The Andhra Pradesh High Court on Tuesday directed the state government to immediately remove the ruling <keyword id="302547" type="ORGANIZATION" weightage="20" keywordseo="YSR-Congress-Party">YSR Congress Party</keyword> flag colours from all government buildings. The court directed the Chief Secretary to ensure that panchayat bhavans and other government buildings are painted in some other colour within 10 days. The Chief Secretary was directed to submit a report on the implementation of its direction supported by evidence. The court passed the orders on a petition filed by one M. Venkateshwara Rao of Guntur district. The high court set aside an order of Panchayat Raj Commissioner for painting Panchayat Raj buildings in blue, white and green, which are the colours on the YSRCP flag. After YSRCP came to power, several government offices, panchayat offices, anganwadis, school buildings, water tanks and other public buildings were painted with the ruling party's flag colours. The officials were also issued orders with regard to the colours and specifications and size of the photo of Chief Minister Y.S. <keyword id="64899" type="PERSON" weightage="20" keywordseo="Jagan-Mohan-Reddy">Jagan Mohan Reddy</keyword> on the top of every building. This move had come under attack from the opposition <keyword id="83019" type="ORGANIZATION" weightage="20" keywordseo="Telugu-Desam-Party">Telugu Desam Party</keyword> (TDP). Leader of opposition N. Chandrababu had even tweeted a picture of a panchayat office, where the YSRCP party flag colours replaced the Tricolour. After Tuesday's court order, Naidu said that re-painting the government offices with some other colour would cost Rs 3 crore. He wanted to know if YSRCP would bear the expenditure.

Cognizant, Accenture and Caspex accused of 'white collar slavery' in a new lawsuit

The <keyword id="6354335" type="CITY" weightage="20" keywordseo="reserve-bank-of-india">Reserve Bank of India</keyword> has told the <keyword id="6355014" type="ORGANIZATION" weightage="20" keywordseo="Delhi-High-Court">Delhi High Court</keyword> that the cap on the number of withdrawals from ATMs by banking customers without being charged is a policy decision taken in public interest. 
 A bench of Chief Justice <keyword id="2206646" type="PERSON" weightage="20" keywordseo="G-Rohini">G Rohini</keyword> and Justice <keyword id="803423" type="PERSON" weightage="20" keywordseo="Sangita-Dhingra-Sehgal">Sangita Dhingra Sehgal</keyword> was also informed by RBI that the ATM facility was made available with a view to reduce "cash usage and increase electronic transactions in the country". 
 RBI was responding to public interest litigation (<keyword id="6355791" type="ORGANIZATION" weightage="20" keywordseo="PIL">PIL</keyword>) filed by advocate <keyword id="1684541" type="PERSON" weightage="20" keywordseo="Swati-Aggarwal">Swati Aggarwal</keyword>, seeking directions to allow banking customers to make an unlimited number of transactions free of any charge on their own bank ATMs, according to a news agency. 
 
India's central banking institution, which controls the monetary policy of the rupee, however, opposed the PIL, saying it is "not maintainable and is liable to be dismissed, as RBI has not violated any laws of the land". 
 
"The PIL is not meant to be a weapon to challenge the financial or economic decisions which are taken by the RBI in exercise of their administrative/ statutory powers and in the public interest...," RBI's counsel said. 
 
On this, the bench has asked the RBI to file an affidavit with regard to its contention made before it by next date of hearing, December 5. 
 
The RBI's oral submissions were made after the high court on last date of hearing had questioned its decision to put a cap on withdrawals by banking customers using their ATM cards, saying account holders were being "unnecessarily taxed". 
 As per RBI's new guidelines, bank customers in six metros -- Delhi, Mumbai, Chennai, <keyword id="6354925" type="COMPANY" weightage="20" keywordseo="Kolkata">Kolkata</keyword>, Hyderabad and <keyword id="6354321" type="CITY" weightage="20" keywordseo="Bengaluru">Bengaluru</keyword> -- are allowed to withdraw money free of charge only five times a month and every transaction beyond this limit will be charged Rs 20 per use.

<ul><li>India and Pakistan are fighting for the rights of £35 million belonging to the <keyword id="797909" type="PERSON" weightage="20" keywordseo="Nizam-of-Hyderabad">Nizam of Hyderabad</keyword>, in the Royal Courts of Justice in London. </li><li>The then Nizam of Hyderabad, late Nizam <keyword id="226736" type="PERSON" weightage="20" keywordseo="Osman-Ali-Khan">Osman Ali Khan</keyword>, had transferred 1,007,940 pounds and nine shillings to the NatWest Bank in London in 1948. </li><li>The Nizam’s descendents, Prince <keyword id="125800" type="PERSON" weightage="20" keywordseo="Mukarram-Jah">Mukarram Jah</keyword> and his younger brother Muffakham Jah, have joined hands with the government of India. </li></ul>India and Pakistan are heading for yet another clash over a dispute of around £35 million, <a href="https://www.news18.com/news/india/india-pakistan-clash-over-35-million-pounds-deposited-by-hyderabad-nizam-in-1948-in-uk-court-2203743.html">according to a report</a>. The case is underway in the Royal Courts of Justice in London. The trial which is being presided over by Justice Marcus Smith, is listed as The High Commissioner for Pakistan in the United Kingdom versus seven others, including the Nizam’s descendents, the Union of India and the President of India. The judgement from the court <a href="https://www.news18.com/news/india/india-pakistan-clash-over-35-million-pounds-deposited-by-hyderabad-nizam-in-1948-in-uk-court-2203743.html">is expected</a> in six weeks. Soon after the independence and formation of Pakistan, the Nizam of Hyderabad, late Nizam Osman Ali Khan, who then wanted to accede Hyderabad to Pakistan, had transferred his fortune to the high commissioner of Pakistan in Britain and that was then deposited with the NatWest Bank in London. The fortune was 1,007,940 pounds and nine shillings in 1948, which has since then grown into £35 million. India and Pakistan have since then been fighting for the rights of the fortune. The Nizam’s descendents have joined hands with the government of India in the legal pursuit for the fortune, further strengthening the case in India’s favour while Pakistan has been claiming the riches to be rightfully theirs. "His Exalted Highness Nizam VIII and his younger brother have waited decades to receive what their grandfather gifted them. Pakistan has blocked access for 70 years and we hope the recent trial will mean a final resolution at last," said Paul Hewitt, partner at Withers law firm, which is representing the eighth Nizam of Hyderabad, in the Royal Courts of Justice in London. The major question the court has to deal with is who exactly is the beneficial owner of the funds. It is to be noted that the Nizam himself had <a href="https://www.news18.com/news/india/india-pakistan-clash-over-35-million-pounds-deposited-by-hyderabad-nizam-in-1948-in-uk-court-2203743.html">reportedly</a> asked the NatWest Bank to return the funds, which were held back by the bank. The fortune was deposited into the London bank account of the then Pakistan High Commissioner Habib Ibrahim Rahimtoola.

<keyword id="324253" type="ORGANIZATION" weightage="100" keywordseo="Hyderabad-High-Court">Hyderabad High Court</keyword> has directed <keyword id="6357252" type="COMPANY" weightage="100" keywordseo="Hero-MotoCorp">Hero MotoCorp</keyword> not to go ahead with the construction activities on the land allotted it by the <keyword id="68188" type="ORGANIZATION" weightage="100" keywordseo="Andhra-Pradesh-government">Andhra Pradesh government</keyword> in southern part of the state. 
 
This has stalled the capacity addition plans of the of the world's largest two-wheeler manufacturer. 
 
The order comes after a Tamil Nadu-based Ishwariya Orchards filed petition and claimed the ownership of the land. 
 
The high court order has embarrassed the state government as it had stolen a march over neighbouring states to win a fiercely contested battle to host a factory by the company last June. 
 
Economic Times reported that Hero MotoCorp had proposed to build its sixth facility with 1.8 million units capacity at around 3,000 crore, taking the overall annual capacity of 12 million units. 
 
Ishwariya Orchards filed petition after the AP government announced the allotted land to Hero MotoCorp. 
 
The petitioner has alleged that the government failed to follow the provisions of fair compensation, transparent land acquisition and rehabilitation and resettlement. 
 
A top official of Andhra Pradesh Industrial Infrastructure Corporation told ET that the interim orders of the HC were an embarrassment to the AP government, adding that the court admitted the petition of the government to club various litigations in lower courts pertaining to disputes and dispose them of soon. 
 
"There are thousands of acres of lands available with APIIC with clear titles but Hero MotoCorp insisted on this particular land owing to several locational advantages including proximity to Sri City," the official told the financial daily on the condition of anonymity. 
 
When ET contacted Hero MotoCorp, its spokesperson said, "We look forward to a quick and amicable resolution of the issue in cooperation with all concerned. We would not like to comment further on this as the matter is currently sub-judice."

The warrant was issued after Mallya <a href="http://www.businessinsider.in/Vijay-Mallya-has-7-days-to-return-to-India-and-appear-before-the-ED/articleshow/51360074.cms">failed to appear in the court</a> in connection with alleged dishonour of a cheque of Rs 50 lakh to GMR Hyderabad International Airport Ltd. 
 
Mallya’s counsel has said that he will move the high court seeking quashing of the non-bailable warrant (NBW). 
 
"He (Mallya) and others were supposed to appear before the court on March 10. They did not appear ... Hence, court issued NBW order which has to be executed by April 13," said GMR counsel G Ashok Reddy. He added that there are a total of 11 cases involving Rs 8 crore payment to GMR and the NBWs were issued in connection with a Rs 50 lakh bounced cheque. 
 
Mallya’s advocate H Sudhakar Rao said, "NBWs have been issued in this case. There are other cases going on wherein we have got orders from high court dispensing with his (Mallya's) attendence." 
 
"I will be filing an application in the high court for quashing this order of issuing warrants," Rao told PTI. 
 
When contacted by ET, GMR refused to comment on the issue claiming the matter to be sub judice.

Another woe for Mallya, Hyderabad court issues non-bailable warrant

New Delhi, <keyword id="1564214" type="COMPANY" weightage="20" keywordseo="the-Enforcement-Directorate">The Enforcement Directorate</keyword> (ED) on Wednesday said it has arrested three promoters of the <keyword id="4334121" type="PERSON" weightage="20" keywordseo="agri-gold-group">Agri Gold Group</keyword> of Companies in a Ponzi Scheme Fraud Case worth ₹6,380 crore. Those arrested have been identified as Avva Venkata Rama Rao, <keyword id="10482453" type="COMPANY" weightage="20" keywordseo="avva-venkata-seshu-narayana-rao">Avva Venkata Seshu Narayana Rao</keyword>, Avva Hema Sundara Vara Prasad, who are the main accused under the sections of the prevention of money laundering act (PMLA). The accused were produced before <keyword id="10482454" type="COMPANY" weightage="20" keywordseo="the-ed-pmla-court">the ED PMLA Court</keyword>, Hyderabad, which granted them 14-day judicial custody. The ED had filed a case on the basis of multiple FIRs lodged in the Andhra Pradesh, Telangana and Karnataka. The scam was perpetrated by Avva Venkata Rama Rao through Agri Gold Group of Companies. Avva Venkata Rama Rao had earlier worked in the Golden Forest CIS Fraud scheme. The ED claimed that having learnt the tricks of the trade in that scheme, he hatched a well-planned conspiracy and along with his seven brothers and other associates set up more than 150 companies and started collecting deposits from general public with a promise of providing developed plots/farm lands or withdrawal at a high rate of return on maturity/pre-term. It said that thousands of commission agents were engaged to lure people with various schemes for hefty commission and managed to collect ₹6,380 crore from 32,02,628 such investors. In the end, the gullible investors neither got plots nor could recover their deposits. The group collected the deposits illegally from across the country. According to ED officials, the company duped lakhs of investors from Andhra Pradesh, Telangana, Karnataka, Odisha, Tamil Nadu, Maharashtra, Chhattisgarh and Andaman and Nicobar islands. The ED claimed that the modus operandi involved encouraging the gullible investors to pay the desired deposits either directly or through the agents under the pretext of real estate deal. "These companies did not mention either the actual market value of the land or its location or its boundaries or survey numbers or the permissions required to be obtained for the layouts from the concerned authorities. "They tried to color it as a real estate business, but in reality it was an unregulated unlicensed collective investment scheme," it said. The ED further stated that the Agri Gold Group of Companies did not obtain permission from RBI to collect such deposits. Even SEBI has reported that the business of <keyword id="10482452" type="COMPANY" weightage="20" keywordseo="the-agri-gold-farm-estates">the Agri Gold Farm Estates</keyword> India Private Limited was nothing but a Collective Investment Scheme and ordered the company to stop taking further deposits and return the money to the depositors. "Instead of complying with the directions of the SEBI in letter and spirit, accused Avva Venkata Rama Rao opened new Companies and started collecting deposits in the names of new companies on the pretext of real estate business with the help of an army of commission agents, thus, turning this into a ponzi scam," the ED said. Although the accused collected deposits from 32 lakh investors, they never developed lands sufficient to give plots to all the investors. Even by their unverified claims, at the end they had only 5.5 lakh plots available with them. "Considering the huge discrepancy in the amount of land available, the group should have used all their resources in identifying, buying and developing more land parcels. Instead, Avva Venkata Rama Rao and his family went on a siphoning spree and illegally diverted the public deposits and invested in myriad verticals and in private companies which were directly owned by their family," the ED said. During probe it was revealed that the accused also set up companies abroad and diverted large amounts of funds to off-shore entities. "Their names also figured in the Paradise Leaks and they had incorporated companies with the help of the infamous Mossack Fonsenca in Cayman Islands," the ED said. Earlier, searches were conducted at the residences of Avva Venkata Rama Rao and other directors including the residences of auditors at Vijayawada and Hyderabad. Various property related documents, cash amount of ₹22 lakh, digital devices and other documents were recovered and seized. Three promoters of Agri Gold Group arrested for Ponzi Scheme Fraud Case worth ₹6,380

The <keyword id="6355014" type="ORGANIZATION" weightage="20" keywordseo="Delhi-High-Court">Delhi High Court</keyword> has questioned <keyword id="6354335" type="CITY" weightage="20" keywordseo="reserve-bank-of-india">Reserve Bank of India</keyword>’s (<keyword id="30067" type="ORGANIZATION" weightage="20" keywordseo="RBI">RBI</keyword>) move to limit withdrawal from ATMs. The court even said that the account holders were being “unnecessarily taxed.” 
 
According to new norms issued by RBI, bank account holders in Delhi, Mumbai, Chennai, Kolkata, Hyderabad and Bangalore can withdraw money without any charge only five times a month and they will be charged Rs 20 per transaction from the sixth time. 
 A division Bench of Chief Justice G Rohini and Justice PS Teji issued notice to RBI, Indian Banks’ Association (IBA) and <keyword id="6354731" type="CITY" weightage="20" keywordseo="State-Bank-Of-India">State Bank of India</keyword> (SBI). The next hearing in the case will take placed on February 18, 2015. 
 
“Why are you unnecessarily taxing your own account holders? File your response by next date of hearing,” the Bench said. 
 
Advocate Swati Aggarwal had filed a public interest litigation, asking the court to direct RBI to allow unlimited number of transaction. 
 
According to the plea, “the guidelines came into force from November 1 and have already been implemented by several banks, including SBI.”
