New Delhi, Cutting across party lines, <keyword id="48510" type="General" weightage="100" keywordseo="rajya-sabha" source="Orion">Rajya Sabha</keyword> members on Thursday supported the bill to provide 33 per cent reservation for women in the <keyword id="197797" type="General" weightage="80" keywordseo="lower-house-of-parliament" source="Orion">Lower House of Parliament</keyword> and state assemblies, even as some opposition members termed it an election gimmick. During the debate in the <keyword id="122785" type="General" weightage="80" keywordseo="upper-house" source="Orion">Upper House</keyword> on the 128th Constitution Amendment Bill that seeks to reserve a third of seats in the Lok Sabha and state assemblies for women, members also highlighted the need to accelerate the process instead of waiting for a fresh census and delimitation exercise. Taking part in the discussion, Elamaram Kareem of CPI(M), while supporting the bill, said the BJP had promised to bring the <keyword id="109340" type="General" weightage="20" keywordseo="womens-reservation-bill" source="Orion">women's reservation bill</keyword> in 2014 and in 2019 as well but did not take any action. He held the ruling party responsible for women's reservation losing nine years. This is an election gimmick by the BJP after losing elections in Karnataka and Himachal Pradesh, besides facing defeat in the civic polls in Delhi polls, he said. Citing violence against women in strife-torn Manipur and allegations of sexual harassment by women wrestlers, Kareem alleged the government cared little for women. Ram Nath Thakur of the JD(U) questioned the timing of bringing the 'Nari Shakti Vandan Adhiniyam'. Bharat Rashtra Samithi (BRS) MP K Keshava Rao stressed the need to accelerate the process for women's reservation and said the 2011 Census could be taken as the benchmark. He urged immediate appointment of the delimitation commission. MDMK's Vaiko also echoed similar sentiments. Saroj Pandey of the BJP said it was unfortunate that questions have been raised on the timing and the intent of bringing the bill. As the country celebrates 'Amrit Kaal', this was the ideal moment for such a legislation, she said. Asom Gana Parishad MP Birendra Prasad Baishya noted that the women's reservation bill has come at a "proper time" after failed attempts in the past. JD(S) leader H D Devegowda also supported the bill and recollected steps taken by him for women's reservation while he was the chief minister of Karnataka and also the prime minister. Manoj Jha of the RJD said demanded that the women's reservation bill be referred to a select committee to consider extending similar benefits to Other Backward Classes. V Vijayasai Reddy (YSRCP) also supported the bill and said the reservation for women must also be extended to Rajya Sabha and state legislative councils. KC Venugopal of the <keyword id="1575" type="General" weightage="80" keywordseo="congress" source="Orion">Congress</keyword> sought immediate implementation of the legislation. He also sought reservation for the OBC women under the bill. Venugopal claimed the <keyword id="6354477" type="General" weightage="80" keywordseo="narendra-modi" source="Orion">Narendra Modi</keyword> government did not make any effort to bring the bill in the last nine years and it is due to the political calculations that the government has brought the legislation now. (Eds: Adding details) New Delhi, Mar 3 () A bill to provide more powers to the RBI for regulating cooperative banks was introduced by Finance Minister Nirmala Sitharaman in the Lok Sabha on Tuesday.The Banking Regulation (Amendment) Bill, 2020, which comes in the backdrop of PMC Bank scam, seeks to strengthen cooperative banks by increasing professionalism, enabling access to capital, improving governance and ensuring sound banking through the RBI.Introducing the bill, Sitharaman said it is the "need of the hour" to avoid a PMC Bank-like crisis in the future.Noting that the happenings at the PMC Bank had "unfortunately" put a lot of small depositors in difficulty, she said there were demands that the government should do something about it.The Bill was introduced in the Lok Sabha amid the din, with Sitharaman saying that if the opposition wants to deny the small depositors their rights then "it is a shame". It could not be cleared because of the ongoing ruckus in the House over the issue of violence in Delhi.The proposed law seeks to enforce banking regulation guidelines of the RBI in cooperative banks, while administrative issues will still be guided by the Registrar of Cooperative.It also proposed to bring cooperative banks on par with developments in the banking sector through better management and proper regulation of cooperative banks with a view to ensure that affairs of cooperative banks are conducted in a manner that protects the interest of depositors, it said."Keeping in view developments in the banking sector and regulation thereof overtime, it has become necessary to strengthen provisions of the said Act as applicable to cooperative banks," said the Statement of Objects and Reasons of the Bill.In her Budget speech, Sitharaman had said that to strengthen cooperative banks, amendments would be brought in the Banking Regulation Act for increasing professionalism, enabling access to capital and improving governance and oversight for sound banking through the RBI.The decision assumes significance in the wake of a scam in the Punjab and Maharashtra Cooperative (PMC) Bank affecting lakhs of customers who have been facing difficulty in withdrawing their money due to restrictions imposed by the RBI.The PMC Bank was found to have given over Rs 6,700 crore loan to a single realty company HDIL through alleged fraudulent means and also hid the stress from the RBI by creating separate books of accounts.There are 1,540 cooperative banks with depositor base of 8.60 crore having total savings of about Rs 5 lakh crore. This time around, food delivery apps like Zomato, Uber Eats and Swiggy saw their <a href="https://timesofindia.indiatimes.com/india/cabs-to-food-e-biz-hit-by-internet-shutdown/articleshow/72920805.cms">volumes dip by 10 to 20%</a> in Delhi. Grofers, an online grocery delivery service, had to reschedule 20,000 to 25,000 of its orders in Lucknow.

 In addition the effect on businesses, this might not be the best time for the Indian government to be exercising its power in such a way with the Personal Data Protection Bill underway. The bill is currently under discussion by a joint committee after being tabled in the Parliament in its last session. There are concerns that it has too many loopholes that will give the government access to user data in the name of ‘national security’ or a ‘public emergency’ — the very same reason used to justify the many internet shutdowns across the country. Indian government shut off the Internet over a 100 times in 2019 — and China is lovin' it

New Delhi, Dec 11 () The Personal Data Protection Bill giving investigating agencies unbridled powers to carry out surveillance on private data has spooked companies and experts who argue that such overarching access is against established principles and is a dramatic step backwards.
 The Personal Data Protection Bill, 2019, was introduced in the Lok Sabha on Wednesday, and the government proposed sending the Bill to a joint select committee of both Houses of Parliament amid protests by the opposition.
"Critically, this latest Bill is a dramatic step backward in terms of the exceptions it grants for government processing and surveillance," said Mozilla, the not for profit entity behind the web browser Firefox.
The biggest concern, it rued, is the Bill's expansion of the broad exceptions that were present in the 2018 draft of the data protection bill for the government processing of data. 
Crucially, the requirement that government processing of data be "necessary and proportionate" has been cut. Furthermore, a provision was added granting the government complete discretion to exempt any entity or department from any part of the law, it said in a blogpost.
Mozilla argued that this "leaves the current legal vacuum around India's surveillance and intelligence services intact, which is fundamentally incompatible with effective privacy protection".
Software Freedom Law Centre, India (SFLC.in) said it believes that granting access of personal data to the State, without appropriate safeguards and judicial oversight is against established constitutional principles and should not form part of the Bill.
It also expressed concern that Data Protection Authority (DPA) - a regulatory body proposed under the Bill - will be completely dependent on the Centre for its formation and membership. 
"We believe that to ensure the independence of the DPA, there should be sufficient involvement of judicial members in the selection committee as well as in the DPA. This will guarantee judicial review and will quell concerns of conflict of interest," it said.
On the same issue, Mozilla said under the structure proposed it will be harder for the DPA "to be empowered and effective as the entire governing structure will be appointed exclusively by the government".
The Bill proposes that personal data will not be processed without consent of the owner of the information, and that no personal data will be processed except for clear and lawful purpose.
However, one of the provisions of the Bill will "empower the central government to exempt any agency of government from application of the proposed legislation" - which experts say will give sweeping powers to government agencies to collect data of citizens.
The Bill states that the Centre can - in the interest of sovereignty, security of the state, and public order - "direct that all or any of the provisions of this Act shall not apply to any agency of the Government in respect of processing of such personal data..."
The Bill also states that the central government can frame policy for the digital economy with respect to non-personal data. In particular, it can direct any data processor to "provide any personal data anonymised or other non-personal data to enable better targeting of delivery of services or formulation of evidence-based policies by the central government".
Further, the Bill says that social media entities with user base above a certain threshold and whose "actions have, or are likely to have a significant impact on electoral democracy, security of the State, public order or the sovereignty and integrity of India," will be notified as 'significant data fiduciary'.
Every social media intermediary classified as a 'significant data fiduciary' will be required to enable users in India to voluntarily verify their accounts. Any user undergoing such voluntarily verification will have to be provided with a verification mark that is visible to all users of the service. Such entities will also have to get their policies and conduct (of data processing) audited annually by independent data auditors.
When contacted, a Facebook spokesperson said the Bill will encourage people to be privacy conscious and exercise greater privacy controls available to them. 
"We welcome India's efforts to frame data protection legislation. We believe that a data protection law will empower Indian users and boost India's fast growing digital economy," the Facebook spokesperson said.
Protecting people's information is a priority for Facebook, the spokesperson said adding that the company will continue to work alongside governments and regulators to find the right solutions to safeguard users' safety and security.
On the provision around social media user verification on voluntary basis, Mozilla, said the move will be "disastrous for the privacy and anonymity of internet users" as "this would likely entail users sending photos of government issued IDs to the companies". 
"This provision will also increase the risk from data breaches and entrench power in the hands of large players in the social media space who can afford to build and maintain such verification systems," it said.
The Bill also provides for stringent ground rules for processing of personal and sensitive information of children, while mandating processing of 'critical' personal data only in India. 
Violations in case of processing of personal data of individuals as well as children, and failure to adhere to security safeguards will attract a fine of up to Rs 15 crore or 4 per cent of the global turnover. The Bill also proposes up to three-year imprisonment and/or fine of up to Rs 2 lakh for re-identification and processing of de-identified personal data. SR MBI ANU

Sweeping powers to govt under data protection Bill a step backwards, say experts

New Delhi, Jan 27 () The power ministry has asked states to nudge their power regulators to reduce electricity retail tariff for prepaid consumers, saying prepayment metres will help discoms reduce associated expenses incurred on meter reading, billing and collection.
 The government aims to make all electricity meters smart prepaid ones in three years starting from April 1, 2019, in a bid to cut transmission and distribution losses.
 A power ministry order stated that "states may request the State Electricity Regulatory Commission (SERC) to consider reduction in power retail tariff to consumers for power purchased through prepayment metres".
 The order also stated that necessary changes in the relevant regulations or orders or mechanism to reduce cost of power in case of advance payments or prepayments by any entity or consumers, should be implemented within six months of issuance of this letter (on January 16, 2020).
 The ministry explained in the order that in case of prepayment, the carrying costs will come down, leading to reduced requirement of working capital for discoms.
 It also said the prepayment will eliminate associated costs involved in meter reading, billing and collection and, thus, the electricity tariff per unit should come down.
 The government had earlier placed on record that the move towards smart meters is a pro-poor step as consumers need not pay the whole month's bill in one go, they can pay as per their requirements. KKS HRS

Delhi Polls: BJP Follows AAP’s Footsteps, Announces 50% Reduction In Electricity Bill If Voted To Power

New Delhi, Nov 20 () The Centre approved on Wednesday the Industrial Relation Code Bill, which is the third code under labour reforms.
The government wants to codify 44 central labour laws into four broad codes.
While the Code on Wages has already been approved by Parliament, the Labour ministry will push the Code on Occupational Safety, Health and Working Conditions Bill in the Budget session. The Code on Social Security is in pre-legislative stage.
The Union Cabinet, chaired by Prime Minister Narendra Modi, has given its approval for introduction of the Industrial Relations Code, 2019, in Parliament, an official statement said.
The bill provides for setting up of a two-member tribunal (in place of one-member), thus introducing a concept that some of the important cases will be adjudicated jointly and the rest by a single-member resulting speedier disposal of cases.
It also provides for imparting flexibility to the exit provisions relating to retrenchment and others, for which the threshold for prior approval of appropriate government has been kept unchanged at 100 employees, but added a provision for changing 'such number of employees' through notification (executive order). That means there would be no need for Parliament approval. The threshold can be changed by executive order.
