Providing an interim relief to travel website <keyword id="143717" type="COMPANY" weightage="20" keywordseo="Makemytrip-com">Makemytrip.com</keyword>, the <keyword id="6355014" type="ORGANIZATION" weightage="20" keywordseo="Delhi-High-Court">Delhi High Court</keyword> has ordered <keyword id="2662980" type="UNKNOWN" weightage="20" keywordseo="Make-My-Tours-Pvt-Ltd">Make My Tours Pvt Ltd</keyword> not to use the trademark and logo of Makemytrip.com for ticket bookings. The next hearing in the case will take place on February 13, 2015. 
 
“Considering the facts of the present case as well as settled law applicable to the present case, this court is of the opinion that the plaintiff has been able to make out a strong prima facie case in its favour and the balance of convenience also lies in favour of the plaintiff and against the defendants,” the court said. 
 
“The use of the impugned marks (Makemytours, and the logo) by the defendants would cause irreparable loss and injury to plaintiff, in case interim order is not passed. Accordingly, till the next date of hearing (Feb 13), defendants, jointly and severally, by themselves, their partners, servants, agents, representatives and all those acting in concert with them or claiming under or through them or otherwise howsoever, are restrained from using the impugned marks (Makemytours, and the logo)…,” it added. 
 
Makemytrip.com said that it came to know about the website <a href="http://www.makemytours.com">www.makemytours.com</a> in October.

MakeMyTrip is a household name in most metros and large cities of India. People of India love to <keyword id="6354692" type="ORGANIZATION" weightage="100" keywordseo="Travel">travel</keyword> and MakeMyTrip is one of the preferred choices for them to make a reservation (for both airlines and <keyword id="6368036" type="PERSON" weightage="80" keywordseo="Hotels">hotels</keyword>). Recently, MMT announced <keyword id="6357455" type="EVENT" weightage="80" keywordseo="Funding">funding</keyword> of $15 million <keyword id="306629" type="ORGANIZATION" weightage="80" keywordseo="Innovation-Fund">innovation fund</keyword> for new entrepreneurs in the travel circuit. We got a chance to catch up with Rajesh Magow, <keyword id="170488" type="POSITION" weightage="80" keywordseo="co-founder">Co-Founder</keyword> and CEO-India, <keyword id="143717" type="COMPANY" weightage="100" keywordseo="Makemytrip-com">MakeMyTrip.com</keyword> and he told us some interesting facts about the journey so far and why did the company decide to raise this fund. 
 
MakeMyTrip has grown by leaps and bounds. Can you give BI India readers a small glimpse of the MMT’s journey till date? 
 
MakeMyTrip.com was founded in the year 2000. Deep Kalra (Founder) conceptualized it with the idea to empower Indian travellers through choice, flexibility and transparency of pricing. The travel industry in 2000 had not achieved momentum yet. There were a couple of websites that offered air-tickets but none that could comprehensively claim to cater across categories (LCCs and full-service) and offer Best Deal and Lowest Airfare Guarantee. 
 
Upon launching the first version of the site in October 2000, we received a favourable response from the US. In India however, travellers were more inclined to research online, but make the actual buying decision using traditional modes of payment. We had to take a hard call to stop all marketing in India; on hindsight this turned out to be one of the best decisions for the company. By focusing solely on the NRI market, we managed to conserve precious marketing dollars while our competitors burnt their fingers in a pre-mature online market. 
 
After consolidating our position in the market as a brand recognized for its reliability and transparency, we launched our India operations in 2005. As the pioneer among Online Travel Companies in India, MakeMyTrip heralded a revolution in the way travel was purchased in India – and soon became the go-to website for booking travel. In 2010 we became the first Indian travel company to list overseas through a successful IPO on NASDAQ. 
 
Today, we are the dominant market-leader with 47% market-share (per a study conducted by PhocusWright in 2013). 
 
MMT like many others has started a venture fund, what was the reason behind it? 
 
We have announced the institution of a $15 million Innovation Fund primarily to support early stage companies/ start-ups in the travel technology space with a special focus on Mobile and IP-based companies. The fund will be focused on young and new ventures in the travel technology space for our market. 
 
This initiative is an additional prong of our inorganic growth strategy of pursuing M&amp;A opportunities in the travel technology space. We intend to purposefully go out and look for such companies and take early stage positions. 
 
What is MMT expectations from this venture funding? 
 
We are excited about the Technology talent in the global marketplace and how it can be leveraged to serve customer needs. We are hopeful that this initiative will encourage entrepreneurs building niche companies in the travel technology domain. 
 
What are the future plans for MMT besides this? 
 
We are already the largest travel company in the country and the largest eCommerce business, recognized for providing the best value-based offerings. In the mid to long-term, we intend to use our core strength i.e. technology to innovate, provide best-in-class service and delight customers.

Innovation Fund, Will Bring New Talent To The Indian Travel Industry

With 2.1 billion monthly active users globally, Facebook currently has 212 million monthly active users on smartphones in the country. "With over 217 million monthly active users in India -- most of whom are active on mobile -- Facebook is at the heart of a mobile-first shopping journey. We want to help all marketers and businesses drive revenue growth by tapping into the shift in consumer behavior towards mobile, and help them adopt practices to drive both penetration and loyalty," informed Sandeep Bhushan, Director, India and South Asia. Some of the top strategies focused on growth marketing includes acquiring customers and generating intent, creativity and measuring what matters. "Facebook's people-based measurement solutions can help measure what's working across channels to enable optimised spending to those attributing to the best results," the company said. Brands and businesses across industries in India are already taking advantage of Facebook's full-funnel marketing solutions. E-commerce and travel brands such as <keyword id="6388367" type="COMPANY" weightage="20" keywordseo="Jabong">Jabong</keyword>, Shopclues and MakeMyTrip have used "Dynamic Ads" to capitalise on intent and find interested customers. The company claims that with Facebook's "Lead" ads, brands like Raymond and Mahindra have been able to drive offline sales while others like GSK, Vodafone, Mondelez and Myntra have leveraged Facebook's measurement solutions to refine their marketing spends. "Facebook in no time (within a period of six months) has become one of the key contributors to our business for orders from retargeting channels," said Saujanya Shrivastava, Group CMO (MakeMyTrip.com and Goibibo.com). According to Siddharth Banerjee, EVP-Brand Communications and Insights, Vodafone, partnering with Facebook on the launch campaign for Vodafone Supernet 4G helped them cut build awareness with the right audience. "With the target audience leaning towards digital, Facebook delivered some of the highest impact across all media vehicles on driving salience and key brand messages," Banerjee said. Facebook-owned WhatsApp has over 200 million monthly active users in India.

How Facebook is planning to help businesses drive growth in India

Flights and trains will continue into <keyword id="6354785" type="COUNTRY" weightage="100" keywordseo="France">France</keyword>, even as the country is shaken by a series of terrorist attacks last night. <keyword id="6358200" type="CITY" weightage="100" keywordseo="Jet-Airways">Jet Airways</keyword> and <keyword id="2573" type="CITY" weightage="100" keywordseo="Air-India">Air India</keyword> said their flights to Paris will operate as per schedule. Both carriers operate one daily flight on their own from Mumbai and Delhi respectively. French government officials have said trains, flights will continue into France despite the state of emergency. Still, some carriers such as <keyword id="88011" type="COMPANY" weightage="100" keywordseo="american-airlines">American Airlines</keyword> have delayed flights into Paris. 

	Executives at travel companies in India said customers may cancel holiday packages to Paris. 
 

	"But we will come to know only next week. As of now there is no effect," Manoj Samuel, executive director at Riya Travels, one of India's biggest online travel agencies told ET. 
 

	"We are closely monitoring the situation in Paris and are in constant connect with our concerned customers. While we have received queries, here have not been any cancelations. All our packages are in place as per schedule," said Ranjeet Oak, chief of business holidays at Makemytrip.com, India's biggest online travel portal. 
 

	"We are in touch with the embassy and as of now, we have not received any formal notification from them regarding any suspension. But we are monitoring the situation very closely," he added. 
 

	A spokesperson at VFS Global, which handles visa operations for European countries said the company hasn't got any directive yet from France.

Paris Attacks: Air India, Jet Airways flights to continue in France despite emergency

The <a href="http://www.businessinsider.in/searchresult.cms?query=competition+commission+of+India">Competition Commission of India</a> (CCI) has accused <a href="http://www.businessinsider.in/searchresult.cms?query=google">Google</a> of abusing its dominant market position to rig search outcomes and if proven right, this can lead to long <a href="http://www.businessinsider.in/searchresult.cms?query=regulatory+battle">regulatory battle</a>. 
 
Queries were raised by the watchdog to which 30 businesses, including <a href="http://www.businessinsider.in/searchresult.cms?query=flipkart">Flipkart</a>, <a href="http://www.businessinsider.in/searchresult.cms?query=facebook">Facebook</a>, Makemytrip.com, Nokia’s maps division, and other social networks, travel and content sites, responded and complained that Google abused its dominant market position. 
 
Based on the corroborated complaints, the CCI director-general has filed a report that accuses Google of abusing its dominant position to rig search outcomes, both the actual search result as well as sponsored links. This marks the first case globally where an anti-trust body is formally raising such charges against Google. 
 
Google has time till September 10 to file its response to the findings and present itself before the seven-member commission headed by Chairman Ashok Chawla, a week later. 
 
The CCI may also impose a fine up to 10% of Google's income. 
 
Meanwhile, Google said it was reviewing the report from the CCI and exuded confidence that they follow prescribed Indian laws. 
 
As per the CCI’s report, Google is liable on two counts, first being Google's proprietary content and second on sponsored links. 
 
Proprietary content means that for instance, even though a website may have a higher hit rate for a specific section, Google’s content is given priority. Like Google Hotels gets preference over other travel portals that may have higher traffic and therefore mathematically more appropriate as first results of a search. 
 <keyword id="6354742" type="COMPANY" weightage="100" keywordseo="Flipkart">Flipkart</keyword> stated that it found search results to have a direct correlation with the amount of money the <a href="http://www.businessinsider.in/searchresult.cms?query=ecommerce">e-Commerce</a> portal spends on Google advertising. 
 Meanwhile, the CCI report dismisses Google's submission that its nature of search is similar to that of <keyword id="6354576" type="CITY" weightage="100" keywordseo="Facebook">Facebook</keyword> and Twitter, which the report says are social networks, not web searches. 
 
Google's using foreign arbitration clauses in case of disputes is also considered abuse of dominance, according to the report. 
 
Though Google can seek more time to respond to the CCI report, it was fined Rs1 crore last year for delaying information the commission had sought. 
 
Google’s case will be represented by law firms AZB &amp; Partners and Economic Law Practice.
