391107" type="ORGANIZATION" weightage="100" keywordseo="DIPP">DIPP</keyword>) to become a matchmaker between several ministries of Indian government and start-ups that work in fields that these ministries seek. 
 
There are several arms of the government that are looking for innovative ideas so that they can find a solution to their unique problems. On the other hand, there are also many start-ups that have found way outs of these problems, but don’t even know if those are required or not, or have no contacts in the government. 
 
"The idea is to act as a facilitator between the two," a government official aware of the matter told <a href="http://economictimes.indiatimes.com/small-biz/policy-trends/dipp-to-handhold-startups-put-them-in-touch-with-government/articleshow/52948280.cms">ET</a>. "It can aid in solving critical problems of the government," added the person. 
 
Sitharaman has asked DIPP to look seriously into the booming startup ecosystem so that it can find innovative solutions for all the major problems that various government departments are looking solutions to. 
 
The first phase of the concept will be tested during the start-up national fest that is going to be held this August in Hyderabad. In the fest, a contest, called the Grand Challenge, will be held, for which DIPP will ask various ministries to share their problems, and start-ups would be selected on the basis of effective solutions.

Start-ups from all over the world will now be able to register their patents in India at a faster rate and for much lower costs, thanks to a 'tatkal (instant)' option that the government is offering under its latest amended patent rules. 
 
These benefits will also be available to entities who would be filing their first application in India. 
 
As reported yesterday, India has changed the rules for patent registration, also including the definition of 'start-up' in the patent rules so that special benefits can be passed on to the start-ups. As per the amended rules, the time period for granting patents has been reduced from 5-7 years to 2.5 years immediately and would further be reduced to 1.5 years by March 2018. 
 
"We want to encourage domestic filings," said Rajiv Aggarwal, joint secretary of DIPP. 
 
Talking of start-ups, they have been qualified as "individual persons" rather than companies, so that patent fees can come down and make them eligible for 80% rebate, according to the start-up action plan. 
 
For ‘tatkal’ scheme, start-ups will have to pay Rs 8,000 while for companies it is about Rs 60,000. 
 
Not only this, amended rules also hint at refund of patent fees for the first time. When an application is withdrawn and there is no need for the request for examination, 90% of the amount would be reimbursed.

Global start-ups will now be able to register cheaper & faster patents in India

As reported earlier, Xiaomi had <a href="http://www.businessinsider.in/Xiaomi-India-fdi/articleshow/52006652.cms">applied for single brand retail licence</a>, in order to be able to set up single brand showrooms in India as per <a href="http://www.businessinsider.in/100-FDI-in-e-commerce-in-India-now-So-whatCorporateGossip/articleshow/51615169.cms">new FDI rules</a>. However, the application has been put on hold by the Indian government, and the Chinese handset maker has been asked to provide more documents to support its application.

Department of Industrial Policy and Promotion (DIPP) will forward the said application to the <a href="http://www.businessinsider.in/Not-everything-can-be-termed-state-of-the-art-says-Indian-government-to-facilitate-FDI/articleshow/51628211.cms">"cutting edge panel"</a> only when the company submits all the details that are to be considered for exempting it from the 30% sourcing norm, a senior government official told ET. 
 
"We are in constant discussion with the department for small clarifications, and have not met any major obstacles to date. We are unable to comment further on the specifics of the application as it is still being processed," Xiaomi's spokesperson said.

The patent regime in India is all set to be streamlined, since the government would now offer an option of 'Tatkal' window, so that patent applications can be cleared at the earliest. 
 
Not only this, the government is also planning to significantly cut down the time period for which patents are granted, to two and a half years immediately and one and a half years by March 2018. As of now, it ranges from 5 to 7 years. 
 
The modified patent rules would allow entities to choose the fast clearance route so that they can get patents earlier in return of some additional fees, in case they select India as International Search Authority or International Preliminary Examining Authorities. For this, they would have to file their applications in India first. 
 
"The move is aimed at popularising India as a patent filing hub so that more companies file applications in India," said Rajiv Aggarwal, Joint Secretary, DIPP. 
 
These benefits will only be made available to new applicants. 
 
Start-ups meeting the prescribed criteria will also be able to use the Tatkal route. While individuals and start-ups would need to pay Rs 8,000 for this, for companies this fee could be as much as Rs 60,000.

 <keyword id="6354424" type="ORGANIZATION" weightage="20" keywordseo="World-Bank">World Bank</keyword> officials will meet people from <a href="http://www.businessinsider.in/searchresult.cms?query=DIPP&amp;sortorder=effectivedate">Department of Industrial Policy &amp; Promotion</a> (<keyword id="6391107" type="ORGANIZATION" weightage="20" keywordseo="DIPP">DIPP</keyword>), which will present a data on significant improvements made across 14 parameters on which the ranking is decided. 
 
India, which is presently at 130th rank out of 184 nations, will present data on various sectors such as enforcing contracts, resolving insolvency and starting a business, in which India ranked poorly last year. 
 
World Bank researchers will spend two weeks in Delhi and Mumbai and speak with actual users and stakeholders to get the on-ground reality. 
 
"<a href="http://www.businessinsider.in/searchresult.cms?query=prime+minister+narendra+modi&amp;sortorder=effectivedate">Prime Minister Narendra Modi</a> has given us a mandate that we have to be in the top 50 in the next three years. Dismantling the complex procedures has been a mammoth task. If it was easy it would have been done long time back," DIPP secretary Ramesh Abhishek told ET. 
 
DIPP is targeting areas like <a href="http://www.businessinsider.in/searchresult.cms?query=starting+a+business&amp;sortorder=effectivedate">starting businesses</a>, insolvency procedures, construction permits, ease of trading across borders and electricity connections specifically as there have been said complexities for decades. 
 Meanwhile, India's own ranking of states has improved <keyword id="6354423" type="UNKNOWN" weightage="20" keywordseo="Ease-of-Doing-Business">ease of doing business</keyword> across India. "States know they need investments to create jobs, infrastructure, for which they need to provide a business-friendly environment," Abhishek told ET, adding “the Centre is just trying to facilitate these reforms." 
 
Jaijit Bhattacharya, partner, government services and infrastructure, KPMG India, told ET, “The change is happening in all the states. Given the state we are in, we have an enormous amount of work still to do."
