"It does not matter who sits on the CM chair because the mandate was for Arvind Kejriwal. The public chose Arvind Kejriwal. He has said that he will not sit on the CM chair until the people ask again but the chair belongs to Arvind Kejriwal for these and the next 5 years... One of us will sit on the chair until the elections take place. It will be similar to the way Bharat ruled in the absence of Lord Ram," Bharadwaj said. On being asked who will replace Arvind Kejriwal, Bharadwaj said, "It can be an MLA or any present minister. There will be a discussion with the MLAs today and the name may be decided". Kejriwal announced on Sunday that he would resign and would not resume the CM's post until the people of Delhi declared him "honest." He has also called for advancing polls in the national capital to November this year, ahead of the scheduled February elections. Kejriwal stated that if re-elected by the public, it would serve as a "certificate" of his honesty. He added that he would push for early elections, alongside those in Maharashtra. In his plea, Naidu contended that the Andhra Pradesh High Court had rejected his petition by ignoring his pleading that under Section 17A of the PC Act, which came into force on July 26, 2018, no FIR against a public servant could be registered without prior sanction of the appropriate authority. Former Andhra Pradesh Chief Minister and Telugu Desam Party (TDP) chief, N Chandrababu Naidu, was arrested by the Criminal Investigation Department (CID) on September 9 in connection with the multi-crore skill development scam case.

The <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> has been informed that cases pending against sitting and former MP/MLAs increased from 4,110 in December 2018 to 4,984 in December 2021. A report submitted by amicus curiae, senior advocate Vijay Hansaria said: "Some of these cases were pending for more than three decades. 2,324 cases were against sitting legislators, and 1,675 cases were against former legislators. In 1,991 cases, even charges were not framed. 264 cases were pending due to stay granted by the High Courts." The amicus filed the report in a case connected with the expeditious trial of MPs and MLAs. According to the report, which provided state-wise data on cases, Uttar Pradesh topped the list with 1,339 cases pending for final disposal as on December 1, 2021, whereas in December 2018, 992 cases were pending, and in October 2020, 1,374 cases were pending. Therefore, data reveals that only few cases were disposed of between October 2020 and December 1, 2021. As on December 4, 2018, UP disposed of 435 cases -- 364 by sessions court and 71 by magistrates. In Bihar, in December 2018, there were 304 cases pending, which rose to 557 in October 2020, and then 571 in December 2021. Out of 571 cases, 341 cases are pending before magistrate courts and 68 cases before sessions judges. The report, which was submitted in the top court on Thursday, added: "It is submitted that despite a series of directions by this Hon'ble Court and continuous monitoring, as many as 4,984 cases are pending out of which 1,899 cases are more than 5 years old. It may be noted that the total number of cases pending as on December 2018 were 4,110, and as on October 2020 were 4,859. Even after disposal of 2,775 cases after December 4, 2018, the cases against MPs/MLAs have increased from 4,122 to 4,984." In 2018, the apex court issued the directive to set up special courts to expedite trials of cases against MPs and MLAs and since then, it has issued many directions, including asking the Centre to set up a monitoring committee to examine reasons for delay of investigation in cases. Citing the volume of cases against the lawmakers, the report said: "This shows that more and more persons with criminal antecedents are occupying the seats in the Parliament and the State Legislative Assemblies. It is of utmost necessity that urgent and stringent steps are taken for expeditious disposal of pending criminal cases." The report added that the Centre hasn't provided any suggestions after the court's order in August last year regarding the setting up of a monitoring committee to evaluate the reasons for delay in investigation. Nearly 5,000 cases pending against  politicians in Supreme Court; cases from UP tops the list

In a significant judgement, the Supreme Court on Thursday directed political <keyword id="15047" type="PERSON" weightage="20" keywordseo="Parties">parties</keyword> to upload on their respective websites the details of all pending criminal cases against candidates contesting polls, citing the alarming increase in criminalisation of politics in past four general elections. A bench headed by Justice R.F. Nariman said the parties would have to clarify on reasons for selecting candidates with pending criminal cases and upload this information on their websites. The top court also observed that political parties will have to submit a compliance report within 72 hours, to the Election Commission, after selecting candidates having pending criminal cases. The order from the top court came on a contempt plea filed by Advocate Ashwini Upadhyay, raising critical issues due to increase in criminalisation of politics. The plea claimed the directions given by the apex court in its September 2018 verdict, which specified guidelines to disclosure of criminal antecedents by candidates, is not being followed in letter and spirit. The top court also directed that political parties would have to publish this information on their social media platforms like <keyword id="6354576" type="COMPANY" weightage="20" keywordseo="facebook">Facebook</keyword> and <keyword id="6354616" type="COMPANY" weightage="20" keywordseo="Twitter">Twitter</keyword> besides publishing this information in one local vernacular and one national newspaper. Parties must publish candidates criminal cases on sites: SC

A total of 163 ( 68 per cent) out of the 241 winners in the Bihar Assembly polls have declared criminal cases against themselves in the poll affidavits, with <keyword id="42678" type="ORGANIZATION" weightage="20" keywordseo="RJD">RJD</keyword> topping the list with around 73 per cent, Bihar Election Watch and Association for Democratic Reforms (ADR) said. Of the 163 MLA-elects, 123 (51 per cent of total affidavits analysed) have serious criminal cases pending against them, including those related to murder, attempt to murder, kidnapping and crimes against women. In the 2015 Assembly elections, 142 (58 per cent) MLAs had self-declared such cases against them in their affidavits. This time, the ADR had analysed the self-sworn affidavits of 241 of the 243 victorious candidates. The ADR did not say anything on such details of remaining winners. The results of the three-phase elections were declared on Wednesday early morning after counting that went on for over 20 hours. Out of the 123 winners, 19 have murder cases, 31 attempt to murder and eight crimes against women against their names. Among the major parties, 54 (73 per cent) of the 74 winners from Tejashwi Yadav-led <keyword id="123786" type="ORGANIZATION" weightage="20" keywordseo="Rashtriya-Janata-Dal">Rashtriya Janata Dal</keyword> (RJD) have pending criminal cases, followed by 47 (64 per cent) out of 73 from BJP, 20 (47 per cent) out of 43 from Janata Dal-United, 16 (84 per cent) out of 19 from Congress, 10 (83 per cent) out of 12 from Communist Party of India-Marxist Leninist Liberation, and five (100 per cent) out of 5 from Asaduddin Owaisi's All India Majlis-e-Ittehadul Muslimeen. A total of 44 (60 per cent) out of 74 RJD winners, 35 (48 per cent) out of 73 from BJP, 11 (26 per cent) out of 43 from JD-U, 11 (58 per cent) out of 19 from Congress, eight (67 per cent) out of 12 from CPI-MLL and 5 (100 per cent) out of 5 from AIMIM have serious criminal cases pending against them. The results of the analysis were hardly surprising - 77 (35%) of the 221 newly-elected MLAs have declared criminal cases against themselves. Of these, 54 MLAs have declared serious criminal cases against them, which could include anything from murder to kidnapping. While 34% of the previous assembly (2013) had a criminal background the percentage was significantly lower in 2008 at 24%. The elections in the southwestern Indian state of Karnataka this week has been fraught with high drama. The results of 222/224 seats were as follows - the BJP won 104 seats, the <keyword id="190679" type="ORGANIZATION" weightage="20" keywordseo="Indian-National-Congress">Indian National Congress</keyword> bagged 78 seats and the <keyword id="123462" type="ORGANIZATION" weightage="20" keywordseo="Janata-Dal">Janata Dal</keyword> (Secular) won 37 seats. Needless to say, a battle ensued as to who would claim the throne but just today the BJP legislature party leader B S Yeddyurappa was sworn in as the chief minister. According to the ADR analysis, 42 of the 104 MLAs from the Bharatiya Janata Party (BJP) have criminal backgrounds, while 23 of the 78 MLAs from the <keyword id="1571" type="ORGANIZATION" weightage="20" keywordseo="Congress-party">Congress party</keyword> and 11 out of 37 Janata Dal (Secular) MLAs declared criminal cases against them in their affidavits. Other shocking but not-so-shocking revelations from this report include: Assets <ul><li>215 out of 221 MLAs declared assets of over Rs 1 crore. </li><li>15 MLAs from the three leading parties declared assets of more than Rs 100 crore.</li><li><keyword id="28100" type="ORGANIZATION" weightage="20" keywordseo="MLA">MLA</keyword> N. Nagaraju declared the highest assets of over Rs 1,015 crore whereas D.K Shivakumar (Rs 640 crore) came in second and Suresh B.S. (Rs 460 crore) third - all three belong to the Congress Party.</li><li>SA Ramadas from Krishnaraja constituency in Mysuru is the poorest MLA with assets to the tune of just ₹39 lakh. </li></ul>Gender <ul><li>There are only seven women among the 222 newly elected MLAs.</li></ul>Education <ul><li>61% declared that they are graduates or above, 36% declared themselves as Class V-XII pass</li><li>One MLA has declared he is ‘literate’ while “one did not give his educational qualification in his affidavit."</li></ul>Age <ul><li>135 MLAs are between 41 and 60 years old</li><li>64 are between 61 and 60 years old</li><li>15 MLAs are between 25 and 40 years old </li><li>Three are above 80 years old.</li></ul>

More than half the candidates contesting the elections from some of the major parties in India have criminal cases registered against them. The Association for Democratic Reforms (ADR) analysed 3112 of the 3237 candidates fighting in the Maharashtra Assembly Election across all 288 constituencies.

 They found that while the incidence of crime was high, two-thirds of the overall contestants have committed serious crimes. Serious crimes a subset of criminal cases where the offence is not bailable and the minimum punishment is at least five years in jail. No one to point fingers Bharatiya Janata Party (BJP) has the worst of the pack with 59% its candidates having criminal records. And, 36% of them fall under the ambit of serious offences. Its ally, the Shiv Sena, projects a more dangerous image with 61% criminal candidates and 48% — which is still half of the contesting candidates — having committed serious crimes. The opposition isn’t any position to point fingers either.

 Majority of the candidates from the Indian National Congress (INC) and Nationalist Congress Party (NCP) — 57% and 63%, respectively — also have criminal cases registered against them. But they do have fewer candidates with serious crimes registered against them. As many as 30% of INC candidates and 35% of NCP candidates fall into the category. Overall, the incidence of candidates with a criminal history has increased by 5% — from 798 to 916 candidates between 2014 to 2019.
