But Harvey just might have a case. And the outcome of her suit is about more than just a potentially massive payday for one woman. <a target="_blank" class="" href="https://www.businessinsider.com/baby-reindeer-timeline-fiona-harvey-richard-gadd-piers-morgan-martha-2024-5">The drama over "Baby Reindeer,"</a> which has been both a boon and a threat to the streamer, reflects a larger reckoning for prestige TV's favorite pastime: adapting true stories. <h2>'Baby Reindeer' is far from the first Netflix drama to face a defamation suit, but its marketing was slightly riskier</h2>"Baby Reindeer" features compelling performances from its cast (four of whom are now first-time Emmy nominees) and powerful writing from Gadd. But the show is far from the first prestige drama to excel on those two fronts — nor is it the first Netflix series to face <keyword id="19982808" type="General" weightage="20" keywordseo="legal-action" source="keywords">legal action</keyword> from a person who didn't like how they were portrayed in it. Rachel DeLoache Williams, a onetime friend of con artist Anna Delvey (aka Anna Sorokin) who accused the fake socialite of conning her out of $62,000, sued Netflix over its series "Inventing Anna," alleging the show portrayed her as a "greedy, snobbish, disloyal, dishonest, cowardly, manipulative and opportunistic person." The streamer<a target="_blank" href="https://www.rollingstone.com/tv-movies/tv-movie-news/netflix-inventing-anna-defamation-lawsuit-1234995042/"> lost its bid</a> to dismiss the case in March 2024. Former New York City prosecutor Linda Fairstein <a target="_blank" class="" href="https://www.latimes.com/entertainment-arts/business/story/2024-06-04/netflix-ava-duvernay-linda-fairstein-when-they-see-us-lawsuit">settled with Netflix</a> and Ava DuVernay in June 2024 after she disputed her portrayal as a "villain" in "When They See Us," DuVernay's award-winning 2019 limited series about the 1989 Central Park jogger case, which Fairstein famously prosecuted (she was portrayed by Felicity Huffman on the show). Two other pending suits involve Netflix's unscripted docuseries. Buster Murdaugh, the son of convicted murderer Alex Murdaugh,<a target="_blank" href="https://www.nbcnews.com/news/us-news/buster-murdaugh-sues-netflix-warner-bros-saying-was-falsely-accused-mu-rcna157783"> sued Netflix</a> over allegations made against him in the docuseries "Murdaugh Murders: A Southern Scandal," and R. Kelly's former assistant filed a complaint against Netflix and Lifetime in February for painting her in a "sinister and defamatory light" in the docuseries "Surviving R. Kelly," which aired on both the streamer and the network. So what's different here? Harvey's lawyer, Richard Roth, told Business Insider in a phone interview that "Baby Reindeer" is a unique case because Netflix didn't market it as a fictionalized drama or say it was "based on" a <keyword id="20352963" type="General" weightage="20" keywordseo="true-story" source="keywords">true story</keyword>. Instead, the show's title card called it a true story outright from the opening moments of the first episode. While Gadd took pains to emphasize on his press tour that the series was "emotionally true" to his experience and not a line-by-line retelling of events, Netflix's marketing, which highlighted things like <a target="_blank" href="https://x.com/netflix/status/1779162630520729877?lang=en">the show's use of real emails</a> Gadd says his stalker sent him, fed the "true story" intrigue. Ultimately, viewers were compelled to play detective and go searching for the real Martha anyway. <h2>Defamation lawsuits are common – but not all of them get this much press</h2>Hollywood has been dramatizing true stories for as long as it has existed. The difference in the beginning was that most of the subjects were long dead: there are dozens of films about the real Macbeth, for instance, and Joan of Arc, each telling the story in a slightly different way. Things got a little more tangled once writers started dramatizing stories involving people who were still alive. One of the earliest examples of a case filed by an individual against a major media company was Street v. NBC, tried in Tennessee in July 1977. The case has similar echoes to the defamation lawsuits we see today. Victoria Street (formerly Victoria Price) sued the network over her portrayal in "Judge Horton and the Scottsboro Boys," a 1976 docudrama that recounted one of the many trials in the <a target="_blank" class="" href="https://www.pbs.org/wgbh/americanexperience/features/scottsboro-ruby-bates-and-victoria-price/">highly publicized Scottsboro case,</a> in which she and another white woman named Ruby Bates accused nine Black teenage boys of raping them on a train forty years earlier. Eight of the nine were sentenced to death for the crime despite a lack of medical evidence, but none were executed after Bates recanted her testimony and the accused received new trials on appeals. Street, who never recanted her testimony, took offense to the way she was portrayed and sued the network on charges of libel and invasion of privacy, arguing that she was no longer a public figure. <a target="_blank" href="https://www.nytimes.com/1982/10/19/obituaries/victoria-p-street-dies-at-77-a-figure-in-scottsboro-case.html">The case was ultimately settled</a> out of court, and Street died at 77 a few years later in 1982. Scores more defamation lawsuits have been filed in the years since, against everything from the 2013 Michael Bay movie "Pain &amp; Gain" (the real kidnapping victim <a target="_blank" href="https://www.hollywoodreporter.com/business/business-news/hollywood-docket-clemency-project-erin-887395/">didn't like</a> how the character based on him was portrayed as "an unlikeable, sleazy, rude, abrasive braggart") to the 2017 FX drama "Feud: Bette and Joan" (Hollywood legend Olivia de Havilland, then 101, would have <a target="_blank" href="https://www.theguardian.com/film/2018/mar/16/feud-olivia-de-havilland-sues-fx">preferred to be excluded</a> from this narrative). With the advent of the streaming wars in the late 2010s, there was a rush to produce the most <a target="_blank" href="https://d18rn0p25nwr6d.cloudfront.net/CIK-0001065280/c5e64982-659f-4726-97c9-c57767c3bec3.pdf">compelling content</a> to win the largest share of subscribers. And while we're still <a target="_blank" href="https://www.businessinsider.com/why-hollywood-remakes-franchises-avatar-percy-jackson-one-piece-2024-3">retreading (and re-retreading) old IP</a> and always chasing the dangling carrot of the ever-elusive Original Idea, more and more shows are riffing on true events. Except instead of focusing on historical figures (though there's plenty of that too), they're increasingly about contemporary stories and people who arguably aren't hugely public personas. And unlike Macbeth and Joan of Arc, those people will absolutely sue you. <h2>Harvey's <keyword id="19905885" type="General" weightage="20" keywordseo="lawsuit" source="keywords">lawsuit</keyword> may not deter Netflix from making more shows like this</h2><a target="_blank" href="https://markets.businessinsider.com/stocks/nflx-stock">Netflix is an incredibly lucrative company</a> with presumably deep pockets — it's settled with everyone from a Georgian chess grandmaster <a target="_blank" href="https://variety.com/2022/tv/news/netflix-queens-gambit-lawsuit-settlement-nona-gaprindashvili-1235361680/">who says she was defamed</a> in "The Queen's Gambit," to former New York prosecutor Fairstein for "When They See Us," to <a target="_blank" href="https://www.businessinsider.com/griselda-blanco-family-settles-lawsuit-against-netflix-sofia-vergara-2024-2">drug queenpin Griselda Blanco's family</a> over "Griselda." Whether they fight Harvey's case in court or opt to settle, the amount it would cost to do either won't bankrupt them. That much we know. The real question is whether the sheets are balanced in the end: Would the cost of legal fees and a potential settlement or damages be more or less than what Netflix has made off "Baby Reindeer"? If it's more, will that stop Netflix and others from making more of these legally risky but creatively compelling shows? Harvey's lawyer Roth doesn't think Netflix particularly cared about the risk of legal action when it greenlit "Baby Reindeer." "I think they say, 'We're going to make so much money on this. If someone sues us, let them sue us,'" Roth says. There's also an argument to be made that any press, even a lawsuit, is good press. "I don't know if I have any inside knowledge about Netflix in particular, but I can say this: This is a very unique time for streamer wars, and Disney+ and Netflix and all these companies trying to land on top, or Netflix trying to stay on top," Jeff Lewis, a First Amendment attorney in Los Angeles, told Business Insider. "And it could be for this window of time, while there's some uncertainty as to which streamer will survive, perhaps Netflix might be more willing to take a risk and get more attention and eyeballs on their screens in exchange for paying some lawyer fees. Who knows?" That said, there's a chance Netflix will have to pay a hefty settlement to make the Harvey situation go away. The streamer has the advantage of the suit being filed in California, which has "one of the most robust pro-defendant defamation laws in the country," Lewis says, pointing out that an anti-SLAPP motion would dismiss the case and make Harvey responsible for paying all of Netflix's legal fees. Sure enough, on July 29, Netflix filed an anti-SLAPPP motion and a motion to dismiss the case, arguing that the claims in "Baby Reindeer" are "substantially true" and that any reasonable viewer would know that the show is not "a documentary representing literally true details and imagery." The streamer's filings included a declaration from Gadd, which detailed instances of harassment he says he faced from Harvey, and a declaration from Laura Wray, another woman who says she was once stalked by Harvey. But if Netflix doesn't win its motions, which are still awaiting judgment as of this writing, Harvey could potentially see a payout anywhere from $200,000 all the way into "mid-seven figures," according to Lewis. Jackie Ward, a Los Angeles-based entertainment attorney specializing in rights and clearances, points to the million-dollar donation Netflix made to the Innocence Project as part of Fairstein's settlement for "When They See Us" as a comparable example. "For Netflix to make something where they think that they do have some sort of liability, to make that go away for something like a million dollars, it's probably worth it to them for a company of that size," Ward says. "A smaller distributor, maybe not."

Finding mentorship and the right guidance was a challenge, too.Everyone around Hassan told him that going to the <a target="_blank" class="" href="https://www.businessinsider.com/resume-tips-google-software-engineer-skills-experience-careers-software-tech-2024-3">US for a master's degree</a> was the next big opportunity. He has since launched two startups.Hassan is part of a group of <a target="_blank" class="" href="https://www.businessinsider.com/i-moved-back-to-india-after-living-abroad-for-decade-2024-9">expat Indians moving back</a> home to venture out on their own. As such, he's also part of a decades-long trend of reverse migration back to India.The trend began in the 1990s and picked up at the turn of the century, driven by the economic collapse in 2008, said Binod Khadria, the president of Global Research Forum on Diaspora and Transnationalism. Many of those who returned to India for work were largely working for multinational companies.Today, the impetus for the move often looks a bit different: It's driven by factors like unstable visa policies and economic recessions, which lead to uncertainty when it comes to jobs and duration of stay in these destinations.Many returnees find work in tech, but the finance, retail, and climate sectors also absorb a large number of expat Indians, Khadia said. And some of the returnees are heading back to India to start companies of their own.India is undergoing a startup explosion. The country reported over<a target="_blank" href="https://pib.gov.in/PressReleaseIframePage.aspx?PRID=2043805"> 140,800 recognized startups</a> at the end of June — nearly 50,000 more than last year — and credited them with creating 1.6 million direct jobs.To be sure, not all of these companies will make it big — and some do still stumble, like <a target="_blank" class="" href="https://inc42.com/features/what-are-the-current-problems-being-faced-by-oyo/">Oyo </a>and <a target="_blank" class="" href="https://www.businessinsider.com/blackrock-hsbc-funds-byjus-startup-valuation-zero-edtech-india-raveendran-2024-6">Byju's</a>. But the chaos, where even established startups are trying and failing, makes India a fair playing field for new entrants, Hassan said.Business Insider spoke to six <a target="_blank" class="" href="https://www.businessinsider.com/india-vc-wants-see-5-traits-new-founders-fundraising-antler-2024-8">first-time founders </a>about why they have recently returned to India after spending several years, or even an adult life, abroad.<h2 id="0e4a3c47-ba19-4690-8b52-c6bfece1c81d">Fastest-growing economy</h2>The health of the economy and interest from investors are fueling the entrepreneurship boom.<a target="_blank" class="" href="https://www.businessinsider.com/india-billionaire-karan-adani-plans-challenge-china-dominance-seaports-2024-8">India's economic growth</a> in 2023 — 8.2% — was the fastest of all large economies worldwide. That's led to greater purchasing power, which lets companies, including startups, sell more.India's inflation rate of about 3.5% is well below its annual wage growth of 9.6%. This makes inflation less of a challenge than it is for slower-growing peers, where consumer-focused businesses have been <a target="_blank" class="" href="https://www.businessinsider.com/economy-jobs-report-sentiment-consumers-elections-recession-inflation-mortgage-rates-2024-9">hurt by high prices</a>.Investors are getting in on the action.From 2015 to 2021, the number of <a target="_blank" class="" href="https://www.businessinsider.com/sequoia-capital-vc-firm-split-china-india-2023-6">unique investors in India</a> nearly quadrupled, though the number is tracking much lower this year, per PitchBook."Other than a slight downturn in 2022 and 2023 due to global macroeconomic factors, VC funding has been consistently growing in India," said Ben Mathias, a managing partner at Vertex Ventures Southeast Asia &amp; India.Besides funding, domestic developments have encouraged founders and VCs too, Mathias said.The Indian government's Universal Payment Interface system has spurred consumers and businesses to pay online, and <a target="_blank" class="" href="https://www.bcg.com/press/2june2022-digital-payments-in-india-projected-to-reach-10-trillion-by-2026">40% of all digital payments</a> globally happen in India today, the partner said.Programs like Startup India, which provides founders benefits like tax exemption, easier compliance, and funding support, have made creating a company smoother.Devyani Parameshwar worked in the microfinance and fintech space in India in the 2010s before heading to the UK and Africa. She returned to India in 2022 to launch a financial management venture."It's changed dramatically. I remember standing in line at various ministries in Delhi trying to get meetings and then trying to get answers and it wasn't easy in the past," she said of her memories of India.Now, she can use an online platform to ask the country's central bank and banking regulator questions.It's easier than ever for foreign companies to invest in India, which means startups have a clearer exit path through acquisition — something VCs think hard about before entering new markets or writing checks.<h2 id="e5dd7b6f-a09f-4ff2-84c1-5907de96dc5e">Market ripe for the taking</h2>For Rohan Bhide, who spent most of his college and professional life <a target="_blank" class="" href="https://www.businessinsider.com/worked-in-big-tech-before-launching-my-own-startup-engineer-2024-9">preparing to launch something of his own</a>, a trip home in 2017 while he was studying in the US was a turning point.Indian telecom giant Reliance had recently launched a cheap unlimited data plan, which spiked Indian internet adoption. India was charting among the countries with the highest online transactions."That really, really drew my attention," said Bhide, who worked at Meta after graduation. "It was my dream come true — a huge market, a huge user base, and at the same time, the ability to adopt technology was incredible."Bhide returned to India in January, leaving behind about $580,000 in total compensation at ticketing platform StubHub. He and a cofounder are working on launching a consumer tech product later this year.<div type="image" title="Rohan Bhide" height="2304" width="3072" msid="113831979" hostid="261" sizebytes="218468"></div>Most Indians grew up wanting to work at a multinational company — but that's changing, Bhide said.Freelancing, running your own business, or working for a startup is much more socially acceptable now, because people see the success of other Indian startups. The country has the third-largest number of "unicorns" — companies worth $1 billion or more — with 64, per PitchBook.<h2 id="7f423804-745b-4e04-a250-839e01663f09">Boom in entrepreneurship culture</h2>A lot has changed since Hassan first wanted to launch his hardware startup in the early 2000s.Tech hot spots like Bengaluru and Gurugram have seen a boom in entrepreneurship culture in the last few years, with meet-ups, networking mixers, and even morning walks with like-minded builders.<div type="image" title="man standing in front of mountains in USA" height="2268" width="3024" msid="113831980" hostid="261" sizebytes="141132"></div>Dhruv Anand, who left Google in the US to move back to India in 2021 to launch an <a target="_blank" class="" href="https://www.businessinsider.com/ai-startups-most-promising-2024-9">AI startup</a>, said that there were lots of other founders and mentors to help guide him."If you want to figure out who's the right chartered accountant to talk to, who's the right lawyer to help you draft agreements, all of that stuff is very easy," Anand said."It's been a really, really supportive community," Bhide said. There are people "telling you about their entire lives just because they want to help you and they're hoping that you pass the favor onto the next person who moves to India and wants to start their own company."<h2 id="3c8bff36-e855-4530-9b44-bcc7f36b0825">Not everything is perfect</h2>Although these founders made the decision to return to India, that doesn't mean they no longer see the benefits of operating in the US.Ruchit Garg founded an agriculture startup in Silicon Valley in 2016, with a focus on supporting farmers around the globe. In 2019, he returned to India, where his late grandfather worked as a farmer.Garg has been building in India ever since, but he says its startup ecosystem cannot yet compete with the Valley's decades of experience."The overall ecosystem was more mature back in Silicon Valley. It's still one of the best places for entrepreneurs. India isn't there yet, although it's growing pretty drastically," he said.Despite efforts to digitalize key processes, many bureaucratic challenges persist.For most founders, after living in US cities where populations are a fraction of those in Mumbai and Bangalore, congested roads and poorer air quality are also everyday annoyances.But India provides some big perks, including affordable domestic help and the appeal of building solutions for problems they witness firsthand."It's a different joy to be able to build for problems that you feel for very personally," Parameshwar, the fintech founder, said. When she worked in Africa, she needed translators. Now, she can speak with her users herself.Bhide said the general sentiment among local founders is shifting from "Build from India" to "Build for India."For some founders, being surrounded by family and the culture they grew up in was another selling point.Niranjan Vemulkar moved back to India in 2015 and later founded a digital legacy planning platform.He said that he never fully felt at home in the US, where he lived for over a decade."For us, it was the fact that we wanted to raise a family in an environment where the children would have access to the grandparents and Indian culture," Vemulkar said. Reynolds American's document states it made a campaign contribution to New Mexico Gov. Michelle Lujan Grisham, but Grisham's office told Insider the governor received no such contribution, which state campaign finance filings support.But the data provides a glimpse into how the nation's second-largest tobacco company is attempting to broadly influence lawmakers and otherwise participate in low-profile elections that may nevertheless have notable policy implications for companies that market smoking products. Reynolds American favored conservatives in its political giving, with more than 80% of its 2021 contributions — more than $5 million — going to Republican candidates and committees. Reynolds American says it considers several factors when donating to a politician, including geography and whether a politician serves on committees overlapping with the <keyword id="13115232" type="UNKNOWN" weightage="60" keywordseo="tobacco-industry" source="Orion">tobacco industry</keyword>'s interests."Contributions must be lawful, and in the interests of the organization rather than the individual interests of any employee, officer, or director," the website says. "All proposed corporate contributions go through a review process to ensure compliance with applicable laws and regulations, and to determine that they are in the best interests of the RAI companies."Insider reached out to more than 25 of the candidates who received money from Reynolds American, but none were willing to speak on the record about their Reynolds American-related contributions.<h2>Much at stake for Big Tobacco</h2>In <a href="https://www.fda.gov/news-events/press-announcements/fda-commits-evidence-based-actions-aimed-saving-lives-and-preventing-future-generations-smokers">2021, the FDA announced</a> its intention to prevent "future generations of smokers" by banning menthol cigarettes, flavored cigars, and other similar products. "Its giving is directed towards individuals and places that in recent years have been considering restrictions on menthol cigarettes."In late 2020, California lawmakers agreed to institute a ban on flavored tobacco products with Senate Bill 793. Tobacco companies, including Reynolds American and affiliates, have since donated more than $20 million dollars to the <a href="https://cal-access.sos.ca.gov/Campaign/Committees/Detail.aspx?id=1431407&amp;session=2021&amp;view=received">California Coalition for Fairness,</a> which opposes the legislature's decision and succeeded in getting the issue of flavored tobacco onto the ballot for the 2022 midterm elections. Hindenburg alleged that Buch and her husband had undisclosed investments in obscure offshore funds in Bermuda and Mauritius, the same entities allegedly used by <keyword id="20283220" type="General" weightage="20" keywordseo="Vinod-Adani" source="keywords">Vinod Adani</keyword> - the elder brother of group chairman Gautam Adani - to round-trip funds and inflate stock prices. SEBI, in October 2020, began a probe into the shareholding structure of Adani group companies after red flags were raised over the high concentration of foreign holdings in the conglomerate's listed companies. An investigation was launched to determine if the foreign investors were genuine public shareholders or acting as fronts for the promoters. SEBI, last year had told a Supreme Court-appointed panel that it was investigating 13 opaque offshore entities that held between 14-20% across five publicly traded stocks of the conglomerate. It hasn't stated if the two probes have since been completed, something which Hindenburg used to attack the market regulator. Madhabi Puri Buch and her husband Dhaval Buch in a joint statement strongly denied the "baseless allegations and insinuations made in the report". The same, they said, "are devoid of any truth". "Our life and finances are an open book," they said. "It is unfortunate that Hindenburg Research against whom SEBI has taken an enforcement action and issued a show cause notice, has chosen to attempt character assassination in response to the same." Buchs further said they have no hesitation in disclosing any financial documents, including those that relate to the period when we were strictly private citizens, to any and every authority that may seek them. While the statement did not talk about the questions Hindenburg raised over SEBI probe, the duo promised to come out with a detailed response. Separately, Adani group in a regulatory filing called the allegations by Hindenburg as "malicious, mischievous and manipulative selections of publicly available information to arrive at predetermined conclusions for personal profiteering with wanton disregard for facts and the law." "The Adani Group has absolutely no commercial relationship with the individuals or matters mentioned in this calculated deliberate effort to malign our standing," it said. "We remain steadfastly committed to transparency and compliance with all legal and regulatory requirements". Rejecting the allegations, it said they were nothing but a "recycling of discredited claims that have been thoroughly investigated, proven to be baseless, and already dismissed by the Supreme Court in March 2023." "It is reiterated that our overseas holding structure is fully transparent, with all relevant details disclosed regularly in numerous public documents," Adani group said, adding Anil Ahuja was a nominee director of 3i investment fund in Adani Power (2007-2008) and, later, a director of Adani Enterprises until 2017. "For a discredited short-seller under the scanner for several violations of Indian securities laws, Hindenburg's allegations are no more than red herrings thrown by a desperate entity with total contempt for Indian laws," it added. Hindenburg on Saturday stated that the SEBI chairperson and her husband invested in offshore entities that were allegedly part of a fund structure managed by India Infoline, and in which Vinod Adani also had investments. These investments reportedly date back to 2015, well before her appointment as a full-time member of SEBI in 2017 and the subsequent elevation as chairperson in March 2022. It said the Bermuda-based Global Opportunities Fund, which allegedly was used by entities connected to Adani Group to trade in shares of group companies, had sub-funds. Buch and her husband were investors in one of these sub-funds in 2015. Citing "whistleblower documents", Hindenburg said, "<keyword id="22743118" type="General" weightage="20" keywordseo="Madhabi-Buch" source="keywords">Madhabi Buch</keyword>, the current chairperson of SEBI, and her husband had stakes in both obscure offshore funds used in the Adani <keyword id="22743230" type="General" weightage="20" keywordseo="money-siphoning" source="keywords">money siphoning</keyword> scandal." SEBI, it claimed, has "shown a surprising lack of interest in Adani's alleged undisclosed web of Mauritius and offshore shell entities." Buch and her husband may have first opened their account with IPE Plus Fund 1 on June 5, 2015, in Singapore. IPE fund is a small offshore Mauritius fund set up by Vinod Adani director through India Infoline (IIFL), a wealth management firm with ties to the Wirecard embezzlement scandal. "Vinod Adani, brother of Gautam Adani, used this structure to invest in Indian markets with funds allegedly siphoned from over-invoicing of power equipment to Adani Group," claimed Hindenburg. Latching on to the Hindenburg allegations, Congress said the revelations only reinforced its demand for setting up a "joint parliamentary committee to investigate the full scope of the Adani mega scam" while the Trinamool Congress said the SEBI chairperson must resign. "This raises fresh questions about Gautam Adani's two 2022 meetings in quick succession with Ms Buch shortly after she became SEBI chairperson. Recall that SEBI was supposedly investigating Adani transactions at the time," Congress leader Jairam Ramesh said. In January last year, Hindenburg Research, which in the past has shorted - or bet against - companies like electric truck maker Nikola Corp and Twitter, accused Adani Group of pulling "the largest con in corporate history" by using a web of companies in tax havens to inflate its revenue and manipulate stock prices, even as debt piled up. Though the conglomerate vehemently denied all allegations, the damning report sent the group's shares into a free fall, wiping out over USD 150 billion in market value of the 10 listed entities at their lowest point. Most of the 10 listed companies have since recouped the losses. After the Hindenburg report, the Supreme Court asked market regulator SEBI to complete its investigation and set up a separate expert panel to look into regulatory lapses. The panel did not give any adverse report on Adani and the apex court too stated that no other probe other than one being done by SEBI was required. On June 26 this year, SEBI in a show cause notice charged Hindenburg of "deliberately sensationalizing and distorting certain facts" as well as working with a New York hedge fund to make its bet. Hindenburg had responded to that saying it made just USD 4.1 million from its declared positions on Adani stocks and criticized the regulator for not focusing its investigation into the January 2023 report "providing evidence" of the conglomerate creating "a vast network of offshore shell entities" and moving billions of dollars "surreptitiously" into and out of Adani public and private entities. The group led by billionaire Gautam Adani, who was the world's third-richest man before Hindenburg, in an epic comeback strategy raised USD 15 billion in equity and debt, sold some assets, repaid loans that were raised pledging shares, reined in expenses, repaid some debt and refocused energies on core business. Adani is now ranked 12th richest in the world, one notch and USD 6 billion shy of rival billionaire Mukesh Ambani. The group has also made some acquisitions, buying cement company Sanghi Industries and the news agency IANS. Adani has insisted the Hindenburg report has not changed operations at his companies, which include ports, airports, renewable parks generating electricity from sunlight and wind energy, gas distribution, cement processors, data centers, and even apple farms. 360 One Wam Ltd, formerly known as IIFL Wealth Management Ltd, separately said IPE-Plus Fund 1, a fully compliant and regulated fund, was launched in October 2013 and operated until October 2019. "Throughout the fund's tenure, IPE-Plus Fund 1 made zero investments in any shares of the Adani Group either directly or indirectly through any fund," it said. "At its peak, the fund's Assets Under Management (AUM) reached approximately USD 48 million, with over 90% of the fund consistently invested in bonds." The fund, it said, was managed as a discretionary fund by the Investment Manager. "No investor had any involvement in the fund's operations or investment decisions. Mrs. Madhabi Buch &amp; Mr. Dhaval Buch's holdings in the fund were less than 1.5% of the total inflow into the fund." Hindenburg on Saturday alleged that just weeks before Buch's appointment to SEBI, her husband requested the transfer of their investments into his sole control, potentially to avoid any scrutiny related to her new regulatory role. The couple's investments were reportedly funneled through a complex, multi-layered offshore structure, raising questions about their legitimacy and purpose. On March 22, 2017, just weeks ahead of Buch's appointment as SEBI Wholetime Member, her husband, Dhaval Buch, wrote to Mauritius fund administrator Trident Trust. That communication was regarding his and his wife's investment in the Global Dynamic Opportunities Fund (GDOF), the US firm alleged. "In the letter, Dhaval Buch requested to"be the sole person authorized to operate the accounts", seemingly moving the assets out of his wife's name ahead of the politically sensitive appointment," Hindenburg alleged. Dhaval Buch is currently a senior advisor at Blackstone and at Alvarez &amp; Marsal. He also serves as a non-executive director on the Board of Gildan. "In a later account statement dated February 26, 2018, addressed to Madhabi Buch's private email, the full details of the structure are revealed: "GDOF Cell 90 (IPEplus Fund 1)". Again, this is the same Mauritius-registered "cell" of the fund, found several layers deep in a convoluted structure, reportedly used by Vinod Adani," Hindenburg alleged. From April 2017 to March 2022, while Buch was a Wholetime member and Chairperson at SEBI, she had a 100 % interest in an offshore Singaporean consulting firm, called Agora Partners, it alleged adding On March 16, 2022, two weeks after she was appointed SEBI Chairperson, she quietly transferred the shares to her husband. To date, SEBI has taken no action against these funds, it claimed. "If SEBI wanted to find the offshore fund holders, perhaps the SEBI Chairperson could have started by looking in the mirror," Hindenburg said. In response to requests from the Supreme Court to investigate the Adani matter, SEBI is said to have hit a wall unveiling the holders of the offshore funds. The Supreme Court said that while SEBI seemingly agreed with its concerns over who funded Adani's offshore shareholders, "it is evident that SEBI has drawn a blank in this investigation", the firm alleged.
