A total of 163 ( 68 per cent) out of the 241 winners in the Bihar Assembly polls have declared criminal cases against themselves in the poll affidavits, with <keyword id="42678" type="ORGANIZATION" weightage="20" keywordseo="RJD">RJD</keyword> topping the list with around 73 per cent, Bihar Election Watch and Association for Democratic Reforms (ADR) said. Of the 163 MLA-elects, 123 (51 per cent of total affidavits analysed) have serious criminal cases pending against them, including those related to murder, attempt to murder, kidnapping and crimes against women. In the 2015 Assembly elections, 142 (58 per cent) MLAs had self-declared such cases against them in their affidavits. This time, the ADR had analysed the self-sworn affidavits of 241 of the 243 victorious candidates. The ADR did not say anything on such details of remaining winners. The results of the three-phase elections were declared on Wednesday early morning after counting that went on for over 20 hours. Out of the 123 winners, 19 have murder cases, 31 attempt to murder and eight crimes against women against their names. Among the major parties, 54 (73 per cent) of the 74 winners from Tejashwi Yadav-led <keyword id="123786" type="ORGANIZATION" weightage="20" keywordseo="Rashtriya-Janata-Dal">Rashtriya Janata Dal</keyword> (RJD) have pending criminal cases, followed by 47 (64 per cent) out of 73 from BJP, 20 (47 per cent) out of 43 from Janata Dal-United, 16 (84 per cent) out of 19 from Congress, 10 (83 per cent) out of 12 from Communist Party of India-Marxist Leninist Liberation, and five (100 per cent) out of 5 from Asaduddin Owaisi's All India Majlis-e-Ittehadul Muslimeen. A total of 44 (60 per cent) out of 74 RJD winners, 35 (48 per cent) out of 73 from BJP, 11 (26 per cent) out of 43 from JD-U, 11 (58 per cent) out of 19 from Congress, eight (67 per cent) out of 12 from CPI-MLL and 5 (100 per cent) out of 5 from AIMIM have serious criminal cases pending against them. Nearly 70% of Bihar election winners have declared criminal cases against them, mostly from RJD

A lacklustre show by the Congress in Bihar seems to have proved costly for the opposition grand alliance, as it dragged down the RJD too from the government formation in the Hindi heartland state. While the Congress lost ground in Bihar, it also suffered significant electoral losses in Madhya Pradesh, Uttar Pradesh and Gujarat, losing a majority of bypolls in key states that saw the BJP surging ahead. <div type="Article" hostid="261" msid="79142084" title="Bihar Election Results 2020: With 40 seats still hanging in the balance, NDA widens its lead but RJD continues to be the single largest party" mstype="2" mssubtype="0"></div> The Congress also alleged foul play in elections accusing the ruling NDA of misuse of power. The Congress also went to the EC making the allegations that their candidates were not given certificates of victory despite winning. "Democracy is being murdered and mandate being abducted in Bihar," Surjewala tweeted in Hindi citing examples of seats where their party candidate had won but not given certificates of victory. Senior party leaders again blamed EVMs for the losses, with former Madhya Pradesh chief minister Digvijaya Singh and Dalit leader Udit Raj claiming that the electronic voting machines (EVMs) can be hacked and tampered with, though their party colleague Karti Chidambaram said the EVM system is accurate and dependable, and "it's time to stop blaming the EVM". "What is the reason that no developed country is using EVMs... if a chip is there, then it is not tamper-proof," Singh said, alleging "selective" rigging. In Bihar, the Congress's tally dropped from 27 in 2015 to 19 as per the latest trends available, that saw the RJD-led grand alliance narrowly lag behind the BJP-led NDA. Though the Congress improved its vote share from 6.66 per cent in 2015 to nearly 9.5 per cent in this election, its strike rate this time was less than 30 per cent as against 66 percent last time. The grand old party had contested in 70 seats this time with its ally RJD contesting in the majority seats. In 2015, the Congress had contested in 41 seats. On their part, Congress sources said it would be "unfair" to say that the party fared poorly as it contested those seats in Bihar which were traditionally NDA strongholds and the JDU-BJP combine had a strike rate of over 95 in the past. Party insiders said the seats it contested also did not have the advantage of Muslim-Yadav combination and were never contested by it earlier. The presence of AIMIM also cost the Congress dearly as the Asaduddin Owaisi-led outfit won five seats and cost the Mhagathbandhan some 15-odd seats, insiders said. The RJD had also not won those seats since 1990, a leader claimed, adding that even in 2015 when RJD-JDU-Cong fought as part of 'Mahagathbandhan', the Congress had won 23 out of 32 seats from this area. Leaders said the party failed to put up a strong base in Bihar in the last two years after its former Bihar chief Ashok Choudhary defected to the JDU, and could not consolidate its position riding on the RJD support-base. Shiv Sena, an ally of Congress in Maharashtra, also accused the Congress of being the "weak-link" and dragging down the RJD. Sena's Sanjay Raut said had the Congress performed better, Tejaswi Yadav would have been declared CM by now. Of the 28 seats in Madhya Pradesh, the party lost 19 seats to the BJP and was leading in 8 seats it was holding, with Congress rebel Jyotiraditya Scindia posting big gains for the saffron party. In UP and Gujarat, the Congress drew a blank in 15 bypoll seats in Gujarat and Uttar Pradesh. However, one consolation for the Congress was its victory in bypolls in Haryana's Baroda seat, where the BJP is in power. The Congress held on to its Baroda assembly seat in the bypoll necessitated after the death of its MLA Shri Krishan Hooda. The Congress also won one seat each in Chhattisgarh and Jharkhand in bypolls held today.

New Delhi, More than 10 years after a Supreme Court judgement paved way for introduction of the <keyword id="20335981" type="General" weightage="20" keywordseo="nota" source="keywords">NOTA</keyword> button on EVM for polls, the number of voters choosing it still remains low, with the experts dubbing it as a "toothless tiger" with no implications on the results. NOTA (None of the Above) was introduced in India through the Supreme Court's judgement in September 2013. The need to introduce NOTA was felt to discourage the parties from fielding tainted candidates. The Supreme Court directed the Election Commission to make necessary provision in the ballot papers/EVMs so that the voters can decide not to vote for any of the candidates in the fray. Introduced in 2013, the NOTA option on electronic voting machines has its own symbol - a ballot paper with a black cross across it. After the Supreme Court order in September 2013, the Election Commission added the NOTA button on the EVMs as the last option on the voting panel. One ballot unit has 16 buttons. Before the apex court order, those not inclined to vote for any candidate had the option of filling what is popularly called form 49-O. But filling out the form at the polling station under Rule 49-O of the Conduct of Elections Rules, 1961, compromised the secrecy of the voter. However, even as NOTA has secured over 1.29 crore votes in the state assembly elections and the <keyword id="19895394" type="General" weightage="20" keywordseo="lok-sabha" source="keywords">Lok Sabha</keyword> elections combined in the last five years, the number of candidates with criminal records has increased in both the general and the assembly elections. According to a report by Association for Democratic Reforms (ADR), the share of MPs with declared criminal cases against them has been increasing in the last decade. While 30 per cent elected MPs had criminal cases against them in 2009, which went up. Of the 543 winners analysed by the ADR in the 2009 Lok Sabha elections, 162 (30 per cent) had declared criminal cases against them, with 76 (14 per cent) had serious criminal cases against them. In 2019, the share of MPs with criminal and serious criminal cases increased to 43 per cent and 29 per cent. "NOTA has made no difference as far as criminality is concerned, in fact the number of candidates with criminal cases has increased," Major General (Retd) Anil Verma, Head of ADR, told PTI. "The concept of NOTA was that some pressure would be on the parties not to field tainted candidates. It has not happened," he said. Overall in different state and general elections, votes polled on NOTA have been between .5 per cent to 1.5per cent, according to data compiled by the ADR. It secured around 1.06 per cent votes in the 2019 Lok Sabha polls, and among states, highest was when it got 1.98 percent of the total votes in the 2018 Chhattisgarh Assembly polls. The lowest number of votes NOTA in the Lok Sabha was 100 votes in Lakshadweep, and among the state polls, it secured the lowest percentage of vote share - 0.46 percent in both the Delhi State Assembly Elections, 2020, and the Mizoram State Assembly Elections, 2018. "Unfortunately, it turned out to be a toothless tiger. It merely provided a platform to express dissent or one's anger for political parties to take note and nothing more," <keyword id="20887282" type="General" weightage="20" keywordseo="maj-gen-verma" source="keywords">Maj Gen Verma</keyword> (Retd) said. He, however, pointed out that overall, the percentage of NOTA votes in seats reserved for the Scheduled Castes and the Scheduled Tribe has been slightly higher, which may indicate there are more grievances among these groups. "In the reserved constituencies, we have seen the percentage of NOTA votes are higher. Perhaps the tribals and SCs have more grievances so they go in larger numbers for NOTA," he said. Constituency wise, NOTA has secured as high as 27,500 votes in Maharashtra's Latur Rural constituency, a seat reserved for the SC community, over 13 per cent of the total votes. NOTA got the second spot, with Congress' Dhiraj Deshmukh winning with over 67 per cent of the total votes. In 'Red Alert Constituencies', the seats with three or more candidates with criminal cases contesting the elections, NOTA secured 26, 77,616 votes (26.77 lakhs) in the state assembly elections since 2018. It ranges from 1.63 per cent in Bihar in 217 red alert constituencies to 0.43 per cent in Delhi. In the 2019 Lok Sabha polls, the highest number of NOTA votes (51,660) were polled in Bihar's Gopalganj, another reserved SC constituency, where it secured the third spot getting 5.03 per cent of the total votes. Axis India chairman <keyword id="20816878" type="General" weightage="20" keywordseo="pradeep-gupta" source="keywords">Pradeep Gupta</keyword> said there is a requirement to give more teeth to the NOTA option. "I believe that candidates, who have lost against NOTA should not get a chance to contest again. That is what the logic is all about. Since there is no such rule, many voters think what is the point of choosing NOTA," Gupta told PTI. "In 2014, 1.08 pc voters chose NOTA, the percentage was 1.06 pc in 2019. It is a sizeable number but I believe it is more due to error and less due to intention," Gupta said. "But if a rule is brought in barring the rejected candidates from contesting again, I believe the number will go up like anything. The political parties understand the sensitivity of this and that is why I believe no one will favour such a law and hence NOTA is a toothless option," he added. Calls have also been made for scrapping NOTA. Former Chhattisgarh chief minister Bhupesh Baghel had last year sought scrapping NOTA, stating that in certain cases it polled more votes than winning margin. In 2018, the Supreme Court had ruled that NOTA option should not be given in the <keyword id="19895369" type="General" weightage="20" keywordseo="rajya-sabha" source="keywords">Rajya Sabha</keyword> elections.

Ahead of the last phase of polling, Rashtriya Janata Dal <a href="https://www.bbc.com/hindi/amp/india-48275180?__twitter_impression=true">(RJD) has alleged</a> that Nitish Kumar, the current Chief Minister of Bihar and leader of the Janata Dal (United), will do a backward flip-- and break away from its alliance with the Bharatiya Janata Party (BJP). The basis of this speculation comes from JD(U)’s party secretary, K C Tyagi’s statement seeking special status for the state,which is one of Modi’s undelivered promises from 2014. While striking a dissonant chord with ally BJP, JD(U)’s Tyagi has also tried to woo rivals in Odisha ( Biju Janata Dal’s (BJD) Naveen Patnai), and in Andhra Pradesh (YSR Congress’s Jaganmohan Reddy and his immediate rival <keyword id="83019" type="ORGANIZATION" weightage="20" keywordseo="Telugu-Desam-Party">Telugu Desam Party</keyword>’s (TDP) Chandrababu Naidu), who have similar demands from the centre. A motley crew of regional satraps ahead of the last phase of polling may be a crucial political manoeuvre. On May 19, 60 seats in Bihar, Uttar Pradesh, Jharkhand, Punjab, Madhya Pradesh, Himachal Pradesh and Chandigarh are going to the polls. The Kingmakers Apart from its traditional rival, the Congress Party-led United Progressive Alliance (UPA), the BJP-led National Democratic Alliance (NDA) is challenged by Mahgathbandhan or a Grand Alliance that includes 12 political parties. It is led by Mayawati of Bahujan Samaj Party (BSP), and <keyword id="6355031" type="PERSON" weightage="20" keywordseo="akhilesh-yadav">Akhilesh Yadav</keyword> of <keyword id="6354265" type="DEFINITION" weightage="20" keywordseo="samajwadi-party">Samajwadi Party</keyword> (SP), who were former foes turned friends; proving yet again politics makes strange bedfellows. These are the clear sides in the election so far and one of the leaders is likely to become the next Prime Minister. However, the BJD, the YSR Congress, its state rival TDP, and the Telegana Rashtra Samiti (TRS) led by K Chandrashekhar Rao who are yet to pick sides, will have fewer seats but an outsized say in deciding the winner of this Lok Sabha election, in the case of an utterly fractured mandate. The three states put together have 86 seats at stake in the Lok Sabha. Even half of those seats will wield significant power in case any of the other three national coalitions fail to cross the halfway mark. ‘Special’ unity The one factor binding four out of the five regional parties is the demand for ‘special status’ for their respective states. Special status is given to states with historic disadvantages be it geographic issues like tough terrains or unviable state finances. It provides them with autonomy like the ability to establish development boards, and decide on reservations. Special status has also been the bone of contention between BJP and TDP. TDP head Chandrababu Naidu broke away from the NDA, after BJP refused the status, as Naidu re-builds the state after Telangana split from AP. What is bringing these parties together is a recent comment from the union finance minister and BJP leader Arun Jaitley that categorically dismissed the demand for <a href="http://www.newindianexpress.com/business/2019/apr/04/arun-jaitley-against-special-status-special-financial-packages-for-states-1960238.html">special status for AP</a>, saying the ‘time for seeking special status is over’. While JD(U) has denied any attempt to break away from the NDA, it has enough common ground with the other four parties that can influence government formation. This may be the prelude to hectic parleys after the results on May 23.
