The disputes center around allegations that Grover breached confidentiality terms outlined in his <keyword id="20424040" type="General" weightage="20" keywordseo="employment-agreement" source="keywords">employment agreement</keyword> with the fintech firm. Justice C. Hari Shankar of the Delhi High Court has ordered the appointment of a sole arbitrator to resolve disputes between Ashneer Grover and BharatPe. BharatPe's plea under a relevant section of the Arbitration and Conciliation Act sought to resolve issues stemming from Grover's alleged breach of confidentiality by disclosing sensitive company information on social media. BharatPe proposed former <keyword id="19895345" type="General" weightage="20" keywordseo="Supreme-Court" source="keywords" meta.keywordsubtype="org" meta.entityname="Supreme Court" meta.hostid="261" meta.entityid="Supreme Court">Supreme Court</keyword> Justice Hemant Gupta as the arbitrator, but Grover suggested Justice (Retired) J.R. Midha instead. Grover's advocate, Giriraj Subramanium, did not oppose arbitration, but proposed that the matter be handled by the Singapore International Arbitration Centre (SIAC), given its ongoing involvement with related disputes over the shareholders' agreement. BharatPe's advocate, Anuj Berry, contested this, asserting that the employment agreement specifies arbitration under the Delhi International Arbitration Centre (DIAC), which the Court upheld. Additionally, BharatPe had previously sought a restraining order to prevent Grover from publicly disclosing company details. The Delhi High Court had previously imposed a penalty of Rs. 2 lakh on Ashneer Grover for breaching a court order by posting derogatory content about BharatPe on social media. Justice Rekha Palli, expressing disapproval of Grover's repeated violations, mandated that he pay the costs to the Delhi High Court Clerk Association. Grover issued an unconditional apology, which the court accepted, contingent upon the payment of the imposed costs.

The <keyword id="6355392" type="General" weightage="20" keywordseo="high-court" source="Orion">high court</keyword>, which was dealing with a case of dowry death of a woman after being allegedly harassed by her husband and in-laws for bringing insufficient dowry and giving birth to two daughters, said in contemporary times, the idea of a woman's worth being tied to material considerations contradicts the principles of equality and dignity. "The persistent prevalence of regressive mindsets and instances exemplified by cases involving insatiable demands for dowry underscores a broader societal concern. It highlights the challenges faced by married women, whose intrinsic value and dignity should not be contingent upon their parents' ability to meet the insatiable financial demands from their in-laws," Justice Swarana Kanta Sharma said. The <keyword id="6355392" type="General" weightage="20" keywordseo="high-court" source="Orion">high court</keyword> said it is disturbing to witness a scenario where parents wish for the well-being of their daughter and her comfort after she leaves her paternal house and tries to settle in the matrimonial home but instead of providing her love and support, the new bride is met with unrelenting greed and harassment from in-laws family. It said the trauma is multiplied and becomes lifelong when the victim of a dowry-related offence gives up her life due to constant torture and harassment, especially when the two daughters she has given birth to and loved also become a ground to harass and traumatise her as if she is solely responsible for the <keyword id="20152579" type="General" weightage="20" keywordseo="childs-gender" source="Orion">child's gender</keyword>. "Surprisingly, the genetic science in this regard is ignored according to which, the genetic determination of gender of the unborn child when the child is conceived, involves the combination of X and Y chromosomes, with females possessing two X chromosomes (XX) and males having one X and one Y chromosome (XY)." "According to <keyword id="20139732" type="General" weightage="20" keywordseo="encyclopedia-britannica" source="keywords">Encyclopedia Britannica</keyword>, the outcome of fertilisation depends on whether an unfertilised egg fuses with a sperm carrying an X or Y chromosome, resulting in the birth of a girl or boy, respectively," the high court said. It said the court had dealt with numerous cases of harassment, nagging and suicide or dowry deaths due to the victim being victimised for giving birth to daughters after being constantly harassed over not being able to fulfil her husband and in-laws' desire of "preserving the family tree". Justice Sharma said the court is "constrained to observe that such people need to be educated that it is their son and not their daughter-in-law whose chromosomes through the union of a married couple will decide the gender of their child. "Even if this judgement becomes the birthplace of such enlightenment, it will go a long way to change the mindsets of perpetrators of such crimes and save lives of innocent married women, by using principles of science through principles of law," she said. The high court made the observations while denying bail to the husband in a dowry death case. The allegations against the accused were that he along with his family members used to torture his wife for dowry leading to her committing suicide. It has been alleged by the complainant, father of the deceased woman, that the accused and his family pressured his daughter for additional dowry and financial demands, causing significant distress. It has also been alleged by him that she was taunted and mistreated for giving birth to two daughters. The high court, in its order, said prima facie at this stage, a woman has lost her life for giving birth to daughters, which should be unacceptable to a conscientious society and such offences have to be considered grave and serious when the trial is yet to begin. "In view of the above facts and circumstances, and since the allegations against the present applicant/accused are grave and serious in nature, the charges are yet to be framed and the material witnesses are yet to be examined, this court is not inclined to enlarge him on bail," it said. The court further opined that in a society that emphasises equality and strives for equal progress of women and women empowerment, incidents like this are etched as disheartening markers on the path of equal societal advancement for women. It said the notion that a woman's value diminishes if her parents cannot fulfil dowry expectations of her husband and in-laws reflects a deep-seated bias and discrimination against women. Such expectations not only violate the principles of gender equality but also contribute to an environment where women are objectified and reduced to mere transactions, the court said while acknowledging the profound distress experienced by parents, who in the earnest pursuit of their daughter's happiness, bestowed everything they had to allegedly fulfil the dowry demands of her in-laws.

New Delhi [India], May 14 (ANI): Actor <keyword id="19956789" type="General" weightage="100" keywordseo="Jackie-Shroff" source="keywords">Jackie Shroff</keyword> has approached the <keyword id="19895875" type="General" weightage="20" keywordseo="Delhi-High-Court" source="keywords">Delhi High Court</keyword> to seek protection of his personality and <keyword id="21653032" type="General" weightage="20" keywordseo="publicity-rights" source="keywords">publicity rights</keyword>. The suit has been filed against various entities using his name, photographs, voice and word "<keyword id="19960424" type="General" weightage="20" keywordseo="Bhidu" source="keywords">Bhidu</keyword>" without his consent. Through this suit, actor Jackie Shroff seeks direction to protect the Plaintiff's name, voice, image, likeness, and all other elements of the Plaintiff's persona which are distinctive and the unauthorized use by third parties is likely to create confusion and deception amongst the public. The bench of Justice Sanjeev Narula on Tuesday issued a summons on the actor's suit and said it will consider the case tomorrow on the interim injunction application. The actor seeks a permanent injunction restraining the defendants from infringing the Plaintiff's personality rights and publicity rights by the use of the Plaintiff's name 'Jackie Shroff", "Jackie', '<keyword id="21052256" type="General" weightage="20" keywordseo="jaggu-dada" source="keywords">Jaggu Dada</keyword>', 'Bhidu' voice, image and any other attribute which is exclusively identifiable with him for any commercial or personal gain. The plea asks the court to pass a decree of permanent injunction restraining Defendant Bhidu Shawarma restaurant and its associates, servants, agents, affiliates, holding companies, and representatives, from infringing the Plaintiff's registered trademark by using the same as part of its trade name 'Bhidu Shawarma &amp; Restaurant' or any other trade name/trade mark which is deceptively similar to the Plaintiff's registered trademark numbers. The suit also pertains to the violation of the Plaintiff's moral rights in his performances conferred upon him by virtue of section 38B of the <keyword id="21653033" type="General" weightage="20" keywordseo="copyright-act" source="keywords">Copyright Act</keyword>, 1957. The Plaintiff, as an actor has acted in many cinematographic films and thus enjoys moral rights in his performances in such films and is entitled to restrain any third party from distorting, mutilating or making other modifications to his performance that are prejudicial to his reputation. In the context of the claims in the present proceedings, the Defendants are extracting clips of movies or other cinematographic works which contain performances of the Plaintiff, for the purpose of creation, communication of graphic/ interchange formats (GIFs), etc. The suit states that Plaintiff has not been informed prior to the creation and dissemination of such GIFs, nor has his consent been sought or secured. The Defendants, by reproducing clips containing the Plaintiff's performance, and that too in a manner which brings disrepute to the Plaintiff and makes him the subject of unsavoury humour, are violating his moral rights in his performances. The misappropriation of any attribute of the Plaintiff's persona without his express permission for a commercial purpose is liable to be restrained not only on the basis of the traditional conception of publicity rights namely the exclusive right to commercially exploit one's persona but also on the basis of the tort of dilution, more particularly tarnishment. Recently, the Delhi High Court also restrained the unauthorised use of actor Anil Kapoor's personality or name for commercial purposes. In the year 2022, Amitabh Bachchan had also moved the Delhi HC against the illegal use of his voice and image. (ANI)

Regarding the FIR filed against the company and its officials, the company in its statement said: "This is to inform that it is an old matter pertaining to the year 2009-10 with a disgruntled service provider, Brains Logistics Pvt. Ltd. (Promoter - Roop Darshan Pandey)." It may also be noted that while the complainant has mentioned company officials in the complaint, no official has been named in the FIR. "In 2013, Hero MotoCorp also registered an FIR against Brains Logistics and the matter is ongoing before the competent court," the Hero MotoCorp statement added.
