Finance Minister Nirmala Sitharaman meets President ahead of Budget speech

The government cleared the common misconception of thousands who thought that service charges collected by restaurants/hotels/eateries are ‘<keyword id="6355686" type="COMPANY" weightage="100" keywordseo="Service-tax">service tax</keyword>’ imposed by the government. It is not. "Some restaurants/hotels/eateries besides charging for the food and beverages are also charging 'service charges' in their bills. The proceeds of the 'service charges' are retained by the restaurants/hotels/eateries," a <keyword id="156153" type="ORGANIZATION" weightage="100" keywordseo="Ministry-of-Finance">Ministry of Finance</keyword> press release said. 

	"It is further clarified that effective service tax rate in respect of services provided in relation to serving of food or beverage by a restaurant, eating joint or mess having the facility of air-conditioning or central air-heating in any part of the establishment is 5.6% (14% of 40%) of the total amount charged," the release added. 
 

	The new service tax rate of 14 per cent came into effect from June 1, a move that made eating out in restaurants, insurance and phone bills expensive, among many other things.
 In his <keyword id="117156" type="UNKNOWN" weightage="100" keywordseo="Budget-speech">Budget speech</keyword>, <keyword id="25455" type="ORGANIZATION" weightage="100" keywordseo="finance">Finance</keyword> Minister <keyword id="42575" type="PERSON" weightage="100" keywordseo="Arun-Jaitley">Arun Jaitley</keyword> had said that to facilitate a smooth transition to levy of tax on services by both the Centre and the States, "it is proposed to increase the present rate" of service tax plus education cess from 12.36 per cent to a consolidated rate of 14 per cent.

New Delhi, Feb 4 () Finance Minister Nirmala Sitharaman, who gave the longest-ever Budget Speech, on Tuesday made fun of it saying she wanted to keep it shorter but ended up breaking her own record. Sitharaman had on February 1 given a curtailed 161-minute speech presenting the Budget 2020-21. This bettered the record of the previous longest Budget Speech made by her in July last year. In July presenting her maiden Budget, Sitharaman had spoken for 2 hours 17 minutes. Speaking at an industry event, Sitharaman said, "...not just my speech which was very long and that's the grouse that I am holding up against the ministry. "I keep telling that in each one of them, and as a matter of fact, I have been persistently nagging them to say last year's was long, I want this year to be shorter. But, somebody conspired to say that Haha...No, you will do it longer." The preparation for this Budget was also the longest as it started after the presentation of the last Budget in July. Wanted to keep Budget Speech shorter but ended up breaking own record: Sitharaman

New Delhi, Feb 1 () Amendments have been proposed to the companies law, Finance Minister Nirmala Sitharaman said on Saturday as she highlighted the debate about criminal liability for acts that are civil in nature.
 Presenting the Union Budget for 2020-21 financial year, she assured taxpayers that the government remains committed to taking measures so that they are free from any kind of harassment.
 The corporate affairs ministry, which is also helmed by Sitharaman, would be seeking amendments to the Companies Act, 2013, to decriminalise various offences following recommendations from a high level committee last year.
 "There has been a debate about building into statutes, criminal liability for acts that are civil in nature. Hence, for Companies Act, certain amendments are proposed to be made that will correct this. Similarly, other laws would also be examined, where such provisions exist and attempts would be made to correct them," Sitharaman said in her nearly 160-minute speech.
 In November, the Company Law Committee -- chaired by Corporate Affairs Secretary Injeti Srinivas -- recommended decriminalising more than half of the existing compoundable offences under the companies law.
 Amendments to 46 penal provisions, "so as to either remove criminality, or to restrict the punishment to only fine, or to allow rectification of defaults through alternative methods", have been suggested by the committee.
 As per the committee's report, 23 out of the 66 remaining compoundable offences under the Companies Act could be re-categorised.
 Such offences could then be dealt with in-house adjudication framework wherein these defaults would be subject to a penalty levied by an adjudicating officer, according to the report.
 Generally, compoundable offences are those which can be settled by paying certain amount of money.
 In 2019, the ministry de-criminalised 16 minor procedural/technical lapses under the Act into 'civil wrongs'. RAM ANS

India's Finance Minister makes a statement even before the budget speech with a red cloth covering the budget docs

NEW DELHI: The <keyword id="6355512" type="ORGANIZATION" weightage="20" keywordseo="Union-Cabinet">Union Cabinet</keyword> on Wednesday allowed foreign investment in the Railways for the first time and raised limit for such investment in the defence sector, steps intended to raise funds for expansion of the Railways and encourage domestic manufacture of arms. 
 
100 per cent foreign investment in railway infrastructure projects will be allowed while in the case of defence the limit has been raised to 49 per cent from the current 26 per cent, subject to the Indian owners exercising management control. 
 The <keyword id="44528" type="ORGANIZATION" weightage="20" keywordseo="FDI">FDI</keyword> hike in defence is intended to cut imports by indigenising defence production as India is one of the world’s largest arms importers. 
 "It is a composite cap, incorporating all forms of foreign investment, FDI, FII, FPI, NRI, etc," said a <keyword id="6542458" type="POSITION" weightage="20" keywordseo="Government-official">government official</keyword> confirming that the proposals has been cleared. Experts did not seem impressed with the cautious stance of the <keyword id="6360789" type="ORGANIZATION" weightage="20" keywordseo="Modi-Government">Modi government</keyword> on defence. 
 
"Good development, but not great. Round one has gone to protectionist forces. 49 per cent is the same as 26 per cent technically and hence may not open the investment floodgates," said Amber Dubey, Partner and India Head of Aerospace and Defense at global consultancy KPMG. 
 
"We hope better judgment prevails and we have the FDI limit enhanced to 74 per cent later this year," he added. Official notifications giving effect to changes will be issued soon, after the minutes of the cabinet meeting are finalised. 
 Foreign investment in defence will be though the approval route, implying it will have to be cleared by the Foreign Investment Promotion Board (FIPB). Though the 49 per cent cap will be general rule for the defence sector, 100 per cent overseas ownership will be allowed in case the <keyword id="6362476" type="ORGANIZATION" weightage="20" keywordseo="investments">investments</keyword> comes bundled with state of the art technology. Such investment proposals will have to be cleared by the Cabinet Committee on Security (CCS). 
 
In companies with a 49 per cent foreign holding, more than one Indian company will be allowed to hold the 51 per cent share, unlike the present norm that mandates that a single Indian entity should own and control the entire 51 per cent, a move that will encourage more domestic players to enter the sector. 
 
In case of Railways, 100 per cent FDI will now be allowed in railway infrastructure segments such as electrification, signalling, high speed and suburban corridors. 100 per cent FDI will also be allowed through the Special Purpose Vehicle route to provide last mile connectivity to ports and mines. Further, some railway operations have also been partially opened up to foreign investment. 
 FDI is now allowed in PPP projects, suburban corridors, high speed train systems, and dedicated freight lines. Estimates suggest that the opening of railways to foreign <keyword id="47916" type="UNKNOWN" weightage="20" keywordseo="invest">invest</keyword>ors will add 1-1.5 percentage points to the overall GDP growth. China and Japan are keen to invest in the railways sector. 
 
As a result of these changes, railways transport will be removed from the list of prohibited sectors in the consolidated FDI policy.

It is widely expected that the government will try to revive the economy's animal spirits-- a term used to describe people's level of confidence in the economy-- which will be essential to the lift the growth in Gross Domestic Product (GDP) from the five year low it hit in the January-March 2019 quarter. That has led to a rise in unemployment as millions of young Indians join the workforce every year and there just aren't enough jobs created. That in turn has affected consumption. The two biggest numbers that are key to deciding the market confidence are the fiscal deficit projection for 2019-20 and the government borrowing programme. Fiscal deficit is the difference between the amount of money the government makes and the amount spent. The government had said in February that in 2018-19, the deficit would be 3.4% of the GDP. The fiscal deficit target for 2019-20 will decide whether the government takes its targets seriously. The excess of expenditure over earnings, the deficit, is met by borrowing money from the market. "From an investor point of view we want RBI, which is adeauately capitalised, and we want an economy which is adequately liquid. Today, apart from liquidity it is also transmission of credit which is also important. Today we have a scenario where PSU banks are not lending because they are not adequately capitalised," Nilesh Shah of Kotak Asset Management told Business Insider. Bank recapitalisation And that is one of the most significant numbers to look forward to in Sitharaman's speech-- the amount of money that the government will invest in state-owned banks that have been squeezed by a pile of bad loans threatening to rise further. In the last financial year ending March, the government invested a total of ₹1 lakh crore, according to Financial Services Secretary Rajiv Kumar in February. Still, there still isn't enough money floating around in the economy. "As a matter of fact if you look at the 50 year chart, the money supply has grown in the last few years at the same rate as it used to grow in the 1960s when the economy used to grow at 3-4%," market veteran Vallabh Bhanshali, Chairman of the Enam Group, told Business Insider. Banks need money (and confidence) to lend more and they are looking towards the government for support. Demands galore Essentially, everyone from the individual taxpayer to different industry segments-- from farmers to industrialists, from manufacturers to retailers, from real estate developers to banks to home buyers, from car makers to car buyers--- needs some kind of government support. Where is the money going to come from? Disinvestment One way of making up for the shortfall is for the government to sell stake, or fully priavatise, in companies that it owns. All eyes are on the hoardes of sick government companies that are sitting on millions of assets that are under-utilised and therefore, the companies are turning in losses for years. The most high-profile of them is Air India. The government has already indicated that it is looking for a strategic private investor in the airline. Government-owned telecom operators BSNL and MTNL are two other companies that have run out of cash even to pay salaries. Spectrum sale The other big source of government revenue is the sale of spectrum, which yields a lot of money. The government would want the upcoming auction of 5G spectrum to be a big money spinner but the bidders, the telecom operators are buried in debt. While the government would want 5G to give impetus to its Digital India programme, the 5G spectrum has to be reasonably priced. The Budget on the whole will be a tightrope walk.
