The <keyword id="19895345" type="General" weightage="20" keywordseo="Supreme-Court" source="keywords">Supreme Court</keyword> on Thursday opined on the need for identifying creamy layers in <keyword id="20490946" type="General" weightage="100" keywordseo="SC/STs" source="keywords">SC/STs</keyword>, as four out of seven judges of the Constitution Bench on Thursday suggested excluding these people from the benefit of affirmative <keyword id="19914887" type="General" weightage="20" keywordseo="reservation" source="keywords">reservation</keyword>. Justice BR Gavai expressed his view that the state must evolve a <keyword id="19958928" type="General" weightage="20" keywordseo="policy" source="keywords">policy</keyword> for identifying the <keyword id="22418374" type="General" weightage="20" keywordseo="creamy-layer" source="keywords">creamy layer</keyword> for the <keyword id="19936432" type="General" weightage="20" keywordseo="Scheduled-Castes" source="keywords">Scheduled Castes</keyword> and <keyword id="19957637" type="General" weightage="20" keywordseo="Scheduled-Tribes" source="keywords">Scheduled Tribes</keyword> (SCs and STs). The suggestion of identifying creamy layers in scheduled castes and scheduled tribes was part of the judgment delivered on Thursday by the seven-judge bench, whereby a majority judgment of 6:1 held that <keyword id="20495193" type="General" weightage="20" keywordseo="sub-classification" source="keywords">sub-classification</keyword> within the SC/STs is permissible. The judgment was delivered by the seven-judge bench led by Chief Justice of India DY Chandrachud, which overruled an earlier judgment in the EV Chinnaiah matter, which held that sub-classification was not permissible because SCs and STs form homogenous classes. Besides CJI Chandrachud, other judges on the bench were Justices BR Gavai, Vikram Nath, Bela M Trivedi, Pankaj Mithal, Manoj Misra, and Satish Chandra Sharma. Justice Bela M Trivedi, in a dissenting opinion, said that she disagreed with the majority judgment that sub-classification within the scheduled caste and scheduled tribes is permissible. Justice BR Gavai suggested that the state evolve a policy for identifying the creamy layer, even from the Scheduled Castes and Scheduled Tribes to exclude them from the benefit of <keyword id="20572974" type="General" weightage="20" keywordseo="affirmative-action" source="keywords">affirmative action</keyword>. "I am therefore of the view that the State must evolve a policy for identifying the creamy layer even from the Scheduled Castes and Scheduled Tribes so as exclude them from the benefit of affirmative action. In my view, only this and this alone can achieve the real equality as enshrined under the Constitution," Justice BR Gavai said. Justice Gavai further added that the criteria for exclusion of the creamy layer from the Scheduled Castes and Scheduled Tribes for the purpose of affirmative action could be different from the criteria as applicable to the Other Backward Classes. Expressing similar opinions to Justice Gavai, Justice Vikram Nath, Justice Pankaj Mithal, and Justice Satish Chandra Sharma, they said that they agreed with his brother's judge for the exclusion of the creamy layer for affirmative action. In the order copy, Justice Vikram Nath said, "I am also in agreement with the opinion of Brother Justice Gavai that the 'creamy layer' principle is also applicable to Scheduled Castes and Scheduled Tribes and that the criteria for exclusion of creamy layer for affirmative action could be different from the criteria as applicable to the other backward classes." An identical view was also given by Justice Pankaj Mithal, who said, "It is reiterated that periodical exercise has to be undertaken to exclude the class of person who after taking advantage of reservation has come to march, shoulder to shoulder with the general category." Relatable suggestions came from Justice Satish Chandra Sharma, who remarked that the identification of the 'creamy layer' of Scheduled Castes and Scheduled Tribes ought to become a constitutional imperative for the state. "However, on the question of the applicability of the 'creamy layer principle' to Scheduled Castes and Scheduled Tribes, I find myself in agreement with the view expressed by Justice Gavai, i.e., for the full realization of substantive equality between the Scheduled Castes and Scheduled Tribes, the identification of the 'creamy layer' qua Scheduled Castes and Scheduled Tribes ought to become a constitutional imperative for the State," Justice SC Sharma said in the order copy. Justice Gavai, in his order copy, also highlighted disparities and social discrimination that are highly prevalent in rural areas. "I have no hesitation in holding that putting a child studying at St Paul's High School and St. Stephen's College and a child studying in a small village in a backward and remote area of the country in the same bracket would obliviate the equality principle enshrined in the Constitution," Justice Gavai said. Justice Gavai noted that some of the officers from the Scheduled Castes and Scheduled Tribes categories, who, after receiving the benefit of reservation under the Constitution, have reached high positions, are doing their bit to pay back to society. "They are providing coaching and other facilities to the less advantaged so that they can compete and come up in their life. However, putting the children of the parents from the Scheduled Castes and Scheduled Tribes who on account of the benefit of the reservation have reached a high position and ceased to be social, economically and educationally backward and the children of parents doing manual work in the villages in the same category would defeat the constitutional mandate," Justice Gavai said. "However, I may observe that, taking into consideration that the Constitution itself recognises the Scheduled Castes and Scheduled Tribes to be the most backward section of society, the parameters for exclusion from affirmative action of the person belonging to this category may not be the same that applies to the other classes. If a person from such a category, by bagging the benefit of reservation, achieved a position of a peon or maybe a sweeper, he would continue to belong to the socially, economically, and educationally backward class," Justice Gavai said. "At the same time, the people from this category, who, after having availed of the benefits of reservation, have reached the high echelons in life cannot be considered to be socially, economically, and educationally backward to continue availing of the benefit of affirmative action. They have already reached a stage where, on their own accord, they should walk out of the special provisions and give way to the deserving and needy," Justice Gavai said. Justice Gavai quoted the observations of Dr BR Ambedkar, which are as follows: "History shows that where ethics and economics come into conflict, victory is always with economics. Vested interests have never been known to have willingly divested themselves unless there was sufficient force to compel them." The Supreme Court on Thursday ruled by a majority judgment of 6:1 that sub-classification within the scheduled caste and scheduled tribes (SC/STs) reservation is permissible. The top court was dealing with the issue of whether subclassification of the Scheduled Castes for reservation is constitutionally permissible. The apex court was dealing with the constitutional validity of Section 4(5) of the Punjab Act, which depends upon whether any such classification can be made within the class of Scheduled Castes or Scheduled Tribes or whether they are to be treated as a homogenous class. The Punjab Government had stipulated that fifty percent of the vacancies of the quota reserved for Scheduled Castes in direct recruitment shall be offered to Balmikis and Mazhabi Sikhs, subject to their availability, by providing first preference from amongst the Scheduled Caste candidates. On March 29, 2010, the Punjab and Haryana High Court struck down the provisions, relying on the decision in EV Chinnaiah. The appeal was filed in the top court against the High Court judgment. In August 2020, the top five-judge benches referred the matter to a larger bench.

Creamy layer of SC/STs must be identified and excluded from affirmative reservation: SC Justice Gavai

The Centre on Thursday told the <keyword id="19895345" type="General" weightage="20" keywordseo="Supreme-Court" source="keywords" meta.keywordsubtype="org" meta.entityname="Supreme Court" meta.hostid="261" meta.entityid="Supreme Court">Supreme Court</keyword> that the decision to give <keyword id="21375140" type="General" weightage="20" keywordseo="grace-marks" source="keywords">grace marks</keyword> to 1,563 <keyword id="20055256" type="General" weightage="20" keywordseo="NEET-UG" source="keywords">NEET-UG</keyword>, 2024 candidates for admission to <keyword id="19968296" type="General" weightage="20" keywordseo="MBBS" source="keywords">MBBS</keyword>, <keyword id="20007002" type="General" weightage="20" keywordseo="BDS" source="keywords">BDS</keyword> and others courses has been cancelled and they will be given an option to take a re-test on June 23. A vacation bench of justices Vikram Nath and Sandeep Mehta was told by the counsel for the Centre and the <keyword id="19904021" type="General" weightage="20" keywordseo="National-Testing-Agency" source="keywords" meta.keywordsubtype="org" meta.entityname="National Testing Agency" meta.hostid="261" meta.entityid="National Testing Agency">National Testing Agency</keyword> (NTA) that the students, who were given grace marks, will be given an option to take the re-test. The court said it will not stay the counselling process for admissions. If the candidates, out of the 1,563, do not wish to take up the retest then their earlier marks, sans the grace marks, will be given for the purposes of the results. The results of the re-test will be declared on June 30 and the counselling for admission in the MBBS, BDS, other courses will start on July 6, the Centre said. Taking note of the submissions, the bench said all the pleas, including the one filed by Alakh Pandey, the chief executive of EdTech firm Physics Wallah over the issue of award of grace marks, will be taken up for hearing on July 8. They also include the petitions seeking cancellation of NEET-UG, 2024 on account of allegation of question paper leaks and other malpractices. The examination was held by the NTA on May 5 across 4,750 centres and around 24 lakh candidates took it. The results were expected to be declared on June 14 but were announced on June 4, apparently because the evaluation of the answer sheets got completed earlier. The allegations such as question paper leak and the grant of grace marks to over 1,500 medical aspirants have led to protests and filing of cases in seven high courts as also the Supreme Court. As many as 67 students scored a perfect 720, unprecedented in the NTA's history, with six from a centre in Haryana's Faridabad figuring in the list, raising suspicions about irregularities. Scores of students protested in Delhi on June 10 seeking a probe into alleged irregularities. It has been alleged that grace marks contributed to 67 students sharing the top rank. The NEET-UG examination is conducted by the NTA for admissions to MBBS, BDS, AYUSH and other related courses in government and private institutions across the country. Row over NEET-UG: Grace marks given to 1,563 candidates withdrawn, Centre to SC

Chandigarh, The Punjab and <keyword id="101738" type="COMPANY" weightage="20" keywordseo="Haryana-High-Court">Haryana High Court</keyword> on Tuesday issued notices to the Punjab government and the Centre on a plea filed by <keyword id="6354504" type="PERSON" weightage="20" keywordseo="reliance-jio">Reliance Jio</keyword> Infocomm Ltd, seeking action against "miscreants" damaging its telecom infrastructure and forcibly closing its stores in the state. During the ongoing agitation by farmers against three new farm laws enacted by the Centre, over 1500 mobile towers in Punjab have been damaged. Reliance Jio, a subsidiary of <keyword id="6487" type="DOMAIN" weightage="20" keywordseo="Reliance-Industries-Ltd">Reliance Industries Ltd</keyword>, on Monday, submitted in its plea that "vested" interests are engaged in spreading "false rumours" against it and that the petitioner, its <keyword id="1464040" type="PERSON" weightage="20" keywordseo="parent-company">parent company</keyword> and its affiliates had no plans to enter corporate or contract farming. Justice Sudhir Mittal has issued notice of motion for February 8, according to Aashish Mittal, the counsel for Reliance Jio. The company has made the state of Punjab through its chief secretary, Union Ministry of Home Affairs, <keyword id="116246" type="COMPANY" weightage="20" keywordseo="Department-of-Telecommunications">Department of Telecommunications</keyword> and the Punjab Director General of Police as respondents in the matter. In the civil writ petition, Reliance Jio has also sought appropriate directions to respondents for investigation into the well-orchestrated and sustained disinformation campaign being carried out by <keyword id="2404104" type="PERSON" weightage="20" keywordseo="Vested-interests">vested interests</keyword> and miscreants against it. In the petition, the company has stated that in the past few weeks, its over 1,500 telecom towers were damaged or rendered inoperative by miscreants crippling its mobile network in Punjab. A number of its centres and stores were also forcibly closed by miscreants by using illegal force and intimidation, it submitted. The petitioner submitted that its subscribers were being forced to port to other networks, while its employees were being subjected to grave threat to life and forcibly prevented from serving subscribers in the state. According to the petition, vested interests inimical to the petitioner and its parent company <keyword id="6355199" type="DOMAIN" weightage="20" keywordseo="reliance-industries">Reliance Industries</keyword>, are engaged in spreading false rumours to the effect that the petitioner and its affiliates were somehow a beneficiary of recent legislation passed by Parliament governing marketing of agricultural produce. In a statement, Reliance said it "has nothing whatsoever to do with the three farm laws currently debated in the country, and in no way benefits from them . The company also sought constitution of a competent authority under the Punjab Prevention of Damage to Public and Private Property Act for the assessment of losses caused to it.

Loya was presiding over the Sohrabuddin Sheikh case, when he died in December 2014 at Nagpur under mysterious circumstances. The Ministry of Law and Justice on Wednesday transferred Justice S. Muralidhar of the Delhi High Court to the <keyword id="6363691" type="UNKNOWN" weightage="20" keywordseo="Punjab-and-Haryana-high-court">Punjab and Haryana High Court</keyword>. The transfer came on a day when a High Court bench headed by Justice Muralidhar passed a series of orders with regard to the violence in northeast Delhi and said that "another 1984-like situation cannot be allowed to happen in the city under its watch." As many as 27 people have lost their lives while over 200 have been injured after clashes between pro and anti-CAA protesters turned violent in northeast Delhi. The transfer order is now read in connection with his strong stance against the government. "In exercise of the power conferred by Clause (1) of Article 222 of the Constitution of India, the President, after consultation with the Chief Justice of India, is pleased to transfer Justice S. Muralidhar, Judge of the Delhi High Court, as a Judge of the Punjab and Haryana High Court and to direct him to assume charge of his office in the Punjab and Haryana High Court," read a notification of the Law Ministry released on Wednesday. Recently, the Supreme Court Collegium had recommended the transfer of Justice Muralidhar to the Punjab and Haryana High Court. Though the transfer was procedural but the day of the government's issuance of notification has now sparked off a political row.

They also gave the responsibility to all the citizens of Punjab and Haryana, to act as their ‘guardians’. It also issued 29 mandatory directions to crackdown on cruel and brutal behaviour against animals. The decision was given after it heard a case where 29 cows were packed and transported from Haryana to Uttar Pradesh in two trucks. As per the current order, the state governments of Punjab and Haryana are ensure that no individual is harnessing any animal to push vehicles in extreme high or low temperatures, exceeding 37 degree celsius during 11am and 4pm; and when the temperature below 5 degrees celsius in winter. Justice Rajiv Sharma, who was part of the bench in this ruling, had earlier passed a similar judgement in Uttarakhand last year. The bench also fixed the amount of load to be carried by animals. The use of animal drawing carts is also limited to nine hours a day in aggregate, not exceeding five hours without a break. The court has also banned the use of spike sticks, harness or yokes with spikes, knobs, projects and other sharp instruments to avoid the bruises, swelling, abrasions and severe pains. Similar fashion Last year in July, a bench of <keyword id="173384" type="ORGANIZATION" weightage="20" keywordseo="Uttarakhand-High-Court">Uttarakhand High Court</keyword> comprising Justice Rajiv Sharma passed a similar ruling that declared the entire animal kingdom as ‘legal persons’. In fact, Justice Rajiv Sharma and Justice Alok Singh also declared the river Ganga and Yamuna, along all their tributaries, streams, every natural water flowing with flow continuously or intermittently of these rivers, as legal entities. They were also given all corresponding rights, duties and liabilities of a living person.

The demand has gone through the roof and manufacturers are not able to keep up with the required pace to meet the demand. Bad folks are using the time to take advantage of the truly desperate. Meanwhile, more patients are queuing up and the vicious cycle perpetuates. The top court's observation came when senior advocate Kapil Sibal, appearing for Joshi, listed the reasons for starting disqualification proceedings and said that these MLAs did not attend party meetings and conspired to destabilise their own government. The plea urged the apex court to pass an interim ex-parte order staying the July 21 order of the Rajasthan High Court. Our grievance is purely constitutional and there cannot be any order till a decision is taken by the speaker."</li><li>Sibal said that at the most the Speaker can be asked to decide disqualification within a time frame but the process can't be interfered with and no writ can lie to challenge proceedings before Speaker prior to the decision on disqualification or suspension of MLAs.</li><li>Rajasthan Speaker told Supreme Court that the state high court has no jurisdiction to restrain him from conducting disqualification proceedings till July 24 against 19 dissident Congress MLAs, including sacked deputy chief minister Sachin Pilot.</li><li>Sibal referred to a famous top court verdict rendered in the 1992 Kihoto Hollohan case, in which it was held that courts can't intervene in disqualification proceedings undertaken by the Speaker under Tenth Schedule to the Constitution.</li><li>Sibal added that courts could only intervene when the Speaker takes a decision to suspend or disqualify a member of the House</li></ul>The hearing on the plea is still underway. Rajasthan High Court can deliver judgement in Sachin Pilot’s case tomorrow, says Supreme Court

<ul><li><keyword id="48485" type="ORGANIZATION" weightage="20" keywordseo="Bombay-high-court">Bombay High Court</keyword> has dismissed a PIL which claimed <keyword id="6214644" type="UNKNOWN" weightage="20" keywordseo="Dream11">Dream11</keyword> encourages gambling. </li><li>The High Court order has said that it is a game of skill, and not chance. </li><li>Earlier, the Punjab and Haryana High Court too had declared the Dream11 format of fantasy sports as legal.</li></ul>Indian gaming unicorn Dream11 has got another big boost – from Bombay High Court no less. The <a href="https://www.livelaw.in/news-updates/dream-11-bombay-hc-dismisses-pil-fantasy-league-145760">High Court</a> dismissed a PIL filed by an advocate and said that Dream11 is a game of skill and not of chance. The PIL had claimed that online fantasy league game encourages gambling. This comes after the Punjab and Haryana High Court too declared the Dream11 format of fantasy sports as legal. The order said that the game requires considerable skill and judgment. This order was further ratified by the Supreme Court. The Indian fantasy gaming industry is projected to be a ₹118.8 billion market by 2023. While cricket holds the majority of the market share, other games are picking up too. Dream11 has had a great run this year – from turning a unicorn with a billion Dollar valuation, in April 2019. Its users also swelled to 67 million after IPL in 2019, and was also the official partners for the league. With the ongoing World Cup, Dream11 aims to gain even more. “We expect to have 90 million users by the end of the World Cup and 100 million by the end of 2019,” Bhavit Sheth, COO, Dream11 had told Business Insider in an interview earlier.
