The Centre on Thursday told the <keyword id="19895345" type="General" weightage="20" keywordseo="Supreme-Court" source="keywords" meta.keywordsubtype="org" meta.entityname="Supreme Court" meta.hostid="261" meta.entityid="Supreme Court">Supreme Court</keyword> that the decision to give <keyword id="21375140" type="General" weightage="20" keywordseo="grace-marks" source="keywords">grace marks</keyword> to 1,563 <keyword id="20055256" type="General" weightage="20" keywordseo="NEET-UG" source="keywords">NEET-UG</keyword>, 2024 candidates for admission to <keyword id="19968296" type="General" weightage="20" keywordseo="MBBS" source="keywords">MBBS</keyword>, <keyword id="20007002" type="General" weightage="20" keywordseo="BDS" source="keywords">BDS</keyword> and others courses has been cancelled and they will be given an option to take a re-test on June 23. A vacation bench of justices Vikram Nath and Sandeep Mehta was told by the counsel for the Centre and the <keyword id="19904021" type="General" weightage="20" keywordseo="National-Testing-Agency" source="keywords" meta.keywordsubtype="org" meta.entityname="National Testing Agency" meta.hostid="261" meta.entityid="National Testing Agency">National Testing Agency</keyword> (NTA) that the students, who were given grace marks, will be given an option to take the re-test. The court said it will not stay the counselling process for admissions. If the candidates, out of the 1,563, do not wish to take up the retest then their earlier marks, sans the grace marks, will be given for the purposes of the results. The results of the re-test will be declared on June 30 and the counselling for admission in the MBBS, BDS, other courses will start on July 6, the Centre said. Taking note of the submissions, the bench said all the pleas, including the one filed by Alakh Pandey, the chief executive of EdTech firm Physics Wallah over the issue of award of grace marks, will be taken up for hearing on July 8. They also include the petitions seeking cancellation of NEET-UG, 2024 on account of allegation of question paper leaks and other malpractices. The examination was held by the NTA on May 5 across 4,750 centres and around 24 lakh candidates took it. The results were expected to be declared on June 14 but were announced on June 4, apparently because the evaluation of the answer sheets got completed earlier. The allegations such as question paper leak and the grant of grace marks to over 1,500 medical aspirants have led to protests and filing of cases in seven high courts as also the Supreme Court. As many as 67 students scored a perfect 720, unprecedented in the NTA's history, with six from a centre in Haryana's Faridabad figuring in the list, raising suspicions about irregularities. Scores of students protested in Delhi on June 10 seeking a probe into alleged irregularities. It has been alleged that grace marks contributed to 67 students sharing the top rank. The NEET-UG examination is conducted by the NTA for admissions to MBBS, BDS, AYUSH and other related courses in government and private institutions across the country. Row over NEET-UG: Grace marks given to 1,563 candidates withdrawn, Centre to SC

The Directorate General of Health Services (<keyword id="6430867" type="General" weightage="100" keywordseo="dghs" source="Orion">DGHS</keyword>) has informed the <keyword id="6354977" type="General" weightage="20" keywordseo="Supreme-Court" source="Orion">Supreme Court</keyword> that four rounds of online counselling for <keyword id="11196228" type="General" weightage="20" keywordseo="NEET-PG-2021" source="Orion">NEET-PG 2021</keyword> have been already conducted and 1,456 medical seats have remained vacant, as the software stands closed. The DGHS said since the software is closed, further rounds of counselling could not be conducted to fill up the medical seats. The DGHS in an affidavit, submitted the software, which was used for online counselling of NEET-PG 2021, is closed and refund of security deposit for participating in PG counselling has been initiated. It also added that the petitioner has made the plea at a belated stage and it may impact the whole process for upcoming counselling session for <keyword id="12826212" type="General" weightage="20" keywordseo="NEET-PG-2022" source="Orion">NEET-PG 2022</keyword>, and it is also difficult to run concurrently counselling for two academic sessions. A vacation bench comprising Justices M.R. Shah and Aniruddha Bose on Wednesday sought response from the Central government on petitions seeking a special stray round of counselling for the 1,456 vacant seats. The DGHS said it has acted in a bonafide manner and complied with the direction of the apex court in full letter and spirit, and no further rounds apart from four online rounds of counselling could be conducted. It added that NEET-PG 2021 counselling was delayed due to third wave of the Covid-19 pandemic. The DGHS said as per the direction of the top court it conducted four rounds of online counselling for the PG course and the last date of admissions for the PG course was May 7. These rounds of counselling also included an additional online special round for 146 seats, following March 31 order of the apex court, it added. The Supreme Court is scheduled to take up the matter on Thursday. The Supreme Court on Wednesday slammed the <keyword id="1873824" type="General" weightage="50" keywordseo="medical-counselling-committee" source="Orion">Medical Counselling Committee</keyword> (MCC) on the 1,456 vacant medical seats in NEET PG-2021, saying if students are not given admission, then it will pass orders and also grant them compensation. The vacation bench told the MCC Counsel, "Even if a single course has remained vacant.....It's your duty to see that they don't remain vacant." The bench got angry to see that 1,456 seats have remained vacant in medical colleges during the 2021-22 session. It said the MCC and the Central government are playing with the life of students by not conducting a mop up round of counselling for students. "You're playing with the future of students....," said the bench, adding that in May, the authorities learnt that seats were vacant, why didn't they conduct a mop up round? The MCC Counsel submitted that orders in the matter would lead to cascading effect and requested the court to allow him to place an affidavit on record to explain the matter. The top court allowed the Central government to file a response in the matter. NEET-PG 2021: DGHS tells SC no further rounds of counselling can be conducted, software closed

The Centre assured the <keyword id="6354977" type="General" weightage="20" keywordseo="Supreme-Court" source="Orion">Supreme Court</keyword> on Monday that the counselling process of NEET-PG will not commence till the top court decides the challenge to 27 per cent reservation for <keyword id="45661" type="General" weightage="20" keywordseo="OBC" source="Orion">OBC</keyword> and 10 per cent for <keyword id="11939755" type="General" weightage="100" keywordseo="ews" source="Orion">EWS</keyword> category in PG All India Quota seats (MBBS/BDS and MD/MS/MDS) from the current academic session. A bench of Justices D Y Chandrachud and B V Nagarathna recorded the assurance given by Additional Solicitor General (ASG) K M Nataraj, appearing for the Centre, and observed that students will be in serious problem if the counselling process goes ahead as scheduled. The assurance by Nataraj was given after senior advocate Arvind Dattar, appearing for some NEET candidates, mentioned that as per the schedule announced by the Director General of Health Services, the counselling process for the NEET-PG is to commence from October 25. He said that by the time the court decides the pending batch of petitions, challenging the July 29 notification, introducing the reservation from academic year, the entire process of admission will be over and serious prejudice would be caused to the students. Nataraj said the communication which counsel for petitioner is referring to was sent only to the medical colleges for verification of seats and one more clarificatory notification has been issued on Monday. The counselling process will not begin till the court decides the pending batch of petitions, the ASG submitted. The bench said that it is taking the word on record. We will take your word on record that counselling process will not start till we decide the batch of petitions one way or the other. You know, students will be in serious problem, if the process continues, the bench said. Nataraj agreed with the observation of the court and said that if there is any problem at all in the future, the petitioner's counsel can contact him directly. On October 21, the top court had asked the Centre whether it would like to revisit the limit of rupees eight lakh annual income, fixed for determining the Economically Weaker Sections (EWS) category for reservation in NEET admissions for medical courses. The top court had clarified that it is not embarking into the policy domain but is only trying to ascertain whether constitutional principles have adhered or not. It had asked the Ministry of Social Justice and Empowerment and the Department of Personnel and Training (DOPT) to file their affidavits in a week's time and had formulated questions to be answered by the Centre. The top court had said, Tell us if you want to revisit the criteria or not. If you want us to discharge our duties, then we are ready to do so. We are formulating questions which you need to answer them . It had added, We may stay the government notification fixing rupees eight lakh criteria for determining the EWS and you can keep filing the affidavits . The top court was hearing a batch of pleas challenging the Centre and Medical Counselling Committee (MCC) July 29 notice providing 27 per cent reservation for Other Backward Class (OBC) and 10 per cent for EWS category in the National Eligibility cum Entrance Test (NEET) admissions for medical courses. It had asked searching questions from Centre, and asked whether any exercise was undertaken before fixing a limit of Rs 8 lakh annual income for determining the EWS category. It had said the court is not going to tell the government as to what should be the limit whether it should be rupees four lakh or rupees six lakh because it is for the executive to decide but all it wants to know is on what basis Rs. 8 lakh criteria was fixed. For determining creamy layer in Other Backward Classes (OBC) category the limit was fixed as Rs 8 lakh annual income and they were considered progressed class among OBCs and they were excluded from reservation benefits. Here, for the EWS category, the limit is the same Rs 8 lakh annual income but it was for inclusion in the reservation benefits, the top court had said. On October 7, the top court had posed searching questions to the Centre on its decision to fix a limit of rupees eight lakh annual income for determining the EWS category for reservation in NEET admissions. The Centre had then said fixing a limit of Rs eight lakh annual income for the EWS category is a matter of policy based on the National Cost of Living Index. On September 17, the top court has agreed to hear a batch of pleas of students against the July 29 notice providing 27 per cent reservation for OBC and 10 per cent for EWS category in 15 per cent UG and 50 per cent PG All India Quota seats (MBBS/BDS and MD/MS/MDS) with effect from the current academic session 2021-22. NEET-PG counselling not to commence till Supreme Court decides on OBC, EWS quota, says Centre

On January 25, six <keyword id="48426" type="General" weightage="20" keywordseo="MBBS" source="Orion">MBBS</keyword> graduates had filed a plea in the Supreme Court seeking postponement of the National Eligibility-cum-Entrance Test (NEET) scheduled on March 12 for admissions in postgraduate medical courses, claiming that many MBBS graduates would not be able to take up the examination due to non-completion of the mandatory internship period. Dr B Srinivas, Assistant Director General (Medical Education) and Member Secretary of the <keyword id="1873824" type="General" weightage="20" keywordseo="medical-counselling-committee" source="Orion">Medical Counselling Committee</keyword>, in a communication sent to Dr M Bajpai, executive director of NBE, said that a lot of representations were being received from medical doctors requesting to postpone the NEET-PG 2022 examination as it was clashing with the NEET PG 2021 counselling. "Keeping the above facts in view, the HFM (ministry of health and family welfare) has taken the decision to postpone NEET PG 2022 by 6-8 weeks or suitably. NEET state counselling 2020 schedule released — Here are the state-wise details for MBBS, BDS counselling

The <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Friday cleared the decks for postgraduate medical counselling and admissions, including the Other Backward Classes (<keyword id="45661" type="General" weightage="80" keywordseo="obc" source="Orion">OBC</keyword>) and economically weaker sections (<keyword id="11939755" type="General" weightage="100" keywordseo="ews" source="Orion">EWS</keyword>) reservations for the current academic year, 2021-22. A bench headed by <keyword id="3360108" type="General" weightage="20" keywordseo="Justice-D-Y-Chandrachud" source="Orion">Justice D.Y. Chandrachud</keyword> and A.S. Bopanna upheld the constitutional validity of 27 per cent reservation for OBC and 10 per cent EWS for the NEET-UG and NEET-PG. However, the top court added that it would decide on the rationale of criteria of Rs 8 lakh income for EWS category in March this year. On Thursday, after conducting a day-long hearing on petitions challenging the validity of EWS quota in postgraduate medical admissions and the Centre's argument favouring the quota, the court said there is a situation, where in national interest, the counselling has to begin, which was also a key demand of protesting resident doctors. A bench comprising Justices D.Y. Chandrachud and A.S. Bopanna said: "We are in a situation, where in the national interest the counselling has to begin." Solicitor General Tushar Mehta, representing the Centre, argued that all candidates eligible for the EWS quota, as per existing criteria, have got their certificates for registration and added that seats in all the government colleges have been increased to accommodate the EWS quota. "So, this will not harm the chances of general category students...", he added. Mehta also clarified that super-speciality courses have no reservation and none of the judgments remotely suggests that there cannot be reservation in PG courses. On the aspect of the EWS quota, he said there was a study, application of mind, and wide consultation when the government decided to fix the Rs 8 lakh income limit. The Centre has accepted the report of a three-member panel constituted to revisit the EWS criteria. The panel, in its report, said: "Firstly, the EWS's criteria relates to the financial year prior to the year of application whereas the income criterion for the creamy layer in OBC category is applicable to gross annual income for three consecutive years." The panel added: "Secondly, in case of deciding the OBC creamy layer, income from salaries, agriculture, and traditional artisanal professions are excluded from the consideration whereas the Rs 8 lakh criteria for EWS includes that from all sources, including farming. So, despite being the same cut-off number, their composition is different and hence, the two cannot be equated." After hearing the parties in the matter, the top court reserved its judgment on the petitions challenging the 27 per cent reservation for Other Backward Classes (OBC) and 10 per cent reservation for EWS in all-India quota seats for postgraduate medical courses. As many as 15 per cent seats in MBBS and 50 per cent seats in MS and MD courses are filled through all-India Quota from the candidates selected through the NEET. NEET counselling 2020 registrations begin today: Here’s all you need to know

It’s the last day to register for counselling at the All India Institute of Medical Sciences, India’s most prestigious institution for medicine. The registrations for the AIIMS MBBS Open Counselling will close today at 5 pm. The open counselling session is to fill up seats that were vacant after the third round of counselling and voluntary withdrawals. The candidates who are still to apply can register on the official website of the All India Institute of Medical Sciences (AIIMS) at<a href="https://www.aiimsexams.org/"> aiimsexams.org</a>. And the counselling will be held on 20 August 2019 at 8:30 am at the J.L. Auditorium, AIIMS, New Delhi. Document checklist for open counselling: <ul><li>The candidates will have to show their registration slip at the time of counselling. </li><li>Admit Card of the entrance exam </li><li>Educational marksheets — class 10th and 12th </li><li>If the candidate belongs to the reserved category — SC/ST/OBC — he will have to show proof </li><li>Self attested photocopies of the certificates, along with original copies.</li></ul>In case the student is not able to provide the original certificates, a DD(Demand Draft) of ₹100,000 is to be submitted. The Centre on Tuesday again urged the <keyword id="6354977" type="General" weightage="80" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> to urgently hear the matter connected with the validity of <keyword id="11939755" type="General" weightage="100" keywordseo="ews" source="Orion">EWS</keyword> quota in postgraduate courses in medical colleges. Solicitor General Tushar Mehta, after failing to get the matter listed on Tuesday, requested a bench headed by Chief Justice N.V. Ramana to list the matter for hearing. Mehta emphasized that the matter needs to be considered on priority since resident doctors are protesting. The Chief Justice told Mehta that he has to constitute a special bench. Justice Ramana said: "Let me see tomorrow. This entire week is a miscellaneous week..." Mehta said the resident doctors are protesting and their concerns are genuine. The bench said: "If it is a three-judge bench matter, then it will be listed before a three-judge bench tomorrow". On Monday, Mehta asked a bench led by Justice D.Y. Chandrachud to advance the hearing on the matter to Tuesday from January 6. The Centre has told the top court that Rs 8 lakh income criterion for determining the EWS is much more stringent than the one for the OBC creamy layer. The Centre has accepted the report of a three-member panel constituted to revisit the EWS criteria. The panel, in its report, said: "Firstly, the EWS's criteria relates to the financial year prior to the year of application whereas the income criterion for the creamy layer in OBC category is applicable to gross annual income for three consecutive years." The panel added, "Secondly, in case of deciding the OBC creamy layer, income from salaries, agriculture and traditional artisanal professions are excluded from the consideration whereas the Rs 8 lakh criteria for EWS includes that from all sources, including farming. So, despite being the same cut-off number, their composition is different and hence, the two cannot be equated". The panel comprised Ajay Bhushan Pandey, former finance secretary; Prof V.K. Malhotra of ICSSR; and Sanjeev Sanyal, principal economic advisor to the government. The panel was set up on November 30. On November 25, the Centre informed the Supreme Court that it has taken a decision to revisit the criteria of Rs 8 lakh annual income limit for EWS criteria and added that a fresh decision will be taken within a period of 4 weeks. On October 21, the Supreme Court had questioned the Centre over adopting the criteria of OBC creamy layer of Rs 8 lakh annual income for granting reservations under the economic weaker section (EWS), despite the latter not suffering from social and educational backwardness. The top court told the Centre's counsel "You just cannot pull out eight lakh from thin air. You are making unequal equal by applying the Rs eight lakh limit". In an affidavit, the Centre had told the Supreme Court that its decision to fix Rs 8 Lakh income limit for OBC and economically weaker section (EWS) is not arbitrary in the <keyword id="6361994" type="General" weightage="20" keywordseo="neet" source="Orion">NEET</keyword> All India Quota, and it was finalised after considering diverse economic factors in different states. The top court is hearing writ petitions challenging 27 per cent reservation for Other Backward Classes (OBC) and 10 per cent reservation for EWS in all-India Quota seats for postgraduate medical courses. As many as 15 per cent seats in <keyword id="48426" type="General" weightage="20" keywordseo="mbbs" source="Orion">MBBS</keyword> and 50 per cent seats in MS and MD courses are filled through All India Quota from the candidates selected through NEET. Supreme Court agrees to hear Centre's plea on EWS quota for NEET-PG admissions

After being pushed by the Supreme Court, the <keyword id="6356303" type="General" weightage="20" keywordseo="Centre" source="Orion">Centre</keyword> on Wednesday told the top court that NEET-Super Speciality exam scheduled in November this year will be held as per the old question pattern. Additional Solicitor General Aishwarya Bhati, representing the Centre, submitted before a bench headed by Justice D.Y. Chandrachud that in the larger interest of students, the government has decided that the revised <keyword id="12191324" type="General" weightage="20" keywordseo="NEET-SS-exam" source="Orion">NEET-SS exam</keyword> syllabus will be introduced from 2022 -- the new question pattern will be applicable from next year. The bench replied that the "government has been very fair". Bhati said the exam scheduled this year will be held as per the old pattern. Advocate <keyword id="6368850" type="General" weightage="20" keywordseo="prashant-bhushan" source="Orion">Prashant Bhushan</keyword>, representing a petitioner, submitted that this should not in any way imply that the court is accepting the revised pattern exam for the next year. The bench recorded that the Centre states that decision has been taken in consultation with the National Medical Commission (NMC) and National Board of Examinations (NBE) and taking note of students' interest who would have commenced preparation for NEET-SS, before the change of pattern was notified. The bench said the Centre has stated that the modified pattern will be in effect from academic year 2022-23. "Since the grievance addressed under Article 32, and in these circumstances petitions under Article 32 are disposed of", said the bench. On Tuesday, the Supreme Court pulling up the Centre on the changes in the National Eligibility-cum-Entrance Test-Super Specialty (NEET-SS) 2021 pattern, said the impression and message which will go out is that the medical education and medical regulation in the country has become a business and it appears the entire haste is for filling the vacant seats. On the aspect of syllabus change, the bench told the NBE counsel, "What was the hurry. You have an examination pattern which had been going on from 2018 to 2020." The top court said: "The impression we get is that the medical education has become a business and medical regulation has also become a business". The bench also comprising Justices Vikram Nath and B.V. Nagarathna said this would become a tragedy for the medical education in the country. Nearly 90% of the registered applicants appeared for the exams. The National Testing Agency had strict standard operating procedures in place because of the pandemic, including measures like reducing the number of candidates per room from the earlier 24 to 12. The NTA had also increased the number of centres from 2,546 in 2019 to 3,862 this year to ensure crowd management and staggered entry and exit protocols. The counsel argued that many students abroad intended to sit in both the NEET and Joint Entrance Exams (JEE). The petitioners said that only 6-day gap between JEE (September 1-6) and NEET exam (September 13) was also an issue. The petitioners had moved the apex court to challenge a Kerala High Court order to dismiss their plea to set up examination centres abroad, or postpone the exams due to the pandemic. The Centre has already decided not to postpone the NEET and JEE exams.
